1 Orders of Commissioners Court Bexar County, Texas TUESDAY, FEBRUARY 26, 2013 Court met at 10:00 a.m. A Regular Meeting was held by the Honorable Commissioners Court, in and for said State and County, met at the Courthouse, of thereof, in Bexar County on Tuesday,. Present at roll call: Nelson W. Wolff, County Judge; Sergio "Chico" Rodriguez, County Commissioner Precinct No. 1; Kevin A. Wolff, County Commissioner Precinct No. 3; Tommy Adkisson, County Commissioner Precinct No. 4; David Smith, County Manager; Susan Yeatts, County Auditor; Gerard Rickhoff, County Clerk (Rep. by Leonor Salazar); Susan Reed, District Attorney (Rep. by Ed Schweninger); David Marquez, Executive Director of Economic Development; Daniel Garza, Purchasing Agent. When the following proceedings were had to-wit: Everett Elstak, President of the St. Luke Men s Club gave the invocation at today's meeting. County Commissioner Kevin A. Wolff led the Pledge of Allegiance. County Commissioner Paul Elizondo is excused from today s meeting due to illness. A letter of condolence is to be sent to the family of Mary G. Trevino expressing to them the sympathy of the court on the loss of their loved one. She is survived by her son, Julian H. Trevino and wife, Diana, 2 grandchildren and 4 great-grandchildren. A letter of condolence is to be sent to the family of Arthur S. Rodriguez Jr. expressing to them the sympathy of the court on the loss of their loved one. He was a 1941 graduate of Central Catholic High School. He began his career in aircraft metal surface repair at Kelly Field, San Antonio in He volunteered in the U.S. Army Air Corps and was assigned to a unit destined for China. His unit became part of the esteemed Flying Tigers and his job was to repair planes damaged in battle. Following the war he returned to the US and was discharged 1946 and resumed his civilian career at Kelly Field. He was a founding member of St. Margaret Mary s Church, and served on the Pastoral Council, Eucharistic Ministry, and the Hospitality Committee. He was a member of the Men s Club and devoted much of his time to St. Margaret Mary s School. Mr. Rod as he was affectionately known to hundreds of boy scouts was active in scouting for 50 years primarily with Troop 144. He is survived by his wife, Felice and 7 children, Arthur, Francis, Raymond, Paul, Richard, Peggy and Martin; 18 grandchildren, 21 great-grandchildren. A letter of condolence is to be sent to the family of Nancy Martinez expressing to them the sympathy of the court on the loss of their loved one. Commissioners Court will adjourn today s meeting in honor and memory of: Mary G. Trevino Arthur S. Rodriguez Jr. Nancy Martinez
2 Item 3a Commissioners Court The Court hereby ordered and approved a motion approving a Resolution supporting and encouraging the State of Texas to expand Medicaid statewide to adults to take advantage of federal matching funds which would provide a significant boost to the economy and local taxpayer relief, while providing access to the right care in the right place to millions of currently uninsured Texans; and requesting the members of the Bexar County State Delegation to work on behalf of our community to craft a Texas plan to improve Medicaid delivery and provide for Statewide Medicaid expansion by the State of Texas. (Record) Item 3b-c Commissioners Court The Court presented a proclamation recognizing and proclaiming Saturday, March 2, 2013 to be St. Luke Men s Club Wild Game Dinner Day in Bexar County. (Record) The Court presented a proclamation to the National Women and Girls HIV/AIDS Awareness Day Planning Committee, recognizing and proclaiming Sunday, March 10, 2013 as National Women and Girls HIV/AIDS Awareness Day. Item 7 Commissioners Court The Court hereby ordered and approved a motion approving the Consent Agenda (items 10-60) with the exception of agenda items 14, 35, 45 & 48 which will be pulled and heard separately. Item 10 Commissioners Court, Pct. 1 The Court hereby ordered and approved a motion approving the appointment of Dr. Stephen E. Wilson to the City/County Joint Commission on Elderly Affairs to fill the term vacated by Eugene Sheppard, effective upon appointment and set to expire on September 30, (Record) 2
