SPECIAL INSTRUCTIONS TO THE TENDERERS 1. The enderer should carefully go hrough he schedules and quoe heir raes for all iems which is inclusive of all axes payable such as Sales ax, Labour Welfare Cess, Service ax ec. as applicable. 2. The raes should be filled in nealy in figures and worlds and aking ino accoun he meric uni specified in he ender, scrubbing, over wriing and erasing should be avoided as for as possible. 3. The amoun for each iem of work should be worked ou and furnished. Proper care mus be aken in working ou he amoun of each iem of work aking ino accoun uni for which he rae is quoed and he quaniy of work o be done under he iem. 4. The oal of each page should be noed a he end of each page and carried over o every page and he grand oal value of work should be worked ou and shown a he end. 5. Year wise deails should be furnished so as o see ha hose enderers have minimum experience of major buildings. iv. Lis of various machineries and oher equipmen of he ender, disposal for use in he execuion of work. v. The ender forms should be filled in while submiing he ender. The enders submied wihou filling up he ender form are liable o be rejeced. vi. The enders mus be submied in a fullscape cover here by duly signed all he condiions, plans and schedules issued as ender documen. Posal Tender 1. The conracors may have he opion o presen he ender direcly or o send i by regisered pos acknowledgemen due on or before he las dae for receip of enders. 2. In case of sending enders by regisered pos acknowledgemen due i is he responsibiliy of he enderer himself o dispach he ender sufficienly early so as o reach he ender opening auhoriy before he dae and ime noified in he ender noice for opening of enders. 3. The governmen shall no be liable o pay for, any loss or damages occasioned by or arising ou of fire, flood, volcanic erupion, earh quake, oher convulsions of naure and all oher naural calamiies, risk arising of acs of God during such period and ha he opion wheher o ake assurance coverage or no o cover such risks is lef o he conracor. 8

Sandard specificaion For deailed descripion of various iems of works o be execued in addiion o he brief descripion given in he schedule for he righs and obligaions of he conracors, ec/ he aenion of he conracors, is invied o Tamil Nadu Buildings Pracice which should be followed in all respec boh in leer spri. The maerials used, he workmanship, he mode of execuion of he work ec., should confirm o relevan specificaion of TNBP or NBC (or) Indian sandard specificaion as o be specified. Safey Code The safey measures and all ameniies for he labours shall be he conracor a his cos as indicaed in he safey code appendix o General condiions of conracor and clause 34, 35 and 42.1 of General condiions o conrac. 9

TENDER NOTICE 1. Sealed enders will be received by he General Manager, TamilNadu Medical Services Corporaion Limied, Chennai 8, upo 3.00 p.m. on 30.08.2016 for he work of Consrucion of connecing corridor from 2 nd floor of exising TNMSC office o he 2 nd floor of new building, Compound wall, False ceiling, wall paneling, Fire Fighing we riser hydran sysem, ec. 1.1. The Tenders will be opened by he Managing Direcor, Tamilnadu Medical Services Corporaion Ld., Chennai-8 or his auhorized officer, a his office a 3.30 p.m. on 30.08.2016. 1.2. The Tenderers or heir auhorised agens are expeced o be presen a he ime of opening of enders. The ender receiving officer will on opening each ender, prepare a saemen of he aesed and unaesed correcions herein and hand i over o he enderer concerned and iniial all correcions in he presence of he enderers. If any of he enderers or heir agens find i inconvenien o be presen a he ime hen in such case, he ender receiving officer will, on opening he ender of he absenee enderer, make ou a saemen of he unaesed correcions and communicae i o him. The absenee enderer shall hen accep he saemen of he correcions wihou any quesion whasoever. 2. Tenderer mus be submied in sealed covers and should be addressed o he Managing Direcor, Tamilnadu Medical Services Corporaion Ld., Chennai-8, he name and address of enderer and he name of he work being noed on he cover. 2.1. If he Tender is made by an individual, i shall be signed wih his full name and his address shall be given. If i is made by a firm, i shall be signed wih he Co-parnership name by a member of he firm who shall also sign his own name, and he name and address of each member of he firm shall be given, if he ender is made by a corporaion, i shall be signed by a duly auhorized officer who shall produce wih his ender saisfacory evidence of his auhorizaion. Such endering corporaion may be required before he conrac is execued o furnish evidence of is corporae exisence. 3. Each ender mus also send a cerificae of Income Tax verificaion (Saral form) from he appropriae income ax auhoriy in he form prescribed herefor. The cerificae will be valid for he year from he dae of issue for all enders submied during he period. 3.1. In he case of propriey or parnership firm, i will be necessary o produce he cerificae aforemenioned for he proprieors or parner and for each if he parners as he case may be. 3.2. If he enderer is a regisered Public Works Deparmen conracor, if a cerificae for he curren year had already been produced by him during he calendar year in which he ender is made, i will be sufficien. If pariculars 10

