1 Guidance Document regarding waste generated from vessels The Legal Framework: 1. Waste Regulations, 2011(LN 184 of 2011, as amended - S.L. 549.); 2. Waste Management (Activity Registration) Regulations, 2007 (LN 106 of S.L. 549.); 3. Commission Decision 2000/532/EC - European Waste Catalogue (EWC); 4. Regulation (EC) No 1069/2009 laying down health rules as regards animal by-products and derived products notintended for human consumption and repealing Regulation (EC) No 1774/2002 (Animal by-products Regulations); Steps to follow: 1. The Shipping agent needs to identify the different types of waste and weight which have been generated by each vessel being serviced in Malta. 2. L.N. 106 of 2007 requires shipping agents to commission a waste carrier who is registered with the Environment and Resources Authority (ERA) to carry a particular type of waste. A separate waste carrier registration needs to cover the transport of different types of waste. A particular vehicle may have more than one registration, albeit some (such as Refuse Collection Vehicles) can only collect municipal waste. It is essential to note that there is no one particular class which allows carriers to transport every type of waste in the same trip. This means that the utilisation of one carrier under for example class A2 to transport different waste types is not acceptable unless the vessel requires the disposal of bulky waste only. Different wastes need to be transported by different classes as below (see Schedule 1 for samples): A1: Construction and Demolition Waste; A2: Road Services & Furniture (Bulky Refuse, beach cleaning, road cleaning, etc); A3: Kitchen/ food waste and mixed municipal waste (waste in black bags)-reserved for RCV s only; A4: Separated waste (separate carton, plastic, metal, paper, wood, cooking oil, etc); C1: Sharps / Hospital / Pharmaceutical Waste D1 Liquid Waste (Bowsers) including sewage D2 WEEE including White Goods D3 other types of liquid wastes including waste oils Each waste carrier is in possession of a windscreen tag with details of the licence type and expiry date. Certain vehicles may transport several classes of waste, however others (such as RCV/ scammels) can only carry one type. In addition, certain vessels are also registered as waste carriers under classes B1 (construction and demolition waste), B2 (waste oils) and B3 (separated waste). 3. For waste unloaded at shipping terminals, the shipping agents contracted on behalf of the vessel owners shall provide the following information to the Terminal Operators prior to the movements of waste: - A list of wastes (categorised as per EWC codes) to be unloaded from the vessel;
2 - The weight of each specific waste; and - The registration (GBR) number of the waste carriers contracted to transport such waste. 4. Port operators are obliged to only allow the declared vehicles to enter their site; 5. Different waste management sites are permitted to accept different types of waste. Moreover, certain wastes, such as food wastes generated from a vessel whose last port of call was a non - EU Member State needs to be diverted to the Marsa Thermal Treatment Facility (incinerator) and not to the Ghallis Engineered Landfill. Food wastes from vessels which have visited non-eu ports of call is classified as international catering waste which under ABP regulations is classified as category 1 material (ie highest risk material). This only way this material could be disposed of is through incineration at an approved incinerator, the Thermal Treatment facility in Marsa. This material must be transported to the incinerator by a registered vehicle and an approved carrier. Approval of the carrier is carried out by the Veterinary Regulation Directorate.. 6. The shipping agent is obliged to provide confirmation of proper disposal by requesting copies of receipts issued by waste management facilities to the waste carrier. This can be achieved by including a clause in all contracts which requests the waste carrier to provide a copy of the receipts from waste management sites. In this manner the agent will know whether the waste was delivered to a recycling site, landfill site etc. The management of waste remains the responsibility of the generator of the waste until its final disposal in a permitted facility. The shipping agency (as a representative of the vessel owner/s) is however also responsible for the waste until it reaches a waste management facility authorized to accept that particular waste. Kindly note that the Authority may require auditing of the waste management activities so as to assess potential illegal operation. The Authority and the terminal operator have a right to request a copy of the waste transfer receipts. Waste transfers and shipments will require certain permits issued by the Authority. Consignment notes (CN) are required under LN 184 of 2011 (as amended) for transport of hazardous waste. Transfrontier shipment Permit (TFS) might be required under Council Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste.