3 Item 11 District Attorney s Office The Court hereby ordered and approved a motion approving the submission of an electronic grant application to the Office of the Governor, Criminal Justice Division for the Bexar County Criminal District Attorney s Human Trafficking Unit Program in the amount of $222,273.88; the term of the grant will be from September 1, 2013 through August 31, 2014; and authorizing the County Judge to execute a Resolution to effect this approval; and acceptance of funds upon award with no County match required. (Record) Item 12 District Attorney s Office The Court hereby ordered and approved a motion approving the submission of an application to the Office of the Governor, Criminal Justice Division for continuation funding of a Crime Victim Liaison for the period of September 1, 2013 through August 1, 2014 in the amount of $49,440.00, with a cash match of $8,300 from the Bexar County Family Justice Center Foundation and an in-kind match of $11, from the Bexar County Criminal District Attorney s Office; and authorizing the County Judge to execute a Resolution to affect this approval; and acceptance of funds upon award. (Record) Item 13 Sheriff s Office The Court hereby ordered and approved a motion approving the Sheriff s request to withdraw one (1) vehicle from inventory and place up for auction. (Record) Item 15 County Auditor s Office The Court hereby ordered and approved a motion authorizing the County Auditor to pay routine bills from Monday, February 25, 2013 through Friday, March 8, The list of bills paid will be presented to the court on Tuesday, March 12, (Record) 3
4 Item 16 County Auditor s Office The Court hereby ordered and approved a motion approving the disbursement of payroll, including overtime, and auto allowances to be paid, Thursday, February 28, (Record) Item 17 County Auditor s Office The Court hereby ordered and approved a motion approving accounts and authorizing payment be drawn totaling: (Record) $ 10,179, (Bills printed February 13, 2013) $ 15,389, (Bills printed February 15, 2013) $ 3,212, (Bills printed February 20, 2013) $ 1,675, (Bills printed February 22, 2013) Item 18 County Auditor s Office The Court hereby ordered and approved a motion approving the Tax Refunds for Paid in Error Requests totaling $364, which have been reviewed by the Auditor s Office and found to be valid. 5 County Auditor s Office The Court hereby ordered and approved a motion accepting an FLSA summary report regarding non-exempt County personnel that have accrued FLSA hours in excess of 199 but less than 240, and law enforcement personnel FLSA hours in excess of 439 but less than 480 as of the month ending January 31, (Record) Item 20 County Auditor s Office The Court hereby ordered and approved a motion approving the certification of additional revenue into the Bexar County Sheriff s State Asset Forfeiture Fund 312 of $18,067, pursuant to Local Government Code (Record) Item 21 Juvenile Probation The Court hereby ordered and approved a motion approving the submission of an application to the Office of the Governor, Criminal Justice Division for 11 th year funding of the Bexar County Juvenile Drug Court over the term of September 1, 2013 through August 31, 2014 in the amount of $119,104, representing $107,193 in Juvenile Accountability Block Grant Discretionary funds, plus a cash match of $11,911, with power to accept grant funds if awarded, and authorize the County Judge to execute a resolution to effect this approval. (Record) Item 22 Juvenile Probation The Court hereby ordered and approved a motion approving the submission of an application to the Office of the Governor, Criminal Justice Division for 3 rd year funding of the New Life project over the term of September 1, 2013 through August 31, 2014 in the amount of $101,500 representing $81,200 in Victim Assistance grant funds, plus an in- kind match of $20,300, for acceptance of funds upon award, and authorizing the County Judge to execute a resolution to effect this approval with no cash match required of the County. 6 Item 23 Purchasing Department The Court hereby ordered and approved a motion authorizing the removal and sale of one (1) surplus firearm weapon to retired Bexar County Deputy: Leonard R. Crawford in the amount of $250 in accordance with the Surplus Firearm Equipment List, as requested by the Bexar County Sheriff s Office; and authorizing the Purchasing Agent to update the Bexar County Inventory Records and file the appropriate documents for record. (Record) Item 24 Purchasing Department The Court hereby ordered and approved a motion authorizing the execution of an Agreement with Touchpay, Incorporated for the purchase of external Jail Kiosk Services to provide inmate money account transfer, bail and booking transactions for a one-year period, and presenting for four (4) one-year options to renew, as requested by the Bexar County Sheriff s Office in the estimated generated annual revenue amount of $54,000. (Record) Item 25 Purchasing Department The Court hereby ordered and approved a motion awarding a delivery order to Cooper Equipment Company for the purchase of one (1) Schwarze Model A7000 Regenerative Air Street Sweeper, as requested by the Bexar County Public Works Department in the amount of $175,198.08, and authorizing the Purchasing Agent to execute and file the appropriate award documents for the record. 