4 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCI AT/ON ARTICLE 1: PROCEDURAL AGREEMENT 1.01 RECOGNITION The Reading Board of Eduation, hereinafter referred to as the "Board", reognizes the Reading Eduation Assoiation (REA), an affiliate of the Southwestern Ohio Eduation Assoiation (SWOEA), the Ohio Eduation Assoiation (OEA), and the National Eduation Assoiation (NEA), hereinafter referred to olletively as the "Assoiation", as the sole and exlusive bargaining agent for the bargaining unit as desribed in Setion 1.02 having the right to represent exlusively the members of the bargaining unit and the right to unhallenged and exlusive representation during the term of this Contrat BARGAINING UNIT The term "professional staff member" of the employee bargaining unit overed by this Contrat is defined as all ertifiated personnel employed exluding: the Superintendent of Shools, all assistant superintendent(s), prinipals, assistant prinipal(s), Coordinator of Speial Servies, athleti diretor, substitutes, aides, hourly paid tutors, auxiliary personnel, and all others for whom ertifiation in supervision or administration is required as a ondition of employment MANAGEMENT RIGHTS AND SCOPE OF BARGAINING All matters pertaining to wages, hours, or terms and other onditions of employment and the ontinuation, modifiation, or deletion of an existing provision of this Contrat are subjet to olletive bargaining between the Reading Community City Shool Distrit Board of Eduation, hereinafter referred to as the "Board", and the Reading Eduation Assoiation, hereinafter referred to as the "Assoiation" Exept as modified by a speifi and express term of this written Contrat, the Board hereby retains and reserves to itself and the Superintendent all the powers, rights, authority and duties vested in them by laws of Ohio and the United States, inluding but not limited to: A. Determine matters of inherent managerial poliy whih inlude but are not limited to areas of disretion or poliy suh as the funtions and programs of the Board, standards of servies, its overall budget, utilization of tehnology, and organization struture; 8. Diret, supervise, evaluate or hire employees; C. Maintain and improve the effiieny and effetiveness of the Board's operations; D. Determine the overall methods, proesses, means or personnel by whih the Board's operations are to be onduted;

Lay off, transfer, assign, shedule, promote or retain members; G. Determine the overall mission of the shool distrit; H. Effetively manage the work fore; and I. Take ations to arry out the mission of the Board The Board is not required to bargain on subjets reserved to the rnanage!ment and diretion of the Distrit exept as affet wages, hours, terms and onditions of employment of members (that is, the Board need not bargain about deisions in the exerise of its management rights but has a duty to bargain about the effet(s) of suh deisions on the wages, hours, terms and other onditions of employment of member(s), and the ontinuation, modifiation or deletion of an existing provision of this Contrat NEGOTIATIONS PROCEDURE General Provision The parties agree that Chapter 4117 of the Ohio Revised Code (ORC) shall govern the proedures of bargaining between the Board and the Assoiation Direting Requests A. All requests for negotiation meetings shall be made in writing.. Requests initiated by the Assoiation shall be direted to the Superintendent, ating as the representative of the Board. Requests initiated by the Board shall be direted from the Superintendent to the Assoiation President. The written request for professional negotiations shall inlude: 1. Date of writing. 2. Statement of purpose for meeting. 3. Name, address and phone number of the person to ontat representing the requesting party to arrange a mutually satisfatory time for the initial negotiations meeting. 4. Three (3) proposed meeting dates. B. A written reply shall be sent by the reeiving party within ten (10) days to the offiial representative of the requesting party. This ommunique shalf inlude: 1. Date of writing. 2. Reognition of request for a professional negotiations meeting. 2
6 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION EFFECTIVE SEPTEMBER 1..?Q10 THROUGH AUGUST 31, Time, plae and date of a mutually agreeable initial negotiations session. 4. Aeptability of proposed dates Negotiations Meeting Period A. The first negotiation session shall be held within fifteen ( 15) days of the date listed on the initial request for negotiations, but no later than Marh 15, unless mutually agreed upon in writing by both parties. B. At the first negotiation session, the first item of business will be to exhange a list of items to be negotiated, with detailed explanation and the ost impat, when the ost an be determined. One the agenda is approved by both negotiation teams, no new matters shall be introdued for onsideration during the ourse of this negotiation meeting without mutual onsent of both teams. C. A mutually agreeable time for the next meeting shall then be established. This time limit shall not exeed two (2) weeks, unless mutually agreed upon by both parties. D. Assoiation team members shall be released, when neessary, from their normal shool duties to attend negotiation sessions without loss of pay, with no reprisal or punitive ation. E. Negotiation meetings shall be in exeutive session. F. During the ourse of negotiations, items agreed to shall be redued in writing and initialed by representatives of eah negotiation team, and set aside. G. Eah negotiation team shall have no more than five (5) members. The Assoiation may have one (1) member as an observer. H. Eah negotiation team may use onsultants as they feel essential in the ourse of negotiations. I. No other person or person(s) shall be present during the negotiations meeting, unless mutually agreed upon by members of both negotiation teams. J. Either team may delare a reess when it appears that meaningful progress annot be attained. A reess an only ommene after mutual agreement for the time and plae for the ontinuation of the negotiations has been determined and item agreement (Setion herein) has been followed. A reess shall be for no more than seventy-two (72) hours, unless extended by mutual onsent. 3
7 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION AS SOCIA T!ON K. Either team may all for a auus at any time. A auus shall not be for longer than thirty (30) minutes, unless an extension is mutually agreeable by both teams. L. The negotiation period shall be for a length of time not to exeed forty-five ( 45) days. All sessions are to be ompleted within this time period, unless extended by mutual agreement. M. Prior to and during the period of the negotiation sessions, the Board and the Assoiation agree to provide to the other upon written request, and in a reasonable time period, available information onerning finanial resoures of the distrit and suh other information as will assist the respetive negotiation teams in developing intelligent, aeurate< and onstrutive programs that will be in the best interest of all parties onerned with a quality eduational program. N. Members of the respetive negotiation teams have the power and authority to negotiate, that is to make proposals, onsider proposals, and rnake onession(s) in the ourse of disussion. 0. All sessions of the negotiation meetings shall be in good faith. P. While negotiations are in progress, news releases shall be made' only with the mutual agreement of the negotiation teams. Said releases shall be in writ"1ng and eah team shall have a opy of the statement prior to release. Q. Progress reports may be made to the represented bodies by <3ither negotiation team at the disretion of the teams. R. During the ourse of the negotiation session or at any time during the length of this Contrat, ad ho study ommittees (e.g. Supplemental Duty Salary Shedule) may be reated by mutual onsent of the Boa rei and Assoiation respetively. Members of these study ommittees will be determined by the Board and Assoiation. The purpose and part1iular assignment shall be stated at the time these ommittees are reated as well as the time for a report of findings. Findings/reommendations are not binding unless/until they have been offiially aepted and approved by their respetive parties Agreement A. When agreement is reahed on the items being negotiated, a final written opy shall first be submitted to the Assoiation and ratified and then to the Board at its next regular or speial Board meeting. The final written opy will ontain the following: 1. Terms of the provision. 2. Effetive date of the provision. 4
