Welcome to DOL Appeals DOL Appeals is the gateway to information about formal hearings and appeals at the U.S. Department of Labor (DOL). DOL Appeals is an interactive Web site designed to allow parties before the Boards to gain electronic access to appeals. This site is designed to walk the parties through the Boards appeal process and provide helpful tools and information along the way. It also allows the party to submit a new appeal electronically, get electronic service of documents, file briefs/motions and check the status of an existing appeal. 1

Register for a New Account This section will describe how to register for a new efiler Account. 1. From the entellitrak login screen click on the Click Here link above the Username field. 1

Once all desired information has been input click the Continue button. 4. Verify that the information on this screen is correct then hit the Confirm button. 2

An email will be sent to the email address provided upon creation of the account. Access that email to proceed. The email will provide a temporary password and a link to login. 5. Click the link provided in the email to continue. 3
entellitrak DOL Appeals efiler User Guide: Register for a New Account 6. Your username is the full email address you provided during the registration process and your temporary password is provided in the email notification. Enter those in the appropriate fields and the click the Sign On button. 4

entellitrak Basics 2.1 Log Out 1. Users log out of DOL Appeals by clicking the Sign Out link that appears in the upper right corner of the screen. DOL Appeals initiates an inactivity clock when a user logs onto the system. If 30 minutes of inactivity occur, the user is automatically logged off the system. Periods of inactivity include those times between saving data, clicking a navigation tab, or refreshing the screen by clicking on the refresh icon on the screen. Typing in a text box is considered inactivity by the system since no information is being sent to the server until the save button is clicked. Note: DOL Appeals licensing is based on concurrent usage. If the browser is closed without clicking the Sign Out link the session will not end until the account is timed-out because of inactivity. As a best practice always sign out to free up licenses for other users. 2.2 Navigating Users can navigate throughout DOL Appeals by using the tabs at the top of the screen. To enter a new screen, click the appropriate tab. Every time a user enters a new screen, a link will be added to the Breadcrumb Trail. The Breadcrumb Trail is a series of links separated by right pointing arrows, which display a visual record of exactly where the user is within the system. DOL Appeals allows the user to return to a previous screen by clicking on any of these links. 1. To navigate using the Breadcrumb Trail, click on the section of the path to be viewed. For example, in the screen shot below the user is looking at the New Appeal Access Request screen within an Account that is in the Tracking Inbox. Click on the link containing the name of the screen that needs to be viewed. 7
entellitrak DOL Appeals efiler User Guide: entellitrak Basics Users should navigate in DOL Appeals by using the tabs, buttons and links provided by the application rather than the browsers back button. This will ensure that the information they see will be pulled from the DOL Appeals server and will reflect real time data. If a user accidently clicks the browsers back button they will be defaulted to an error page. Click the Refresh button next to the address bar, to return to DOL Appeals. 2.3 Changing Roles Some users may have multiple roles within the system, allowing them to have different permissions and access. Roles are defined by the system administrator. If a user does not have multiple roles, they will still see the Change Role link, but no other roles will be available to change to. If you have multiple roles you may change your role without logging out by using the Change Role link at the top of the screen. 1. Hover over the Change Role link. A pull down menu will appear with all your available roles. 2. Click on the role you wish to work under. 3. The screen will refresh according to that role. 8

This will open the change password window. 3. Enter the desired password in the New Password field and then the Confirm New Password field. Click the Submit button to proceed. 4. Make any desired changes and then click the Save button. 9

Check your email and follow the steps outlined in the email to complete the change. 2.6 Password Reset Process Use the steps in this section to reset your password if needed. 1. From the login screen click the Forgot Password? link. 12

File New Appeal 3.1 File a New Appeal Use the steps in this section to file a new appeal. 1. Click the File New Appeal button to begin the process of filing a new appeal. The New Appeal Filing screen will display. All fields with the icon are required fields. 2. Hover over the [?] icon in the Board field to view information about each of the available boards. 15