regarding he previous occasions on which he said cerificae was produced are given. 3.3 All Tenders received wihou a cerificae, as aforemenioned will be summarily rejeced. 4. Each enderer mus pay as Earnes Money, a sum of Rs.70,000/- (Rupees Seveny housand only) by Bank draf from Naionalized Bank owards he paymen of EMD drawn in favour of he Managing Direcor, TamilNadu Medical Services Corporaion Ld. Chennai and enclose Bank Draf wih ender and EMD will no be acceped in any oher form. Tenders no accompanied by he Bank Draf are liable for rejecion. This earnes money deposi will be refunded o he unsuccessful enderer along wih inimaion of rejecion of ender or a he expiraion of hree monhs from he dae of ender which ever is earlier. The earnes money deposi of he successful enderer will no be refunded and will be adjused owards Securiy Deposi. 4.1 Earnes Money will be reained in his case of he successful enderer and will no carry any ineres, i will be deal wih as provided in he ender. 5. The ender will remain valid for a period of Three calendar monh from he las dae for receip of ender. The validiy period can be exended furher, if he conracor gives his consen in wriing specifying he period of exension. 5.1. The enderer whose ender is under consideraion shall aend he Tamilnadu Medical Services Corporaion Ld, Chennai office, before he end of he period specified by wrien inimaion o him. If he enderer fails o aend he office before he end of he specified period, his ender will no be considered. He shall forhwih, upon and inimaion being given o him of accepance of his ender, by he officer duly auhorized in his behalf under Aricle 290(1) of he consiuion herein afer called he acceping auhoriy make securiy deposi of 2% of he value of conrac in one of he forms prescribed in Tamil Nadu Medical Services Corporaion Ld., (i.e) by aking in accoun of he amoun of Earnes Money Deposi already deposied wih he ender. I would be sufficien o pay he balance amoun o make up he 2% of he value of he conrac for he purpose of securiy deposi. 5.2. The Securiy Deposi ogeher wih Earnes Money Deposi and he amoun wihheld according o clause 64-1 of General condiion o conrac, shall be reained as Securiy for due fulfillmen of conrac. 5.3. On receip of wrien communicaion of accepance of ender if he enderer fails o pay requisies Securiy Deposi wih in he period specified in he wrien communicaion or back ou from he ender or wihdrawal his ender, 11

he Earnes Money Deposi shall be forfeied o he Tamilnadu Medical Services Corporaion Ld., Chennai. 5.4. On evaluaion of Tender if i is found ha i he overall quoed amoun of he Tender is less han 5 o 15% of he value pu o ender, he conracor shall pay an addiional securiy a 2% of he esimaed value. If he ender discoun exceeds 15% o 20%, he conracor shall pay an addiional securiy deposi of 50% of he difference beween he quoed amoun and esimae amoun. Failure o furnish he Addiional Securiy Deposi wihin 15 days from he dae of receip of accepance order and execue he agreemen shall enail cancellaion of award of conrac and forfeiure of EMD furnished. 5.5. If he conracor fails o carryou he conrac, afer paying he Securiy Deposi, hen he will be liable for he excess expendiure if any incurred o complee he work as conemplaed in he General Condiions o he conrac. 5.6. I shall be expressly undersood by he Tenderer ha in receip of wrien communicaion of accepance of ender by he Tenderer, here emerges a valid conrac beween he Tamilnadu Medical Services Corporaion Ld., Chennai and he Tenderer, for execuion of he work wihou any separae wrien agreemen. Hence for his purpose, he General condiions o he conrac, special condiions o he conrac, Negoiaion correspondences, wrien communicaions accepance of ender ec., shall be open o he acceping auhoriy o insis of execuion of any wrien agreemen by he enderer, if adminisraively considered necessary or expedien. 6. The Tender shall examine early he Tamil Nadu Building pracice and also he General condiions o conrac conained herein and sign he copy of he Tamil Nadu Building pracice and is addenda volume in oken of such sudy before submiing his Tender uni raes, which shall be for finished work in sie. He shall also carefully sudy he drawing and addiional specificaions and all he documens conneced wih he conrac. The Tamil Nadu Buildings pracice and oher conneced documens wih he conrac such as specificaion, plans, descripive specificaion shee regarding maerials ec., can be seen a any ime beween 11.00 AM and 5.00 PM on all office day in TNMSC office. 7. The Tenderers aenion is direced o he requiremens for maerials under he clause Maerials and Workmanship in he General Condiions o he conrac, maerials confirming o he ISI sandards shall be used on he work and he enderer shall quoe his raes accordingly. 8. Every enderer is expeced before quoing his raes, o inspec he sie of he proposed work. He should also inspec he quarries and saisfy himself abou he qualiy and availabiliy of maerials. The bes class of maerials o be used on he work. In every case he maerials mus comply wih he relevan sandard 12

specificaions. Sample of maerials as called for in he sandard specificaion or as required by he Managing Direcor, Tamilnadu Medical Services Corporaion Ld., in any case shall be submied for he Managing Direcor, Tamilnadu Medical Services Corporaion Ld. approval, before he supply o sie of work is begun. If he conracor afer examinaion of he source of maerials defined in he descripive, specificaion shee is of he opinion ha maerials complying wih he sandard or oher specificaions of he conrac canno be obained in qualiy of sufficien quaniy from he source defined in he descripive specificaion shee, he shall so sae in his ender and sae where from he indens, o obain maerials, subjec o he approval of he Managing Direcor, Tamilnadu Medical Services Corporaion Ld. I should be definiely undersood ha he TNMSC does no accep any responsibiliy for he correcness of compleeness of his schedule and ha his schedule is liable o aleraions by omissions, deducions or addiions a he discreion of he Managing Direcor, Tamilnadu Medical Services Corporaion Ld., Chennai or as se forh in he condiions of Conrac. The enderer will however base his lumpsum ender on his schedule of quaniies. He should quoe specific raes for each iem on he schedule and he rae should be wrien boh in and figures and he unis in. 13

10.1 The enderer should also show he oals of each iem and he gran oal of he whole conrac and quoe in he ender a lumpsum for which he will underake o do he whole work subjec o he condiions of conrac such lumpsum agreeing wih he oal amoun of schedule accompanying. 11. Tenderers offering a percenage deducion from or increase on he esimae amoun, called for specifically under percenage ender sysem and hose no submied in proper form or in due ime will be rejeced. 12. The ender should work ou his own raes wihou reference being made o he Public Works Deparmen curren schedule of raes or he Public works Deparmen Esimae. However, in case ender called for in percenage ender sysem he ender should work ou his own rae, bu quoe his percenage above or below he oal esimaed cos of work of he deparmen indicaed in he enders schedule. 13. Tenderers shall quoe heir price for finished work accordingly. No wih sanding any subsequen change in he marke value for hese maerials, he change o he conracor remain as originally in he wrien conrac. No cenage or incidenal charges will be born by TNMSC. 14. The aenion of he enderers is direced o he conrac requiremens as o he ime of beginning work, he raes of progress and he daes for he compleion of he whole work and is several pars. The rae of progress and proporionae value of work o be done has been indicaed below. The Successful enderers should adhere o he schedule. The Managing Direcor, Tamilnadu Medical Services Corporaion Ld., Chennai reserves he righ o rejec any ender or all he enders wihou assigning any reason. 14