8 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIA TJON AND READING COMMUNITY CITY SCHOOL DISTRICT BOARD OF EDUCA TJON EFFECTIVE SEPTEMBER THROUGH AUGUST Impasse B. When approved by both parties, it shall be signed by their respetive presidents. Thereupon, the items agreed to shall onstitute the legal binding ontrat between the parties. C. Offiial opies of the Contrat shall be reprodued and distributed to all members by the Assoiation. The ost of reproduing the negotiated Contrat shall be shared equally by the Assoiation and the Board. A. The parties pledge themselves to negotiate in good faith and, in the event agreement is not reahed, to utilize in good faith suh mediatory failities as are available. In the event that tentative agreement annot be obtained by both parties on all items being negotiated within forty-five ( 45) alendar days after the first negotiation session, either party may delare to the other in writing that an impasse exists. B. The party delaring impasse shall request the Federal Mediation and Coniliation Servie to appoint a mediator, and the seletion shall be in aordane with the rules of the Federal Mediation and Coniliation Servie. C. The mediator shall meet with both parties forthwith, either jointly or separately, and shall take steps as he/she may deem appropriate to persuade the parties to resolve their differenes and effet a mutually aeptable agreement. D. If mediation fails to resolve the impasse within fourteen ( 14) alendar days. The parties may mutually agree to extend the Contrat and ontinue to negotiate. E. If mediation has been ompleted and the parties do not mutually agree to extend the Contrat, the Assoiation and the Board then has the right to exerise its rights as outlined in ORC ASSOCIATION RIGHTS Exlusive reognition shall entitle the Assoiation to these rights exlusively: Use of all building staff bulletin boards for staff information Payroll dedution of membership dues Announements at faulty meetings at a time agreed to by the prinipal or Superintendent Use of publi address system for Assoiation announements, with approval of the supervising prinipal. 5
9 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION AND READING COMMUNITY CITY SCHOOL DISTRICT BOARD OF EDUCA T/ON Distribution of faulty bulletins to members aording to normal shool proedure with a opy to the prinipal at the time of distribution Shool Board Meetings: The Assoiation shall be provided all agendas, appendies, and minutes no later than the time said material is provided to the Board. A representative of the Assoiation shall be permitted to addres.s the Board during Board meetings at a time designated by the Board Attendane at the OEA Delegate Assemblies by the duly el eted representatives of the Assoiation, with substitutes paid by the Board. The number of representatives shall be determined by the OEA formula. The Assoiation shall be granted twelve (12) Assoiation days per year whih may be used for attendane at the OEA Delegate Assemblies or for other Assoiation business The Assoiation may all meetings of the Assoiation members in any of the Distrit's buildings. Said meetings shall be held outside of th<l members' workday. Prior to sheduling or alling any suh meeting, the Assoiation shall advise the building prinipal of the meeting. No Assoiation meeting may be sheduled during the workday, in onflit with other previously sheduled meetings, or at any time when the meeting will disrupt the regular work a:tivity of any member to be in attendane at the meeting without the prior approval of the building prinipal Suh approval shall not be unreasonably denied Upon the request of the Assoiation President, the Board will provide the names and addresses of newly employed staff members The Assoiation President shall be permitted to address all members at the first general meeting at a time designated by the Superintendent The Assoiation shall be granted the right to use shool equipment designated for the members, provided that suh use does not onflit with Distrit business. All onsumable materials used with the equipment shall be provided by the Assoiation Eah member shall have the right to Assoiation representation during any meeting whih will or may lead to disiplinary ation by the Board or an administrator. The member shall reeive reasonable notie of the meeting in order that Assoiation representation may be obtained. Should disiplinary ation be likely to our at a given meeting, the member shall be advised immediately of said possibility and be advised by the Board of the right to representation under this provision of the negotiated Contrat 6
10 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION 1.06 PROVISIONS CONTRARY TO LAW/SUPERSEDES If any provision of this doument shall be found ontrary to law, then suh provision or appliation shall be deemed invalid, exept to the extent permitted by law, but all other provisions or appliations shall ontinue in full fore and effet. In the event of any suh holding, both parties shall meet not more than thirty (30) days after suh holding for the purpose of renegotiating the provision(s) affeted Consistent with Ohio Revised Code Chapter 4117, this agreement shall supersede and replae, in its entirety, any and all provisions of Ohio law whih are in onflit or inonsistent with any provisions of this agreement AMENDMENT PROCEDURE If either party desires to amend the proedures stipulated in this Contrat, that proposal shall be submitted to the other party in aordane with the proedures stated in this Contrat. Neither party is required to agree to amend the Contrat GENERAL PROVISIONS -Individual & Organization Rights Fair Pratie Clause: The Assoiation agrees to admit persons to membership without disrimination on the basis of rae, reed, olor, national origin, sex, age, marital status, or handiap The Assoiation shall admit to membership all members of the bargaining unit in aordane with the Constitution and Bylaws of the Reading Eduation Assoiation No reprisal of any kind shall be taken by or against any partiipant in negotiations with the administration or the Board by reason of suh ativity DEFINITIONS Bargaining Unit: All ertifiated/liensed personnel employed by the Board whether on leave, on per diem basis, employed, or to be employed, exluding the Superintendent of Shools, all assistant superintendent(s), prinipals. assistant prinipal(s), athleti diretor, substitutes, aides, hourly paid tutors, auxiliary personnel, Coordinator of Speial Servies and all others for whom ertifiation/liensure in supervision or administration is required as a ondition of employment Member: All professional staff members as defined in Setion 1.02 represented by the Assoiation. 7
