3 BRIEFING MAY 2014 ALERT FOR SAN FRANCISCO BAY AREA EMPLOYERS COMMUTER BENEFITS REQUIRED AS OF SEPTEMBER 30, 2014 If you are an employer with 50 or more employees in the San Francisco Bay area, you will soon be dealing with a new law that will require you to provide a commuter benefits program to your employees. THE LAW Senate Bill 1339, signed into law in 2012, created the Bay Area Commuter Benefits Program, which will be implemented by the Bay Area Air Quality Management District (BAAQMD) and the Metropolitan Transportation Commission (MTC) on a pilot basis through the end of In response to SB 1339, the BAAQMD and MTC have written regulations which were finalized on March 19, 2014 and go into effect on September 30, The commuter benefit requirement will apply to all employers for which an average of 50 or more full-time employees per week perform work for monetary compensation within the geographic boundaries of the Bay Area Air Quality Management District (BAAQMD). The law defines full-time employees as those working an average of 30 hours or more per week. The BAAQMD is comprised of the following counties: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo and Santa Clara, the southern portion of Sonoma County and the southwestern portion of Solano County. EMPLOYER OPTIONS AND REQUIREMENTS To comply with the law, employers must offer covered employees a commuter benefit under at least one of the four following options. Option 1 - Pre-Tax Option: The employer can allow employees to pay for their transit or vanpooling expenses with pre-tax dollars, through a Section 132(f) plan. Option 2 - Employer-Provided Subsidy: The employer may offer employees a direct transit or vanpool subsidy to reduce or cover the employees' monthly transit or vanpool costs. The amount of the subsidy would be equal to either the monthly cost of transit or $75, whichever is lower. Option 3 - Employer-Provided Transit: An employer may furnish free or low-cost bus, shuttle or vanpool service directly to employees. Option 4 - Alternative Commuter Benefit: The regulations also allow employers to propose an alternative method that would be as effective as the other options in reducing single-occupant vehicle trips (and/or vehicle emissions). The proposal must be in writing and must be approved by the BAAQMD. If you are an employer within the geographic boundaries of the BAAQMD, you should take the following steps to ensure your readiness to comply with this law by September 30, 2014: 2014 Keenan & Associates License No Innovative Solutions. 4 1. Determine if your organization is covered by the law. To determine your full-time employee count, the regulations require you to calculate the average number of employees per week carried on the payroll over the course of the most recent three month period. Any person who performs services in return for monetary compensation and to whom your organization has provided or will provide an IRS Form W-2 is considered an employee for this purpose. If you have an average of 50 or more full-time employees per week within the geographic boundaries of the BAAQMD, you are a covered employer. 2. Choose a commuter benefit option. For most organizations, the easiest and lowest-cost option will be to establish a Section 132(f) pre-tax commuter benefit plan. This must be offered to all covered employees. Please note, the law defines a covered employer by reference to the number of 30 hour per week employees it has, but the regulations define covered employees as those who performed an average of at least 20 hours of work per week within the previous calendar month within the geographic boundaries of the BAAQMD. Seasonal employees (those working for the employer 120 days or less within the calendar year) do not have to be offered this benefit. 3. Designate a Commuter Benefits Coordinator. The regulations require employers subject to this law to designate a person who is responsible for implementing the commuter benefits program. 4. Register with the BAAQMD. Employers subject to this law must register with the BAAQMD s Air Pollution Control Officer (APCO) no later than September 30, The following information must be supplied upon initial registration and updated and verified annually thereafter: employer name; the name, title and contact information for the employer s Commuter Benefits Coordinator; total number of full-time employees and covered employees within the geographic boundaries covered by the law; the location of each covered worksite; and the commuter benefits option the employer has chosen to implement. 5. Notify employees. You must notify all covered employees that your organization is subject to the requirements of this rule and inform them which commuter benefit option(s) you will offer. The notice should also provide covered employees with information as to how they may apply for and receive the commuter benefit and provide a point of contact within the organization for further information. This notice can be made through , paper memos, in-house newsletters or bulletins and/or conventional or electronic bulletin boards. The notice must go out when the commuter benefit is first made available to employees, and then annually thereafter. Commuter benefits information must also be included as part of the employee benefits package and explained to all newly hired employees. 6. Maintain and retain records. You must keep records, files and documentation to establish your compliance with this law for a period of three years. 