18. The enderers who are hemselves no professionally qualified shall underake o employ qualified Technical men a heir cos o look afer he work. The enderer should sae in clear erms wheher hey are professionally qualified or wheher hey underake o employ echnical men required by he Deparmen specified in he schedule below for he work. In case he seleced enderer is professionally qualified or has underaken o employ echnical men under him he should see ha one of he Technically qualified men is always a he sie of he work during working hours, personally checking all iems of work and paying exra aenion o such works as may demand special aenion (or) reinforced concree work ec., EMPLOYMENT OF TECHNICAL ASSISTANTS 19. Engineers wih Mechanical Engineering qualificaion and reired from Civil Engineering Deparmen are also suiable for supervising he Civil Engineering works subjec o condiion ha evidence for experience in Civil Engineering filed is produced. f. A enderer submiing a ender which he ender acceping auhoriy considers excessive and or indicaive in sufficien knowledge of curren prices or definie aemp a profieering will rended himself liable o be debarred permanenly from endering or for such period as he ender acceping auhoriy may decide. The ender raes should be based on he conrolled price for maerials, if any fixed by Governmen or he reasonable price permissible for he enderer o charge 3 privae purchaser under he provisions of clause 8 of he Hoarding profieering Prevenions ordinance 1943, as amended from ime o ime on similar principles in regard o labour and supervision in he consrucion. 20. The conracor should offer employmen o ex-oddy lappers as far as possible. The conracors shall comply wih he provisions of he Apprenices, Ac 1961 and he rules and orders issued here under from ime o ime. Wihou prejudice o he above clause he conracor shall during he period of he conrac when called upon by he Engineer, incharge engage and also ensure engagemen by he sub-conracors and oher employees by he conracor in connecion wih he work, such number of apprenices in all caegories for such period as may be required by he Engineer-in-Charge. 22. In he case of conracs for consrucion of buildings, eiher permanen of semi permanen buildings a sum of equivalen o 2 ½ % of he value of work done will be reained for he period of one year from he dae of compleion of work in order o enable he deparmen officers o wach he effec of all seasons on he work done by he Conracor. The amoun so reained wih he Governmen will be refunded only on he expiry of one year period referred o above and on execuion of indemniy bond by he conracor for a furher period of four years. DAMAGES FOR DELAYS AND NONCOMPLETION If he conracor fails o complee he works wihin he period noed in Rae of Progress or wihin any exended ime allowed by he Managing Direcor, he conracor shall pay o Corporaion he sum of Rs.500/- as liquidaed and ascerained damages for every day beyond he said dae or exended ime as he case may be during which he works shall remain unfinished as provided in clause Rae of Progress. Liquidaed and ascerained damage will be levied as deailed below. LIQUIDATED AND ASCERTAINED DAMAGES Below Rs.5.00 lakhs Rs. 5 o 10 lakhs Above Rs.10 lakhs Liquidaed and ascerained damages per day Rs.125/- Rs.250/- Rs.500/- The liquidaed and ascerained damages will be levied up o a maximum of 5% of he value of he conrac and if he conracor fails o complee he work even hen, acion will be aken o erminae he conrac and execue he work a he risk of he Conracor and cos as per provisions of he General Condiions of Conrac of TNBP. NON-TENDERED ITEMS In case of iems of works for which supplemen agreemen is o be enered ino he following procedures will be adoped. For iems of work for which raes can be derived eiher from he rae for he iems in he original agreemen, he rae will be derived eiher by applying he pro raa excess or discoun for he iem of work, or he rae is derived from sandard daa and he lesser rae of hese wo will be adoped for making paymen o conracor. For iems of work for which raes canno be derived from he raes for he iems in he original agreemen, he raes for paymen will be as follows: 1. When he schedule of raes has no changed during he period from he dae of execuion of he original agreemen o he dae of supplemenal agreemen, he raes for he supplemenal agreemen shall be he prevailing schedule of raes wih he ender premium applied. 2. When he schedule of raes has changed during he inervening period, he raes prevailing as per he schedule of raes a he ime of execuion of supplemenal agreemen will be adoped wih no ender premium or discoun applied. 23

The said condiions shall be read and consrued as forming par of his agreemen and he paries hereo will respecively abide by, submi hemselves o he condiions and sipulaions, and perform he agreemen on heir pars respecively. PAYMENTS AND CERTIFICATES Paymen will be made o conracor under he cerificaes o be issued a reasonable frequen inervals by he Managing Direcor, TNMSC wihin 14 days of he dae of his cerificae. Paymen will be made for sum equal o 95% of he value of work as cerified and he balance 5% will be wihheld and reained as a securiy for he due fulfillmen of he conrac. Under he cerificae issued by he Managing Direcor, TNMSC on he compleion of he enire works he conracor will receive he final paymen of he money due or payable o him under or by virue of he conrac as per condiion, provided here is no recovery or forfeiure by he conracor o be made under clause 47 of General Condiions of he Conrac. MAINTENANCE PERIOD The conracor shall mainain he works execued by him in proper condiion for a period of one year from he dae of compleion of work and 2.5% reenion amoun will be reained for a period of one year from he dae of compleion of work in order o enable he Officers of Managing Direcor, TNMSC Ld., o wach he effec of seasons on he work. An indemniy bond for a furher period of four years should be furnished by he conracor in he form approved by he Governmen in G.O. MS.No. 654, daed 15.04.88 of PWD such ha he conracor shall make good he loss or damage ha may be caused o Tamilnadu Medical Services Corporaion Limied in respec of recificaion of any defec noiced due o he fauly workmanship by he conracor or subsandard maerials used by he conracor in he execuion of work. GUARANTEE PERIOD FOR ELECTRICAL INSTALLATIONS The enire elecrical insallaions barring he fiing and lamp shall be guaraneed for one year. During his period if any faul is developed due o defecive workmanship or defecs in he maerials supplied, shall be aended and recified by he conracor wihin 48 Hours of receiving such inimaions, failing which he securiy deposi and reenion amoun will be forfeied. The rae shall be quoed for he iems of work as per he enclosed schedule. Excise duy, sales ax and surcharge on sales ax if any shall be menioned clearly in he offer. Any defecs in he works noiced wihin he said period of mainenance from he dae of final check measuremens shall be made good a he expenses of he conracor. 24

