MAURIZIO FERRO, Lawyer 1993-1998 The two sides of the Atlantic save Mickey Mouse because copyright matters ABSTRACT The 1886 Berne Convention sets in 50 years after the author's death the term limit for the exclusive exploitation of rights over literary and artistic works: with Walt Disney dying in 1966, in 2016 his creations would have fallen in the public domain. In 1993, Directive 93/CEE imposed to Member States the extension of said term up to 70 years. In 1997, the USA Congress started debating on a similar extension, finally enacting the Mickey Mouse Protection Act in 1998. In both cases, the laws have had a retroactive effect, with a blatant bending of usual rules why? Because copyright is the backbone of protection for artistic works, including movies: they re linked to enormous interests, object of desire for powerful lobbies. From «Spider- MickeyMouse» to «Steambot Willie», twenty years for «Winnie The Pooh» s honey jar, looking at a lawyer defeating «Terminator»: four real situations in the field of animation movies, many billions of dollars at stake. BIOGRAPHIC NOTE MAURIZIO FERRO With a degree in Law at Turin University, where he got a Post-Graduation Master too, he is serving as a Lawyer in the Turin Order and since his apprenticeship he has dealt with judicial and extra-judicial consultancy in the intellectual and industrial property fields. Since 2007 he regularly works with Aprà Law Office, where he mainly supervises the sectors of TMs and judicial litigation.

The aim of the presentation is to highlight the role of trademarks, designs and merchandising in the protection of cartoon characters. CLAUDIO COSTA, Lawyer BIOGRAPHY: Mr Claudio Costa is a former lecturer at the Course of Private Law of Informatics at the Faculty of Law of the University of Eastern Piedmont. Currently is lecturer of licensing at the International Trade Law Post-graduate Course UN-ILO and is the author of publications in the field of intellectual property and licensing agreements.