7 State of California Commission on Teacher Credentialing 1900 Capitol Avenue Sacramento, CA credentials@ctc.ca.gov Website: CERTIFICATE OF COMPLETION OF STAFF DEVELOPMENT The Certificate of Completion of Staff Development (CCSD) authorizes the holder to teach Specially Designed Academic Instruction Delivered in English (SDAIE) to English learners (EL) within the subject matter content and grade level of the holder's prerequisite credential. REQUIREMENTS Individuals must satisfy all of the following requirements: 1. Hold a valid prerequisite teaching credential (preliminary, clear, or life California Designated Subjects Teaching Credential, including Full-time or Part-time, or Services Credential with a Special Class Authorization) 2. Complete one of the following: a) 45 clock hours in a Commission-approved staff development program, verified by the program sponsor on form 41-CCSD, entitled Recommendation for a Certificate of Completion of Staff Development, or b) Submit official transcripts verifying completion of approved course work in methods of providing SDAIE from an institution with a Commission-approved CTEL program Applicants must obtain an original letter from the authorized person in the credentials office of an approved California Teachers of English Learners (CTEL) program verifying course work taken meets that program' s SDAIE requirement. Each approved CTEL program must determine if it will offer this option and notify the Commission of their intent. Regardless of when the course was taken, Form 41-CCSD does not need to be submitted with the application packet. 3. Submit a completed application (form 41-4) and processing fee PERIOD OF VALIDITY The Certificate will remain valid for as long as the prerequisite teaching credential is valid. The Certificate does not need to be renewed. 9 CODED CORRESPONDENCE DATE: NUMBER: June 25, TO: All Individuals and Groups Interested in the Activities of the Commission on Teacher Credentialing FROM: Mary Vixie Sandy Executive Director Commission on Teacher Credentialing SUBJECT: Application Processing Fee Increase Effective July 1, 2015 Summary: In the May Revision, the Governor proposed that the Commission on Teacher Credentialing's (Commission) budget include a processing fee increase from $70 to $100 (reference Education Code 44235). The Legislature has adopted and the Governor has approved the proposal as part of the 2015 Budget Act; therefore, the proposed fee increase will become effective July 1, Key Provisions: Application Processing Fees Effective July 1, 2015, the processing fee for teach ing and services credentials, certificates, permits, authorizations, and waiver documents unless exem t) will be $ an additional service ee will be assessed for online applications). The new processing fee applies to initial, renewal, and subsequent applications for teaching and services documents received at the Commission on or after July 1, The processing fee will continue to be waived on the initial credential application submitted by an out-of-state prepared applicant who relocates to California due to orders received from a branch of the United States Armed Forces requiring his or her spouse to relocate to California. Refer to the Military Service leaflet (CL-892) for additional information regarding this fee waiver. Applications Submitted via the Online Recommendation System The CTC Online system has been updated to reflect the increased processing fee for application payments received on or after July 1, Applicants completing the online payment process on or after that date will be required to submit the $ processing fee plus the $2.50

However, paper applications postmarked on or after July 1, 2015 will be returned for 'iii'sufficient fees if the enclosed payment is less than $ Certificate of Clearance Fees and Credits The processing fee for a Certificate of Clearance (COC) is $50.00 (with an additional $2.50 service fee assessed for online applications) effective July 1, The fee credit for a COC issued on the basis of the $ processing fee will be $50.00 if requested at the time an individual applies for an initial teaching or services credential. The COC fee credit will be considered "used" if not requested at the time the initial teaching or services credential is issued or when the COC expires, whichever occurs first. Certificate of Eligibility Credit The processing fee to upgrade a Certificate of Eligibility (Administrative Services or Education Specialist Instruction) is one-half the processing fee in effect at the time the application for the preliminary/level I is submitted. Therefore, the processing fee to upgrade a Certificate of Eligibility to a Preliminary Administrative Services Credential or a Level I Education Specialist Instruction Credential on or after July 1, 2015 is $50.00, regardless of the amount paid at the time the Certificate was issued. Request for Restriction Change Effective July 1, 2015, the processing fee required at the time an employing agency requests a restriction change on a permit or waiver or when a program sponsor requests a restriction change on an intern credential is $ The $50.00 processing fee for restriction changes is only available with the submission of a paper application. The full $ processing fee plus the $2.50 service charge will be required for restriction changes submitted via the CTC Online system. Child Development Permit Upgrades Regulations allow the holder of an initially issued Child Development Permit to upgrade to a more advanced permit within three years of the issuance date of the permit held for one-half of the processing fee in effect at the time that the application is submitted. Effective July 1, 2015, the processing fee required for individuals who upgrade from an initially issued Child Development Permit to a more advanced permit will be $ Certificate of Completion of Staff Development The statutory processing fee for the Certificate of Completion of Staff Development (CCSD) is set at $45.00 [reference Education Code ll(e)]. The revenue for these funds comes from the fees collected as the result of issuing documents, administering the various education preparation programs, and examinations for candidates. The processing fee increase will allow the Commission to maintain the essential core functions of the agency. 