FOR CONTRACTORS SPECIAL ATTENTION 1. Clean river sand shall be used in all cases. 2. Only clean fresh waer shall be used on he work. The conracor shall make his own arrangemens for waer and shall mee all charges herefore. The special aenion of he Conracor is drawn o clause 39 of preliminary specificaion of he T.N.B.P. regarding waer and lighing. 3. The broken sone for concree and RCC work shall be granie and passed by he Managing Direcor, Tamilnadu Medical Services Corporaion Ld., Chennai. 4. All iron work or seel work of every kind such as o be embedded in concree shall immediaely on arrival a he sie be properly scrapped and wire brushed and given priming coa of approved lead paining wihou claims for exra. 5. The iron holdfass shall be buildup on he walls in cemen morar 1:3 a he ime of consrucion of walls. No exra claim shall be due for he same wherever he holdfass are o be provided o 9 hick wall. Those should be fixed wih cemen concree 1:3:6 using 20mm gauge broken granie sone jelly for proper anchorage and proper biding. No separae for such pockes of concree filling a masonry along wih adjacen masonry. 6. The work will be carried ou wih he les hindrance o he adjoining building and he conracor will be responsible for he damages caused o he exising fixures, elecric fiings ec. he course of execuion and he conrac shall make good nay damages wihou any claim for exra. 9. In he case of T beams and L beams he quaniy given in he schedules is he quaniy for rib porion only. The op flange porion will be always measured wih he general slab porion and paid for he slab rae only. For all RCC works, he rae shall be include he reamen of bearing as per TAMILNADU BUILDING PRACTICE. 26

10. Concree works: All exposed concree surfaces will be required o be finished by cemen plaser as deailed in Schedule A. 11. Plasering all exernal corners, edges of beams, edges of doors and windows openings ec. shall be finished sharp using richer morar and also finished ruly verical or horizonal as he case may be. The rae for plasering shall include he cos of finishing as above and no separae exra for he corners, edges beams ec shall be paid. 12. If raes are no separaely called for, for similar iems of works in difference floors, he conracor should no ha one rae is applicable for all floors indicaed in he deailed plans. Any claims for exra for such iems floor war will no be enerained under any circumsances. 13. The projec if any o he masonry will be measured under he relevan iems and non exra will be paid for finishing he same. 14. (i). The work execued by he conracor under he conrac shall be mainained by he conracor unil he work is aken over by he Managing Direcor, TNMSC. The conracor shall accordingly arrange his own insurance agains fire, flood, volcanic erupion, earh quake oher convenion of naure and all oher naural calamiies risk arising ou of acs of God during such period and ha he TNMSC shall no be liable for any loss or damages occasioned by or arising ou of any such acs of God. (ii). Provided, however ha he conrac shall no be liable for all or any loss or damages occasioned by or arising ou of ac of foreign enemies, invasion hosiliies or war like operaion (before or afer declaraion of war) rebellion, miliary or Usurped power. RETENTION OR WITHHELD AMOUNT (iii). 2½% of he oal value of he work will be reained in he final bill of he work for he period one year reckoned from he dae of compleion of he work in he order o enable he deparmen o wach he effec of all seasons of he work. The conracor should furnish an indemniy bond for furher period of four year. If any defecs are noified in he above said period he defecs should be recified by he conracor a his own coss as direced by he Deparmenal Officers and no exra paymen be made for he recificaion of such work. PAYMENT BY NEFT / RTGS ONLY (iv). Unless Oherwise specified all paymens o he Conracor shall be made by NEFT / RTGS only. TAX DEDUCTION AT SOURCE (v). Where here is a sauory requiremen for Tax deducion a source, such deducion owards Income Tax, Service Tax and oher Taxes as applicable, will be made from he invoices payable o he Conracor a raes as noified from ime o ime. SALES TAX ON WORK CONTRACTS (vi). Sales ax on works conrac shall be borne by he Conracor and will be deemed o have been buil by him in he Conrac price. I will no be reimbursed by he Employer. 27

