Equivalent outcome 20 October 2014 Update HLTAID Release 4.0 to 4.1 22 July 2014 PADI Asia Pacific Pty Ltd is a Registered Training Organisation (RTO #6729) that complies with the National Vet Regulator (NVR) standards and is registered with the Australian Skills Quality Authority (ASQA) - Australia s national regulator to deliver Vocational Education & Training (VET) qualifications. This allows PADI s RTO to issue Nationally Recognised Training (NRT) certificates, called statements of attainment (SOA). For a clarification or definition of any unfamiliar terms in this guide, refer to the Glossary of Terms in Appendix. The PADI RTO General Standards and Procedures - Trainer Handbook is designed for use by PADI or Emergency First Response (EFR) Instructors who are registered with PADI s RTO. The information provided here is addressed to you, the registered RTO Trainer. Important requirements are highlighted in bold print. For a list of units of competency and accredited course we are able to offer please click here and follow the link under the Scope heading. You cannot issue statements of attainment until you have received written authorisation from PADI to teach the unit(s) of competency for which you register. Written authorisation will be sent only once the required RTO registration process (including the induction) has been completed and your signed induction documents have been received by PADI s RTO. You may upgrade your registration for additional units of competency at any time once verified, you will also receive written authorisation to teach those additional unit(s). HOW TO USE THIS GUIDE Use the PADI, EFR or TecRec Instructor Guide(s) as usual when teaching. For any additional information not covered therein, use the RTO Trainer Guides. The General Standards and Procedures on these pages apply to all RTO-related training activities, while each individual guide contains only the additional course-specific knowledge and skills that must be taught beyond those of normal PADI, EFR or TecRec courses. Read the entire RTO Trainer Guide for each unit/course you are wishing to teach so you become familiar with the procedures and assessment tools required to document the student has achieved competency under the VET system. PADI RTO REGISTRATION PROCESS STEP ONE Application to Register Fill out the RTO Trainer Registration Form: 1. Provide your name, number, date of birth, contact details and indicate the store(s) where you ll teach 2. Select box for each unit/course you want (and are qualified) to teach 3. Prerequisites select the boxes only if you already hold the rating if not, you need to apply and attach the related Application Form signed by your Instructor Trainer; make sure you include documentation of your statement of attainment in CPR/First Aid, LVR and O2 provider level skills 4. For the diving/snorkelling units you need a statement of attainment for the following units. If you hold these statements of attainment, select the appropriate boxes and attach copies; if you don t hold these, we can send you the RPL Assessment Guides and for an additional fee we can assess and recognised prior learning. a. Professional Units (OHS/RSK) SISXOHS101A - Follow defined Occupational Health and Safety policies and procedures SISXRSK301A - Undertake risk analysis of activities b. Planning Units (PLN) SISOODR302A - Plan outdoor recreation activities SISOOPS304A - Plan for minimal environmental impact 5. If you don t hold a prerequisite Specialty Instructor rating, you need to apply and attach the appropriate application form. 6. Select box for Cert IV TAE and attach copy. If you will teach diving units only under supervision of a Cert IV holder also registered to teach at the same store you need to provide the name and number of at least one Cert IV holder. 7. Select box for Child Check or write disclaimer in front of this box attach copy for each State or Territory where you will teach 8. Select box for CV attach copy of your own CV or use our template; attach copy of overview of Professional Ratings and Student Counts (you can downloaded these from the PADI Pros site > My Account, go to links at bottom; save web pages as PDF files). 9. Provide photo evidence of all equipment required when teaching the units/courses as outlined on the PADI RTO Course Overview document. You also need to provide photos of your training classroom facility. 10. Sign the Trainer Acknowledgment statement and the VET Quality Framework Agreement. 11. Send the RTO Trainer Registration Form and provide payment details for the registration fee only when you can also attach all required copies and / or application forms. 12. Attach samples of all current marketing materials (including website links) with fee structure and course prices. 13. Ensure you have your own personal RTO General Standards and Procedures Trainer Handbook and the relevant RTO Trainer Guides for all units you wish to teach. STEP TWO RTO review PADI s RTO reviews your registration, including RPL Assessment Guides and all evidence provided; feeds all information into the RTO database; communicates if anything is missing. Once PADI s RTO has received all documentation as required, the submitted evidence will be assessed against the Training and Assessment Strategies (TAS), the requirements of the relevant Training Package, the VET Quality Framework and the Standards listed in this RTO Trainer Handbook and all other applicable PADI and EFR Standards. If found complete, you will receive a Welcome letter outlining the RTO Induction process ; which prompts you to contact rto@padi.com.au with a choice of several dates and times you are available for the induction (10-15 mins phone call) please give PADI s RTO support team 2-3 days advance notice for your preferred dates. STEP THREE RTO Induction At time of the induction phone call, have the RTO General Standards and Procedures Trainer Handbook available for reference, with hard copies of the RTO Induction Checklist, the RTO Trainer Agreement, the Acknowledgment Declaration and the VET Quality Framework Agreement from the Appendix, ready to complete and sign during the call. At the end of the phone induction, send those four (4) signed documents to rto@padi.com.au. The VET Quality Framework Agreement (found in the Appendix) outlines the responsibilities of each party in ensuring the training and assessment delivered by the RTO Trainer in the name of PADI Asia Pacific is of the desired quality and rigor, protects the interests of the students and is compliant to the requirements of the Federal Legislation SNR 2012. STEP FOUR Authorisation to teach PADI s RTO reviews your file for completeness, adds evidence of the RTO Induction to the RTO database and returns PADI s written authorisation to teach the specific units/courses you applied for. We then also confirm that you (and the store where you teach PADI Vocational Training courses if any) can now purchase student registration credits. If you are teaching under the supervision of a Cert IV holder, only the store can order student credits. REGISTRATION UPGRADE Repeat Step One, selecting new unit(s) you also want to teach and are now qualified for; attach only new evidence not yet on file. PADI s RTO will review your application to upgrade; update the RTO database; communicate anything missing. Once found complete, PADI s RTO will send written authorisation that you can now also teach the additional unit(s) you applied for. TRAINER REQUIREMENTS Trainer prerequisites and requirements depend on which unit(s) of competency you wish to teach. Please refer to details provided on the RTO Trainer Registration Form and the Course Overview section in Appendix. Inform PADI s RTO of any changes in your contact details, renewed clearance to work with children, continue to develop your Vocational Education and Training (VET) knowledge and skills as well as your industry currency and Trainer/Assessor competence; PADI RTO Trainers teaching first aid units of competency must also send copies of their currency in CPR (annually), workplace first aid (every three years), LVR and O2 (annually) - as appropriate; templates are available in the Appendix. Furthermore, it is your responsibility to ensure you also adhere to any local workplace regulations that apply in the State or Territory where you teach; e.g. to teach the diving units, Australian Standards indicate you need to hold a medically fit to dive certificate current within 12 months and in accordance with the AS/NSZ2299.1 criteria. PADI RTO TRAINER AUDITS As PADI s RTO needs to comply with all ASQA requirements we will need to audit our RTO Trainers to ensure compliance with all Training and Assessment Strategies (TAS), the requirements of the relevant Training Package, the VET Quality Framework and the standards listed in this RTO Trainer Handbook and all other applicable PADI and EFR Standards. PADI s RTO will conduct random audits at any time to ensure PADI RTO Trainers are compliant with all requirements and standards. Failure to comply with these requirements or standards will result in the non-compliant RTO Trainer being placed in non-teaching status until such time that all requirements and standards have been met. The following standards and requirements may be audited at any time but are not limited to: Required material and equipment Classroom facilities All administrative requirements including documents which do not need to be submitted for statement of attainment processing (e.g. LLN assessments, other knowledge assessment answer sheets, etc.) Sample of all current marketing materials (including website links) with fee structure and course prices The audits may be conducted through site visits by PADI Regional Managers or by requesting to provide evidence in writing with a 48 hour notice. Each PADI RTO Trainer will be audited at least once per calendar year to ensure compliance as outlined above. The following audit schedule has been implemented and will commence on January 1, 2014, however, RTO Trainers may also be audited at any time outside the below schedule. RTO Trainers Location NSW QLD WA SA, TAS, NT, ACT Audit time frame March, April June, July, August September October, November STUDENT REQUIREMENTS All standards listed in the relevant PADI, TecRec or EFR Instructor Guide(s) apply; only the additional student requirements are listed in the individual RTO Trainer Guides, e.g. students must document holding specific statement(s) of attainment before you can issue them with one for continuing education diving units. TRAINING AND ASSESSMENT When conducting training that results in a statement of attainment, you must abide by the RTO Trainer Agreement and Responsibility Statement, the VET Quality Framework Agreement as well as the listed requirements of all general and course-specific training standards and procedures contained in the current PADI Instructor Manual, PADI Specialty Course, TecRec or EFR Instructor Guide, the latest version RTO Trainer Guides, any published updates such as Training Bulletins, The Responder, RTO News and other electronic newsletters these are required reading to remain up-to-date. For already certified PADI Divers, you must screen and evaluate students to ensure their knowledge and skills are current ( Assessing for Open Water Dive Readiness ); you must remediate as necessary and also verify they meet any other student prerequisites or requirements outlined in the relevant RTO Trainer Guide. Once confirmed, you may teach and assess only the additional knowledge and skills listed in the relevant RTO Trainer Guide. NATIONALLY AGREED NOMINAL HOURS The National Centre for Vocational Education Research (NCVER) provides nationally agreed nominal hours data for the use of State and Territory training authorities. The data have been agreed to by all States and Territories for use in national reporting of VET data only. You can download the nominal hours for any course here. PADI s educational philosophy follows a performance-based rather than a time-based approach. The student undertaking the unit of competency must meet all knowledge and skills requirements as outlined in the corresponding PADI RTO Trainer Guide. Only then a statement of attainment can be issued. Other factors which may influence the anticipated hours of learning or training deemed necessary in order to adequately present the educational material include class size, equipment-to-student ratios and the availability of independent study. PADI VOCATIONAL TRAINING REQUIRED MATERIALS RTO Trainers must have and use the latest version of the RTO General Standards and Procedures Trainer Handbook and all individual RTO Guides for the units the Trainer is authorised to teach to ensure they have and use all training standards and procedures as well as the current assessment tools required to issue statements of attainment through PADI s RTO. During the RTO induction process, i.e. before starting to teach and