12 No F3 NewsFlash JULY 2014 CTC Must Make Credentialing Applicants Aware of Reporting Responsibilities Under Child Abuse Law On July 9, 2014, Governor Jerry Brown signed Assembly Bill 2560 ( AB 2560 ), which imposes an obligation on the Commission on Teacher Credentialing ( CTC ) to ensure that all applicants clearly understand their responsibilities as mandated reporters under the Child Abuse and Neglect Reporting Act ( CANRA ). AB 2560 was designed to address the growing number of cases across the state involving child abuse in schools and the delays in response time that have allowed many incidents of abuse to go unaddressed. CANRA requires a mandated reporter as defined to include a teacher to report whenever he or she, in his or her professional capacity or within the scope of his or her employment, has knowledge of or observes a child whom the mandated reporter knows or reasonably suspects has been the victim of child abuse or neglect. Specifically, AB 2560 requires the CTC, as part of its standards and procedures for the issuance or renewal of teaching or services credentials, to require an initial or renewal applicant who submits an application for his or her credential online, to read and attest by signature a statement that he or she understands the mandated reporter duties imposed by CANRA. The obligation also applies to an initial teaching or services credential applicant who submits an application in paper form. CANRA currently imposes a duty on employers including school districts who hire an individual for a position that requires mandated reporting to provide the new employee with a document detailing his or her reporting responsibilities and confidentiality rights. We strongly encourage districts to review current training programs and provide instruction on CANRA s requirements to all employees who are mandated reporters, including training in child abuse and neglect identification and reporting obligations. The criteria became effective on January 1, Required criteria for initial issuance includes: Hold Bachelor's degree in Speech-Language Pathology hold a Multiple Subject Teaching Credential or an Education Specialist Credential; and Enrollment in California or out-of-state program. Required criteria for reissuance includes: Enrollment in California or out-of-state program; and Verify progress towards issuance of credential; and No more than five waivers with another two possible if specific criteria are met. Key Provisions: Requirements for Initial Issuance 1. For the initial issuance of a VTW for the SLP Services Credential individuals must verify one of the following: a. Bachelor's degree from a regionally-accredited college or university in Speech-Language Pathology, Communicative Disorder, or a closely aligned field. Examples of closely aligned fields are listed in Appendix A. ; or

A valid California Multiple Subject Teaching Credential, Education Specialist Instruction Credential, or older equivalent credential. 2. Program Enrollment - individuals must verify one of the following: a. Enrollment in a Commission-approved SLP Services Credential program with an original letter on official letterhead from the Commission approved SLP program verifying program enrollment; or b. Enrollment in an out-of-state ASHA-accredited graduate level SLP program, with an original letter on official letterhead from the out-of-state ASHA program; or c. Verification of an inability to enroll in a Comm ission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program and confirm that all requirements for entry are met, by one of the following methods: i. A verification notice from the college or university of an inability to enroll in a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program (i.e., within 100 miles or available online) due specifically to limitations of space or due to a mismatch between the requested initial employment date and the program enrollment date. ii. Confirmation from the employer or institution that all minimum admission requirements for a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program were met by the applicant. d. For holders of a val id Multiple Subject Teach ing or Education Specialist Instruction Credential: i. Submit a verification of intent to enroll in a minimum of six semester units of coursework in Speech-Language Pathology or Communicative Disorders coursework appropriate for admission to a Commission-approved SLP Services Credential program or out-of-state ASHA-accredited graduate level SLP program. Please note: applicants who verify Program Enrollment through option a or b will not be held for requirement 1. Requirements for Reissuance Individuals must demonstrate adequate progress toward earning the SLP Services Credential for re issuance of the VTW by one of the following: a. Completing a minimum of six semester units toward completion of a Commission-approved SLP Services Credential program; or b. Completing a minimum of six semester units toward completion of an out-of-state ASHA-accredited graduate level SLP program; or c. Complete a minimum of six semester units of coursework in Pathology or Communicative Disorders necessary for Commission-approved SLP Services Credential program ASHA-accredited graduate level SLP program; or Speech-Language admission to a or out-of-state d. Verify an inability to enroll in a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program and confirm that all requirements for entry are met by the following methods: i. A verification notice from the college or university of an inability to enroll in a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program (i.e., within 100 miles or available online) due specifically to limitations of space or due to a mismatch between the requested initial employment date and the program enrollment date. ii. Confirmation from the employer or institution that all minimum admission requirements for a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program were met by the applicant. Number of Reissuances The number of VTWs for the SLP Services Credential will be limited to five total issuances (initial issuance and four reissuances), with the option for an employer to request up to two more reissuances for the following specific circumstances: The individual holds a valid Multiple Subject Teaching Credential or Education Specialist Instruction Credential and must verify active enrollment in a Commission-approved SLP Services Credential program or an out-of-state ASHA-accredited graduate level