LABOUR WELFARE CESS (vii). 1% of he bill value shall be deduced and remied o he Tamilnadu Consrucion workers welfare Board, payable a Chennai along wih saemen in Form IV. SERVICE TAX ON WORKS CONTRACTS (viii). The Employer shall deduc 50% of he Service Tax amoun of he par bill / final bill and remi direcly o he Service Tax auhoriies as per he Service ax noificaion. The balance 50% of he Service Tax shall be paid along wih he bill amoun claimed by he civil conracors and advised hem o submi he proof of remiance of he (balance 50%) Service Tax elemen along wih he nex bill o enable he Employer o process heir paymen of he subsequen bill. The Service Tax componen payable by TNMSC are compued as follows: 1) Capial work consrucion 40% of he oal conrac value will be considered as labour componen on which service ax a 15% (40% x 15% = 6%) will be compued on he oal conrac value. 2) In case of oher Repairs & Mainenance works 70% of he oal conrac value of he repairs & mainenance will be considered as labour componen on which service ax a 15% (70% x 15% =10.5%) will be charged as service ax on he oal conrac value. REVENUE RECOVERY ACT (ix). Whenever any amoun has o be paid by he conracor in lieu of deerminaion of he conrac by virue of clause 57 (4) any amoun ha may be due or may be come due from he conracor under he presence and he conracor is no responding o he demands for he paymen of said amoun, hen he TNMSC shall be eniled o recover he said amoun under he provision of he Revenue Recovery Ac. RISK INSURANCE (x). The work execued by he conracor or under his conrac shall be mainained by he conracor s risk unil he work is aken over by he Managing Direcor, TNMSC. ARBITRATION CLAUSE (xi). In case any dispue or difference beween he paries o he conrac eiher during he progress or afer he compleion of he works or afer deerminaion, abandonmen or breach of he conrac or as o any oher maer or hing arising here under excep as o he maers lef o he sole discreion of he Managing Direcor, TNMSC under clause 18, 20, 25-3, 27-1, 34, 35 and 37 of he general condiion of he conracor as o he wih holding by he Managing Direcor, TNMSC or he paymen of any bill o which he conracor may claim o be eniies. No cenage of incidenal charges will be borne by he Governmen in connecion wih he supply of he maerials referred o in his paragraph. ADDITIONAL SPECIFICATION 1. The arrangemens of M.S. rods for all RCC works shall be in accordance wih he working drawing supplied. 2. (i). Paymens for cenering works for all RCC iems shall be made only afer he concree is laid, even hough separae iems for cenering works are included in he schedule. The cenering and form shall be provided o he exen and area ordered by he Managing Direcor, TNMSC during execuion. (ii). all cemen concree for RCC works shall be machine mixed and vibraed. (ii). All lime morar shall be ground in morar will be as per TNBP 3. M.S. seel rods should be cu and placed as reinforcemen wih proper care according o he available rods a sie, so as o ensure he minimum possible wasage. The maximum percenage of wasage of permissible in any size of reinforcemen rods shall be of 5% which will be charged on a he issue rae of Seel. ADDITIONAL CONDITION 1 1. The conracor shall be responsible for he safe cusody and sorage of he maerials under dry condiions a he places of he work spo approved by he Managing Direcor, TNMSC. 3. No royaly shall be charged where due for maerials quarried from PWD or Disric Board or oher Governmen Quarries. Necessary assisance will be given o he Conracor by he PWD o obain access o quarries approved by he Managing Direcor, TNMSC. No plo ren shall be charged for maerials sacked on he Governmen land during he course of consrucion, provided, all such maerials are removed wih a monh afer he work is compleed. 4. The conracor shall pay royaly or charge due for use of privae quarries and privae land. 5. The conracor shall form his own approach road o he work sie for which no exra will be due o him. On compleion of work, he conracor shall no be permied o remove he maerials laid for formaion of road. If he conracor is allowed o use he exising road, he shall mainaining hem in good condiion a his own cos hroughou he period of he conrac. 1. Any surplus maerials remaining a he sie, will no generally be aken over by he Deparmen wheher before or afer he compleion or erminaion of conrac. Such maerials eiher which were originally procured by he conracors were issued o hem by he deparmen and charged o heir accouns are he propery o he conracors and can however be aken by he Deparmen is required, for use on oher works, which are in progress only, be special arrangemens and a he prevailing marke raes viz. The raes which he aricle or aricles of a similar descripion can be procured a a given ime a he sore, godown, from Public marke suiable o he Division for obaining such here of. 2. If he maerials originally used by he Deparmen he price allowed o he conracor on re-acquisiion shall no exceed he amoun charged o he conracor excluding he elemen of sorage charges if any. 3. If a any ime subsequen o he execuion of his arrangemens, Governmen maerials oher han hose specified in he agreemen are supplied o he conracor for use on he work hey will be charged a he marke value prevailing a he ime of supply or sock issue raes whichever is higher. The conrac will be informed in wriing of his charge and he should inimae in wriing he rae he demands for finishing he work in view of he fac ha he is no o use Governmen maerials. No cenage or incidenal charges will be borne 30

by he Governmen in connecion wih he supply of maerials referred o in his paragraph. 5 4. The surplus maerials which were originally issued o he conracor back o he deparmen for use of he work shall no be removed from he sie of work wihou geing he wrien permission of he Managing Direcor, TNMSC. 5. The conracor s special aenion is invied o clause 37 and 38 of he preliminary specificaion of T.N.B.P. and he is requesed o provide a his own expenses shed, larine and Urinal for his workmen. 6. If nigh work is required o fulfill he agreed rae of progress all arrangemens shall be made by he conracor including of lighing wihou any claim for exra. 7. The conracor shall no employ he labours below he age of 12 years and shall also noe ha he mus offer employmen ex-oddy appers and unemploymen agriculure labours as far as possible. 8. Any of he iems in he schedule may be omied or radically alered no variaion in raes shall become payable o conracors on accoun of such omissions or variaion in quaniy. 9. Reference o TNBP in he schedule of quaniies referred and addenda and corrigenda issued hereafer. 10. The conracion of building will be deemed o be compleed only, if all he iems of work including finishing iems conemplaed herein afer execued. 11. The conracors shall abide he conracor s labour regulaion of he PWD framed by he Tamilnadu Governmen. 5. Consrucion maerials 5.1. Cemen : Supplemenal o clause of 20 of General condiions. The conracor has o make his own arrangemens for he procuremen of Cemen of required specificaions for he works subjec o he followings :- (A). The conracor shall procure cemen required for he works only from repued cemen facories (main produced of heir auhorised agens, manufacuring cemen o ISI sandard) accepable o he Engineer-in-Charge. The conracor shall be required o furnish o he Engineer-in-Chief bills of paymen and cos cerificaes issued by he manufacures or heir auhorised agens o auhenicae procuremen of qualiy cemen from he approved cemen facory. The conracor shall make his own arrangemens for safe haulage and adequae sorage of cemen. (B). The conracor shall procure in sand packing of 50Kg per bag from he auhorised manufacurer. The conracor shall make necessary arrangemen a his own cos o he saisfacion of Engineer-in-Charge for acual weighmen of random sample from he available sock and shall confirm wih he specificaion laid down by he Indian Sandards Insiuions or oher sandard foreign inuiions as he case may be. Cemen shall be go esed for all he ess as direced by he Engineer-in-Charge aleas one monh in advance before he use of cemen bags brough and kep a sie godown. (C). The employer will furnish air recraing agens and admixures required o he conracor free of cos a he employer sores. The use of such admixures and agens shall be made 31

