PENATY Any person frm or corporaton who volates any provson of ths Ordnance shall be deemed gulty of a msdemeanor and upon convcton thereof n the Muncpal Court shall be subect to a fne of not more than $ for each offense and each and every day such offense s contnued shall consttute a new and separate offense. SECTON. REPEAER Every ordnance or parts of ordnances found to be n conflct '" herewth are hereby repealed. SECTON V. 13 . DEFNTONS r ~ Buldng. A structure (anythng constructed or erected) des.gned to be used as a place of occupancy storage or shelter. Buldng ot. A sngle tract of land located wthn a sngle block whch (at tme of flng for a buldng permt) s desgned by ts owner or developer as a tract to be used developed or bult upon as a unt under sngle ownershp or control. t shall front upon a street or approved place. Therefore a "buldng lot" may not concde wth a lot of record. A buldng lot may be subsequently subdvded nto two or more buldng lots and a number of buldng lots may be cumulated nto one buldng lot subect to the provsons of ths ordnance.. Cty. The Cty of ewsvlle Texas and all ts governng and operatng bodes. Cty Staff. All Cty employees desgnated by the Cty and by properly consttuted authorty to recommend and enforce the regulatons contaned n ths ordnance. Clear Vson Area. A part of a lot (generally corner lot) whch may not be utlzed for plantngs walls fences parkng vendng machnes or other obstructons whch would cause danger as determned by the Cty to traffc by obstructng the vew. Commercal Development. Any non-sngle famly resdental development requrng an engneerng ste plan n accordance wth the General Development Ordnance.. l. Control of Access ne. nes along sectons of the street and alley rghts-of-way whch delneate areas where no drveway access wll be permtted these lnes shall be shown wthn the lmts whch the cty determnes to be potentally unsafe for drveway access. Corner Clp. A trangular area of addtonal rght-of-way at street and alley ntersectons. Councl. The Cty Councl of the Cty of ewsvlle Texas.. Easement. The rght granted for the purpose of lmted publc use across over or under prvate land. Engneer. The Cty Engneer of the Cty of ewsvlle or any Texas regstered cvl engneer. Fnal Plat. A plat of a subdvson whch has been approved n accordance wth the requrements of ths ordnance and a copy of whch has been fled for record wth the county clerk of Denton County Texas... \. Fre ane. A fre apparatus access road that s a mnmum of 20 feet n wdth and constructed of ether asphalt or renforced concrete suffcently desgned to support the mposed loads of fre apparatus and provdes a surface capable of beng strped n accordance wth current Cty specfcatons. Fre apparatus access roads wll be requred and mantaned n accordance wth the Unform Fre Code. ot of Record. A lot whch s created by an approved subdvson the plat of whch has been duly recorded n the offce of the approprate county clerk. Master Plan. The varous plans for the Cty and ts adonng areas as adopted by the Councl and as t may subsequently be amended and whch ndcates the exstng and recommended general locatons of varous land uses streets parks and other publc and prvate developments and mprovements. Ordnances Standards and Codes. The offcal maps master plans ordnances and specfcatons of the Cty of ewsvlle. Plannng & Zonng Commsson. The plannng and zonng commsson of the Cty of ewsvlle Texas.. A complete and exact plan map or drawng on whch a subdvder's plan of a subdvson s presented and s submtted for approval and a copy of whch has been or wll be fled n the offce of the approprate county clerk. Prelmnary Plat. A prelmnary plan or drawng that represents a subdvder's plan of the subdvson showng all boundares and locaton of ndvdual propertes and streets. Prelmnary plats must be approved by ether the Plannng and Zonng Commsson or Cty Councl as applcable. Replat. The subdvson of any part or all of any block or blocks of a prevously platted subdvson addton or lot.. Screenng Devce. A sold opaque screenng wall made of brck stone or decoratve concrete block to be erected at desgnated areas n accordance wth the screenng secton of ths ordnance. Set Back ne. A lne whch a buldng must be set back trom the property lne the street rght-ot-way lne or easement lne. Ste mprovements. All necessary ste related mprovements requred by ths ordnance. J.:: - Off Ste Publc mprovements. All publc mprovements constructed on publc property. On Ste Publc mprovements. All publc mprovements constructed on prvate property n publc easements. Publc mprovements. All nfrastructures necessary for development as requred by ths ordnance whch nclude surface mprovements (curbs gutters drveway approaches sdewalks paved streets alleys brdges culverts street lghts and etc.) and utltes (water and sewer lnes storm drans fre hydrants and etc). Sem-Publc mprovements. All mprovements requred by ths ordnance nstalled on prvate property other than easements and prvately mantaned. (e.g. fre lanes fre lnes on ste prvate fre hydrants screenng devces on ste dranage meters and backflow devces). Ste Plan. The development plan for one or more lots upon whch s shown all nformaton requred by ths ordnance. There are specfc requrements for Engneerng Ste Plans and for Archtectural