CORPORATION OF THE CITY OF CLARENCE-ROCKLAND BY-LAW 2014-06 BEING A BY-LAW TO AUTHORIZE THE CORPORATION OF THE CITY OF CLARENCE-ROCKLAND TO ENTER INTO AN AGREEMENT WITH DAN D. COTE CONSTRUCTION FOR THE RENOVATIONS AT THE CLARENCE CREEK AND ROCKLAND CITY HALLS. WHEREAS the Corporation of the City of Clarence-Rockland intends to sign the agreement for the renovation work at the Clarence Creek and Rockland City Halls; WHEREAS Sections 8, 9, and 11 of the Municipal Act, 2001, S.O. 2001, Chapter 25 and amendments thereto provides that every municipal Corporation may pass by-laws for the purpose of governing its affairs as it considers appropriate; NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE CITY OF CLARENCE-ROCKLAND ENACTS AS FOLLOWS: 1. THAT Municipal Council authorizes the Director of Community Services of the Corporation of the City of Clarence-Rockland to sign the agreement for the renovations at the Clarence Creek and Rockland City Halls; 2. THAT the agreement be in the form hereto annexed and marked as Schedule A to this by-law; 3. Schedule A This agreement made in duplicate on the day of 2014 by and between: THE CITY OF CLARENCE-ROCKLAND hereinafter called the "CITY" and Daniel D. Côté Construction Inc. hereinafter called the "Contractor" A. PLACE OF THE WORK Site one Site two Rockland City Hall Clarence Creek City Hall 1560 Laurier 415 Lemay street Rockland, On Clarence Creek, On B. SCOPE OF WORK Supply all labour, materials and equipment in order to comply with all codes: SCOPE OF WORK SITE ONE (Rockland City Hall) 1. Build the wall (1) with transom window in the new office space. Window shall be a minimum of 12 inches in height and 60 inches wide (not on plans) 2. Prime and paint the two offices area (not on plans) 3. Build all walls as specified and as per plans - 3½ inch metal studs at 16 o/c
- ½ inch drywall on each side of the walls - Plaster and prime all walls - Paint all walls with 2 coats of superior high quality matching paint - The contractor must take every precaution needed in order not to damage the existing carpet and or ceramic tiles. 3a. All walls shall be insulated in order to make the offices areas sound proof 4. Build two office spaces as per plans (Rockland City Hall 1560 Laurier) 5. Install the new door leading to the office area with a window and frame 36 inches wide to match existing millwork and colours. Install commercial grade door closer. The door frame shall be modified in order to receive the card access latch. 5a. Install the 2 offices new doors with side windows in order to match existing mill work of the Finance Department. 6. Electrical: relocate all light fixtures, light switch and electrical receptacle as required. These items will be identified once the walls have been constructed and shall meet all electrical code requirements. The contractor must have all appropriate permits from ESA and shall supply a proof of final inspection. 6a. Relocate the existing light fixtures to accommodate the 2 new offices and the hallway 7. Relocate existing air vent and modify the duct work as required for each new office space. 8. Build suspended ceiling in order to match the existing one were needed. 8a. Install a bulkhead at both windows in order to accommodate the new drop ceiling 9. The contractor will have to coordinate with the City some work needed for the alteration for the data and voice connections (The City will assume this part of work) 10. Repair, replace and change all required ceiling, drywall or tracks and tiles to match existing ones. 11. Patch prime and paint the complete area (colours to be determined)
SCOPE OF WORK, SITE TWO (Clarence Creek City Hall) First floor: 1. Remove existing wall # 1 including the frame and doors. 1a. Install new matching carpet in section #1 (approximately 140 sq.ft.) in order to replace the existing one. 2. Remove door frame and door in wall # 2 3. Close the wall # 2 with required metal studs, drywall, plaster 4. Build a platform stage # 3, install required carpet and electrical work as required. (Stage shall be similar to the Rockland council of chambers) 4a. Relocate required floor electrical into the new stage. 5. Relocate existing council table (desk): from Rockland to Clarence Creek 6. Install and modify the council table as required in Clarence Creek 6a. Laminate the council tables top 7. Plaster, prime and paint all walls, door frame and doors in the new council chambers. 8. Men washroom will be converted into an accessible washroom: remove existing door and frame. Build a wall # 4 to fill the existing door access. (Respect section 3.8 of the Ontario Building Code) 9. Cut existing wall #4 in order to install a new commercial frame, door, door closer, door handle to match existing millwork with the minimum width of 32 inches 10. Retrofit the washroom in order to respect all accessible standards for a public washroom. (ex: paper holder, holding bars, sink heights..) If plumbing work is needed all work shall be inspected by a city inspector. 11. Supply, replace and install all floor tiles, wall tiles and carpet as required. 12. Repair required drywall at the rear entrance, prime and paint the entrance area. 13. Remove wall # 5 in order to create one large office space.