SLP program. A minimum of six semester units in the approved program must be completed for each of the two subsequent reissuances; or The individual qualified for one or more reissuances based on a valid medical appeal as outlined in Credential Leaflet AL-3 and submits a letter verifying active enrollment in a Commission-approved SLP Services Credential Program or an out-of-state ASHA accredited graduate level SLP program; or An individual who exceeded four or more issuances of the VTW for the SLP Services Credential prior to January 1, 2015 must submit a letter verifying active enrollment and progress in either a Commission-approved SLP Services Credential program or an out-ofstate ASHA-accredited graduate level SLP program. Important Dates: The Commission adopted the initial SLP VTW criteria with an effective date of January 1, Expanded criteria were adopted at the February 2015 meeting. Background: A credential waiver is an employment option available to local education agencies when there is a shortage of credentialed personnel. The Commission has had the responsibility for granting credential waivers since July A credential waiver is the option of last resort for employing agencies to legally assign an individual who is not appropriately credentialed. 16 Coded Correspondence 15-05: Variable Term Waiver for the SLP Services Credential page 4 The VTW allows the employing agency to fill the assignment while searching for a fully credentialed educator and gives the waiver holder additional time to complete the requirements for the associated credential. The VTW is restricted to service with the local education agency granting the waiver and is generally issued for one school year with specific criteria set for the reissuance of a subsequent waiver. While the VTW for the SLP Services Credential is restricted to service with the employing agency that requested the waiver, the authorization of the SLP VTW is the same as the SLP Services Credential. The Commission approved criteria to strengthen the requirements for the initial issuance and reissuance of the VTW for the SLP Services Credential. The adopted criteria will increase assurance that individuals in the schools who hold VTWs for the SLP Services Credential meet appropriate minimum standards of competency to provide SLP services and are on the preparation pathway towards becoming fully credentialed. 17 Coded Correspondence 15-05: Variable Term Waiver for the 5LP Services Credential page 5 Appendix A Examples of Closely Aligned Fields Commission adopted criteria state that a waiver applicant must hold a Bachelor's degree from a regionally-accredited college or university in Speech-Language Pathology, Communicative Disorder, or a closely aligned field. The information below provides examples of acceptable closely aligned fields but is not meant to be all inclusive. We thank you for continuing to join with us in dedicating your time and talents to providing a quality and seamless education for all students in the absence of regular teaching staff. Our hope is you will continue to substitute teach for the school year. In order to do so, we ask you to return the enclosed "Substitute Annual Re-Registration Form" in the envelope provided. Once your re-registration form has been processed, you will receive a new "Substitute Teacher's Identification Verification forthe 2015/2016 School Year" and a "2015/2016 Marin Substitute Teacher Rate Sheet" with current day rates of pay and district office contact information. In an effort to go paperless you will receive this document via unless "No " is marked on your re-registration form. In order to be activated for the school year, you will need the following: A valid California teaching credential or 30-Day Emergency Substitute Teacher Permit Verification of freedom from active tuberculosis, tested within the last four years, on file in the MCOE Credentials Office New for : o Certification for Mandated Reporter Training (see attached information sheet) o Proof of Immunization from Measles (see attached information sheet) Once you receive your 2015/2016 verification it is your responsibility to do the following: Forward the new ID verification to each district office with whom you have previously registered. Contact new district offices you would like to register with, fill out employee paper work and forward the new ID. Our Marin County substitute teacher database reflects the following information: Name: <NAME> Tuberculosis test expires four years from <DATE> Credential(s)/permit: <CREDENTIAL> Expiration Date: <DATE> Remember: It is your responsibility to have current authorization and clearance and provide it to our office. In addition, do not accept certificated sub work if your credential, permit and/or TB clearance is expired. The virus is spread by sharing the same area with an infected person, especially if that person coughs or sneezes. Individuals are usually contagious four (4) days before they develop symptoms, and may unknowingly make others ill. In 2015, California and Marin County experienced a recent measles outbreak. This situation has prompted all schools in Marin County to take extra precautions in an effort to protect our students and staff from the spread of the disease. As a result, measles immunity information is required for all Marin County Substitute Teachers. Providing documentation of immunity/immunization will ensure that you can continue to work in the event of an outbreak. All Marin County Substitute Teachers must provide "Proof of Measles Immunization" by submitting one of the following documentation: A copy of government issued documentation (e.g., birth certificate, passport, driver's license) affirming date of birth prior to 1957; or Documented laboratory confirmation of immunity to Measles -Rubeola by attaching titer test laboratory results from a licensed health care provider; or Documented proof (official immunization record) of having at least one (1) dose of the MMR vaccine. o You may have the MMR Vaccine administered at the Marin County ' Immunization Clinic or go to a licensed health care provider.