Ste Plans. Street. A way for vehcular traffc whether desgnated as street hghway thoroughfare parkway road boulevard or however otherwse desgnated. - e - - Alleys. Mnor ways whch are used prmarly for vehcular servce access to back or the sde of propertes otherwse abuttng on a street. Alleys nteror. nternal alleys wthn a subdvson not parallel to a Cty street. Alleys Permeter. Alleys adacent to and parallel to a Cty street requrng a screenng wall between the rghts-of-ways. Arteral Streets. Maor streets n the Cty's street system that serves as an avenue for the crculaton of traffc onto out or around the Cty and carry hgh volume of traffc desgnated on the thoroughfare plan as P6D P4D. Collector Streets. Streets whose prncpal functon s to carry traffc between resdental streets and the arteral streets but that may also provde drect access to abuttng propertes ncludng the prncpal entrance streets of a resdental development desgnated on the thoroughfare plan as C2U and C4U. 15 Controlled Access Streets. Streets whch are parallel to and adacent to arteral streets and hghways and whch provde access to abuttng propertes and protecton from through traffc. Cul De Sacs. Short mnor streets havng only one vehcular access to another street and termnated by a vehcular turn-around. Dead End Streets. Streets other than a cul-de-sac wth only one outlet. ) - d. ' Resdental Streets. Streets whch are ntended prmarly to serve traffc wthn a neghborhood or lmted resdental dstrct and whch s used for access to abuttng propertes. Subdvson. The dvson of a parcel of land nto two or more lots or buldng stes for purpose of sale or buldng development (whether mmedate or future) ncludng one lot subdvson and all dvsons of land nvolvng dedcaton of streets alleys and easements or change n exstng streets. The term also ncludes re-subdvson and the term subdvder or developer are synonymous and nterchangeable and nclude any person partnershp assocaton frm trustee or agent who partcpate n subdvson of land wthn the ntent scope and purvew of ths ordnance. Dvsons of land for agrcultural purposes n parcels of fve (5) acres or more shall not be ncluded wthn ths defnton unless any such dvson of fve (5) acres or more nclude the plannng or development of a new street or access easement. Tract. An unplatted parcel of land whose boundares have been establshed by a recorded deed and whch s recognzed as a separate parcel for purpose of transfer of ttle. _ Truck ay. The route Fre Department apparatus travels from a fre hydrant to all ponts of a structure or combustble storage area. Actual dstance s measured along a paved street and/or fre lane as the apparatus would travel. Utlty Company. Companes corporatons and other enttes who undertake transmsson and dstrbuton of electrcty telecommuncatons rado or televson communcatons. Utlty nes. Poles structures wre aeral cables and related facltes used n transmsson and dstrbuton of electrcty telecommuncatons rado or televson communcatons. Utlty nes Exstng. Poles wres aeral cables and other related facltes that are n place and n operaton at the tme of the effectve date of ths Ordnance. - Utlty nes New. Poles wres aeral cables and other related facltes that are not n place and n operaton at the tme of the effectve date of ths Ordnance. Utlty nes 60KV. An electrc lne used for electrcal dstrbuton havng a voltage ratng of volts. Varance. 17 -. GENERA PROVSONS. PURPOSE. The purpose of ths ordnance s to provde for the orderly safe and healthful development wthn the Cty of ewsvlle Texas and to promote the health safety and general welfare of the communty. 2. AUTHORTY. Ths ordnance s adopted under the authorty of the Consttuton and laws of the State of Texas and the Cty Charter of the Cty of ewsvlle Texas. l' JURSDCTON. Provsons of ths ordnance shall apply to the Cty mts of the Cty of ewsvlle Texas and any applcable Extraterrtoral Jursdcton of the Cty of ewsvlle Texas. EXTRA-TERRTORA JURSDCTON. The General Development Ordnance of the Cty of ewsvlle Texas as t now exsts or may hereafter be amended s hereby extended to all areas lyng wthn the Extra-Terrtoral Jursdcton ofthe Cty of ewsvlle and the rules and regulatons wthn ths ordnance governng plats and subdvson of land shall be applcable to such area wthn the Extra Terrtoral Jursdcton from and after the date of fnal passage of ths ordnance. No person shall subdvde or plat any tract of land wthn the Extra-Terrtoral Jursdcton of the Cty of ewsvlle except n conformty wth the provsons of the General Development Ordnance. 5. SPECA DSTRCTS. Specal dstrcts such as utlty dstrcts road dstrcts etc. wll be allowed only after approval of the Cty of ewsvlle. 6. SUBMTTA PROCEDURE. The submttal of plats ether prelmnary or fnal engneerng ste plans and buldng permt applcatons shall be drected to the Department of Communty Development Central Permttng secton of the Cty of ewsvlle. Such submttals wll be processed n accordance wth procedures as outlned wthn ths General Development Ordnance and polces adopted n conuncton therewth.. 