11 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION Sole and Exlusive Agent: The Assoiation, granted suh status, shall be reognized by the Board as the offiial voie of all members of the instrutional staff. The exlusive representative shall further represent members of the bargaining unit regardless of their rae, olor, reed, national origin, sex, age, marital status, or handiap Negotiations: To onfer, disuss, propose, onsider, make onessions and ounterproposals, in good faith, in an effort to reah mutual a9reement on items under onsideration. Suh negotiations shall be onduted by representatives of the Board and the Assoiation with authority to negotiate in good faith Negotiation Meeting Period: That period of time from the first negotiation session until agreement has been reahed, or the time fator of forty-five (45) days. The period of time when negotiations are reognized to be taking plae Negotiation Session: The atual onferring of the representatives of the Board and the Assoiation Negotiation Team: The body of offiial representatives of the Board or the Assoiation Exeutive Session: A meeting with admittane to be limited to the disretron of the partiipants alling the meeting or the provisions of suh a session as provided in this negotiations proedure Consultants: Advisors to the negotiations teams. Individuals due to speial training, experiene, and talents have abilities to assist in larifying points under onsideration and to assist in resolving misunderstandings Reess: The period of time between negotiation sessions one the negotiation session has ommened. A negotiation session shall not be reessed for a period longer than seventy-two (72) hours, unless mutually agreed by both negotiation teams Cauus: A limited break in the negotiation session of not more than thirty (30) minutes, unless mutually extended Good Faith: The willingness to onsider, propose, make oness,ons and ounterproposals in an effort to reah a mutually agreed position. Good faith requires the partiipants in the negotiations to provide explanations for proposals and ounterproposals. Good faith does not mean that e ither negotiations team is given authority to make final ommitment for the Board or the Assoiation News Release: A report on the status of negotiations, given diretly to publi news media personnel; i.e., the newspaper, radio or television news bureaus Progress Report: Reports made to the Board or Assoiation while negotiations are in proess. 8
12 NEGOT/A TED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION Ad Ho Study Committee (joint study ommittee): A group given a speifi assignment to develop a more meaningful understanding of a given area to assist the negotiation teams in oming to a mutual agreement. The responsibility of suh study ommittees shall be determined by the negotiation teams at the time that the study ommittee is organized. Information reported by the study ommittee shall be advisory only and not a diretion or in any way impose a reommendation or ompliane to the members of the negotiation teams Mediation: An assistive proess and proedure that attempts to help the parties to reognize their differenes and similarities under the rules and regulations of the Federal Mediation and Coniliation Servie Impasse: Disagreement, a deadlok on a given item being negotiated. Impasse is reahed when no further hange of positions by the members of the negotiation teams is taking plae and agreement is not reahed within the speified time limit Writing Disposition: The findings and reommendations of parties used to resolve an impasse situation. Suh a disposition is an advisory notie and should be given the greatest onsideration by both the Board and the Assoiation in an effort to obtain agreement Memorandum of Understanding: An agreement reahed by the parties, during the life of the Contrat, whih adds, deletes or modifies existing language and is agreed to and signed by both the Assoiation and the Board. 9
13 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIA T/ON ARTICLE II: SALARY & FRINGE BENEFITS 2.01 HORIZONTAL PLACEMENT/ADVANCEMENT ON SALARY SCHEDULE Salary inreases for additional semester hours (or quarter hours onverted to semester hours utilizing the formula outlined in Setion ) shall be l,imited to the start of the shool year as follows: A. The offiial transript indiating the ompletion of the ourses must be reeived by the Board by September 15. B. Letters from lass instrutor(s) indiating ompletion of the ourses shall be aeptable provided the offiial transript is reeived by the Bos1rd by November 1. C. Graduate level ourse-work only and only ourse-work after the degree in question has been earned will be aepted for horizontal movement on the salary shedule with the following exeptions: 1. Superintendent-requested ourse-work whih is neessary for a member to obtain distrit-requested ertifiation, endorsement, or liensure may be undergraduate level ourse-work, if this is the only ourse-work readily available. Doumentation, signed by the superintendent and member, shall be maintained in member's file and the Treasurer's offie and shall inlude superintendent's signed written request and member's signed written aeptane (priior to taking ourse-work). An offiial transript shall also be~ filed upon suessful ompletion of ourse-work. 2. Other possible exeptions whih may arise whih ould possibly justify horizontal movement on the salary shedule may be petitioned by the member to the superintendent. If approved, the same doumentation requirements in "C. 1" above also apply (i.e. member's written request and superintendent's written approval prior to ourse-work, and offiial transript following sue,ssful ompletion of ourse-work) Upon reeipt of the offiial transript(s)/letter(s), the member will bel plaed on the appropriate training olumn of the salary shedule retroative to the beginning of said shool year All redit to be aepted for horizontal advanement on the salary shedule must meet the riteria identified in "A" below; and, any one of "B" through "E" below. 10
14 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION EFFECTIVE SEPTEMBER 1, 2010 THROUGH AUGUST A. Credit beyond the BA olumn must be graduate level ourse-work, exept as noted in (C) above, taken at a reognized ollege. The term "reognized ollege" is defined as any institution from whih redit is aepted for ertifiation/liensure by the Ohio Department of Eduation, Division of Eduation and Certifiation; and, B. Course work must be in the area of professional eduation as defined in the regulations for teaher ertifiation/liensure in Ohio; or, C. Course work is in the area of ertifiation/liensure for whih the person is presently ertified; or, D. Course work is in an area of ertifiation/liensure for whih the person is pursuing a planned program toward additional ertifiation (the planned program must be verified by the ollege or university advisor); or, E. Course work has been approved in advane by the Superintendent as being pertinent to the member's plaement on the salary shedule To onvert quarter hours to semester hours, multiply the number of quarter hours by two-thirds (2/3). Numbers are not to be rounded up to the nearest whole number. (Example: 44 quarter hours onverted to semester hours would yield 29.3 semester hours.) 11

