INSTRUCTIONS 1. Remove and Replace Page A Remove D-ISD Health and Safety. 3. Remove SP F Crane Swing Agreement. 4. Upon award of the contract the successful contractor will be required to complete the Contractor/ Consultant Health & Safety Compliance form and the Crane Swing Agreement requested by Capital Railway. Insurance The following additional insurance requirements relating to the Crane Swing Agreement indicated below will be required upon award. 1. The Contractor shall, at its sole cost and expense, provide and maintain the following insurance coverages for the term of the Authorization: a. a Project Specific Wrap Up Liability insurance subject to limits of not less than TWENTY MILLION DOLLARS ($20,000,000) inclusive per occurrence for bodily injury, death and damage to property, including loss of use thereof in operation of the Crane. Such insurance policy shall be in the name of the Contractor, and shall name the City of Ottawa/Capital Railway as an additional insured thereunder. The Project Specific Wrap Up Liability insurance policy shall include, but is not limited to insurance coverage for premises and operations liability, products liability and broad form completed 1 OCA

2 operations liability, broad form property damage, severability of interest clause, Contractors and sub-contractors protective coverage, occurrence property damage; medical payments; employees as Additional Insured(s); contingent employers liability; cross liability, personal injury liability, blanket contractual liability and non-owned automobile liability. This insurance shall be non-contributing with and apply as primary and not as excess of any insurance available and shall contain a waiver of subrogation in favour of the City of Ottawa; b. in addition, the Contractor shall provide and maintain during the term of the agreement Motor Vehicle Liability insurance in respect to licensed owned and leased motor vehicles subject to a limit not less than FIVE MILLION DOLLARS ($5,000,000) inclusive per occurrence for bodily injury, death and damage to property including loss of use thereof; and c. such insurance policies shall contain an endorsement to provide City of Ottawa/Capital Railway with thirty (30) days prior written notice of cancellation or of a material change that would diminish coverage. Evidence of such insurance, satisfactory to the City, shall be provided prior to the commencement of the Authorization. 2. The Contractor shall bind any contractors or subcontractors to the same terms and conditions as those contained in this Authorization, including the insurance requirements in section 1 of this Authorization, above, however each of any contractors or subcontractors must maintain their own Commercial General Liability Insurance policy for limits of not less than $5 million. Questions & Answers Question 1: RE: Section D Special Provision D-ISD Statement A-Contractor Qualifications (Rail Sub-Contractor Information) Please confirm if Statement A-Contractor Qualifications provided in the above noted Special Provision is to be submitted with our tender submission. Response 1: Yes, Statement A-Contractor Qualifications is to be submitted with the tender submission. 2

3 Question 2: F Property Restoration Capital Railways: it states to restore back to original, this will be impossible. The area in question is an unmanaged bush, the replacement trees are non-existent and the scrub brush also is non-existent please clarify. Response 2: The area shall be restored to original or better condition. This may include some minor landscape work (quantities included in tender package). Question 3: You have quantities for landscaping items, is there a drawing showing what we are doing? Response 3: There is no landscaping drawing at this time. These landscape quantities relate to anticipated work in restoring the areas around each abutment. Question 4: We would like to get an alternate bridge supplier pre-qualified but you require 10 days to approve, can we get that requirement shortened Response 4: At this time, the 10 day approval requirement will not be changed. Question 5: Temperature control plan is required for cold weather works, no problem Control of Temperature, shall not fall below 10 C, this will require us to incorporate temporary heat measures Concrete Subject to Cold Weather, design the protection system for the worst conditions. My preliminary review of the schedule will have us pouring the bridge deck in December. The average low in December is -10, so well need to protect and heat the slab from below and above. With the O-Train running heating and protecting the slab while it cures is next to impossible. Response 5: Refer to contract specifications (F ). Pouring of concrete deck over O-Train line will not be permitted. 3

4 Question 6: Concrete in Structures requires a bridge deck finishing machine is required for decks 3m or wider, is the bridge deck machine required? Response 6: In this instance, the requirements for need not apply. The contractor may elect to use a bridge deck finishing machine. Refer to contract specification (F ) for deck finish requirements. Receipt of this addendum shall be acknowledged on Page A-9 of the Form of Tender. Failure to do so may result in the rejection of the tender submission.