Each board will be explained in the following sections. 3.1.1 ARB All fields with the icon are required fields. 4. In the desired fields enter or select the applicable information. 16

Or you can type the date in the mm/dd/yyyy format. 6. Select the date on the calendar by clicking on the appropriate date. Clicking the or will move the month in the desired direction. Clicking the or will move the year in the desired direction. 7. If more than three ALJ numbers are required then click the Add Another ALJ# link. A new ALJ entry field will be available. 8. Click the Remove Last ALJ# link to remove that newly added field. 9. If any role besides attorney is selected in the Your Role on This Approval field then the Has Attorney field will appear. 10. Once all desired information has been entered click the Save button. 17

Clicking the or will move the year in the desired direction. 5. If more than three OWCP numbers are required then click the Add Another OWCP# link. A new OWCP# entry field will be available. 6. Click the Remove Last OWCP# link to remove that newly added field. 7. If Yes is selected in the Oral Argument Request? field then the Oral Argument Reason field will appear. 8. If Claimant is selected in the Your Role on This Approval field then the Has Attorney/Rep field will appear. 9. If Yes is selected in the Has Attorney field then the Second Signature Type field will appear. 25
entellitrak DOL Appeals efiler User Guide: File a New Appeal 10. If File is selected in the Second Signature Type field then the Signature File field will appear. You must then download and print an ECAB consent form, which must be signed by both parties, then uploaded as a PDF file in the Signature File field. 11. If Online Signature is selected in the Second Signature Type field option then you will be required to provide the email address of the other party when entering their other contact information. When you submit this appeal request, an email will be sent to the address you provided, prompting that party to log into this system and verify the appeal information you entered, thereby providing electronic consent. Please note that this party will be required to create an efiler account in this system if they do not have one already, and that the appeal will not be officially filed until this party provides electronic consent. 12. To add a document, click the Browse button. This will open a dialog box allowing a file to be uploaded. Select the appropriate file and click Open. 13. Once all desired information has been entered click the Save button. 26

See Section 3.3 to proceed with an attorney appeal. 3.2 Non-Attorney Appeal Once an appeal filing record has been saved, the Petitioner Information screen will appear. Verify the information is correct on this screen and enter any needed information. 1. If the information is incorrect, click on the Home tab and then click the Update My Account button to update information. See Section 2.4 for information on the Update My Account button. 2. Once the information has been verified click the Save button to proceed. 27

Use the following steps to do so. All fields with the icon are required fields. 3. In the desired fields enter or select the applicable information. 4. Once all desired information has been entered click the Save button. 28

From the Appeal Filing screen click on the Submit Request to Department of Labor button. Note: Clicking the Save for Later button will save the appeal as a draft and not yet submit it to DOL. Clicking the Delete button will delete the appeal. 31

entellitrak DOL Appeals efiler User Guide: File a New Appeal 3. Enter your entellitrak login password and click the Submit button. The appeal request will be submitted. You have two hours from the initial submission time to modify your request, after which time you may not make any additional changes; the request will then be forwarded to the Adjudicatory Boards' staff for review. To modify your request, click the Make Corrections button, edit as needed, then click the Submit Request to Department of Labor button to re-submit your request. You may also delete your request within this two hour window. Note: If the appeal is denied then the process has ended. If the appeal has been returned for corrections then make any needed corrections and then resubmit. The two hour window will not restart. 33
entellitrak DOL Appeals efiler User Guide: File a New Appeal 3.3 Attorney Appeal Once an appeal filing record has been saved, the Attorney Information screen will appear. Verify the information is correct on this screen and enter any needed information. 1. If the information is incorrect, click on the Home tab and then click the Update My Account button to update information. See Section 2.4 for information on the Update My Account button. 2. Once the information has been verified click the Save button to proceed. 34