This is ontingent upon the approval and limits of the arrier Members (inluding retirees) who terminate employment after ompletion of a shool year will ontinue to reeive the board-provided portion of life insurane through August 31 of that year. Any additional insurane (purhased per ) will also ontinue through August 31. Eah of these provisions is ontingent upon arrier approval Upon retirement, members may be able to onvert to other life insurane plans. Interested members should ontat the urrent arrier to inquire about this possibility. Disability Insurane The Board shall purhase from a arrier liensed by the State of Ohio and seleted by the Greater Cininnati Insurane Consortium, hereinafter referred to as "GCIC", disability insurane for eah member now or hereafter employed who have five (5) years or less of servie redit in the State Teahers Retirement System of Ohio (STRS). One member obtains five (5) years of servie overage with STRS, the disability insurane overage purhased through GCIC will terminate and member will be eligible for disability benefits through STRS. The Board shall pay one hundred perent (1 00%) of the total premium ost of this insurane. The disability insurane overage shall be provided by the Board as long as the overage is offered by GCIC. 21
25 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION AND READING COMMUNITY CITY SCHOOL DISTRICT BOARD OF EDUCA T/ON 2.08 COPIES OF INSURANCE AGREEMENTS Upon request, the Assoiation President shall be provided a opy of the omplete agreements, inluding omplete speifiations for ove1 ages, between the Board of Eduation and Health, Dental, Liability and Life Insurane arriers Copies of said agreements will be provided to the Assoiation upon request within fifteen ( 15) days after the Board reeives any new agreements or hange in an agreement The provision of said agreements shall be in addition to explanatory bociklets, pamphlets, et., provided to the individual ertified employee SALARY/BENEFITS FOR PART-TIME EMPLOYEES Salary Salary for part-time members shall be determined by utilizing a formula whih onsiders atual instrutional time (in minutes) with additional minutes awarded for preparation and onferene, lunh, other non-instrutional time, et. The formula reates a "ratio" between time awarded and instrutional time. The formula allows for Jr./Sr. High Shool personnel to be hired for a speifi number of periods per day or for elementary personnel to be hired for a speifi number of minutes per day. The formula is derived by utilizing the Jr./Sr. High Shool's seven period d;ay as the basis for determining the ratio. For the purpose of this formula, a "pe!riod" is fifty-two (52) minutes in length and shall onstitute 117 of a full work day (as set forth in Setion 4.08 herein whih is 7 hours, 40 minutes or 460 minutes per day), whih equals minutes of "awarded time." 27 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION 2.10 MILEAGE REIMBURSEMENT The Board shall reimburse members at the rates allowed by the Internal Revenue Servie for any approved aumulated mileage aerued in the performane of their professional duties (regular and/or supplemental) Any mileage aumulated by the member on behalf of the athleti depariment must reeive the prior approval of the athleti diretor and shall be paid to the member out of the Athleti Fund SEVERANCE PAY The Board, pursuant to ORC Setion , shall pay any memberr who elets to retire from teahing the total per diem rate for one-fourth (1/4) of eah aumulated day of sik leave aredited to that member's aount. If a member meets or exeeds two hundred seventy-two (272) days of aumulated sik leave when he/she elets to retire, that member will r <eive seventy-four (74) days Payment, based upon the member's per diem pay at the time of offiial retirement notie to the Board, shall be issued as soon as possible after, but no later than one month following, presentation to the Treasurer of a opy of member's first STRS retirement hek or bank wire notie Per diem rate is defined as: the rate of pay on the member's reglrlar teahing ontrat If a member of the bargaining unit dies while employed by the Board, and at the time of death was eligible to retire and eligible to reeive retirement benefits from STRS or if the member has been employed by the Board for twenty (20) years or more, then in that event, the estate of the deeased employee shall be paid severane pay, in aordane with the severane pay provisions of the Contrat REIMBURSEMENT FOR COLLEGE CREDIT An annual fixed budget of eighteen thousand dollars ($18,000) shall be available for reimbursement for tuition ost inurred by teahers for olrrses ompleted at an aredited university or ollege. All ourses submitte<j for reimbursement must be approved in writing by the Superintendent or Superintendent's designee prior to attending the first day of the ourse or the employee will not be reimbursed The ourse work taken must be in one of the following areas: teaher's field of ertifiation/liensure; and work to maintain/upgrade the teaher's ertifiation/liensure; in the field of tehnology; and work approved by the Loal Professional Development Committee; and other work to be approve1d in advane by the Superintendent. 24
28 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION -~~~-~~--'=E'-'FF CTIVE SEPTEMBER THROUGH AUGUST 31, The amount of reimbursement shall be prorated and determined by the number of teahers partiipating and the amount of ourse work ompleted during the time period of September 1 through August 31 of eah year. The maximum reimbursement any single teaher may reeive pursuant to this provision is one thousand five hundred dollars ($1,500) Payment shall be issued by the Treasurer's offie on September 15. The teaher is required to provide a opy of the grade report and offiial reeipt from the ollege or aneled hek and must present proof of earned redit (Grade B or better and pass in a pass/fail ourse) by September 1 in order to reeive payment. Suh proof of the grade report and the reeipt from the ollege shall be presented with the form as provided in the appendix of this Agreement approved by the Superintendent who shall authorize payment Tuition reimbursement shall be available to teahers who have ompleted one or more years of teahing experiene with the Board. Teaher must be employed by Reading at the time of reimbursement STRS TAX SHELTER PICK-UP Pursuant to Rulings and of the Internal Revenue Servie and Opinion of the Ohio Attorney General and as restrited by the State Teahers Retirement System (STRS) and the rules of the Board, the ontribution of the member shall be designated as paid by the Board The total annual salary and salary per pay period for eah member shall be the salary otherwise payable under this negotiated Contrat. The total annual salary and salary per pay period of eah member shall be payable by the Board in two (2) parts: (1) Deferred Salary, and (2) Cash Salary. A. Deferred Salary: A member's deferred salary shall be equal to that perentage of said member's annual salary or salary per pay period that is paid to the STRS by the member. This deferred salary shall be paid by the Board to the STRS on behalf of the member as a "pik-up" of the STRS Employee Contribution. B. Cash Salary: A member's ash salary shall be equal to the member's total annual salary or salary per pay period less the amount of the pik-up for the member and shall be payable, subjet to appliable payroll dedutions, to the member No member's total earnings shall be inreased by appliation of this plan nor shall the expenditures of the Board for the member's total annual salary be inreased by appliation of this plan. This provision shall apply uniformly to all members when this plan is implemented The Board shall ompute and remit its employer ontribution to STRS based upon the total annual salary and the salary per pay period, inluding the deferred salary or "pik-up". 25