7. TTE OPNON. To provde evdence that the owner has adequate ttle and authorty to convey dedcaton a Ttle Opnon must be submtted for all plats or actons whch nclude dedcaton of land or easements to the Cty. Sad Ttle Opnon must be deemed to be satsfactory by the Cty Attorney of the Cty of ewsvlle and wll be at the sale expense of the owner. n the event there s one or more len holder(s) wrtten approval by the len holder(s) must be provded to show agreement of the plat or dedcaton. Dedcaton along state routes shall be by warranty deed. 8. TAX CERTFCATE. A Tax Certfcate ssued by the Cty of ewsvlle must be submtted as requred wth all Plats Engneerng Ste Plans requests for permts for constructon of publc or sem-publc mprovements or requests for permts for constructon of prvate buldngs. All taxes due to the Cty of ewsvlle must be current at the tme of approval of plats or ste plans and at the tme of ssuance of sad constructon permts. 9. DESGN STANDARDS. All plats ste plans and plans for buldng constructon shall be submtted drectly to the Buldng nspecton Dvson of the Communty Development Department. Persons wshng to dscuss specfc questons n the development process should contact the approprate dvson but all formal submttals should be made to ths "one stop" locaton to provde a coordnated revew. Copes of the Cty of ewsvlle's development and constructon regulatons are avalable at the Buldng nspecton Dvson. Pror to the flng of a prelmnary plat fnal plat or engneerng ste plan the developer/owner shall consult wth the approprate Cty staff revew commttee concernng the proposal. Staff wll assst n determnng whether the proposed development s generally consstent wth Cty of ewsvlle standards plans and polces. The Cty revew staff wll be avalable on a regular weekly bass for a ont meetng wth any person wshng to dscuss proects n revew or proposed for submttal. The proect engneer s encouraged to attend the revew meetng n orderto drectly receve pertnent nformaton regardng the proposed proect. Ths meetng wll not provde a full revew of any partcular proect but wll provde the opportunty for a developer or engneer to schedule a regular meetng to assst n expedtng the Cty revew process. Persons wshng to schedule a tme for the regular revew meetng should contact the Communty Development Department. ". The ntal revew perod wll be a maxmum of ffteen (5) workng days wth subsequent re-submttal revews to be a maxmum of ten (0) workng days. On larger sets of plans staff may requre addtonal tme for revew. The Buldng nspecton Dvson wll coordnate all submttals and returns of marked-up copes ncludng payment of revew fees as well as acceptance of tax certfcates fle copes and other requred materals. All prelmnary plats fnal plats and engneerng ste plans submtted for revew wll be on the cty's actve lst for a perod of sx months from the date of submttal. f a proect s suspended or abandoned for more than sx months t wll be placed on the nactve lst. n order to actvate a proect after t has been placed on the nactve lst payment of one-half of the orgnal revew fee s requred. Should nactvty exceed one year the proect wll be consdered abandoned and wll be removed from the fles. For all documents to be fled at the Denton County Clerk's Offce ncludng all plats deeds easements abandonments correctons etc. a separate check n the exact amount of the fee must be made drectly to the Denton County Clerk and be submtted wth the document(s) to be fled. PARK AND OTHER PUBC USE DEDCATON REQUREMENT Park Dedcaton for resdental development shall be n accordance wth the Cty of ewsvlle Park Dedcaton Ordnance. All rghts-of-way and land proposed for publc use dedcaton assocated wth a current or future development shall be dedcated wth a fnal plat. Requrement of fees n leu of land for park dedcaton purposes shall be met pror to the approval of the fnal plat for the proect. and for park dedcaton purposes may be deeded to the cty n advance but wll have to be ncluded on the plat as development occurs. Rghts-of-way acquston for publc mprovement proects wll not be affected by ths requrement. WHEN AN ENGNEERNG STE PAN S REQURED. Engneerng ste plan approval s requred for all non-sngle famly constructon nvolvng new buldngs. Engneerng ste plans must also be submtted for approval when any of the followng apply to the ste:. Change n the footprnt or square footage of any structure. 2. Any change requrng addtonal parkng and/or fre protecton to the ste. 3. Change n the fre lane confguraton or locaton. 4. PROCEDURES FOR SSUANCE OF BUDNG PERMT No buldng permt wll be ssued for any resdental or commercal buldng n the cty untl all publc mprovements assocated wth the subdvson are completed and accepted by the cty. These publc mprovements consttute the basc nfrastructure requred to serve the subdvson and nclude constructon of streets dranage water and santary sewer facltes as outlned n Secton V (2) (mprovements on Undeveloped and). Smultaneous constructon of publc and prvate mprovements wll requre cty councl acton. Commercal buldngs have to follow addtonal requrements pror to obtanng a buldng permt. An Engneerng Ste Plan sgned and sealed by a Texas Regstered Professonal Cvl Engneer must be submtted n accordance wth Cty of ewsvlle regulatons and polces. nformaton on specfc Cty regulatons polces and standards s contaned elsewhere n ths development ordnance package. The approval of an engneerng ste plan by the Cty shall be effectve for a perod of one hundred eghty (80) days after the date of the formal approval.