My Appeals This section will give information on the My Appeals section located on the Home screen. The statuses that an appeal may be in are as follows. Status Accepted Awaiting Second Signature Denied Edit Mode Received by DOL Description Your request has been accepted and incorporated into the case record Your request for an appeal has been submitted, but is awaiting authorization by the claimant (if you are the attorney/representative) or by the attorney/representative (if you are the claimant). A request has been sent via email to obtain this authorization. Please note that the appeal will not be filed with the Adjudicatory Boards until this party has completed the authorization process. You will receive a confirmation email when this occurs. Your request has been denied. The reason(s) for denial are indicated. Your request has not been submitted yet, it is in the process of modification, or it has been returned to you for corrections. Please make the necessary changes, then click the "Submit Request to Department of Labor" button to submit it. Please note that the Adjudicatory Boards' staff will not receive your request unless you submit it. You may also delete your request if you so choose. Your request has been received by the Adjudicatory Boards' staff and will be reviewed shortly. You will receive an email upon completion of their review, indicating whether this request has been accepted, denied, or returned to you for corrections. Submitted to DOL Your request has been submitted. You have 2 hours from the initial submission time to modify your request, after which time you may not make any additional changes; the request will then be forwarded to the Adjudicatory Boards' staff for review. To modify your request, click the "Make Corrections" button, edit as needed, then click the "Submit Request to Department of Labor" button to re-submit your request. entellitrak DOL Appeals efiler User Guide: My Appeals 1. Click on the desired appeal to view information regarding the appeal. The My Appeal Screen will display information regarding that appeal. See Section 4.1 for information on the Served Documents, efile Motions, and efile Briefs child tabs. 44
entellitrak DOL Appeals efiler User Guide: My Appeals Note: If you click the Remove My Electronic Access to This Appeal button then you will no longer see the appeal in your tracking inbox. If you require electronic access in the future then contact DOL. 4.1 My Appeals Child Tabs The child tabs allow more information to be entered about an appeal case. Information on each child tab will be given in the following sections. 4.1.1 Served Documents The Served Documents child tab will display a listing of all documents that have been electronically served for the appeal. 1. Click on the desired document. 45
entellitrak DOL Appeals efiler User Guide: My Appeals The served documents screen will appear. It will be available for viewing for two weeks, after which time it will no longer be accessible. However, if a petition for reconsideration is filed, it will be viewable until 45 days after the petition is addressed. 46
entellitrak DOL Appeals efiler User Guide: My Appeals 4.1.2 efile Motions The efile Motions child tab will allow a user to create, view and edit information on efile motions involved in the appeal. 4.1.2.1 Create an efile Motion Use the following steps to create a new efile motion. 1. Start the process of creating a new efile motion by using one of the following two methods. From the efile Motion Listing screen, click the New efile Motion button. Or From the efile Motion Listing screen hover the mouse over the efile Motion child tab and then click the New efile Motion link. All fields with the icon are required fields. 2. In the desired fields enter or select the applicable information. 3. Once all appropriate information has been entered click the Submit Request to Department of Labor button. 47

From the efile Motion Listing screen click on the link for the desired efile Motion. 2. Information about the motion will display. Follow the onscreen instructions if corrections are needed. 4.1.3 efile Briefs The efile Briefs child tab will allow a user to create, view and edit information on efile briefs involved in the appeal. 4.1.3.1 Create an efile Brief Use the following steps to create a new efile brief. 49

From the efile Briefs Listing screen, click the New efile Briefs button. Or From the efile Briefs Listing screen hover the mouse over the efile Briefs child tab and then click the New efile Brief link. All fields with the icon are required fields. 2. Request Electronic Access to an Existing Appeal Use the following steps to request electronic access to an existing appeal. 1. Click on the Request Electronic Access to Existing Appeal button. 2. Select the desired board. 53

The options for each board are displayed below. Regardless of selection in the Board field use the following steps to submit a request. All fields with the icon are required fields. 3.