29 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCA T!ON ASSOCIATION A. The Board shall report for federal and state inome tax purposes as a member's gross inome the member's total annual salary les1s the amount of the deferred salary or "pik-up" for the indiated tax year. B. The Board shall report for muniipal inome tax purposes as a member's gross inome the member's total annual inome, inluding the amount of the deferred salary or "pik-up". C. The Board shall ompute tax withholding based upon gross inome as reported to the respetive authorities The Board agrees to inlude in the member's total annual salary the deferred salary (pik-up) for the purpose of omputing daily rate of pay foi' severane, for determining paid salary and adjustments to be made due to absene, or for any other similar purpose. The deferred salary (pik-up) shall be inluded in the base salary for the purpose of determining supplemental duty salaries RETIREMENT INCENTIVE The Board of Eduation shall provide a retirement inentive payment to any member of the bargaining unit who retires through STRS during the term of this Contrat und~~r the following onditions: Retirement eligibility shall our for one (1) year periods during the term of this Contrat beginning September 1 and ending August 31 of eah year of the Contrat The member must attain thirty (30) years of STRS redited servie durin~! said one (1) year period The member must retire effetive at the ompletion of the shool y aar in whih thirty (30) years of STRS eligibility is attained. Failure to exerise this right shall result in that member's forfeiture of his/her right to a retirement ine,ntive as set forth herein The member must give the Board of Eduation written notie of his/her intention to retire on or before April 1 of the year in whih the member shall attain thirty (30) years of STRS servie eligibility A. Upon reahing thirty (30) years of servie and no later than the end of shool year employee reahes thirty (30) years of servie, teaher must retire. B. Severane shall be at sixty perent (60%) of a maximum of three hundred (300) sik days paid out at one-third (1/3) of the amount on September 1 of the year of retirement, one-third (113) at January 1 of the following year, and one-third (1/3) at January 1 of the next year. 26

Said ompensation shall be paid no later than fifteen (15) days after separation of employment A teaher retiring at the ompletion of the first semester must submit his/her written letter of resignation to the Superintendent no later than June 15 prior to the shool year the teaher retires A teaher retiring at the ompletion of the seond semester must submit his/her written letter of resignation to the Superintendent no later than January 15 of the shool year the teaher retires SECTION 125 PLAN Employees will be able to partiipate in a flexible benefit plan provided by the Board operating within the guidelines of the Internal Revenue Servie Code Setion 125. Tax free reimbursement for qualified expenses related to (1) employee premiums for medial and dental insurane, (2) dependent hildare and (3) non-reimbursed out-of-poket medial and health are expenses should be inluded in the plan The Board shall retain the servies of a third party administrator to oversee and administer the plan The Board shall establish information sessions for employees during the annual enrollment period. The third party administrator will then shedule individual information sessions with interested employees. The plan will begin as soon as the information and sign-up sessions have been ompleted This plan will be available to employees so long as it is made available by the Internal Revenue Servie or until suh time as it is negotiated to be removed from this Agreement This plan shall be made available to additional employee partiipation during the annual enrollment period. 27
31 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION AND READING COMMUNITY CITY SCHOOL DISTRICT BOARD OF EDUCA T/ON ARTICLE Ill: LEAVES 3.01 SICK LEAVE Eah member, with the approval of the Superintendent, shall be granted sik leave with pay for eah ompleted month of servie at a rate of one and onefourth (1.25) days per month. Members who have not attained maximum allowable sik leave aumulation as listed in Setion 2.11 and terminate employment after ompletion of a shool year will ontinue to aumulate sik leave at the above rate through August of that year for up to a maximum of fifteen (15) days for any shool year. Retirees will be awarded two and onehalf (2.5) additional days (for July and August) with their Jun ;J sik leave awarded Members may use sik leave for absene due to the following reasons: A. Personal Illness B. Personal injury, pregnany related illness C. Exposure to ontagious disease whih ould be ommuniated to other employees or students. D. Illness, injury or death of immediate family defined as: spouse, m-other, father, son(s), daughter(s), grandparents, or other person(s) living under the member's roof. Sik leave may be used for siblings and in-laws in ases of serious and/or atastrophi illnesses. (If onferenes are made up [on member's own time outside the regular shool day and at times doumented and mutually agreed upon by the member and building prinipal], then the member shall only be harged for one [1] day.) 3.02 PERSONAL BUSINESS LEAVE Number of Days and Types Eah member, with the approval of the Superintendent, may be granted personal leave. This leave shall not be deduted from the member's sik leave. There will be a total of three (3) personal leave days per year per member. These days shall be unrestrited. Personal days whih are not used during the year will be rolled into the member's sik leave Building Daily Limitations No more than ten perent (10%) of the staff at eah elementary building, ten perent (10%) of the staff at the middle shool, and ten perent (10%) of the staff at the high shool may use personal leave on any given day. Members assigned to more than one building and/or part-time members shall be exluded from this formula. Personal leave will not be granted for less than one-half (.50) day End of the Year Members who are parents of hildren attending shool may wish to attend their hild's end of the year reognition programs or other similar type ativities during the end of the shool year. The Board reognizes and supports this desire, but prefers personal leave not be used for this purpose; rather, it is suggested that members make arrangements with fellow members to over assignments during these absenes so long as arrangements are approved by the building prinipal. Members who over for other members must do so with the understanding that it is without ompensation or redit as outlined in Artile IV, Setion or Proedures to be Followed for Approval of Personal Leave A. Exept in ases of emergeny, a written HR kiosk request must be submitted to the supervising prinipal at least one (1) week in advane. B. The member shall be notified by the supervising prinipal in a timely manner. C. If request is denied, the member may request review by the Superintendent or designee. If leave is of an emergeny nature, an advane request is waived; however, a personal leave request form must 29