issue statements of attainment for which you register, RTO Trainers receive the following resources: PADI RTO Induction Process, the RTO Induction Checklist and the RTO Student Handbook. All other documents are contained in this guide. Before starting a course, RTO Trainers must pre-purchase RTO Student Registration credits as PADI s RTO will only process statements of attainment for RTO Trainers with enough credits on record. ADMINISTRATIVE PROCEDURES From 1 st January 2015, new PADI RTO student management system has to be used for all student enrolments and for issuing of Statements of Attainmnment. The system will enable to issue Statements of Attainments only for trainers and stores that have sufficient credits available. Credits will need to be purchased through the system directly. From 1 January 2015 students enrolling in vocational education training in Australia will need to provide a valid Unique Student Identifier (USI) number in order to be able to participate in vocational training delivered on behalf of PADI RTO. No Statement of Attainment can be issued on behalf of PADI RTO unless a USI is provided by a student and verified in the student management system. It is responsibility of the student to create and provide the USI number and the responsibility of the PADI RTO trainer delivering the training to verify the USI provided by the student. Due to the PADI RTO business model specifications, PADI RTO is not going to create USI numbers for its students. Trainers can assist students to create their USI numbers, however will not obtain a permission to create USI numbers on behalf of PADI RTO. The creation of USI number is sole responsibility of the students enrolling into the training offered on behalf of PADI RTO. When enrolling a student into the new system, it is important to make sure that First Name, Surname, Date of Birth details are exactly same as registered under the USI platform. In case the details will differ, the system will return an error notice as a result of the USI verification process. PADI RTO General Standards and Procedures Trainer Handbook P a g e 11
In addition to the usual administrative procedures and required documents listed in the PADI, TecRec or EFR Instructor Guides, you must: 1. Enrol all students using PADI RTO student management system and ensure valid Unique Student Identifier number is collected from each student prior to attending the training. Make sure the student is enrolled using same First Name and Last Name details as used for USI creation. 2. In case access to the Internet is not available to a student, paper Enrolment form can be used instead, however it is responsibility of the trainer to make sure that the enrolment details are entered correctly into the system. Once a student is enrolled, further enrolment details can be entered by the student using their First Name and Last Name under the following link: bit.ly/padiapac. Same link can be used to fill in post course survey by the student. 3. Use the RTO Language, Literacy and Numeracy Assessment (LLN) Record (found in the Appendix) and for each student keep a copy in the student record folder. 4. Ensure all assessment tools listed in the individual RTO Trainer Guides and in the relevant Training and Assessment Strategies are used. 5. Before submitting student paperwork, you must ensure that the student is competent in all knowledge and skills required for the unit of competency, as listed on the relevant RTO Assessment Record Sheet. 6. Retain a copy of all RTO documents for all students for a minimum period of six (6) months after course completion. The required documents are listed in the relevant Training and Assessment Strategies. 7. Submit at least 10% of all students assessment tools as per relevant Training and Assessment Strategies (e.g. Knowledge Assessment Answer Sheets, Incident Reports etc.) and retain copies of all other student documents for a minimum period of six (6) months after course completion. These items may be requested (audited) by PADI s RTO at any time to ensure the RTO Trainers adherence to the VET Quality Framework Standards. 8. Make sure students fill in AQTF Learner Questionnaire (Post Course Survey) prior to issuing Statements of Attainments. This is an ASQA requirement used to facilitate the quality assurance process. The AQTF Learner Questionnaire is available in the Appendix together with some practical tips to guide your students when completing these Questionnaires in class. It should be submitted online by the student under the link bit.ly/padiapac. In case online submission is not possible, the paper form can be filled in by a student and subsequently entered into the system by the trainer. Scanned copy of the paper form filled by a student has to be uploaded as a proof additionally to the data entry. 9. Submit RTO Student Assessment Record Sheet for each student under the document section of the training program. 10. For the diving units, you must also issue a PADI certification as per usual PADI standards (PIC Procedures apply). Exception: student already holds that PADI Diver certification. THE STANDARDS FOR NATIONAL VET REGULATOR (NVR) REGISTERED TRAINING ORGANISATIONS PADI s RTO and its RTO Trainers are involved in the process of delivering a nationally accredited qualification. This qualification can only be delivered to students by an organisation (an RTO) that has met the required standards of the Australian Skills Quality Authority (ASQA) - Australia s national regulator for vocational education and training. The standards are called the Standards for NVR Registered Training Organisations and replace the former AQTF standards, and are used by ASQA as a key instrument in protecting the interests of all students undertaking vocational education and training in Australia. These are the standards guiding nationally consistent, high-quality training and assessment services in the vocational education and training system. The Standards for NVR Registered Training Organisations are referred to by the abbreviation SNR e.g. SNR 3.3. RTOs must comply with all standards 4 to 25 (standards SNR 4 SNR 14 in Initial Registration together with SNR 15-25 for Continuing Registration). The Standards (SNR) are a component of the VET Quality Framework (VQF) and one of the conditions of registration for RTO s under the National VET Regulator Act 2011. VET Quality Framework means the following: a) the Standards for NVR Registered Training Organisations; b) the Australian Qualifications Framework; c) the Fit and Proper Person Requirements; d) the Financial Viability Risk Assessment Requirements; e) the Data Provision Requirements CLIENT COMPLAINTS AND APPEALS PADI s RTO will act upon any substantiated complaint or appeal. These will be recorded into our RTO management system and will lead where appropriate to Continuous Improvement activities. The data entry responsibility lies with PADI s RTO. A student can complaint about any aspect of our dealings with them, and the student can appeal any decision we make, including assessment decisions. If the complaint is about the CEO in their role as a trainer, the Administration staff is able to take on the responsibility of the CEO in resolving the issue. In the first instance that a student is unhappy or dissatisfied with an aspect of our service delivery, they should consult their RTO Trainer in an attempt to quickly resolve the issue. If the issue is with the RTO Trainer, and the student feels that they would prefer not to approach their Trainer, then PADI s RTO is available to discuss the issue. Should the complaint or appeal not be resolved in the first instance, then the student is requested to formally lodge a complaint or appeal by completing either the Complaints or Appeals Form, these are available from the RTO Student Handbook, the Appendix of this RTO Trainer Handbook, or from PADI's RTO. This formal complaint or appeal will be entered into our Complaints or Appeals register for tracking purposes. This is the responsibility of PADI s RTO. Should the nature of the complaint refer to criminal matters or where the welfare of students is in danger, PADI s RTO will, with the permission of the student, seek assistance from other authorities such as the police, legal representative or other parties as appropriate. Students confidentiality will be maintained at all times as is consistent with NSW Law. Engagement of the external assistance will be the responsibility of the CEO. Upon PADI s RTO receipt of a formal complaint or appeal, the CEO will be responsible for resolving the issue. All complaints are reviewed at our weekly Training and Quality Management meeting and, if appropriate, result in a Continuous Improvement process. This will involve at least a formal interview with the student, the RTO Trainer (if appropriate) and PADI s RTO. The complainant or appellant will be provided with a formal written statement of the resolution of the complaint or appeal; this will state the reasons for the decision. If the above processes are not effective in resolving the issue, then a suitable independent person or panel will be engaged to aid in the resolution of the issue. The independent person or panel will need to be agreed upon by both the student and PADI s RTO, this could include another external Trainer/Assessor, or it could include independent commercial mediators such as Leadr and InterMEDIATE. Leadr can be contacted via www.leadr.com.au, Intermediate can be contact via www.intermediate.com.au. Costs for the independent person or panel will be borne by PADI s RTO. The CEO will negotiate the identification and engagement of the mutually agreed person or panel. ASQA provides information on its complaints handling process at http://www.asqa.gov.au/complaints/making-a-complaint.html Please note, that the ASQA website advises that some complaints about refunds may be directed to the NSW Office of Fair Trading Ph. 133 220 or if in the ACT the Department of Justice and Community Safety on 02 6207 3000.If students are not satisfied with the quality of service or training being provided by an RTO, there are ways to make a complaint. Copies of the Complaints and Appeals Forms are provided in this RTO Trainer Handbook and are also available from PADI s Training Department. Ongoing compliance to the NVR Standards is an operational Risk that needs to be managed within PADI s RTO. As part of our plan to continuously review and improve our operation and our compliance with the NVR standards, PADI RTO General Standards and Procedures Trainer Handbook P a g e 15
during the weekly Training and Quality Management meeting PADI s RTO will review four to six clauses of the NVR standards. The purpose of the review is to: Understand the requirements of the NVR standard See how we comply with that standard See if the process we use for compliance can be improved while still remaining compliant to that standard. We plan to review approximately 4-6 clauses each month at the weekly Training and Quality Management meetings and thus will review all NVR standards every six months. The weekly Training and Quality Management meetings are intended to supply all staff a forum to discuss, learn and improve our policies and procedures, their understanding of the NVR Standards and the quality of the training outcomes to our students. STAKEHOLDER FEEDBACK PADI's RTO and its RTO Trainers are required by good business practice and the NVR Standards to continually review our performance and use these reviews as opportunities to improve our business practice. By NVR standards, particular attention is to be paid to our delivery of training and assessment as well as client services. We have recognised that valuable feedback can come from a variety of sources; this includes as a minimum, our RTO Trainers, our students, and ourselves. We also recognise that valuable feedback can come from other sources, such as ASQA in their conduct of compliance audits and from other regulatory bodies. We will utilise a variety of feedback forms to ensure that we comply with our own obligations and with the requirements of the National Quality Indicators. RTO Trainers and Students will be formally issued feedback forms at completion of a course utilising the Completion feedback forms. The completed feedback forms are collected by the RTO Trainer and sent to PADI s RTO for analysis and action. The CEO will review the forms, identifying all: Areas of success and improvement Positive points or trends Negative issues Negative trends Significant issues Significant issues may require immediate investigation and action by the CEO, other items may require discussion at the weekly Training and Quality Management meetings. In some cases, where the RTO Student was unhappy with aspects of their training and assessment, such as trainer performance, communication, training programmes, assessment materials, or processes, it may be appropriate to discuss these issues