as per he insrucions of he Engineer-in-Charge. The cos of carage / sorage, handling, baching mixing shall be borne by he Conracor and shall be included by him o uni officers endered for concree (d). The conracor should sore he cemen of 60 days requiremen aleas one monh in advance o ensure he qualiy of cemen o brough o sie and shall no remove he same wihou he wrien permission of Engineer in Charge. The conracor shall forhwih remove from he works area, and he cemen ha he Engineer-in-Charge may disallow for use on accoun of failure o mee wih required qualiy and sandard. (E). The conracor will have o consruc sheds for soring cemen having capaciy no less han he cemen required for 9 days use, a approved locaions. The Engineer in Charge or he represenaive shall have free access o such sore a all imes. (F) The conracor shall furher a all imes saisfy he Engineer-in-Charge on demand by producion of records and es books or by submission of reurns and oher profs as direced ha he cemen is being used as esed and approved by he Engineer in Charge for he purpose and he conracor shall a all imes, keeps his record upo dae and enable he Engineer-in-Charge o apply such checks as he may desire. (G) Cemen which has been unduly long in sorage wih he conracor or alernaively has deerioraed due o inadequae sorage and hus become unfi for use on he works will be rejeced by he Deparmen and no claim will be enerained. The Conracor shall forh wih remove from he work are any cemen he Engineer in Charge may disallow for use of work and replace i by cemen complying wih he relevan Indian Sandards 5.2. STEEL The conracor shall provide mild seel (MS) reinforcemen basis, High Yield srengh deformed (HYSD) bars, rods and srucural seel ec., required for he works only from he main and secondary producers manufacuring seel or oher auhorized agens o he prescribed specificaions. Bureau of Indian Sandards requiremens and licensed o affixing ISI es cerificae issued by he Governmen approval laboraory cerificaion marks and accepable o he Engineer in Charge. When here are complains of non-paymen of wages o he labourers bills of he conracor may be wih held pending a clearance of cerificae from he labour deparmen. ADDITIONAL CONDITION OF CONTRACT - III Rules for he provision of healh and saniary arrangemens for workers employed by he Corporaion and his conracors. The conracor s special aenion is invied o clause 37, 38, 39 and 51 of he Tamilnadu Building Pracice and he is requesed o provide a his own expense he following ameniies o he saisfacion of he Managing Direcor, TNMSC. FIRST AID 1. A he work sie here shall be mainained a readily accessible place, firs aid appliances and medicines including adequae supply serilized dressings and serilized coon wool. The appliances shall be kep in a good order. They shall be under he charge of responsible person who shall be readily available during working hours. DRINKING WATER 2. (a) Waer of good qualiy fi for drinking purposes shall be provided for he work people on a scale of no less han hree gallon head per day. (b). Where drinking waer is obained from an inermien Public Waer Supply each work place shall be provided wih he sorage anks where such drinking waer shall be sored. 33

(c). Every waer supply and sorage shall be a a disance no less han 50 fee from any larine / drain or oher exising well which is wihin such proximiy of larine, drain on any oher source of polluion, he well shall be properly closed. If waer is drawn from i for drinking. All such wells shall be enirely closed and be provided wih a rap door, which shall be dus and waerproof. (d). A reliable pump shall be fied o each covered well. The rap door shall be kep locked and opened only for cleaning or inspecion which shall be done aleas once in a monh. WASHING AND BATHING PLACES 3. Adequae washing and bahing places shall be provided separaely for men and women. Such places shall be kep clear and drained condiion. Bahing or washing should no be allowed in or near he drinking waer well. LATRINES AND URINALS 4. There shall be provided wihin he premises of every work place larines and urinals in an accessible place and he accommodaion separaely for each of hem shall be on he following scale or on he scale so direced by he Managing Direcor, TNMSC in any paricular area. 1. Where he number of persons employed does no exceed 50-3 seas. 2. Where he number of persons employed exceed 50 bu does no exceed 100-3 seas. 3. For every addiional 100 persons 3 seas. If women are employed, separae larines and urinals screened from hose for men shall be provided on he same scale. Excep in work places provide wih waer flushed larine conneced wih a waer borne sewage sysem, all larines shall be provided wih acable dry earh sysem which will be cleared aleas four imes daily and aleas wice during working hours and kep in a sricly saniary condiion. The larines and urinals shall be arred inside and ouside aleas once a year. The escrea from he larines shall be disposed off a he conracor s expense, in ouside pis approved by he local public healh auhoriy. The conracor shall also employ adequae number of scavengers, conservancy saff o keep he larines and urinals in a clean condiion. SHELTER DURING REST A he work sie, here shall be provided a free of cos wo suiable sheds one for meals and anoher for res separaely for men and women for he use of labourers. CRECHES 2. A every work place a which 50 or more women are working here shall be provided ow hus of suiable size for he use of children under he age of 6 years belonging o such women. One hu shall be used for infans, games and play and he oher as heir bedroom. The hus shall no be consruced and a lower sandard han he following. i. Thached roofs ii. Mud floors and walls iii. Planks spread over he mud floor and covered wih maing 34