D. Request and approval of personal leave days shall be approved on a first ome basis. Approval of teaher's request for personal leave usage annot be withdrawn one granted unless emergeny or mitigating irumstanes exist Teaher may not request usage of pe rsonal leave more than one (1) week prior to the ommenement of any shool' year. Personal leave shall not be taken on the following days, exept as provided below: 1. Days in whih a regularly-sheduled Distrit meeting, inservie or parent-teaher onferene or professional development is sheodule. 2. The day immediately following or preeding a holiday or vaation, on the first or last day of the shool year, or days in whih a state mandated ahievement test is sheduled. 3. Prior to the seond Monday in September and during the first and last ten ( 1 0) instrutional days of the shool year. E. Personal leave may be disallowed by the building prinipal if it would unduly interrupt or hamper the funtioning of the instrutional proess. Exeptions may be approved solely by the Superintendent or designee upon request 3.03 ASSAULT LEAVE In order to qualify for assault leave with pay whih shall not be harged a~1ainst sik leave or against other leave under ORC Setion , t11e following guidelines shall be observed: A. Inident resulting in the absene due to the physial disability of the member to perform the duties for whih he/she has been employed must have arisen out of a situation determined to have been within the sope of the employment with the Board. B. The determination as to whether or not the physial disability 11s the result of an assault whih ourred in the ourse of Board employm<3nt shall be made by the responsible administrative offier or his/her designee. However, the member must seure from a person liensed to pratie mediine in the state in whih he/she has an established pratie, ertified data as to the injury sustained in any assault laimed as a basis for assault leave. It is preferable that the member's own personal medial pratitioner make this determination. 30
34 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCA TJON ASSOCIATION -~~~-----'=E'-'-FFECTIVE SEPTEMBER THROUGH AUGUST If the preeding determinations are established to have been a physial disability resulting from an assault whih ourred in the ourse of Board employment, the period of time the member will be maintained on a full pay status during the period of suh absene shall be for a maximum of thirty (30) days and shall not be aumulative The return of any member from authorized assault leave shall be prediated on the establishment by the member of his/her fitness to return to duty following the same method assault leave was authorized in the first instane; i.e., namely a determination by the responsible administrative offier or his/her designee based on the member's ertifiate from a person liensed to pratie mediine that the member who previously had been adjudged to have a physial disability that prevented his/her from performing his/her normal duties, may now return to duties similar to those performed prior to going on assault leave All earnings paid to a member under authorized assault leave shall be in lieu of lost time benefits payable under Workers Compensation Insurane; provided, however, that nothing herein preluded the member from applying for hospital and medial benefits under Workers Compensation Insurane PROFESSIONAL GROWTH LEAVE Professional Growth Leave will be overed in aordane with Ohio Revised Code if and when appliable CHILD CARE LEAVE Upon the written request of a member, the Board shall grant hild are leave without pay. Suh leave shall not exeed two (2) onseutive semesters. Under extremely unusual irumstanes, up to two (2) additional onseutive semesters may be granted by the Superintendent. Unless speifially approved by the Superintendent, request for hild are leave is to our within three (3) years of the birth of a member's hild. A. The member's written request for hild are leave must inlude starting and termination dates, and must be submitted at least thirty (30) alendar days prior to the effetive date of suh leave. B. A member not ompleting one hundred and twenty ( 120) atual work days or more during the shool year due to taking hild are leave will not reeive a year of servie for salary step inrease purposes. Sik and other fully paid leave days are ounted as atual work days. C. A member granted a hild are leave shall be returned to the member's original position if the leave is for one (1) semester or less, provided that the member is still under ontrat with the shool distrit. If the hild is five (5) years old or more, the leave shall not exeed one (1) shool semester A member granted an adoption leave shall be returned to his/her o1 iginal position if the leave is for one (1) semester or less, provided that the member is still under ontrat with the distrit. Forms an be obtained from the building seretary. B. Upon approval, the building prinipal shall forward the request to the Superintendent/designee. C. After the request has been reviewed, the member will be notified of approval or denial Possible reasons for granting professional leave: A. To attend professional workshops, onferenes, onventions, and/or seminars. B. To attend, with the prinipal's approval, meetings with individuals. businesses, et., that diretly relate to the member's work ativities. C. For visiting other shools to view exemplary programs. D. To attend meetings of professional organizations Upon returning from the onferene or onvention, the member should submit immediately a resume of the expenses inurred while attending. Reeipted bills must be submitted. He/she should understand that if he/she is traveling by automobile, he/she will be reimbursed at the rate set forth in Setion 2.10 (Mileage Reimbursement) herein Finally, the member should submit to his/her building prinipal, as soon as possible, a written report outlining the subjet of the onvention, and any possible appliation of the knowledge he/she gained to this/her own employment situation or to the Reading Community City Shools in general JURY DUTY/COURT APPEARANCE Eah member who reports for, and/or who serves on, a jury(ies) on a member workday shall reeive his/her full salary while serving on jury duty and shall retain jury duty fees paid to his/her for serving on a jury Any member who is subpoenaed to an administrative hearing and/or ourt involving a matter arising out of the performane of his/her ontratual duties when the Assoiation or the member is not a party to the proeeding shall reeive no Joss in salary while responding to said subpoena and, additionally, shall retain as his/her own any witness fees paid to his/her for responding to said subpoena. 33
37 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION ARTICLE IV: GENERAL WORKING CONDITIONS 4.01 CONTRACTS All members employed by the Board shall be issued written ontrats in aordane with the Ohio Revised Code Suh ontrats shall inlude the following information: A. Name of member. B. Name of shool distrit and board of eduation employing said member. C. Type of ontrat, limited or ontinuing. If limited, the number of years ontrat is to be in effet. D. Annual ompensation to be paid for the f1rst year of the ontrat. E. Basis of determining ompensation (i.e., lassroom teaher, B.A. dogree, 5 years experiene). F. Number of pay days. G. A provision setting forth the beginning date of the ontrat and the length in years of the ontrat, speifially: "An agreement entered into between the BOARD OF EDUCATIOIN OF THE READING CITY SCHOOL DISTRICT, HAMIL TON COUNTY, OHIO, and as a teaher beginning _, and ontinuing in full fore and effet for a period of year(s) or until within said period the said teaher resigns, elets to retire, or is retired pursuant to the Revised Code of Ohio or until this ontrat is terminated or suspended as provided by law and/or Board poliy." H. The ontrat shall inlude provisions for the signatures of the Board President, the Board Treasurer, the member, and date of signing by the member Continuing Contrat Eligibility Not later than Otober 1 of eah year, the Superintendent or his/her desi9nee shall notify the staff in writing of the qualifiations and requirements neessary for ontinuing ontrat status. If a teaher provides written notie of eligibility of ontinuing ontrat to the administration/superintendent after Otot>er 15, said teaher shall be required to sign a statement waiving Artile V, SE!Ction 5.01, Subsetion (C)(1) of this Contrat. Teaher shall be aligible for ontinuing ontrat nor be deemed employed on a ontinuing eontrat by operation of law unless the teaher, no later than Otober 31, files with the Superintendent or his/her designee, a Jetter of intent that they will m~let all legal 34