confidentially with the relevant staff member. All identified issues, either identified by the CEO or in the weekly Training and Quality Management meetings, will have an entry recorded in the Continuous Improvement (CI) register. The CI register will contain the details of the issue, for example: the date of entry the person identified to resolve the issue a solution implementation date a review date to confirm that the solution is effective a final completion date that identifies that the problem has been addressed, rectified, and rectified without further issues. Any changes to policies procedures, etc. will be reviewed and discussed at the weekly Training and Quality Management meetings to ensure a clear understanding of all requirements. MANDATORY REPORTING OF FEEDBACK RESULTS AND COMPLETION RATES It is a requirement of the NVR standards that PADI s RTO complies with all mandatory reporting obligations. All RTOs are required to report annually on the following four metrics: Learner (student) Satisfaction survey results (utilising the mandatory survey questions) Employer Satisfaction survey results (utilising the mandatory survey questions), if we have employers. Enrolment rates Completion rates PADI s RTO has elected to utilise the Competency Completion Online System managed by the National Centre for Vocational Education Research (NCVER) to enter and record the Enrolment and Completion rates and complete an internal analysis of the completion feedback information. The internal analysis of the feedback will involve a 100% review of completed feedback by PADI s RTO CEO. The feedback results will be recorded and collated for completion of the Annual report as required by ASQA. The annual report form is available from the ASQA website on the forms page and is called Quality Indicator annual summary report. The completion data collated from PADI s RTO and transcribed into the Competency Completion Online System (CCOS), see http://rto.ncver.edu.au/. A completion report is generated by the CCOS. Both the Quality Indicator annual summary report and the Competency Completion Online system report are then emailed to ASQA at qidata@asqa.gov.au. These reports will be prepared for each calendar year and provided to ASQA prior to June 30 the following year. The data is to be emailed to ASQA at qidata@asqa.gov.au. The data entry, procurement of the resultant reports and submission to ASQA are the responsibility of the Administration Officer. The CEO is responsible for ensuring the Administration Officer completes these requirements before June 30 each year. Completed surveys are reviewed by the CEO and reported on at the weekly Training and Quality Management meetings. Completed surveys are not required to be retained once they have been summarised in the Survey Register. CONTINUOUS IMPROVEMENT POLICY PADI s RTO recognises the need for ongoing Continuous Improvement, that opportunities for Continuous Improvement will occur in every facet of our business and that they can occur through any means, including stakeholder feedback, complaints and appeals, validation sessions and suggestions for improvements. We recognise the value of these opportunities and have developed a Continuous Improvement record and register. The record and register allow us to record all improvement activities and review these at our weekly Training and Quality Management meetings. Minor changes generally fall into the category of spelling mistakes, typos or other items that can be added to a list and fixed up at next re-print. The manuals are reprinted as guidelines change, thus a spelling mistake will not be maintained. A significant change will precipitate an immediate document change, a new version number and contact to all affected parties with a new document being issued. PADI s RTO will use the Continuous Improvement process as the corrective action tool for any changes required within our documentation process to meet ASQA Standards for NVR RTO. Some of the changes required will occur as a result of a structured review of our tools and processes, such as our moderation meetings, client complaints or appeals, our risk assessment review meetings held at our weekly Training and Quality Management meetings, self-assessment or even external audit, or as a result of feedback from our stake holders. Some of our Continuous Improvement activities will be as a result of ad hoc or inspirational ideas. Progress with Continuous Improvement activities is monitored at weekly Training and Quality Management meetings. Continuous Improvement are discussed and implementation and the results confirmed. The Continuous Improvement system is aware that there can be unexpected results of implementing change and thus Continuous Improvement activities are monitored to check for any knock on effects. These knock on effects will prompt us to re-evaluate the improvement to determine an alternate solution or implement further Continuous Improvement activities. A Continuous Improvement Form is included in your Trainer Resource Pack and held by the Director of Training and Quality Management and/or by the PADI Educational Consultants. The Continuous Improvement register is maintained by the CEO. Continuous Improvement Forms can be raised by any staff member, or RTO Trainer. In the event that a student has raised a Continuous Improvement item, the staff member receiving the item shall complete the form and act as the student s proxy at all relevant meetings. OCCUPATIONAL HEALTH AND SAFETY POLICY The Work Health and Safety Act 2011 and Work Health and Safety Regulations 2011 describes the duty of care of PADI's RTO to provide a safe and healthy working environment for all employees, and the employee s duty of care to take reasonable care for the health and safety of others within the workplace. This includes the provision of: a workplace that is safe to work in, with working procedures that are safe to use, adequate staff training including topics such as safe work procedures, properly maintained facilities and equipment, a clean and suitably designed work place with the safe storage of goods such as chemicals. The following procedures and standards must be observed to achieve a safe working and learning environment: Maintain a safe, clean and efficient working environment, Implement procedures and practices, in a variety of situations, in accordance with State and Local Government Health regulations, Store and dispose of waste according to health regulations, Clean walls, floor and working surfaces to meet health and safety standards without causing damage, Check all equipment for maintenance requirements, Refer equipment for repair as required, Store equipment safely, Identify fire hazards and take precautions to prevent fire, Safe lifting and carrying techniques maintained, Ensure students safety at all times, Ensure procedures for operator safety are followed at all times, All unsafe situations recognised and reported, Display first aid and safety procedures for all staff and students to see, Report any identified Occupational Health and Safety hazard to the appropriate staff member as required. HARASSMENT AND DISCRIMINATION POLICY PADI's RTO and its RTO Trainers are required under Australian law to ensure that we provide a workplace that is free from all forms of harassment and discrimination (including victimisation and bullying) so that all staff and students feel valued, respected and are treated fairly. We will ensure that all of our staff understand their roles and responsibilities in creating such a workplace, by a process of training, communication, mentoring and by example. We will ensure all of our staff are aware of the processes and procedures for addressing any form of harassment or discrimination. Staff and students should be aware of the following definitions: 'Bullying' - is unwelcome and offensive behaviour that intimidates, humiliates and/or undermines a person or group. Bullying involves a persistent pattern of behaviour over a period time and may include verbal abuse, physical assault, unjustified criticism, sarcasm, insult, spreading false or malicious rumours about someone, isolating or ignoring a person, putting people under unnecessary pressure with overwork or impossible deadlines, and sabotaging someone's work or their ability to do their job by not providing them with vital information and resources. 'Confidentiality' - refers to information kept in trust and is a set of rules or a promise that limits access or places restrictions on certain types of information. 'Discrimination' - is treating someone unfairly or unequally simply because they belong to a group or category of people. Equal opportunity laws prohibit discrimination on the grounds of sex, marital status, pregnancy, family responsibility, family status, race, religious beliefs, political conviction, gender history, impairment, age or sexual orientation. Victimisation is also treated as another ground of discrimination. 'Harassment' - is any unwelcome and uninvited comment or action that results in a person being intimidated, offended, humiliated or embarrassed. Equal opportunity laws prohibit harassment on the grounds of sex and race. 'Personnel' - refers to all employees/staff/contractors of PADI s RTO. 'Racial Harassment' - occurs when a person is threatened, abused, insulted or taunted in relation to their race, descent or nationality, colour, language or ethnic origin, or a racial characteristic. It may include derogatory remarks, innuendo and slur, intolerance, mimicry or mockery, displays of material prejudicial to a particular race, racial jokes, allocating least favourable jobs or singling out for unfair treatment. This means that you will not harass, bully or treat anyone poorly, no matter what their personal circumstances, orientation or life choices are. 'Sexual Harassment' - is any verbal or physical sexual conduct that is unwelcome and uninvited. It may include kissing, embracing, patting, pinching, touching, leering or gestures, questions about a person's private or sexual life, requests for sexual favours, smutty jokes, phone calls, emails, facsimiles or messages, offensive noises or displays of sexually graphic or suggestive material. You will not make unsolicited or unwelcome advances to any students, staff members or members of the general public when on our premises, working with our staff and students or in any manner related to the PADI s RTO. 'Victimisation' - includes any unfavourable treatment of a person as a result of their involvement in an equal opportunity complaint. Unfavourable treatment could include: adverse changes to the work environment; denial of access to resources or work. You will not single out a student or a staff member for undue attention, be it in jest or as a deliberate act. People are to be treated as valuable members of our community and not to be belittled or made to feel as a victim. Specific principles All staff and students have a right to work in an environment free of any form of harassment and discrimination, All reports of harassment and discrimination will be treated seriously, impartially and sensitively. Harassment and discrimination, including victimisation and bullying, is unwelcome, uninvited and unacceptable behaviour that will not be tolerated. When management is informed of any harassment or discrimination, it has the responsibility to take immediate and appropriate action to address it. In dealing with all complaints, the rights of all individuals should be respected and confidentiality maintained. Whenever possible, all complaints should be resolved by a process of discussion, cooperation and conciliation. The aim is to achieve an acceptable outcome while minimising any potential damage to our organisation Both the person making the complaint, and the person against whom the complaint has been made, will receive information, support and assistance in resolving the issue. Victimisation is unacceptable and will not be tolerated. No person making a complaint, or assisting in the investigation of a complaint, should be victimised. Harassment or discrimination should not be confused with legitimate comment and advice (including feedback) given appropriately by management or trainers. Staff and students should not make any malicious complaints. All staff and students are expected to participate in the complaint resolution process in good faith. You are to apply these principles to your conduct when dealing with our staff, students and members of the general public. PRIVACY PADI s RTO takes the privacy of our students very seriously and we will comply with all legislative requirements. These include the Privacy Act and National Privacy Principles (2001). In some cases as required by law and as required by the NVR Standards we will need to make RTO Student s information available to others. In all other cases we ensure that we will seek the written permission of the student. The ten Privacy Principles are defined below: 1. Collection - We will collect only the information necessary for one or more of our functions. The individual will be told the purposes for which the information is collected. 2. Use and disclosure - Personal information will not be used or disclosed for a secondary purpose unless the individual has consented or a prescribed exception applies. 3. Data quality We will take all reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and up to date. 4. Data Security We will take all reasonable steps to protect the personal information we hold from misuse and loss and from unauthorised access, modification or disclosure. 5. Openness We will document how we manage personal information and when asked by an individual, will explain the information we hold, for what purpose and how we collect, hold, use and disclose the information. 6. Access and correction - The individual will be given access to the information held except to the extent that prescribed exceptions apply. We will correct and update information errors described by the individual. 7. Unique Identifiers - Commonwealth Government identifiers (Medicare number or tax file number) will only be used for the purposes for which they were issued. We will not assign unique identifiers except where it is necessary to carry out our functions efficiently. 8. Anonymity - Wherever possible, we will provide the opportunity for the individual to interact with external agencies without identifying themselves. 9. Trans-border Data Flows - The individual s privacy protections apply to the transfer of personal information out of Australia. PADI RTO General Standards and Procedures Trainer Handbook P a g e 23