7 The Court hereby ordered and approved a motion awarding a contract to the lowest and best qualified bid submitted by Geosource, Inc. to provide for the purchase of construction services for the mitigation of Ingram Road LWC #58 (LC-8) Project, Precinct 2, in the amount of $117,286.50, as requested by the Bexar County Public Works Department, Flood Control Division; and authorizing the Purchasing Agent to execute and file the appropriate award documents for the record. (Record) Item 27 Purchasing Department The Court hereby ordered and approved a motion awarding the renewal of a requirements service contract with Texas Towing Inc. to provide for the purchase of vehicle towing and storage services in the estimated annual amount of $13,000 for a period beginning upon award through May 31, 2014, under the same pricing, terms and conditions, as requested by the Bexar County Sheriff s Office; and authorizing the Purchasing Agent to execute and file the appropriate award documents for the record. (Record) Item 58 Judicial Services The Court hereby ordered and approved a motion approving execution of the Revival and Amendment with Bexar County and the Center for Healthcare Services (CHCS) extending services effective October 1, 2012 through February 28, 2013 for a total of $119, decreased by $22,665.25, for the Re-Entry Court Bureau of Justice Assistance (BJA) Grant# 2010-RM-BX (Record) Item 59 Judicial Services The Court hereby ordered and approved a motion approving execution of the Revival and Amendment with Bexar County and Alpha Home, Elite Counseling and Rosetta s Key extending services effective September 1, 2012 through February 28, 2013 for a total of $60,000 from the Adult Criminal Drug Court CJD Governor s grant fund. (Record) Item 60 Judicial Services The Court hereby ordered and approved a motion approving execution of the Revival and Amendment with Bexar County and Alpha Home, Lifetime Recovery, Elite Counseling, Rosetta s Key and Center for Healthcare Services extending services effective September 30, 2012 through February 28, 2013 with additional funding of $84,
16 from the Adult Criminal Drug Court Substance Abuse and Mental Health Services (SAMHSA) grant fund. (Record) Item 14 Sheriff s Office/County Manager The Court hereby ordered and approved a motion approving a request for overtime pay for Deputy Sheriff - Detention Officers required to work mandatory overtime to supervise inmates in the Adult Detention Center and physically have worked 40 hours in a work week, in an amount not to exceed $500,000; and Deputy Sheriff Law Enforcement Officers assigned to work in the Court Security Division required to work overtime and physically worked more than 40 hours in a work week through March 31, 2013 in an amount not to exceed $12,350. Item 35 Public Works Department The Court hereby ordered and approved a motion approving a Professional Services Agreement between Bexar County and Atkins North America, Inc. for Construction Inspection Services for the Boerne Stage Road Project an amount not to exceed $710,176. Precinct Number 3 (Record) Commissioner Kevin A. Wolff, which motion was voted on as follows: Commissioners Rodriguez, Wolff, Adkisson, and Judge Wolff voting Aye. Item 45 Facilities and Parks Department The Court hereby ordered and approved a motion authorizing the County Judge to execute a Professional Services Contract with Alamo Architects in the amount of $296,307.00, for Architectural/Engineering and Planning Services in connection with redevelopment of the historic Hot Wells Ruins located between the San Antonio River and South Presa Street, south of the Riverside Drive, to establish the Hot Wells Interpretive Center a new Bexar County Park. (Record) A motion was presented by County Commissioner Sergio Chico Rodriguez, duly seconded by County Commissioner Tommy Adkisson, which motion was voted on as follows: Commissioners Rodriguez, Wolff, 16

Item 48 Resource Management The Court hereby ordered and approved a motion approving the submission of an electronic grant application to the Governor s Office for Drug Court Funding for the Bexar County Veterans Treatment Court (Grant Number: ) in the amount of $203,250, and a resolution, and acceptance of funds if awarded; and the term of the grant is from September 1, 2013 through August 31, (Record) A motion was presented by County Commissioner Sergio Chico Rodriguez, duly seconded by County Commissioner Tommy Adkisson, which motion was voted on as follows: Commissioners Rodriguez, Adkisson, and Judge Wolff voting Aye. Item 4a District Clerk s Office The Court hereby ordered and approved a motion approving a Bexar County District Clerk s participation in Passport Day in the USA to be held on Saturday, March 9, 2013 from 10:00 a.m. until 3:00 p.m. (Record) A motion was presented by County Commissioner Sergio Chico Rodriguez, duly seconded by County Commissioner Tommy Adkisson, which motion was voted on as follows: Commissioners Rodriguez, Wolff, Adkisson, and Judge Wolff voting Aye.