14. Remove door frame and door and close the wall # 6 with required metal studs, drywall, plaster 15. Remove door frame and door and close the wall # 7 with required metal studs, drywall, plaster 16. Remove wall # 8 16a. Install matching carpet where the wall was 17. Repair, replace and change all required ceiling, drywall or tracks and tiles to match existing ones. 18. Patch prime and paint the complete area of the town hall (colours to be determined) 19. The City will be responsible to replace all required ballast and will assume responsibility of new required Exit signs. Lower level: 1. Remove existing wall # 1 2. Remove and disconnect all unwanted electrical receptacles, plugs, fixtures. (ESA permit and final inspection required) 3. Relocate all light fixtures as needed 4. Remove door frame and door in wall #2 5. Build wall # 3 and secure to upper deck 5a. In wall # 3 supply and install a door with a side window as per Rockland City Hall specifications. 5b. Insulate the wall # 3 in order to make it sound proof 6. Frame drywall and plaster the section # 4 7. Remove part of wall # 5 in order to create a doorway, frame drywall and plaster the corners. 8. Fill in wall #6 transom access with metal studs and drywall. 9. In wall #7 and #8 build a transom window 18 inches high X 48 inches wide
10. Remove a section of wall # 9 and relocate the door frame and door, drywall and plaster as required. 11. Cut existing wall #10 in order to install a transom window. Window shall be a minimum of 18 inches in height and 60 inches wide 12. Patch, prime and paint with 2 coats of superior quality commercial paint 13. Repair, replace and change all required ceiling, tracks and tiles. 14. Supply, replace and install all floor tiles or carpet as required. 14a. Plaster, sand and paint both stairwells. 15. Dispose all debris at the municipal dump in Bourget. (No charge to the contractor) 16. Supply a one year parts and labor warranty on all work and material. 17. The contractor must make sure that the place of work is clean, safe and free of dust as much as possible during this project. 18. The contractor shall clean the total area including the washings of all carpets by a professional carpet cleaning enterprise. 19. Contractor will be asked to supply a Workers' Compensation certificate before starting the work and upon completion of the project. 20. All work must be completed within 15 working days (each site) once the contract has been awarded. All work at the Rockland city hall shall be done after regular working hours (after 4:30 pm) and on weekends. 21. The contractor will have to coordinate with the City some work needed for the alteration for the data and voice connections (The City will assume this part of work) 22. The contractor shall take in consideration that this contract is a retrofit project and some parts of this project might have to be modified.