10. Sensitive Information We will seek the consent of the individual when collecting sensitive information about the individual such as health information, or information about the individual s racial or ethnic background, or criminal record. Reviewing the above, you will realise that yours, staff members and students privacy is protected by law. You will not seek to obtain private information about fellow students, or staff. Equally so you will not reveal private information about staff and students. NATIONAL VOCATIONAL EDUCATION AND TRAINING ACTS 2011 These three acts are named in the legislative listing and define the acts of Federal Parliament that empower ASQA to administer the operations and compliance of RTO s in most states of Australia, and any RTO s that operate in more than one state in Australia. This includes the right of ASQA to audit PADI s RTO, apply penalties for non-compliance, and define the requirements to retain records and other administration and operational requirements of a functioning RTO. Thus, PADI s RTO is answerable to ASQA for our conduct as an RTO. Being an RTO is a privilege not a right and as such we need to comply with all the requirements of the standards of ASQA all the time. Working with Children Where we deliver a training programme for participants under 18 years of age, we will comply with all Federal and State working with Children legislation such as the new NSW Child Protection (Working with Children) Act 2012 No 51. A list of all relevant legislation is available from the Federal Police Website: http://www.aifs.gov.au/cfca/pubs/factsheets/a141887/ Further information on the Working with Children s Check is available from PADI s RTO, effectively this means that everyone who comes in contact with people under the age of 18, such as RTO Trainers, administration staff or clerical staff must be cleared as not being a risk to the health and safety of minors. This is done through a submission to the appropriate government agency https://check.kids.nsw.gov.au, and until the response is received, we cannot allow the person being reviewed to conduct or interact with minors unsupervised. Copyright Laws All PADI RTO Trainers must comply with copyright laws. Infringement of copyright is not permissible. All PADI RTO Trainers should note the following conditions: You may copy one or more articles in each issue of a newspaper or magazine relating to the same subject matter, You may copy up to 10% of the number of pages in a collection of works, as long as the works being copied have not been separately published, or, whether the work is separately published or not, it is not more than 15 pages long, PADI RTO General Standards and Procedures Trainer Handbook P a g e 24
You may copy the whole of any work if you check with the supplier that the work will not be available for purchase within 14 days (or six months for textbooks) at the price you would normally pay, You must also acknowledge the copyright holder by stating the title of the work, its author/artist, and the name of the publisher, You must register details of the copies being made, Students may copy up to 10% of a chapter of work. This means that you cannot copy someone else s work and call it your own, thus cutting and pasting from the internet, copying company information and calling it your own is not permitted. All PADI, PADI RTO, EFR and TecRec materials are copyright protected unless specified otherwise. FEES AND REFUND POLICY PADI s RTO does not charge for its training programmes. However, we do charge an administration fee for the processing of certificates, which is charged to the RTO Trainer (or the store where they teach). Any applicable fees for courses aligned to our training programmes are negotiated between the student and the RTO Trainer or the store, training facility or dive centre where they teach. PADI s RTO will issue a statement of attainment (SOA) when we have received notification of the completed training programme in line with the set administrative procedures. A course fee is charged by our registered RTO Trainers when booking and training/assessment dates are set. Guidelines for PADI RTO Trainers state: Course cancellation of 21 days or less forfeits the course fees. Course cancellation of greater than 21 days allows for 100 % of the fees paid to be refunded. Shifting to alternative course start dates with greater than 21 days notice is done without charge. Shifting to alternative course start dates with 21 days or less notice can attract a $100.00 administration fee. Requests for variation of the refund policy should be made in writing to PADI s RTO. The RTO Trainer guarantees to conduct the assessment for the student when full payment of the course fees has been made. Should circumstances occur where the RTO Trainer is unable to provide the service that the student has contracted to s/he will be refunded all monies paid in full. You should inform all students that lost statements of attainment can be replaced; the fee for this is $10 and will require the student to confirm their name and produce photo ID when requesting the replacement certificate through their RTO Trainer. PADI s RTO Trainer may accept payment of no more than $1000 from each individual student prior to the commencement of the course. Following course commencement, the PADI RTO Trainer may require payment of additional fees in advance from the student but only such that at any given time the total amount required to be paid which is attributable to tuition or other services yet to be delivered to the student does not exceed $1,500. DOCUMENTATION POLICY PADI's RTO is committed to maintaining and safeguarding the accuracy, integrity, confidentiality and currency of our company records. Records management responsibility resides with PADI s RTO. PADI RTO Trainers are responsible for the data entry into our student management system, for the secure storage of student records, and storage of other records as indicated below under Student Record/Data Entry Policy. SALE OF OR MATERIAL CHANGE TO PADI S RTO It is a condition of our registration that PADI s RTO must notify ASQA of any material change that has occurred to the management of our operations or an event that would impact on our ability to comply with the VET Quality Framework. Examples of such events are: Change in our CEO Change in our Financial Status Change in the Legal Name or our Legal Status Change in our ownership, directorship and control. This may be incurred as a result of the sale of the RTO. In all situations listed above or similar PADI s RTO is required to notify ASQA of these changes using the "material change or event form" which is available from the "Forms" section of the ASQA website. It should be noted that an RTO cannot be sold or assigned, it is linked to the ABN number of the company and thus a sale of a RTO is only possible where the company is sold. ASQA should be informed of any material change or event as soon as practical (within 20 days of the event occurring). CHANGE OF DETAILS FOR PADI S RTO ASQA must be notified of any "administrative change" to PADI s RTO, should a change occur such as: registered training name/s address and/or contact details of the RTO's head office principal place of business (if different from the head office) contact details of chief executive officer or equivalent person contact details of 'day-to-day' contact person contact details of high-managerial agents location and/or contact details of permanent delivery sites (for delivery to domestic students only) commencement or cessation of offshore delivery commencement of delivery in other states or territories. We will notify ASQA using the "Notification of change of provider details" form which is located on the ASQA website. STUDENT RECORD/DATA ENTRY POLICY PADI s RTO is committed to maintaining and safeguarding the accuracy, integrity and currency of training records without jeopardising their confidentiality of the Trainer/Student s privacy. Individual student records will be stored in a locked secure office area. Our electronic records are protected by password access. We further protect our records PADI RTO General Standards and Procedures Trainer Handbook P a g e 26
by maintaining up-to-date virus, firewall and spyware protection software. We conduct an overnight tape backup of our computer systems; this is the responsibility of our Vice President of Finance and Operations. All student related information such as enrolment forms, assessment material or RPL evidence packs and other related RTO documentation is to be forwarded PADI s RTO. Upon receipt of any information, the administrative staff will review the material for accuracy, completeness and relevance to its intended purpose. Inaccurate, illegible, incomplete or other information that is not in a finished acceptable form will be returned to the responsible individual for rectification and resubmission. Records retained typically will include: Continuous Improvement records Training and Assessment strategies (TAS) Individual Trainer records, including CVs and copies of qualifications Assessment validation documentation and records Complaints and appeals records Any auspicing contracts and associated records Records of qualifications issued Client feedback Minutes of staff meetings Assessment results for appeal or validation Student enrolment records Student participation records. Our software and hardcopy systems will retain student results for a period of no less than 30 years. In the event that we cease to operate as an RTO we will transfer all records to ASQA in the appropriate format and detail as specified by ASQA at the time of ceasing RTO operations. All other records, including training records, taxation records, business and commercial records will be retained for a period of at least seven years. Should we be required to submit statistical data on our students in the future (AVETMISS) we will utilise the features built into our software. PADI s RTO will ensure that any confidential information acquired by us, individuals or committees or organisations acting upon our behalf is safeguarded. Access to individual student training records will be limited to those required by the NVR Standards such as: Trainers and assessors to access and update the records of the students whom they are working with, Management staff as required to ensure the smooth and efficient operation of the business, Officers from ASQA or their representatives for activities required under the NVR Standards Or those required by law such as: people as are permitted by law to access these records (e.g. subpoena / search warrants / social service benefits / evidence act). Or students authorising releases of specific information to third parties in writing, the student s themselves, after making application in writing. Access to student records is to be made directly to the Administration person in the required form available from the Administration person. The Administration person needs to verify the identity of the person collecting the students records. By confirming signature held on file for the student. By the students Driver license. VERSION CONTROL POLICY PADI s RTO ensures that all staff have access to the