Suh one ( 1) year limited ontrat shall be onsidered an extended limited ontrat in aordane with the provisions of ORC Grades and transripts proving eligibility for ontinuing ontrat status must be reeived by the Superintendent or his/her designee prior to April 15. All provisions of this Setion shall supersede and replae ORC , , and where appliable SUPPLEMENTAL CONTRACTS All members assigned additional responsibilities and granted additional ompensation for suh responsibilities shall be given a written ontrat that is in addition to their regular ontrat, in keeping with the Ohio Revised Code. Job desriptions shall be issued at the time of appliation Suh supplemental ontrat shall inlude the following information: A. Name of said member. B. Name of the shool distrit and board of eduation for whih responsibilities shall be performed. C. Year ontrat is to be in fore. D. The total ompensation for the supplemental ontrat. E. Job title Separate ontrats will be provided for eah additional duty The ontrat must be signed and returned by the member within ten ( 1 0) days after reeipt, otherwise the offer of the ontrat may be withdrawn by the Board Compensation shall be paid in two (2) equal payments: one midway through the duty, and one at the onlusion of the duty The Board shall purhase motor vehile insurane in aordane with ORC Setion Positions may be split upon the reommendation of the Superintendent and approved by the Board. 35
39 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION 4.03 PAY PERIODS & PAYDAYS The salary of a member shall begin at the time he/she reports for duty Members will be paid bi-weekly in twenty-six (26) equal installments over a twelve (12) month period. However, it may be neessary to have one threeweek pay period approximately one every seven years to avoid hav'tng twentyseven payrolls within the same fisal year The final payment hek will be issued only after a member has finished his/her regularly assigned duties to the satisfation of his/her supervisor Employees' salaries shall be paid by eletroni funds transfer (diret deposit) POSITION ASSIGNMENTS AND TRANSFERS The Superintendent shall, in aordane with ORC and this Contrat, make position assignments and transfers in the Reading Community City Shool Distrit. The emphasis in making suh assignments will be plaed upon building and/or distrit need and proper ertifiation Prior to the end of the shool year, eah prinipal or designee will meet with eah member of his/her staff to disuss proposed assignments for the next shool year If during the ourse of the summer, the proposed assignment or transfer of a member hanges, said member will be notified as soon as it is known, but not later than August 20. If notified after f-ugust 20, a substitute or aide will be provided, if requested, to assist member for up to two (2) days at the beginning of the shool year Prior to the beginning of the next shool year, members will be sent a notie of their assignment If requested by the member, a onferene shall be held with the Superintendent and/or his/her designee to disuss the reason(s) for a hange in assignment TRANSFERS MEMBER PREFERENCE Eah member being transferred will be made aware of potential openings available in the distrit for whih he/she has proper ertifiation and may express his/her preferene Voluntary transfers will be made whenever the speifi needs of the partiular situation an be met. 36
40 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION AND READING COMMUNITY CITY SCHOOL DISTRICT SOARD OF EDUCATION ~-~~-~_.E,_F:..FE,CTIVE SEPTEMBER THROUGH AUGUST VACANCIES (REGULAR AND SUPPLEMENTAL) The Board shall prepare and maintain a perpetual listing, hereinafter referred to as the "list" or "listing" of position vaanies, administrative openings, new positions and/or supplemental duty positions. Members must be available for all meetings, within reason. A. Members are required to remain in the building during the workday; provided, however, that during any given lunh period, one (1) member will be permitted to leave the premises. If neessary to leave the premises, prior permission must be obtained from the building prinipal. B. Eah member will have a thirty (30) minute duty-free lunh period eah day The member work year shall be one hundred eighty-four (184) days. A. Should the Board determine to inrease the number of workdays in a work year, the Board shall inrease the salary shedule then in effet on a basis whih reflets the perentage of additional days added by an amount equal to the per diem rate of eah member. In imposing disipline on a urrent harge, the Superintendent will not take into aount any prior written warning whih ourred more than one (1) year prior to the urrent harge, or a prior suspension whih ourred more than two (2) years prior to the urrent harge, unless the employee has aumulated other warnings or suspensions during the one year period or two year period, respetively Disiplinary Hearing Before a suspension of any employee overed by this Master Contrat beomes effetive, a hearing shall be held at whih the employee may present his ase. The employee and the Assoiation shall be notified of the reason for the suspension. In the ase of suspension, the hearing shall bel before the Superintendent and take plae no later than three (3) days following ree>ipt of suh notie. Insubordination, refusal to obey orders or instrutions as issued by management and refusal to perform assigned work. Confliting orders or instrutions shall be applied by ranking supervision. B. Bring intoxiants or ontrolled substanes into, or onsuming same, in the Board's vehiles and buildings and other properties or being under the influene of same while at work. C. Fighting during working hours or the use of insulting or abusive language toward the publi, supervisors, or fellow employees. D. Dishonesty or stealing, either from the Board, the publi, or its employees, and forging or falsifying time ards and other douments and/or reports. E. Causing injury to a fellow employee or destrution of a fellow employee's property or Board property through deliberate ation or gross negligene. F. In the event of a grievane over the suspension of an employee is taken to arbitration, the arbitrator's deision shall be binding on all parties, provided, however, that the arbitrator shall be limited to determining, in the ase where the disiplinary ation involved was taken under the progressive disipline provisions of this Master Contrat, that said progressive disipline provisions were followed and that the event or inident upon whih the disiplinary ation being taken is based ourred; or determining, in the ase where the disiplinary ation is being taken for one of the reasons set forth in the Master Contrat as grounds for immediate suspension that the event or inident upon whih the disiplinary ation is based ourred. 47