The size of he crech or creches should vary according o he number of women workers. The creches should be properly mainained and necessary equipmen like oys ec, should be provided and hus shall be provided wih suiable and sufficien sweepers o keep he place clean. There shall be wo ayahs in aendance. Saniary uensils shall be provided o he saisfacion of he healh officer of he area concerned. The number of hus shall be resriced o children and heir aendans of he children. CANTEEN A cooked food caneen on a moderae scale shall be provided for he benefis of he workers if i is considered expedien. SHEDS FOR WORKMEN The conracor should provide a his own expenses shed for housing he workmen. The sheds shall be on a sandard no less han he cheap sheler ype, o live in which he work peraining o localiy area accusomed o. A floor area of abou 1.80 mere X 1.5 mere for 2 persons shall be provided. The sheds o he in rows wih 1.3 meres clear work people s camp shall be laid ou in unis of 400 persons each. Each uni o have clear space of 12 meer around. ADDITIONAL CONDITION IV Safey provision in he building indusry condiions in addiional o clause 36 preliminary specificaion of TNBP. PART I ARTICLES 1 1. Suiable scaffolds shall be provided for workmen for all work ha canno be safely done from ladder or by any oher means. 2. A scaffold shall no be consruced, aken down or subsequenly alered excep, a). Under he supervision of a compeen and responsible person and b). by compeen workers possessing adequae experience in his kind of work. 3. Scaffolds shall be so consruced ha no par hereof can be displaced in consequen of normal use. 4. scaffolds shall no be over loaded so far as pracicable and shall be evenly disribued. 5. Before insalling lifing gear on scaffolds special precauions shall be aken o ensure he srengh and sabiliy of he scaffolds. 6. A compeen person shall periodically inspec scaffolds. 7. Before allowing a scaffold o be used by his workmen every employer shall saisfy as o wheher he scaffold has been execued by his workmen or no be should aken sep o ensure ha i funcions fully wih he requiremens of his aricle. ARTICLE 2 1. Working plaform gangways and saircase shall be so consruced ha no par hereof can sag unduly or unequally. a). Be so consruced and mainained o obviae from risks of persons ripping or slipping and 35

b). be kep free from any unnecessary obsrucion. c). Every working plaform gangway working place and saircase shall be suiably forced. ARTICLE 3 1. Every opening in he building or in a working plaform shall excep for he ime o he exen required o allow he excess of persons or he ranspor or shiring of maerials be provided wih suiable means o preven he fall of persons or maerials. 2. When persons are employed on a roof where here is danger of falling from he heigh exceed ha o be prescribed by naional laws of regulaions, suiable precauions shall be aken o preven he fall of persons of maerials. 3. Suiable precauions shall be aken o preven persons being sruck by aricles which migh fall from scaffolds or oher working places : ARTICLE 4 1. Safe means of access shall be provided, o all working plaforms and oher working places. 2. Every ladder shall be securely fixed and of such lengh as o provide secure hand hold and foo held a every posiion a which i is used. 3. Every place where work is carried on and he means of approach here o shall be adequaely lighed. 4. Adequae precauions shall be aken o preven persons danger from elecrical equipmen. 5. No maerials on he sie shall be so aached or placed as o cause danger o any persons. PART II GENERAL RULES AS TO HOISTING APPLIANCES ARTICLE 5 1. Hoising machines and ackle including heir aachmens enhoages and suppors shall. a) be of good mechanical condiion sound maerial and adequae srengh and free from paien defecs and b) be kep in good repair and in good working order. 2. Every rope used in hoising or lowering maerials or as a means of suspension shall be of suiable qualiy and adequae srengh and free from paien defecs. ARTICLE-6 1. Hoising machines and ackle shall be examined and adequaely esed afer erecion on he sie and before use and be reexamined in posiion a inervals o be prescribed by naional law or regulaion. 2. Every chain ring, hook shackle, swivel and pulley block used in hoising or lowering maerials or as a means of suspension shall be periodically examined. 36

ARTICLE 7 1. Every crane driver or hoising appliances operaor shall be properly qualified. 2. No persons under an age o be prescribed by naional law regulaions shall be in conrol of nay hoising machinery including any scaffold which or gives signals o he operaor. ARTICLE 8 1. In he case of very hoising machine and every chain ring hook, shackle swivel and pulley block used in hoising or lowering or as a means of suspension, he safe working load shall be ascerained by adequae means/ 2. Every hoising machine and all gear referred o in he proceeding paragraphs shall be plainly marked wih he safe working load. 3. In he case of hoising machine having a variable safe working load, each safe working load and he condiions under which i is applicable shall be clearly indicaed. 4. No par of any hoising machine or of any gear referred o in he paragraph (i) of his aricle shall be loaded beyond he safe working load excep for he purpose of esing. ARTICLE 9 1. Moor gearing, ransmission, elecric wiring and oher dangerous pars of hoising appliances shall be provided wih sufficien safe guards. 2. Hoising appliances shall be provided wih such means as well reduce he risk of he acciden descen of he load. 3. Adequae precauions shall be aken o reduce he risk of any par of suspended load becoming accidenally displaced. PART III GENERAL RULES TO SAFETY EQUIPMENT AND FIRST AID ARTICLE 10 1. All necessary personal safey equipmen shall be kep available for he use of he persons employed on he sie and be mainained in a condiion suiable for immediae use. 2. The workers shall be required o use he equipmen hus provided and he employer shall ake adequae seps o ensure proper use of he equipmen by hose concerned. ARTICLE 11 When work is carried on in proximiy o any place where here is risk of drawing all necessary equipmen shall be provided an kep ready for use and all necessary sep shall be aken for he promp reduce of any person in danger. ARTICLE 12 Adequae provision shall be made for promp firs aid reamen of all injuries pixely o be susained during he course of he work. 37

