DATE ISSUED: TITLE: POLICY NO. MPOL-50 MANAGEMENT POLICY DOGS KEEPING OF AND KENNELS OBJECTIVES To ontrol the numer and onditions under whih dogs may e kept within the Shire. POLICY STATEMENT To provide guidelines to indiate the requirements for keeping of dogs. AIM Throughout the residential area of the Shire of Kempsey, a maximum of two dogs per allotment may e kept irrespetive of the area of that allotment. Throughout the rural area of the Shire of Kempsey a maximum of three dogs per allotment may e kept irrespetive of the area of that allotment (unless Counil approves a greater numer whih are required for speifi purposes other than oarding or reeding for whih development onsent is required). Guide dogs for the lind are exempt from the requirements of this poliy as are veterinary linis and animal hospitals. Note: More than two dogs may e kept, in residential zones, on an allotment, upon appliation to Counil, if used for guarding or seurity purposes. These dogs must e seurely tethered or fened in at all times. LEGISLATIVE REQUIREMENTS Loal Government At 1993 The At provides that Counil may issue an Order to keep irds or animals on premises, other than of suh kinds in suh numers or in suh manner as speified in the Order. Note: The provisions of the Loal Government At should not e onfused with those of the Environment Planning and Assessment At and Kempsey Loal Environmental Plan 1987. Development onsent may e required whether or not the numer of dogs is in ompliane with this Poliy. Offenes The At provides for penalties where offenes are proved ontrary to this requirement under the provisions of the Dog At. All dogs of or over the age of six months that are ordinarily kept in the Shire must e registered. Any dog in or on a puli plae must e under the effetive ontrol of some ompetent person y means of an adequate hain, ord or leash. A Greyhound dog must have a muzzle seurely fixed upon its mouth in suh a manner as will prevent it from iting any person or animal exept when suh dog is on any land, vehile or premises of whih the owner of the dog is the oupier or on whih the dog is ordinarily kept. The exerising of greyhounds is prohiited in the following areas:- 1 York Lane, Kempsey, from its intersetion with Belgrave Street to its intersetion with Forth Street; 2 Smith Street, Kempsey, from its intersetion with Forth Street to its intersetion with Belgrave Street; 3 Clyde Street, Kempsey from its intersetion with Forth Street to its intersetion with Belgrave Street; 4 John Street, Kempsey from its intersetion with Belgrave Street to its intersetion with Verge Street; 5 Belgrave Street, Kempsey from its intersetion with Gladstone Street to the highwater mark of the Maleay River; 6 Elow Street, West Kempsey, from its intersetion with Tozer Street to its intersetion with Kemp Street. B POLICY STATEMENT - Kennels To provide guidelines for the estalishment of kennels to house dogs. In aordane with the provisions of the Environment Planning and Assessment At Kempsey Loal Environmental Plan 1987 provides the following definition: "Animal oarding and reeding estalishment" means a uilding or plae used for the purpose of reeding, training, aommodating or nurturing domesti animals for gain or reward, otherwise than as anillary to the use of the uilding or plae for the purpose of agriulture." The aove premises are prohiited within - Zone 1() Rural (Small Holdings) Zone 1(d) Rural (Investigation) Zone 2(a) Residential Zone 2(1) Residential Zone 2(2) Residential Zone 2() Residential Zone 2(d) Residential (Tourist Faility) Zone 3(a) Business Zone 3() Business (Neighourhood) Zone 3() Business (Speial) Zone 3(v) Business (Village) Zone 4(a) Industrial Zone 4() Light Industrial Note: Whereas zone 2(v) (Village or Township) Zone does not prohiit animal oarding and reeding estalishments it is suggested that suh developments e a minimum of 400 metres from any dwelling or ommerial premises. 1 Dog keeping is separated into six ategories (other than the two or three dogs permitted) all of whih are defined as kennels. These are - Greyhounds a Pets (3-4 dogs) Hoy kennel (5-10 dogs) Professional reeder/trainer (11 dogs or more) Other reeds MPOL-50 Page 2 of 6

