4. Technology & Law Being knowledgeable about Austrian, or rather European legislation can be a challenge for many businesses. Within TÜV Austria it is the job of the Technology and Law department to carry out inspections of all legal areas of a company. As the only accredited inspections body in Austria, for many of these tasks the Technology and Law employees carry out their work as highly trained technicians with a high level of legal knowledge too. Inspection under 82b Trade Regulation Act Under trade law, every operational plant must have an inspection every five years, with or without an official invitation, to check that it complies with its permit and other trade regulations. Inspection under 134 Section 4 Water Act For all facilities relating to the storage or management of substances hazardous to water, every precaution must be taken to protect the water. The water tightness of containers and pipelines in particular are tested at intervals not exceeding five years. This does not apply if the authority under consideration prescribes to a shorter interval due to particular circumstances. Inspection under 19a Railway Act Every company that operates a railway (and even if it s only a connecting track!) and has no certified safety management system in accordance with 19a Railway Act, has the legal duty to undergo inspection every five years, to ensure that the railway system, including the rail cars, complies with the provisions of the Railway Act and railway law regulations and decrees. Approval Process, Submission Projects In most cases any changes to the operational plant must be submitted to the relevant authorities for approval. So that facilities do not become legally unsafe, which could potentially threaten their existence. The problem is that with one or more applications for various legal matters, like building permits, water rights, nature protection laws, or energy law approval, an official trade license may be required first of all. With the assistance of TÜV AUSTRIA experts time as well as costs can be saved during this demanding task. Environmental Law Register, Decree Database Using Technodat s syneris software the TÜV AUSTRIA experts are able to create a tailor-made permit database for the facility, for the management of legal authorizations (water, building and trade authorizations) as well as creating one that is adapted to operational relationships to the Environmental Law Register. Inspection under 14a Pipeline Law According to Pipeline Law, the condition of pipelines, which are used for the commercial transport of goods, have to be tested every ten years. Inspection under 140 The Gas Act In order to ensure that they comply with existing regulations and permits, owners have to have natural gas pipelines checked regularly. These inspections refer only to existing Austrian law. They can however also be carried out in accordance with Austrian law for companies, plants and facilities in other countries.

Product Certification A product certification means the confirmation of a product s conformity with certain requirements as defined by standards, laws and regulations. Since conventional standards rarely take into account usability, user-friendliness and quality, such confirmation often only meets a product s minimum requirements. For this reason, TÜV AUSTRIA CERT GMBH has developed a new and profound kind of product certification. Through site visits, surveys, laboratory and user tests, products are user-specifically tested. Only when all these individual tests have been passed, submitted products will receive a certification. After initial recognition by TÜV AUSTRIA, the products are monitored regularly for compliance with the criteria according to strict quality assurance. All kinds of products are certifiable, along with methods, processes and services.
5. Agricultural Controls (LAKO) The demand of consumers on manufacturers, processing plants and trade is constantly growing and thus there is an ever-increasing need for quality control in agriculture. Through the introduction of its own quality label/certification mark and the resulting distinction between food retailers, the production of sustainably produced and local quality products is encouraged. At the same time, adherence to regulations concerning food safety will be stringently controlled by legislature. In order to take this need into account TÜV AUSTRIA CERT GMBH has created a separate department for agricultural control, whose goal is to offer a comprehensive range of services in agricultural production and quality assurance. This includes national and European promotional controls, sustainability and environmental controls as well as monitoring of the environment, hygiene, conservation and protection of plants.