ARTICLE 13 Where large work place are siuaed in ciies, owns or in heir sub-urban and no beds are considered necessary owing o he proximiy of ciy or own hospial, suiable ranspor shall be provided o faciliae removal of urgen cases o he Hospials, a heir work places some conveyance faciliies such as car shall be kep ready available o he injured person or persons suddenly aken seriously ill o he neares hospial. MOSAIC FLOORING 1. Cemen concree flooring illers shall be manufacured from a mixed cemen naural aggregaes and colour maerials where required by pressure process. During manufacure he iles shall be subjec o a pressure of no less han 140 Kg per sq.m. (or 2000 lbs per sq.m.) 2. Proporion of cemen o aggregae in backing of he iles shall no be less han 1.5 by weigh. 3. On removal from mould, he iles shall be kep in mois condiion coninuously for aleas 7 days and subsequenly if necessary kep mois for such a longer period ha would ensure heir conformiy o he requiremens of Transfers srengh, resisance o wear and ear absorpion and would minimize shrinkage and cracking, illers shall be sored under cover. 4. Tolerance : Tolerance on lengh and breah shall be plus or minus one millimeer. However, he maximum oal quaniy of aggregae by weigh per 50 Kg of cemen shall no normally exceed 450 Kg. 18. For any paricular iem compressive srengh required o be obained by he concree a 28 days in he preliminary and work es on he 15cm cubes minimum cemen conen, required o be used and he approximae proporions approved fine and coarse aggregae shall be specified, in he ender schedule. These pariculars will be only for he guidance of he conracor for quoing raes. 19. Immediaely upon he receip of he award of conrac, he conracor shall inform he Managing Direcor, TNMSC he exac locaion of he sources of he maerials which he propose o use and ge he maerials approved. The mix wih he acual approved maerials o be used shall be go designed in an approved laboraory by he conracor wih minimum quaniy of cemen o give he specified srengh in he preliminary ess and he proporions shall be used so long as he maerials coninue o be of he same qualiy and he same sources subjec only o sligh changes in he relaive qualiies is of fine and coarse aggregae for he purpose of promoing 3ork abiliy provided he work ess also show he required srengh. 20. If during he progress of work, he conracor wishes o change he maerials he proporion shall be fixed on he basis of he fresh preliminary ess o give he required srengh afer he Managing Direcor, TNMSC is saisfied ha he maerials saisfy he specificaion. No adjusmen of cos shall be made for change of proporions of cemen fixed in he original preliminary ess. PROPORTIONING OF MIX Each bach of mix shall be proporioned by weigh of cemen fine aggregae and coarse aggregae, waer for each bag shall be added in quaniy measured by volumes or by weigh. Where weigh of cemen deermined by acceping he maker weigh per bag, a reasonable number of bag shall be weighed separaely o check he ne weigh, and he cemen is weighed weigh per bag, a reasonable number of bags shall be weighed on he sie and no in bags. I shall be weighed separaely from he aggregae. In he weighing equipmen s shall be mainained in a clean and serviceable condiion and heir accuracy checked periodically. MIXING Mixing shall be done by mechanical mixes. The quaniies of fine aggregae and waer shall be adjused duly in he filed o compensae for bulkage due o he quaniy of moisure presen in fire aggregae and free waer in he coarse aggregae a he ime of use. TESTS Tess shall be go done in an approved laboraory a he cos of he conracor. PRELIMINARY TEST If concree mixes are specified by is srengh hen he mix needs be designed and preliminary es should be carried ou. Preliminary es is conduced in a laboraory on he rial mix of concree produced in he laboraory wih he objec of : a). Designing a concree mix before he acual concree operaion sars. b). Plain and reinforced concree shall be in seven grades as designaed as M100, M150, M200, M250, M300, M350 and M400. Wheher he srengh of a concree mix, as indicaed by es lies beween he srengh for any wo grades, specified in Table.1. such concree shall be classified for all purpose as a concree belonging o he lower of he wo grade beween which is srengh lies. 4.3. Proporioning and works conrol : 4.3.1. Mehods of proporioning : The deerminaion of he proporion of cemen aggregae and waer o aain he required srengh shall be made by one of he following. a). Wih preliminary ess by adoping nominal concree mixes. Such concree shall be ordinary concree. 4.3.2. Conrolled Concree : 4.3.2.1. As far as pracicable, conrolled concree should be used on all concree works. Conrolled concree for use in plain an reinforced concree srucures shall be in grade M100, M150, M200, M250, M300, M350 and M400. 4.3.2.2. The concree mix shall be designaed o have an average srengh corresponding o he value specified for preliminary es in able.1. The proporions chosen should be given such ha he concree is of adequae workabiliy for he condiions prevailing on he work in quesion and may properly compaced wih he means available. The maximum oal quaniy of aggregae by weigh per 50 Kg of cemen shall no exceed 450 Kg. Excep where oherwise specifically permied by he Engineer in Charge. 4.3.2.3. Excep where i can be shown o he saisfacion of he Engineer-in-Charge ha supply of proper graded aggregae of Uniform quaniy may be mainained over he period of work, he grading of aggregae should be conrolled by obaining he course aggregae in differen sizes being socked in separae sock file. The maerials should be sock piled for several hours preferably a day before use. The grading of coarse and fine aggregae should be checked as frequenly as possible he frequency for a given job being deermined by he Engineer in Charge o ensure ha he suppliers are mainaining he grading uniform wih ha on he samples use in he preliminary ess. 4.3.2.4. In proporioning concree he quaniy of boh cemen and aggregae should be deermined by weigh. Where he weigh of cemen is deermined by acceping he manufacures weigh per bag and reasonable number of bags should be weighed separaely o check he ne weigh where he cemen is weighed on he sie and no in bags i should be weighed separaely from he aggregaes. Workabiliy of he concree should be checked a frequen inervals. Where i is considered no pracicable o use conrolled concree, ordinary concree may be used for concree of grades M100, M150, M200, M250. The proporions of maerials for nominal concree mixes for ordinary concree shall be in accordance wih able.3. 4.3.3.2. In purporing concree he quaniy of cemen should be deermined by weigh. The quaniies of fine and coarse aggregaes may be deermined by volume bu hese should also preferably be deermined from he volume specified in able.3. and he weigh per lire of dry aggregae. If fine aggregae is mois and volume baching is adoped, allowances shall be made for bulking in accordance wih good pracice (VI.5 (9)*) 4.3.3.3. Workabiliy of concree should be conrolled by direc measuremen of waer conen, making allowance for any surface waer in he fine and coarse aggregaes. The slump es may be conduced in accordance wih good pracice (VI.5 (10)). 4.3.3.5. Allowance should be made for surface waer presen in he aggregae when compuing he waer cemen surfaces waer shall be deermined by field mehods in 43

accordance wih good pracice VI.5 (9). In he absence of exac dae he amoun of surface waer may be esimaed from he values given in he Table.4. 4.3.3.6. If ordinary concree made in accordance wih he proporions given for a paricular grade does no yield he specified due o proper qualiies of maerials no being available, such concree shall be classified as belonging o he appropriae lower grade.