current versions of all our documentation. Updates to our documentation will be communicated to relevant staff and all RTO Trainers through our RTO News or via email. Changes to our documentation are the responsibility of PADI s RTO. Should you require any changes to our material, contact the rto@padi.com.au to start the changes. Change is generally done through the Continuous Improvement process. Our documentation should be current, this is defined as: Meeting the current standards of the industry, as industry evolves and develops so should the assessment tools Reflecting all known changes that have been identified from Management meetings, feedback, and validation or any other means. Reflecting the known customisation or contextualisation as required to best suit the student and the client PADI s RTO will ensure that the materials are current. All NVR Standards-related documentation will have a unique document identifier such as an issue date, a revision number, or a unique document name. Additional information may be included that allows for further management of the document. Electronic versions of all current NVR Standards documentation are maintained on our computer system in a current folder, including Learning and Assessment materials. All superseded material is maintained in a suitably named folder on our computer system Archived Documentation Folder. RECOGNITION OF OTHER QUALIFICATIONS All AQF qualifications and statements of attainment issued by other registered training organisations will be fully recognised by PADI s RTO. Students would be required to produce a copy of the original certificate to PADI s RTO or in some cases the RTO Trainer, who will make note of the qualification in the student records. ACCESS AND EQUITY PADI s RTO is committed to ensuring that we offer training opportunities to all people on an equal and fair basis. Including women where under-represented, people with disabilities, people from non-english speaking backgrounds, Indigenous Australians, and rural and remote learners. All students have equal access to our training programmes irrespective of their gender, culture, linguistic background, race, socio-economic background; disability, age, marital status, pregnancy, sexual orientation or carer s responsibilities. All students who meet our entry requirements will be accepted into any of our training programmes. Any issues or questions regarding access and equity can be directed to PADI s RTO. Students who feel that they have been discriminated against can lodge a formal complaint. This process can be initiated through any staff member, or can be referred to the CEO. CULTURAL AWARENESS RTO Trainers may encounter course students from diverse cultural backgrounds representing various customs, practices or beliefs. Briefly discuss specific cultures and other possible sensitive areas the group is likely to come across, e.g. Aboriginal and Torres Strait Islanders, or male student or trainer needing to assist a female student in class you may also wish to refer to the Harassment and Discrimination Policy in this handbook. Cultural awareness is the ability to understand and respond to this variety of unique cultural needs. It recognises that we are all shaped by our cultural background, which influences how we interpret the world around us, perceive ourselves and relate to other people. Cultural awareness involves an individual s ability to treat every person with dignity, respect and fairness, in a way that is sensitively responsive to differences and similarities, and thereby contributes to creating a genuinely inclusive culture. Explain to course students that they should: Approach patients and other course students in a calm, culturally aware, sensitive and respectful manner Learn more about a specific culture in your work environment so you have a better understanding how to act appropriately Encourage patients and their representatives to communicate cultural issues that may impact their care Respond to the needs of all patients regardless of their respective cultural backgrounds (race/ethnicity, faith/religion, gender, disability, sexual orientation, age) during training and in a real life event Develop cultural awareness by reflecting on and examining your own values, beliefs and cultural identity Raise awareness of similarities and differences, social disadvantage and provider inequalities Develop cultural understanding through fostering relationships with different cultural groups Recognise and continuously develop the skills, roles and functions needed to perform cultural assessments; to plan, implement and evaluate culturally sensitive emergency response and challenge discrimination and prejudice Arrange cultural encounters and opportunities to observe culturally sensitive response Develop an environment that recognises that managing diversity is a routine aspect of emergency response, not an exceptional event TRAINER INDUCTION AND DEVELOPMENT INDUCTION The newly contracted RTO Trainer completes our induction programme that includes: 1. Introduction to our staff and facilities. 2. Introduction to the job role and if appropriate: a. Information on the training programme and packages offered by PADI s RTO. b. Review of Competency Based Training (CBT); further details of CBT are covered in the relevant section of this handbook. 3. A review of our ASQA SNR documentation. 4. Signing of the Trainer Agreement and VET Quality Framework Agreement. 5. Completion of the RTO Induction Checklist. All new RTO Trainers will be provided with this RTO GSP Trainer Handbook and work through an induction programme designed to refresh any past knowledge and to confirm the performance requirements of PADI s RTO. All RTO Trainers will be briefed as part of their induction programme where relevant to their job role on each of the following Training Packages: SIS10 Sport, Fitness and Recreation Training Package HLT Health Training Package AHC10 Agriculture, Horticulture and Conservation and Land Management TLI10 Transport and Logistics Training Package UET12 Transmission, Distribution and Rail Sector Training Package The induction process will require RTO Trainers to be guided through the assessment materials and other related documentation. RTO Trainers will be required to confirm this by signing the RTO Induction Checklist, which will be included in their professional records. DEVELOPMENT RTO Trainers are continuously supported in performing their job role. Where opportunities arise for appropriate external or internal training, PADI s RTO will provide appropriate support and guidance to RTO Trainers. RTO Trainers are required to maintain an updated curriculum vitae (CV) with PADI s RTO. As your personal circumstances change or as you acquire more skills we need to record this in our records. RTO Trainers are required to undertake formal continuous professional development on at least one significant occasion each year in at least two subject areas. The first subject area is in their Certificate IV in Training and Assessment skills. These skills relate to a number of areas, including: Assessment Skills, i.e. skills associated with the conduct of an assessment, Conflict negotiation, Assessment design, Assessment validation. A number of vendors offer formal training in training and assessment skill sets. We would recommend the following courses as being well suited to our RTO Trainers: Assessment Validation and Continuous Improvement Customising to Meet Client Needs (formally Mapping, Clustering & Contextualising) We require before November each calendar year that evidence of a course such as the ones listed above be completed. We require evidence of the course completion, and a half page synopsis of the course and its outcome. Our Assessment validation is scheduled for December each year, and thus refresher training, such as Assessment Validation and Continuous Improvement, for those not confident in their retained knowledge may be appropriate. The second subject area is in the RTO Trainers own area of vocational expertise, such as diving, first aid, etc. PADI s RTO will also maintain records of RTO Trainers workplace first aid, CPR, LVR and oxygen administration qualifications and expiry/retraining dates. PADI s RTO will provide reminders and support to RTO Trainers when these qualifications become due for renewal/refresher. However, it remains the RTO Trainers responsibility to keep these records current. If these qualifications have expired, the RTO Trainer will be placed in non-teaching status until such time that current documentation has been submitted. PROFESSIONAL RECORDS It is important that PADI s RTO has the most up-to-date personal details of all RTO Trainers. If any of the following were to alter, please notify PADI s RTO immediately: Name Postal Address Email Address Phone number First Aid, CPR, LVR, Oxygen refreshers Educational/Professional qualifications COMPETENCY BASED TRAINING AND ASSESSMENT Competency Based Training (CBT) focuses on confirming the skills acquired by the students during the training programme. We recognise that not all students are best able to demonstrate skill competency in traditional ways. Thus we will reasonably adapt our training and assessment methods or techniques to meet the needs of a diverse range of students within the restrictions of the training package. The common example of reasonable adaptation is the delivery of the learning material and the conducting of the assessment in a verbal form rather than a written form. We cannot allow the inability to read a document or complete a written assessment as a barrier to determining competency. Any further questions can be referred to PADI s RTO. Competency Based Training and Assessment: Competency Based Training focuses on confirming the skills acquired by the students during the training program. In order for a student to be competent in the required knowledge and skills, the student must: KNOWLEDGE: demonstrate acceptable performance ( mastery learning ) and score at least 75 percent or higher on all relevant knowledge assessment tools any missed questions must be reviewed until complete understanding and therefore competency is confirmed by Trainer and student (sign statements). SKILLS: demonstrate each skill so that the student meets the stated performance requirement in a reasonably comfortable, fluid, repeatable manner, as can be expected for the level of training. REASONABLE ADJUSTMENTS As an RTO Trainer you are required to consider reasonable adjustments in assessment and training for people with a disability. Types of disabilities The Disability Discrimination Act 1992 includes a very broad definition of disability, including illness or disease, past disability and present disability. VET students could have a range of disabilities, such as: learning disabilities sensory impairments (including vision, hearing or speech impairment) physical or mobility impairments psychological or psychiatric impairments (or mental illness) disabilities, such as cerebral palsy or head injury, which may result in multiple impairments medical conditions such as HIV or AIDS, cancer, or chronic fatigue syndrome (which may result in multiple disabilities) intellectual disabilities Making reasonable adjustments Under the Disability Standards for Education 2005, education providers (such as PADI RTO Trainers) must make reasonable adjustments for people with a disability to the maximum extent that those adjustments do not cause RTO Trainers unjustifiable hardship. While reasonable adjustment and unjustifiable hardship are different concepts and involve different considerations, they both seek to strike a balance between the interests of RTO Trainers and the interests of students with and without disability. It is important that RTO Trainers take meaningful, transparent and reasonable steps to consult and to consider and implement reasonable adjustments for students with a disability. What is a reasonable adjustment? An adjustment is any measure or action that a student requires because of their disability, and which has the effect of assisting the student to access and participate in education and training on the same basis as students without a disability. An adjustment is reasonable if it achieves this purpose while taking into account factors such as the nature of PADI RTO General Standards and Procedures Trainer Handbook P a g e 33
