A centrally established and directed national moderation system has been set up by The Skills Organisation. special notes: 1 This unit standard is intended for people who are employed in the New Zealand public sector in the role of Inspector of Weights. The content is based on the Weights Act 1987 and the Weights Regulations 1999 and their subsequent amendments. 2 Definitions Organisation in the context of this unit standard is the Ministry of Consumer Affairs Measurement and Product Safety Service. Organisational requirements in the context of this unit standard includes policy and procedures of the Ministry of Consumer Affairs Measurement and Product Safety Service. Public Sector covers all publicly owned organisations which are connected to the institution of New Zealand
2 2 of 5 government, both central and local, and which include public service, crown entities, non-uniformed staffs of the services and forces, offices of Parliament, and local authorities. Public Service is part of the State sector, and consists of all the ministries and departments of state which carry out core government business which are listed in the First Schedule of the State Sector Act State Sector applies to all national institutions of central government. Elements and Performance Criteria element 1 Determine if a breach of the weights and measures legislation has occurred. 1.1 The section and/or regulation allegedly breached is identified. 1.2 Evidence collected clearly indicates an alleged breach has occurred. 1.3 Evidence collected is admissible in a judicial hearing in accordance with legal requirements. 1.4 Evidence collected meets organisational requirements. element 2 Prepare a breach report on an offence committed against the weights and measures legislation. 2.1 Action to be taken is identified. Range: infringement offence notice, prosecution.
3 3 of Information is factual, relevant to the case, and able to be readily assimilated by the intended reader. 2.3 Selected legislative action is justified in terms of observed facts and evidence. 2.4 All elements of the offence are proven and have appropriate documented evidence. 2.5 Offender is correctly identified. element 3 Demonstrate knowledge of the action taken to issue an infringement offence notice (ION). 3.1 The correct infringement fee for the offence is identified. 3.2 The infringement offence notice is completed in accordance with legal requirements and organisational requirements. 3.3 The offender is correctly identified and advised of their rights. 3.4 Documentation is filed according to organisational requirements. Range: may include but is not limited to interview notes, checklists, inspection reports, seized goods report, breach report, infringement offence notice, timeline, certificate of incorporation. element 4 Prepare summary of facts for a legal hearing. 4.1 Summary of facts is completed in accordance with organisational requirements. 4.2 Evidence and facts that support the information are summarised.
4 4 of Legislation that describes elements of the offence is stated. 4.4 Penalty for offence is stated. element 5 Demonstrate knowledge of action required when recommending prosecution. 5.1 Prosecution file is created in accordance with organisational requirements. 5.2 Information regarding previous instances of non-compliance is included in file. 5.3 Certificate of incorporation, if appropriate, is included on file. 5.4 Summary of facts is included on file. 5.5 Recommendation to prosecute is made.
