1 Private Non Profit Overview Public Law , Section 1120 (a) requires each participating LEA to provide eligible private school children, their teachers, and their families with Title I educational services or benefits that are equitable to those provided to eligible public school children, their teachers, and their families. CONSULTATION LEA RESPONSIBILITIES o Extensive consultation with the private school officials to develop and implement the Title I program for eligible private school students (must include meetings) o Timely and meaningful o Consultation with private school officials prior to making any decision that affects the opportunities of eligible private school children to participate o Includes consultation for services to be provided to students, parent involvement, and professional development o (PAGE 6 NON-REG. GUIDANCE) Must consult with private school officials prior to rank ordering their public schools attendance areas and selecting grade span grouping so that private school officials can address the impact of LEA s choices ALLOCATING FUNDS LEA RESPONSIBILITIES o Allocate funds to public school attendance areas based on number of low-income families residing in each area o Reserve amount of these funds for PNP to provide equitable services o Funding is based on the number of low-income students attending the private nonprofit school who reside within a participating LEA Title I, Part A school attendance area o If no funds are generated, no services are provided o Per-pupil allocation x number of identified private school students residing in Title I attendance areas = Funds available for private school Title I program o Private school funds may be pooled o Funds generated by private school students must be used for instructional services o Funds must supplement, not supplant PRIVATE SCHOOL RESPONSIBILITIES o Private schools are required to provide the LEA with poverty data on private school children o The data source may be different as long as the income level for both sources is generally the same o PNP provides following information to the LEA: Address of each student (student name should not be required) Grade level of each student Size of the family Income level of the parents

2 Page 2 DETERMINING ELIGIBILITY o Must reside in participating public school Title I attendance area AND are failing or most at risk of failing to meet high standards. LEA should look at achievement test scores, grades, and teacher referrals; The PNP does not inform the LEA which students need services, the LEA determines which students are eligible based on educational need o LEA (in consultation with PNP) determines achievement standards for students o Homeless, 2 preceding years in Head Start, Even Start, Early Reading First, Title I Preschool or Title I, Part C (Migrant Education) o District chooses children to be served from the list that the private school provides of eligible students (reside in LEA attendance zone) o Poverty is NOT a criterion Student Funding Criteria Student Must: Reside within school attendance area pf participating participating Title I campus AND Meet the low-income level used for determining low-income status of private school students. FUNDED Student Eligibility Criteria Student Must: Reside within school attendance area of participating Title I campus AND Meet the educational eligibility criteria established and documented for audit purposes by the LEA SERVED INSTRUCTIONAL SERVICES o Specialized instruction outside the regular instructional program o PNP not school-wide, must serve as targeted assisted o LEA must be in control of the services o PNP s cannot have a supplies/materials program only o Multiple types of services must be offered to meet student needs such as but not limited to: Extended learning time (before and after school and in the summer) Family Literacy Early Childhood Home tutoring Computer-assisted instruction Combination of services listed above o Teachers/paras delivering services at PNP must meet requirements of highly qualified o LEA can contract with third-party provider to deliver services, the providers do not have to be highly qualified

3 Page 3 PROFESSIONAL DEVELOPMENT o Professional development addresses how PNP teachers can serve Title I students better o Cannot use PD funds to upgrade instructional program in regular classroom of PNP o LEA (in consultation with PNP) determines achievement standards for students STATUTORY REMINDERS o The LEA must assure that services to private school may only benefit eligible children, their teacher, and their families, never the school itself. o The LEA must be responsible for the design and implementation of PNP program. This responsibility cannot be delegated to the PNP. o Private school teachers may provide the Title I services, as long as: o the LEA remains in control of the program and; o The teacher meets highly qualified standards and; o The services are provided outside the teachers contract with the PNP o The LEA must conduct an annual assessment of private school services. o The LEA must identify students for Title I services. This is not the responsibility of the PNP. o The LEA must consider the views of PNP in providing services through thirdparty contractors. o The LEA cannot provide just one kind of service. Multiple types of services should be offered to meet student needs. o The LEA must consult with PNP before ANY decision is made. IMPLEMENTATION o The LEA has the obligation to contact on an annual basis, appropriate officials from private non-profit schools to determine whether such schools desire to participate in NCLB programs. o Strategies for locating PNPs o Newspaper ads o Letters o Web sites o Telephone book listings o TEA Directory o Home School/PTA o Other?

4 Page 4 NON-PROFIT STATUS o Proof that the Internal Revenue Service currently recognizes the applicant as an organization to which contributions are tax deductible under Section 501(c)(3) of the Internal Revenue Code; o A statement from a State taxing body or the State Attorney General certifying that the organization is nonprofit; The organization is a nonprofit organization operating within the State; or No part of its net earnings may lawfully benefit any private shareholder or individual o A certified copy of the applicant s certificate of incorporation or similar document if it clearly establishes the nonprofit status of the applicant. CONSULTATION o Annual consultation must take place prior to the SAS application submission o Timely and meaningful consultation between appropriate public and private school officials o Design and implement a program that will provide equitable services to meet the needs of eligible private school students and/or teachers o LEA cannot make final plans until they have a Consultation meeting with PNP o Continue consultation throughout the implementation and assessment of activities o Consultation topics (sample framework) o How needs identified o Services to be delivered o How and where services provided o Who provides services o How services assessed o What assessments used MISCELLANEOUS o LEA should obtain from the PNP a written assurance: o Equipment and materials will be used only for the following purposes: Secular, neutral, non-ideological services Equipment and materials remain the property of LEA Equipment and materials must be supplemental o Issues identified by PNPs: o Decisions made w/out PNP input o Short notice of consultation meetings o PNPs not receiving professional development and parent involvement