the student s disability, the views of the student, the potential effect of the adjustment on the student and others who might be affected, and the costs and benefits of making the adjustment. There may be more than one adjustment that is reasonable in a given set of circumstances; RTO Trainers are required to make adjustments that are reasonable and that do not cause them unjustifiable hardship. An RTO Trainer is also required to maintain the academic integrity of a course or programme and to consider the requirements or components that are inherent or essential to its nature when assessing whether an adjustment is reasonable. The inherent requirements in relation to the actual workplace performance requirements of the competency must also inform decision making. What is taken into account in considering unjustifiable hardship? Once it is determined that an adjustment is reasonable, an RTO Trainer is then required to consider whether that reasonable adjustment causes unjustifiable hardship. If it does, then the refusal of the RTO Trainer to make the reasonable adjustment will not be rendered unlawful under the standard. It is recommended that RTO Trainers conduct a thorough, documented and transparent process of consideration of unjustifiable hardship, if they intend to rely upon it. In considering unjustifiable hardship, an RTO Trainers may take into account all costs and benefits, both direct and indirect, that are likely to result for the provider, the student or their associates, and any other affected persons in the learning or wider community. In other words, determining whether a reasonable adjustment imposes unjustifiable hardship is a broad inquiry it is not simply confined to a dollar and cents calculation. Examples of adjustments The following examples of adjustments for particular circumstances are provided to encourage developers to reflect on whether the components they are developing or reviewing provide sufficient information about possible reasonable adjustments. The examples and suggestions are just that they will not necessarily be sufficient for all similar circumstances or for all Training Packages. Modifying workstations Modifying premises Modifying or providing equipment Adapting assessment strategies Adapting delivery strategies Example where an adjustment could compromise outcomes There will be occasions and circumstances when an adjustment would compromise the academic integrity of a course or programme, or would constitute a diminution of the academic requirements of the course or programme, and other PADI RTO General Standards and Procedures Trainer Handbook P a g e 34
requirements or components that are inherent in or essential to its nature. If this were the case, refusal to make this adjustment to the course or programme would not be unlawful under the Disability Discrimination Act 1992 and the Disability Standards for Education 2005. Costs for reasonable adjustment Research shows that most people with a disability require only minor reasonable adjustments to allow them to undertake training and employment on the same basis as people without disability. The importance of completing a thorough, considered and lateral-thinking process of consultation on reasonable adjustments cannot be overstated. Perceived and actual costs in making reasonable adjustments often are outweighed by the wider benefits they bring for training organisations, employers, learner peers, co-employees and others coming into the workplace; for example, by increasing the diversity of the client base and, for employers, savings in staff retention, productivity, morale and customer service. By way of illustration, installation of a ramp to allow access to a workplace or service facility for a person with mobility disability also benefits other customers requiring wheelchair access, people delivering goods with trolleys, customers with prams, and elderly customers. Further information Further information about the Disability Discrimination Act 1992 and the Disability Standards for Education 2005 can be obtained from the Attorney-General s Department website at www.ag.gov.au. ASSESSMENT STANDARDS All assessments conducted by RTO Trainers will: Comply with the assessment guidelines defined in the relevant nationally endorsed training package. In the case of our qualifications PADI s RTO will ensure that the competency assessment is determined by a vocationally competent assessor who holds the relevant TAE10 qualification or equivalent qualifications. All assessments within our RTO will lead to the issuing of a statement of attainment or to the issuing of a qualification under the AQF where a person is assessed as competent against the nationally endorsed units of competency in the applicable training package. All assessments will be: Valid - Assessment methods will be valid, that is, they will assess what they claim to assess, Reliable - Assessment procedures must be reliable, that is, they must result in consistent interpretation of evidence from the learner and from context to context, Fair - Assessment procedures will be fair, so as not disadvantage any learners. Assessment procedures will: be equitable, culturally and linguistically appropriate, PADI RTO General Standards and Procedures Trainer Handbook P a g e 35
involve procedures in which criteria for judging performance are made clear to all students, employ a participatory approach, provide for students to undertake assessments at appropriate times and where required in appropriate locations. Flexible - Assessment procedures will be flexible, that is, they should involve a variety of methods that depend on the circumstances surrounding the assessment, We will achieve this through: careful design of the assessments, validation and moderation of the assessment materials conducted in our annual review, an understanding of the definition and practical application of the above definitions ASSESSMENT VALIDATION AND MODERATION PADI s RTO will initiate, at least annually, an assessment validation and moderation session for each assessment tool, RTO Student and RTO Trainer Handbooks and mapping document used by PADI s RTO using an Assessment Review panel comprising of the CEO, the administrative staff, other RTO Trainers external to PADI s RTO (if possible), industry representatives (if possible) and other interested parties (if applicable). Using the Assessment Validation template or similar document, each assessment tool, mapping document and the RTO Student and RTO Trainer Handbooks will be reviewed: Against the requirements of the current training package Against the current industry standards and expectations Against any relevant legislative framework Against any additional relevant issues that would aid in the assessment tool being appropriate assessment of an individual s job readiness. Samples of completed assessments will be reviewed to determine any: Consistent misinterpretations of questions by students Consistent erroneous answers by students Consistent misinterpretation of questions or answers by trainer/assessors Where an updated assessment tool or answer guide is required, it will be developed and will replace the existing tool or guide. The mechanism for initiating the change and monitoring progress will be the Continuous Improvement process and the weekly Training and Quality Management meeting will be the forum of communicating the intended change and implementation process for the new assessment documentation. SUPERVISION UNDER THE DIRECTION OF (APPLIES TO DIVING UNITS ONLY) At least one RTO Trainer who holds a Certificate IV in Training and Assessment (also referred to as the RTO Supervisor) must be available for consultation at all times to ensure that all training activities take place per RTO procedures. The Certificate IV holder is ultimately responsible for student competency and therefore signs the relevant RTO Assessment Record Sheet for certification. Any RTO Trainers teaching under their supervision must also be registered and have completed an induction with PADI s RTO. People commencing in this role (i.e. working under supervision) must hold the 'TAE10 Enterprise Trainer Skill Set' or be able to demonstrate equivalence of competencies within two years of commencement. Evidence used to demonstrate equivalence of competencies may include consideration of relevant past training, including consideration of superseded and pre-existing teaching qualifications, experience, and professional development. Equivalency is most commonly demonstrated by an individual through mapping his/her past training, experience and ongoing professional development against the unit of competency. The RTO Supervisor/Cert IV holder will need to: Approve all learning and assessment material for use in the supervised training programme. Attend approximately the first 2 training sessions for the directly supervised trainer. Attend approximately 30% of other training sessions. These attendance percentages can be increased as required by the RTO Supervisor/Cert IV holder. This supervision exercise shall be documented on the Direct Supervision Record form. These records shall be maintained in the RTO Supervisor/Cert IV holder. ASSESSMENT CRITERIA All assessments will provide for RTO Students to be informed of the context and purpose of the assessment and the assessment process. This will include information regarding assessment methods, alternative assessment methods if required to accommodate special needs or circumstances, information will also be included at the start of each unit or course as to the assessment processes, number of assessments, types of assessment and the individual weighting of each assessment. RECOGNITION OF PRIOR LEARNING (RPL) POLICY PADI s RTO recognises that RTO Students and RTO Trainers will have acquired vocational skills from a variety of different sources, including those other than formal training. These skills are valid irrespective of how they were acquired. RTO Students and RTO Trainers who believe they have skills and knowledge that would be covered in the training programmes offered or that are required at the time of registration as RTO Trainer, should apply at the time of enrolment/registration to have their skills and knowledge assessed and, where appropriate, have the training programme or registration requirements reduced as appropriate. RTO Students and RTO Trainers can make an application for RPL to PADI s RTO at any time during the training programme or registration process. Evaluation of RPL is charged at $120 per hour. LANGUAGE, LITERACY AND NUMERACY (LLN) ASSESSMENTS In everyday workplace tasks it is common for a person to use and respond to spoken and written language and to use numeracy skills at the same time. When conducting vocational training, the RTO Trainer should be aware of this interlinking of language, literacy and numeracy. However, there will also be situations in which only one of these skills is the focus of the training, e.g. talking to EMS personnel after reporting a traffic accident. In broad terms, Language is the main way we make and understand meaning as humans. Literacy is the ability to read and use written information as well as to write appropriately, at home, at work and in the community. Numeracy is the ability to use the mathematical concepts needed to function effectively in work and social contexts. Every vocational course is different in terms of the level and kind of LLN required at entry as well as during the programme. The RTO Trainer must attend to the LLN needs of all course students and needs the ability to unpack units of competency and identify the embedded LLN requirements. The Australian Core Skills Framework (ACSF) describes levels of performance in the five core skills of learning, reading, writing, oral communication and numeracy skills. The framework comprises of five levels ranging from 1 (low level performance) to 5 (high level performance). The five levels of performance are assessed in regards to the level of required support, the level of understanding context and the level of text and task complexity. Level 1 Works alongside an expert/mentor where prompting and advice can be provided Very restricted range of contexts (or highly familiar contexts) Limited, highly familiar vocabulary and short and simple text complexity Task complexity of 1 or 2 steps include locating, recognising Level 2 May work with an expert/mentor where support is available if requested Familiar and predictable contexts (limited range of contexts) Simple familiar texts with clear purpose (familiar vocabulary) Explicit tasks involving a limited number of familiar steps Processes include identifying, simple interpreting and sequencing Level 3 Works independently and uses own familiar support resources Range of familiar contexts and some less familiar contexts Some specialisation in familiar/known contexts May include some unfamiliar elements, embedded information and abstraction and some specialised vocabulary Tasks involving a number of steps Processes include sequencing, integrating, interpreting, simple extrapolating, inferencing and abstracting PADI RTO General Standards and Procedures Trainer Handbook P a g e 38