General work requirements Clean all site as per original condition. Supply a written one year warranty on all labour and materials. The contractor is responsible to supply all workmanship, work and material related to complete this contract as per the latest version of the electrical code (ESA) and OBC 2006. C. SUPERVISION Supervision of the work to be carried out during the period of this contract will be done by the Recreation and Municipal Facilities Manager or his appointee and Municipal building inspector if needed. D. INSURANCE INSURANCE COMPREHENSIVE GENERAL LIABILITY INSURANCE Comprehensive General Liability Insurance issued on an occurrence basis for an amount of not less than $5,000,000 per occurrence for any negligent acts or omissions by the contractor relating to its obligations under this Agreement. Such insurance shall include, but is not limited to Bodily Injury and Property Damage including loss of use; personal injury; contractual liability; premises, property & operations; non-owned automobile; medical payments; broad form property damage; owners & contractors protective; occurrence property damage; products & completed operations; employees as additional Insured; contingent employers liability; tenants legal liability; cross liability and severability of interest clause. Such insurance shall add the Corporation of the City of Clarence-Rockland as an additional Insured subject to a waiver of subrogation in favor of the City with respect to the operations of the bidder. This insurance shall be noncontributing with and apply as primary and not as excess of any insurance available to the City. The successful bidder shall indemnify and hold the Corporation of the City of Clarence-Rockland harmless from and against any liability, loss, claims, demands, costs and expenses, including reasonable
legal fees, occasioned wholly or in part by any negligence or acts or omissions whether willful or otherwise by the bidder, its agents, officers, employees or other person for whom the bidder is legally responsible. AUTOMOBILE LIABILITY INSURANCE Automobile liability insurance with respect to owned or vehicles leased in excess of 30 days automobiles used directly or indirectly in the performance of the Services covering liability for bodily injury, death and damage to property with a limit of not less than $2,000,000 inclusive for each and every loss. FIDELITY INSURANCE Employee dishonesty coverage including Third Party Extension in the amount of $50,000. The Policies shown above shall not be cancelled, permitted to lapse or materially changed unless the Insurer notify the City in writing at lease thirty (30) days notice prior to the effect date of cancellation, expiry or change. The insurance policy will be in a form and with a company which are, in all respects, acceptable to the City. The contractor agrees the City is in no way responsible for loss or damages to contents, tools or equipment owned, rented or otherwise in the care, custody or control of the contractor. These items are the contractors sole responsibility to maintain and/or replace as required in order to fulfill the duties and obligations as described, including but not limited to the purchasing of any necessary insurance. The successful bidder shall not commence work until such time as the required evidence of insurance has been filed with and approved by the City. E. REPAIRS OF DAMAGES The contractor agrees that all damages caused on the property of the City by the contractor shall be repaired or replaced at the contractor s expenses. F. MUNICIPAL BY-LAW The contractors must comply and abide to the City of Clarence-Rockland by-
laws and regulations at all times, Ex: working period G. CODES AND PERMITS The construction permit will be under the responsibility of the Recreation and Municipal Facilities Manager. Municipal inspections and ESA final inspections report will be required prior to occupancy of all renovated areas. H. WORKERS' COMPENSATION The contractor must provide either Part A OR Part B: A. If the applicant is an INDEPENDENT OPERATOR, namely that there are no employees hired under this contract, you are requested to complete, sign and return with your Annual Registration for preventive maintenance services, the attached "Determining Worker/Independent Operator Status. OR B. If the applicant does have employees hired under this contract, you are requested to provide and attach to your Annual Registration for preventive maintenance Services Form a "Workers Compensation Board Certificate of Clearance" to act as evidence of compliance with the requirements of the province or territory of the Place of Work with respect to Workers' Compensation Insurance. The Applicant shall pay to the Workers' Compensation Board of Ontario all assessments and levies owing to the Board in respect to this contract and any unpaid assessments or levies shall be the sole responsibility of the Applicant. At any time during the term of the contract, when requested by the Owner, the Applicant shall provide such evidence of compliance by him/her and their subcontractors. I. PAYMENT The City agrees to pay $ 60 845.00 (HST included) to the contractor within thirty (30) days after completion of the work as specified in section J. J. DEFINITION OF COMPLETION OF THE WORK The contractor must supply a workers' compensation discharge certificate.
The work shall be done as stipulated in the tender's specifications, and as per contract agreement. Payment will be made by the City of Clarence-Rockland on the successful completion of the project, and upon the receipt of a suitable invoice from the contractor. K. TENDER FOR CONTRACT To the City of Clarence-Rockland This Tenderer has carefully examined the Stipulations and Specifications describing the work to be done under this contract, as well as the existing site conditions. This Tenderer also understands and accepts the said Stipulations, Specifications and Site Conditions and for the prices set forth in this Tender, hereby offers to supply all material and complete the work in accordance with the Stipulations and Specifications.