a Hoy reeder (4-10 dogs) Professional reeder (11 dogs or more) Boarding kennels "Dog" inludes ith and shall inlude all dogs of or over the age of six (6) months. 2 The onsent of the Counil is required efore dogs are introdued to the site. This is not granted automatially and a formal appliation for suh is neessary, whih will e advertised and neighours notified. Any ojetions will e taken into onsideration when assessing the appliation. This does not apply to sites with "existing use" rights. 3 Prospetive kennel operators are advised (a) to study the enlosed requirements arefully prior to seletion of a site; () to ontrat a proposed purhase of a sale "sujet to Counil approval for kennels"; and () where the onsent of the Counil is required to ahieve this prior to property settlement. Any appliation sumitted to Counil will e determined on the numer of dogs, the purpose for keeping them and merits of the appliation in terms of suitale land. Note: "Existing use" rights ould e related to the former Kempsey Planning Sheme Ordinane or the former Maleay Shire requirements and determination of these should e investigated. Code for the eretion of dog kennels and requirements for the keeping of more than three dogs on an allotment within the Shire of Kempsey. 1 General requirements 1.1 Kennels shall e permitted in the following zones with Counil's onsent - Zone no. 1 (a1) Rural "A1" Zone Zone no. 1 (a3) Rural "A3" Agriultural Zone no. 1(e) Protetion Zone (Rural Floodway) "E" Zone Zone no. 1(f) Rural (Forestry) "F" Zone Zone no. 1(g) Rural (Small Agriultural Enterprises) "G" Zone Zone no. 2(v) Village (sujet to uffer zone as presried). Kennels shall not e permitted in the following zones - Zones 1(), 1(d) Rural Zones 2(a), 2(1), 2(2), 2(), 2(d) Residential Zones 3(a), 3(), 3(), 3(v) Business Zones 4(a), 4() Industrial. 1.2 No hoy, professional reeder and/or trainer or oarding kennels shall e estalished on and within two (2) kilometres of land on whih kennels are not permitted. 1.3 The ratio of dogs per site shall not exeed ten (1) per hetare or a maximum of thirty (30) dogs. This ratio is expressed as the maximum ratio possile under the most ideal onditions. A liensee may keep one (1) litter of puppies on the premises providing the litter is removed from the premises within six (6) months of age if the total numer of dogs exeeds the numer of dogs permitted. Every premises must have a register in whih shall e registered the date of irth of eah litter, numer of puppies ontained in the litter, the olour and sex of eah puppy. 1.4 Where the onsent of the Counil is required for the kennels no land shall e used for the keeping of any dogs until development onsent has een granted and all onditions of suh onsent have een omplied with to the satisfation of the Diretor Environmental Health and Development Department. 2 Appliations 2.1 Appliations for onsent shall e aompanied y plans learly representing the proposal and ontaining site, floor and elevation drawings inluding details of existing uildings on the land together with distanes to dwellings on adjoining land. Speifiations detailing proposed type of onstrution of kennels, yards and fenes e sumitted with the appliation. shall 3 Setaks 3.1 Kennels, runs and exerise yards shall e set ak a minimum distane of two hundred (200) metres from the frontage to a puli road and a minimum of sixty (60) metres, depending on site topography, from any rear or side oundary. Pets are exluded from this requirement and may e allowed within these setaks. 3.2 It is onsidered undesirale that kennels or day runs shall e loated within one hundred and fifty (150) metres of any dwelling or approved dwelling in existene at the date of appliation, other than that on the same land. 4 Kennel onstrution detail 4.1 Constrution standards and materials used shall e to the satisfation of the Counil's Diretor Environmental Health and Development. 4.2 The kennels shall e ereted upon a raised, sloped and drained reinfored onrete sla onstruted with footings and ratwalls in aordane with the requirements of Counil's Environmental Health and Development Department. 4.3 External walls shall e lined internally with a smooth material, apale of eing washed and easily leaned and e onstruted from any of the following materials or a omination of suh: a d e 150mm minimum onrete lok work, suitaly reinfored; 100mm minimum rikwork with engaged piers; 110mm minimum thikness reinfored dense onrete, of at least 20 m.p.a. strength, poured in-situ; 6mm flat fire ement sheeting or planking; an approved prefariated sound asorent modular panel is availale for kennel onstrution and has load-earing apaity. 4.4 a For kennels of framed onstrution all external walls and the eilings shall e lined internally with 6mm fire ement sheeting perforated with pegoard pattern. The sheets shall e so fixed as to provide spae within whih shall e plaed a minimum 50mm thik fireglass or rokwool atts or uilding lankets. Kennels of solid onstrution suh as rik, lok or onrete shall have eilings, internal walls and partitions treated as aove to provide an aoustially asorptive surfae approximately equal to the surfae area of the internal faes of the outer walls. 