Some LLN assessment resources are available by visiting http://www.deewr.gov.au/. Next, you will need to find the minimum requirements for LLN for each unit you are planning to teach. The individual RTO Trainer Guide for the unit you are about to teach might list the requirements. Some effective methods of assessing LLN skills pre course entry are described below. Please keep in mind that formal tests are intimidating for students. If it is possible it is a good idea to use less formal means of assessing the LLN needs of students before the start of the course. In fact, you are more likely to gain an accurate assessment of student s current LLN skills if they are relaxed and responsive to the assessment. Make the tests fit the competencies of the course and remember that tasks need to be related to the course and should not require prior knowledge. Interviews Although interviews are time intensive, they can provide valid and useful information about pre-entry LLN skills of your students. Questions about educational background assist RTO Trainers in identifying students who may need additional LLN support with their course. Self-assessment checklists Students (particularly post-entry) usually do not over-estimate their own skills. Giving students a one page checklist containing statements which cover the underpinning competencies of the unit or course which students are required to respond to allows students to reflect on their current skills as well as the skills they are required to develop to successfully complete their chosen programme. Observation As well as analysing the results of any formal or non-formal assessment you can also gain very useful information about LLN skills by observing how students are responding to either an assessment or even the enrolment process. LLN support needs may also be indicated by the length of time any assessment or enrolment process is taking students. An email (letter) to students In the initial session of a programme introductory activities could include an email to students introducing yourself, which students are required to read and then answer in a similar format and length. Because students are required to read the email and then reply using their RTO Trainer s email as a model for their own it is possible to use an introductory getting to know you activity as an informal tool for assessing LLN. You are required to complete the Language, Literacy and Numeracy (LLN) Assessment Record found in the Appendix for each student and keep a copy in the student s record folder. STUDENT LEARNING NEEDS PADI's RTO and its RTO Trainers required to ensure that we make every effort to assist our students in achieving competency in our training programmes. Part of this obligation is to ensure we confirm or re-affirm the information about special needs that was advised to us at time of enrolment. PADI s RTO has consciously decided to have students complete the enrolment form at the commencement of the first training session. Please set the students a time allocation of only 10 minutes to complete the form. Please observe the students for any that appear to be having difficulty in completing the form, some may display masking techniques such as glasses at home or other masking techniques. The aim of this assessment is to ensure that we confirm the learning needs of our students prior to commencement of the training. If we can identify any student with special needs we can then ensure that we modify our training and assessment strategies to accommodate their needs. STUDENT SUPPORT, WELFARE AND GUIDANCE PADI's RTO and its RTO Trainers will assist all students in their efforts to complete our training programmes. In the event that a student is experiencing any difficulties with their studies, we recommend that the student see their trainer, or a member of PADI s RTO staff. The staff member will ensure that the full resources of PADI Asia Pacific are made available to ensure that the student achieves the required level of competency in all accredited courses. Should the student be experiencing a personal difficulty, we will make every attempt to accommodate their needs within our limited capacity. AQF STATEMENTS OF ATTAINMENT PADI s RTO will only issue AQF statements of attainment that are within our scope of registration and that certify the achievement of the requirements of Units of Competency and Qualifications from nationally endorsed Training Packages. We must issue, record and issue statements of attainment that: meet the requirements in the current Australian Qualifications Framework Implementation Handbook identify the units of competency from Training Packages identify the RTO by its national provider number meet the requirements of the ASQA We will note the language of delivery and assessment on AQF statements of attainment issued if the delivery and assessment have been entirely in a language other than English. PROCESS FOR ISSUING STATEMENT OF ATTAINMENT RTO Trainers must submit all required documents stated under administrative procedures of this Hanbook directly into the PADI RTO student management system. Only once all the requirements are met a trainer can issue Statements of Attainment on behalf of PADI RTO. A Statement of Attainment can be either printed by the trainer delivering the training or sent electronically to an email address nominated by the student. ADVERTISING AND MARKETING POLICY PADI s RTO Trainers must ensure that their marketing and advertising is ethical, accurate and consistent with their scope of registration (which is consistent with the existing National Standard 24.1); PADI s RTO Trainers must include details of all fees and charges and their refund policy in their marketing and advertising; PADI s RTO Trainers must clearly and accurately describe the training products they are marketing and advertising, including a mandatory requirement that all marketing and advertising materials include the qualification or unit codes and titles so that clients know exactly what courses are being offered; PADI s RTO Trainers must include PADI Asia Pacific Pty Ltd s national registration ID 6729 in all marketing and advertising material so clients are aware of the organisation that is supplying the training and assessment of any courses in which they enrol; PADI s RTO Trainers must include in their marketing and advertising, in all cases where some or all of the training and assessment is to be sub-contracted to a partner RTO, a full description of the training and assessment services being provided by a partner RTO including its unique national registration code and all qualification or unit codes and titles that will be delivered on behalf of the host RTO that will actually be issuing the qualification; PADI s RTO Trainers must include in their marketing and advertising materials clear details about who the training products are aimed at when marketing and advertising a course that is shorter than the duration PADI RTO General Standards and Procedures Trainer Handbook P a g e 41
required under the Australian Qualifications Framework requirements, such as this course is only open to students who have already completed certain qualifications or units, or who have substantial previous industry experience ; PADI s RTO Trainers must not market or advertise superseded or obsolete qualifications or units; PADI s RTO Trainers must not market or advertise courses that are not currently on PADI Asia Pacific Pty Ltd s scope of registration; PADI s RTO Trainers must not guarantee an assessment outcome in their marketing and advertising such as 100% pass rates guaranteed or enrol and you will achieve a certificate or diploma ; PADI s RTO Trainers must not guarantee the completion of a qualification or unit in unrealistically short time frames in their marketing and advertising that fall well short of the requirements of the AQF; PADI s RTO Trainers must not guarantee an outcome from their training in their marketing and advertising that links enrolment in their courses to outcomes outside their control to ensure it is delivered, such as guaranteeing a job or an immigration outcome once the training is completed; and PADI s RTO Trainers must only use the Nationally Recognised Training logo in accordance with the conditions specified for the use of the logo. PADI s RTO Trainers must ensure that all marketing materials (whether print or electronic) provide accurate information on the relationship between trainers/assessors and the RTO. Emphasise that PADI s RTO has agreements with individual Trainers and not with dive centers or other organisations. USE OF NRT LOGO The Nationally Recognised Training (NRT) logo is a distinguishable mark of quality for promoting and certifying national vocational education and training leading to Australian Qualifications Framework (AQF) qualifications or statements of attainment. The NRT logo is a registered trade mark and as such the NRT logo can only be used by registered training organisations (RTOs), the Australian Skills Quality Authority (ASQA), State and Territory registering/course accrediting bodies and other authorised bodies. The NRT logo use guidelines are: Advertisements and promotional information in any medium (print, television, radio, banners, internet, etc.) 1. Training organisations registered by ASQA or any State or Territory registering/course accrediting body may use the NRT logo to promote training recognised under the AQTF provided that training is within the RTO's scope of registration. 2. Impressions must not be created that may lead an observer to conclude the NRT logo applies to all training provided by the RTO, if this is not the case. The NRT logo cannot be used by an RTO where the training is accredited, but is outside the scope of registration of the RTO. Where training is being promoted and does not meet the requirements stipulated in the AQTF or is outside the RTO's scope of registration, it must be made clear the NRT logo is not associated with that training. 3. Use of the NRT logo is only permitted where there is a direct relationship to an accredited AQF aligned course, Training Package qualification or a course meeting the requirements of the AQTF. Student information (brochures, course handbooks, prospectuses, etc.) 4. When an RTO is promoting the training it offers and wishes to use the NRT logo, its promotional material such as brochures, handbooks and prospectuses must clearly distinguish between nationally recognised training within the scope of registration and that which is not nationally recognised. Corporate stationery, business cards, buildings, training resources and marketing products 5. The NRT logo must not be used on products such as corporate stationery, business cards, building signage, mouse pads, pens, satchels, and packaging around products nor learning resources supporting training. Certificates, statements of attainment and other testamurs 6. The NRT logo must be depicted on all AQF qualifications, Statements of Attainment and certificates relating to courses meeting the requirements of the AQTF. These can only be issued by an RTO when the training delivered is covered by the RTO's scope of registration. The NRT logo must not be depicted on other testamurs or transcripts of results. RTO Trainers are required to check their own advertisings to ensure they comply with the above. TRANSITION TO CHANGED TRAINING PACKAGES PADI s RTO, will ensure that they are subscribed to the email updates from: Relevant Industry Skills Council Training Packages at work www.training.gov.au ASQA Updates These email updates advise of changes to the Training Packages that affect PADI s RTO business, the changes could be to units of competency, the certificate qualification or to the whole Training Packages. When we are notified of a change we need to investigate. PADI s RTO will investigate any changes to the Training Packages and determine the extent and impact of the change. In the event that there is a change in a course or unit of competency that is on our scope of registration, the weekly Training and Quality Management meeting will determine the required course of action. The outcome will be a clearly defined plan of action with clear responsibilities. The intended plan of action will be entered into the minutes of the weekly Training and Quality Management meeting, with clear goals and deadlines. The CEO is responsible for implementing this plan and following up with appropriate individuals. To ensure a clear demarcation between versions of learning and assessment tools, superseded versions of the Assessment tools are to be held by the CEO, and are only accessible via the CEO. It is important to note that new Training Packages must be implemented within 12 months of it being listed on the www.training.gov.au website. RTO TRAINER AGREEMENT AND RESPONSIBILITIES STATEMENT Responsible to: PADI s RTO Training Department Responsible for: PADI s Vocational Training and Assessment Main Duties As an Trainer registered with PADI Asia Pacific s Registered Training Organisation (RTO), you are required to adhere to the following terms and accept the responsibilities listed. VET QUALITY FRAMEWORK AGREEMENT Between PADI s RTO #6729 and Trainer Name PADI/EFR Member Number The purpose of this agreement is to outline the responsibilities of each party in ensuring the training and assessment delivered by the above named RTO Trainer (referenced as RTO Trainer in the remainder of this document) in the name of PADI s RTO is of the desired quality and rigour, and protects the interests of the students and is compliant to the requirements of the Federal Legislation SNR 2012. The scope of this agreement is for delivery of the following: <Insert Scope> PADI s RTO is an Australian Skills Quality Authority (ASQA) registered RTO based in Frenchs Forest, NSW. The RTO Trainer is wishing to deliver the above defined qualifications (known as the scope ). PADI s RTO and the RTO Trainer have teamed together to allow for the delivery of PADI RTO s scope to RTO Trainer clients. As such, it is PADI RTO s responsibility to provide the required infrastructure to allow for the delivery and assessment of the training and assessment required to determine competency for the above course. The RTO Trainer will provide the skilled training staff and the facilities to deliver the training and assessment programme. The RTO Trainer has issued to all its staff that interact with the student of or the accredited course the PADI RTO GSP - Trainer Handbook. The policies and procedures in this handbook shall be adhered to and implemented by the RTO Trainer. Deviation from these agreed polices may only be undertaken after receiving written permission from PADI s RTO. Only documentation approved in writing by PADI s RTO, shall be used in the course, issued to staff and students or used to promote the course. Any changes to documentation must be approved in writing by PADI s RTO. Specifically, each party has the responsibilities individually and where appropriately collectively as detailed below. 