There will be one (1) hour per quarter mandatory distrit direted inservie. On that day there will be an early dismissal of students with meetings beginning at 2:05 p.m. and lasli1ng no later than 4:05 p.m. at the high shool, and beginning at 2:20 p.m. and lasting no later than 4:20 p.m. at the elementary shool. When there are joint meetings (high shool and elementary shool), the meetings will begin at 2:05 p.m. and last no later than 4:05 p.m HIRING OF RETIRED TEACHERS If the Board elets to employ individuals who have retired and are reeiving bemefits through the State Teahers Retirement System, the onditions set forth in this Artile and only the onditions set forth in this Artile shall apply to the employment of these individuals: The salary to be paid to the returning teaher shall be based on the appropriate plaement on the urrent teaher salary shedule training olumn with a maximum of ten (1 0) years of experiene and a minimum of zero (0) years of experiene and shall not be subjet to Chapter 3317 or any other setion of the Ohio Revised Code The Board will pay the employee's ost of health, vision and dental insu1 ane plans as per the ontrat Teahers employed pursuant to this provision shall reeive one (1) year limited ontrats and shall not be eligible to reeive ontinuing ontrats mgardle:ss of their years of servie or ertifiate/liense held Eah one (1) year ontrat shall automatially expire upon the ompletion of the year and it is not neessary for the Board to ondut evaluations in aordane with Chapter of the Ohio Revised Code nor to take formal ation to not re-employ the employee pursuant to Chapter 3319.'11 of the Ohio Revised Code in order to terminate the employment relationship. Observations will be for a minimum of thirty (30) minutes. 4. 71 NEGOTJA TED MASTER CONTRACT BETWEEN READING EDUCA T/ON ASSOCIATION AND READING COMMUNITY CITY SCHOOL DISTRICT BOARD OF EDUCA T/ON 6.08 LEVEL VI (Form VI) A further appeal may be made to the Board. It shall be presented to the Board at its next regular meeting. Again, the problem shall be outlined in writing on Grievane Form - Level VI (page 74) and aess to all doumentation presented up to this point shall be made available to the Board's membe!rship. The Board Treasurer shall arrange for a hearing with the Board within one (1) week of the reeipt of the request. The Board's deision shall be presented in writing on said Grievane Form - Level VI to the staff membel' and to the Assoiation within five (5} workdays of the onlusion of the hearing, and shall be entered upon the Board minutes A. If the Assoiation is not satisfied with the suggestion for resolving the grievane reeived at Level V, the Assoiation, within ten (1 0) workdays of reeipt of suh written response, shall notify the Superint endent of its intent to proeed to arbitration. B. The parties mutually agree to use the following three (3} arbitrators: 1. Mihael Paolui 2. Charles Adamson 3. Tobie Braverman Assignment of grievanes shall be made on a ontinuous rotating basis among the three (3) above-mentioned arbitrators. In the event that an arbitrator is unable to remain on the list, the parties shall meet to mutually agree on a replaement. C. With the exeption of seletion of the arbitrator, or any other ontratual provision related to the arbitration hearing, the parties agree that the arbitration proess shall adhere to the Amerian Arbitration,A,ssoiation's rules. D. The arbitrator shall hold suh meetings as he/she determine~> nee::;sary to make a fair and impartial ruling and issue his/her deision within fortyfive ( 45) alendar days of the hearing. E. The arbitrator shall expressly onfine himself/herself to the preise issue submitted for arbitration and shall have no authority to determine any other issues not so submitted or to submit observations or delarations of opinion whih are not diretly essent'1al in reahing the determination. The arbitrator shall in no way interfere with management prerogatives involving Board disretion nor interfere with the powers, duties and rules and regulations having the fore and effet of law. Additionally, the arbitrator shall have no power to alter, add to, modify or subtrat from the terms of this Agreement. F. The arbitrator has the authority to determine arbitrability if suh an issue exists. The Board must raise the issue of arbitrability thirty (30) work(jays after reeiving notie from the Assoiation of its intent to proeed to arbitration. Suh notie shall inlude a motion of supporting 68

The Assoiation shall have thirty (30) workdays in whih to file a response to the Board's memorandum to both the Board and the arbitrator. The arbitrator shall make a ruling on the arbitrability issue prior to hearing the grievane. G. The arbitrator shall have the power to subpoena witnesses and douments. H. No later than ten (1 0) workdays prior to the sheduled arbitration hearing a dislosure onferene must be held between the representatives of the Board and the Assoiation at whih time all douments, exhibits, evidene, and names of witnesses and the nature of their testimony shall be dislosed. Failure to dislosure prior to the hearing shall result in the exlusion of said evidene, exhibit, or testimony at the arbitration hearing. I. The ruling of the arbitrator shall be binding. J. Arbitrator's expenses and fees shall be paid by the unsuessful party in the arbitration proeeding. However, the arbitrator shall also have the authority to prorate the arbitration expenses and fees between the parties based upon his/her disretion. If either party unilaterally withdraws from the arbitration, the withdrawing party shall be responsible for all osts If a member fails to initiate the use of this instrument within the presribed two (2) weeks following the event or ondition upon whih the problem is based, his/her right to use it is waived. The same will apply if he/she does not adhere to the time limited established between the various levels All the time elements referred to in this instrument are made with the understanding that weekends and holidays shall not be inluded in the time limitations, unless both parties agree to other time limits whih might better serve the irumstanes. An exeption is made in Level VI in whih the time limit of one (1) week is established when requesting a hearing with the Board This time limit shall inlude weekends and holidays other than holiday seasons that exeed one (1) week in duration The offiial reords pertaining to problem solving shall be filed in the offie of the Board Treasurer If any provision of this doument or any appliation of this doument to any member(s) shall be found ontrary to law, then said provision or appliation shall be deemed invalid exept to the extent permitted by law, but all other provisions hereof shall ontinue in full fore. 69
73 NEGOTIATED MASTER CONTRACT BETWEEN READING EDUCATION ASSOCIATION 6.09 RIGHT TO REPRESENTATION During the term of this negotiated Contrat, no member may be represemted by any teaher organization or person(s) other than the Reading Eduation Assoiation in any grievane initiated. The grievant(s) will be entitled to representation at all levels of the grievane proedure by the Assoiation or its agents MISCELLANEOUS A grievane may be withdrawn at any level without prejudie or reord Forms for filing and appealing grievanes will be printed by the Board. Forms will be available in the offie of every shool, and will be kept in an area aessible to all members without request to administrators Nothing in this Contrat will be onstrued so as to deny the Assoiation or its representatives the right to redress before any appropriate admini<otrative ageny or through the ourts The Board and the Assoiation will ooperate with eah other in the investigation or any grievanes No reprisals of any kind will be taken by or against any party of interest, any partiipant in the grievane proedure, or any members by reason of suh partiipation Reords of grievanes will be kept onfidential When a member with a grievane applies for other employment or is employed outside the distrit, no reords, douments and/or ommuniations relating to said grievane shall be forwarded to or shared with the other employer The Assoiation's representative shall not lose pay or benefits for att,~nding grievane meetings with representatives of the Board sheduled by mutual agreement or by Board representatives. 70