4.5 It is reommended that the firous material aove e wrapped in polyethylene or PVC sheet or ags ("Gladwrap" or similar) no thiker than 0.01mm and sealed at all joints with waterproof adhesive tape. 4.6 Wall ladding is to e onstruted so as to provide adequate splashaks. 4.7 Roof shall e of approved roofing material and the kennels shall e weatherproof. 4.8 The kennels shall e properly ventilated. 4.9 The uilding shall stand on a onrete pad with an apron extending 1.8 metres in front to avoid the denuding of grass and the ponding of water. 5.0 Fening 5.1 All dogs shall e kennelled and penned at all times whilst on the premises. 5.2 The minimum seurity fening immediately surrounding and ontaining the kennels, pens and runs shall e a minimum 1.8 metres high of mesh, hain or hinge-joint stok-proof wire, ereted so that the dogs are not ale to enter or esape. The area enlosed shall e suffiient to provide exerise and seurity for the numer and type of dog onerned to the satisfation of the Counil. 5.3 In oarding kennel installations, it shall e further required that seurity fenes e ereted to provide tops whih rank inwards, under-fene onrete strips and wire anopies over all kennels and day runs designed and ereted to prevent the esape of dogs y liming, jumping or digging. Suh features may also e required in other kennel ategories at the disretion of the Counil. 5.4 Fenes etween individual day and exerise yards shall e onstruted of the same materials as desried aove, exept as desried in 6.5 (). 5.5 All gates and posts shall e of galvanised steel fitted where neessary with dog proof athes and olts. 6.0 Effluent Disposal 6.1 The kennels and pens are to e onstruted with impervious reinfored onrete floors drained y gravity to a deep spoon drain and thene to a grit arrestor. Liquid waste from the grit arrestor shall disharge into a Counil approved asorption area. 6.2 Faees (stools) shall e olleted daily from kennels, pens and runs and disposed of y a means of waste disposal approved y the Counil. 7.0 Hygiene Management 7.1 A lean water supply shall e provided at all times for the purposes of drinking and wash down. 7.2 The kennels and surrounds shall e kept free from rodents and vermin and food shall e kept in suitale ontainers. Deomposed food shall not e permitted to remain on the premises. 8.0 Noise emission and ontrol 8.1 Kennel operators must e ale to demonstrate the aility to quikly quieten the dogs when neessary. Evening feeding, rather than morning is preferred y the MPOL-50 Page 5 of 6

Counil so that the animals are in a more ontented state when seured for the evening. 8.2 Between the hours of 8.00 pm and 7.00 am (April to Septemer) and 8.00 pm and 6.00 am (Otoer to Marh) all dogs, unless eing exerised shall e loked in kennels so onstruted as to ensure darkness inside. 8.3 Operators shall take reasonale preautions to ensure that the dogs do not ark after 8.00 pm. 9.0 Landsaping and sreening 9.1 Dense plantings of fast-growing trees, shrus or vines shall e made and maintained in a healthy state to redue the aousti and visual impat of the kennels, runs and dogs upon surrounding properties. 9.2 A landsaping plan shall e sumitted with plans aompanying appliation for onsent. 9.3 No existing trees shall e removed from the land exept in the area required for onstrution and works assoiated with the eretion of the kennels and runs. 9.4 Appliations made upon allotments whih have een lear-felled or denuded of natural vegetation will e resisted unless aompanied y a proposal for major landsaping and sreening works. This shall inlude the provision of an earth mound at least one (1) metre height, lose to and along exposed aspets of the kennels or runs. The mound shall e planted with dense fast growing low trees and shrus. 10.0 Aess, rossovers parking areas 10.1 All kennels shall provide a standard vehile rossover of minimum width 4.88 metres at the aess to the property to the satisfation of the Diretor Operations. 10.2 Boarding kennels, puli trialing traks and other large ommerial kennels shall provide off-street parking areas and vehile aess ways suitaly paved to a minimum standard of 150mm depth with approved gravel aggregate. Aess ways shall e a minimum 4 metres wide and onstruted to the satisfation of the Diretor Operations. 11.0 Permits 11.1 Reeipt of an appropriate permit from the Counil is required efore any of the following works may e performed: - a d e f g foundations, ratwalls and onrete slas; uilding works; retiulation of water; drainage works; installation of septi or other approved forms of kennel waste disposal; eretion of signs; provision of standard vehile rossover. 12.0 Speial provisions 12.1 The Counil reserves the right, in ases whih it onsiders to e extraordinary, to waive any of the foregoing onditions MPOL-50 Page 6 of 6