1. 2. Training and Assessment Strategy (Refer to SNR 15.2) PADI s RTO is responsible for developing and maintaining the Training and Assessment Strategy (TAS). The TAS is to be developed in conjunction with the RTO Trainer to ensure that the TAS accurately reflects the training programme, methods of delivery and assessment and the resources including training and assessment staff required to deliver it. The RTO Trainer is responsible for delivering the training in the manner described in the TAS, and that any required variation to the agreed training plan is discussed with PADI s RTO and agreed upon prior to implementation. 3. Resources required for delivery (Refer SNR 15.3) PADI s RTO is responsible for ensuring that the RTO Trainer has sufficient resources to deliver the training programme as defined in the TAS. Resources shall include: a. Appropriately qualified staff or teams of staff (as defined in SNR 15.4). b. Appropriate commercial infrastructure for learning and assessment, equipment and make-up resources as required. c. Appropriate learning and assessment material d. Other resources as agreed by PADI s RTO and Trainer Name The RTO Trainer is responsible for ensuring that sufficient resources remain available at appropriate times to ensure the delivery of the course as documented in the TAS, and contacting PADI s RTO to discuss relevant issues should there be a change in the resources (this will include staff changes). 4. Training Staff (Refer SNR 15.4) The RTO Trainer will meet the requirements of SNR 15.4 for the training and assessment of the scope, including remaining current and committed to ongoing professional development as defined in this standard. PADI s RTO will review and approve all RTO Trainers prior to the proposed trainers delivering Training or Assessment services. PADI s RTO will retain on record a copy of all RTO Trainers qualifications, CVs and ongoing professional development. The RTO Trainer will provide updated copies of CV s, certificates and qualifications at least annually demonstrating that the RTO Trainer has remained current in their Make Up skills and continue to maintain their Vocational Training and Assessment skills. 5. Assessments and RPL (Refer to SNR 15.5) Both PADI s RTO and the RTO Trainer share joint responsibility for development and use of the PADI s RTO supplied assessment tasks. PADI s RTO is responsible for ensuring that the assessment tools and RPL processes meet the requirements of the Training Package. The RTO Trainer is responsible for ensuring the use of the assessment tools is as designed, and consulting with PADI s RTO regarding any variation to the assessment tools or their implementation, prior to any change. Assessment results will be entered into the PADI RTO mandated Student Record System soon as practical upon their completion by the RTO Trainer. The RTO Trainer recognises and authorises PADI s RTO to review and monitor these results, seeking additional information from the RTO Trainer as required. PADI s RTO may retain copies of assessment results as appropriate to facilitate the smooth delivery of the training programme. PADI s RTO General Standards and Procedures Trainer Handbook P a g e 79
PADI s RTO is responsible for auditing the assessment validation process at least annually, the RTO Trainer is responsible for ensuring that: All relevant trainer/assessors are available A representative sample of completed assessments, 100% of each assessment from each class, (and all RPL applications if relevant) are on hand for review. Implementing any required amendments as determined for the Validation process. 6. Preliminary Information Provided to Trainer Clients (Refer to SNR 16.3 & Condition 24.1) Both PADI s RTO and the RTO Trainer share responsibility to provide clear, accurate and ethical information regarding: PADI s RTO scope of registration, The rights and responsibilities of o PADI s RTO o RTO Students o RTO Trainers All promotional material must be approved by PADI s RTO prior to circulation including websites, email signatures, letterheads, prospectuses and any documentation that refers to or promotes the scope and the relationship with PADI s RTO. PADI s RTO Student Handbook is to be provided to students prior to enrolment. This handbook is to be approved by PADI s RTO prior to issue and any changes to this handbook must be approved in writing prior to release. 7. Engagement of PADI s RTO and the RTO Trainer in Development, Delivery and Monitoring of Training and Assessment (Refer to SNR 16.4 & 17.1) Both PADI s RTO and the RTO Trainer have a joint responsibility to participate in the ongoing development, delivery and monitoring of the training programme for the students. This is to be achieved by regular contact and open and frank discussions where required to ensure that the training programme is effective in delivering the requirements of the training programme to the clients. Both PADI s RTO and the RTO Trainer use this process to ensure the systematic and ongoing review of the training process and use this review to continue to improve the training programme. Further, where students are to be placed in work experience roles, appropriate documentation as provided by PADI s RTO will be used to ensure that the work placement is appropriate and safe for the students. 8. Support for Students (Refer to SNR 16.5) Both PADI s RTO and the RTO Trainer have joint responsibility to ensure that the students are provided with the necessary training, assessment and support services to meet their needs before, during and after the course. The nature of the support service will depend upon the needs of the individual, the RTO Trainer will use the PADI s RTO Student Enrolment Form to ensure that suitable questions are asked regarding the student s needs, and that the enrolment form is used as a language and literacy test. Further, the RTO Trainer provides students with a range of support services appropriate to their needs, this includes additional education support, counselling both personal and vocationally, and if appropriate language and literacy support consistent with the RTO Student Handbook. 9. Access to the Clients own Records (Refer to SNR 16.6) Both PADI s RTO and the RTO Trainer ensure that the students will have access to their training records as held by each party respectively. The RTO Trainer is responsible for recording enrolment details and assessment results into the PADI RTO mandated Student Management System. 10. Clients Complaints and Appeals (Refer to SNR 16.7) The RTO Trainer is responsible for bringing PADI's RTO Complaints and Appeals process to the attention of all students. The RTO Trainer is responsible for ensuring that any complaints and appeals are dealt with as per the process. The RTO Trainer is responsible to ensure that the students are provided with the Complaints and Appeals process for PADI s RTO and that the process is implemented as documented. The RTO Trainer is also responsible for ensuring that any complaint or appeal is copied to PADI s RTO in a timely and efficient manner. 11. Implementation and Maintenance of this Agreement (Refer to SNR 17.3) Both PADI s RTO and the RTO Trainer maintain and implement this agreement; if the responsibilities for this agreement need to vary, it shall be done by mutual agreement prior to implementation of any requested changes. 12. Management of Accurate Records (Refer to SNR 17.4) The RTO Trainer is responsible for ensuring all required information including enrolment and assessment information is entered into the PADI RTO mandated Student Management System within two weeks of the information becoming available. All other records are to be retained in an accurate manner in a secure location and backed up at least weekly to an external location, that prevents unauthorised access. PADI s RTO is responsible for ensuring that records received from the RTO Trainer are: Entered accurately by staff clearly informed of their responsibilities Securely stored Backed up And have assessment results in sufficient detail to allow for a reprinting of qualifications are retained for a minimum of 30 years. 13. Governance (Refer to SNR 18.1) PADI s RTO is responsible for governance of the NVR Standards by: Ensuring compliance to the NVR Standards Ensuring that all material used in the RTO is compliant to standards and meets the requirements of the Training Package That all RTO Trainers are competent in the qualifications they deliver as defined in the NVR standards Ensuring that all RTO Trainers are inducted and aware of the Policies and Processes of PADI s RTO Providing ongoing training in the PADI s RTO Policies and Processes 14. Awareness of Trainer/Assessors and Students of Relevant Legislation (Refer to SNR 20.1 & 20.2) The RTO Trainer will ensure that RTO Trainers and students are provided with information on relevant legislation. The RTO Trainer will achieve this through the: Issuance of the Student Handbook to all prospective and current students Issuance of the RTO Trainer Handbook to all prospective and current staff PADI s RTO General Standards and Procedures Trainer Handbook P a g e 81
Adherence to the course material as supplied by PADI s RTO PADI s RTO is responsible for advising on any changes to relevant legislation and will provide updated documentation as required. 15. Maintaining Public Liability Insurance (Refer to SNR 21.1) The RTO Trainer is responsible for maintaining Public Liability Insurance for their premises for at least the duration of the training programme. 16. Certification, issuing and recognition of qualifications & statements of attainment (Refer to SNR 22.1) The RTO Trainer will adhere to the Fee and Refund Policy as outlined and will not introduce any additional fees, either to the student or to PADI s RTO, or alter any agreed fees without the written approval of PADI s RTO. The RTO Trainer will not alter the Fee and Refund Policy without the written approval of PADI s RTO. 17. Issuance of Qualifications (Refer to SNR 23) PADI s RTO is responsible for designing and issuing the relevant certificates or statements of attainment based upon the assessment results and other information provided by the RTO Trainer. This will be issued within two working weeks of the relevant information being provided. The RTO Trainer is responsible for providing PADI s RTO with the required assessment and other relevant information as soon as practically available. 18. Accuracy and integrity of marketing (Refer to SNR 24) The RTO Trainer is responsible to ensure their marketing and advertising of AQF and VET qualifications to prospective clients is ethical, accurate and consistent with PADI s RTO scope of registration. The RTO Trainer will adhere to PADI s RTO Advertising and Marketing Policy and the Fees and Refund Policy. PADI s RTO will conduct random audits at any time to ensure RTO Trainers are compliant with all requirements and standards. Replacement certificates or statements of attainment will be issued by PADI s RTO upon receipt of the appropriate fee. The undersigned agree to adhere to the terms and conditions stipulated above.
