1 CITY OF CORNING REQUEST FOR PRICE QUOTES PAVEMENT MARKINGS Quotes for the installation of pavement markings for the City of Corning will be received by the City of Corning at the office of the Department of Public Works, 381 East Market St. Ext., Corning, NY until 2:00 PM Wednesday, January 20, SCOPE OF WORK Under this work the contractor shall furnish and apply pavement markings in 2016 within the City of Corning. This work shall include all traffic control related to his work. The City may choose to extend the service agreement with the successful contractor on an annual basis for 2017 and Interested parties should provide prices for a three (3) year period using the forms attached to this Request for Price Quotes. Reflectorized pavement markings shall comply with NYSDOT Standard Specification Section 640. NYS Department of Labor wage rates applies to this project. A map showing all pavement markings is available for review at the Department of Public Works' office. A list of tentative street markings is enclosed for your reference. The City of Corning reserves the right to add or delete pavement markings when it is deemed in the best interest of the City. The Contractor shall commence work within 15 days of notice to proceed, work shall be completed within 45 calendar days. All crosswalks and stop bars in school zones shall be completed prior to September 1 st of the calendar year. METHOD OF MEASUREMENT All lines shall be measured as number of feet of 4" line. For example, a 12-ft. long x 24- inch wide stop bar would be considered a 72-foot line of 4 inch. PAGE 1

2 INSURANCE The CONTRACTOR shall purchase and maintain such insurance as will protect him from claims set forth below which may arise out of or result from the CONTRACTOR'S execution of the WORK, whether such execution be by himself or by a SUBCONTRACTOR or by anyone directly or indirectly employed by any of them, or by anyone for whose acts any of them may be liable: Claims under Worker's Compensation, disability benefit and other similar employee benefit acts; Claims for damages because of bodily injury, occupational sickness or disease, or death of his employees; Claims for damages because of bodily injury, sickness or disease, or death of any person other than his employees; Claims for damages insured by usual personal injury liability coverage which are sustained (1) by any person as a result of an offense directly or indirectly related to the employment of such person by the CONTRACTOR, or (2) by another person; and Claims for damages because of injury to or destruction of tangible property, including loss of use resulting therefrom. Claims for damages because of bodily injury, death of a person or property damage arising out of ownership, maintenance or use of a motor vehicle; and Claims involving contractual liability insurance applicable to the CONTRACTOR'S obligations under this CONTRACT. Certificates of Insurance acceptable to the OWNER shall be filed with the OWNER prior to commencement of the WORK. These Certificates shall contain a provision that coverage's afforded under the policies will not be canceled unless at least fifteen (1 5) days prior WRITTEN NOTICE has been given to the OWNER. The OWNER shall be named as additional insured in all policies. The CONTRACTOR shall procure and maintain, at his own expense, during the CONTRACT TIME, liability insurance as hereinafter specified: The CONTRACTOR shall acquire and maintain commercial general liability insurance, including contractual liability, completed operations, broad form property damage, personal injury and XCU (Explosion, Collapse, Underground) coverage written with a single limit and shall not be reduced by unpaid claims of not less than one million dollars ($1,000,000) per occurrence and a two million dollar ($2,000,000) general aggregate and PAGE 2

3 completed operations aggregate. The policy shall name the OWNER, CONTRACTOR, City and any subsidiaries and affiliated companies of each as additional insured. The policy shall include a waiver of subrogation by the CONTRACTOR, CONTRACTOR'S insurance carrier, the OWNER and the OWNER'S insurance company. The CONTRACTOR shall acquire and maintain business auto liability insurance written with a single limit, and shall not be reduced by unpaid claims of not less than one million dollars ($1,000,000) for any one accident or loss, including hired or non-owned auto liability. The policy shall name the OWNER, CONTRACTOR, City and any subsidiaries and affiliated companies of each as additional insured. The policy shall include a waiver of subrogation by the CONTRACTOR, CONTRACTOR'S insurance carrier, the OWNER and the OWNER'S insurance company. The CONTRACTOR shall procure and maintain, at his own expense, during the CONTRACT TIME, in accordance with the provisions of the laws of the state in which the work is performed, Workers Compensation Insurance, including occupational disease provisions, for all of his employees at the site of the PROJECT and in case any work is sublet, the CONTRACTOR shall require such SUBCONTRACTOR similarly to provide Workers Compensation Insurance, including occupational disease provisions for all of the contractor's employees unless such employees are covered by the protection afforded by the CONTRACTOR. In case any class of employees engaged in hazardous work under this CONTRACT at the site of the PROJECT is not protected under Workers Compensation statute, the CONTRACTOR shall provide, and shall cause each SUBCONTRACTOR to provide, adequate and suitable insurance for the protection of his employees not otherwise protected. The CONTRACTOR shall secure, if applicable, "All Risk" type Builder's Risk Insurance for WORK to be performed. Unless specifically authorized by the OWNER, the amount of such insurance shall not be less than the CONTRACT PRICE totaled in the BID. The policy shall cover not less than the losses due to fire, explosion, hail, lightning, vandalism, malicious mischief, wind, collapse, riot, aircraft, and smoke during the CONTRACT TIME, and until the WORK is accepted by the OWNER. The policy shall name as the insured the CONTRACTOR, the City, and the OWNER. The policy shall include a waiver of subrogation by the CONTRACTOR, CONTRACTOR'S insurance carrier, the OWNER and the OWNER'S insurance company. INDEMNIFICATION The CONTRACTOR will defend, indemnify and hold harmless the OWNER and the City and their agents and employees from and against all claims, damages, losses and expenses including reasonable attorney's fees arising out of or resulting from the performance of the WORK, provided that any such claims, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or the injury to or destruction of tangible property including the loss of use resulting therefrom; and is caused in PAGE 3

4 whole or in part by any negligent or willful act or omission of the CONTRACTOR, or SUBCONTRACTOR, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. In any and all claims against the OWNER or the City, or any of their agents or employees, by an employee of the CONTRACTOR, any SUBCONTRACTOR, anyone directly or indirectly employed by any of them, or anyone for whose acts any of them may be liable, the indemnification obligation shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for the CONTRACTOR or any SUBCONTRACTOR under workers' compensation acts, disability benefit acts or other employee benefits acts. The obligation of the CONTRACTOR under this paragraph shall not extend to the liability of the City, his agents or employees arising out of the preparation or approval of maps, DRAWINGS, opinions, reports, surveys, CHANGE ORDERS, designs or SPECIFICATIONS. GUARANTEE The CONTRACTOR shall guarantee all materials and equipment furnished and WORK performed for a period of one (1) year from the date of SUBSTANTIAL COMPLETION. PAGE 4
