BROOKFALL & SHADOWBROOK APARTMENTS RULES & REGULATIONS/LEASE ADDENDUM (REVISED 10/10) THANK YOU FOR CHOOSING BROOKFALL & SHADOWBROOK APARTMENTS AS YOUR NEW HOME. WE HOPE YOUR TIME HERE WILL BE A LONG AND HAPPY ONE. BELOW ARE THE RULES & REGULATIONS THAT MUST BE FOLLOWED BY EACH RESIDENT. 1. RENT PAYMENT All rent is due on the first day of each month. There is a five (5) day grace period. As of the sixth (6 th ) day of the month, there will be a $25.00 late charge, plus late charges of $2.00 per day until the office receives payment. Evictions will be filed on the tenth (10 th ) unless satisfactory arrangements have been made with management which will result in an additional $40 fee. 2. NSF/RETURNED CHECKS There is a $30.00 charge for any returned check, plus all late charges listed above through the date the check is redeemed from our office. All returned checks must be paid by cashiers check or money order ONLY. After two (2) returned checks, we will no longer accept personal checks from that apartment. WE DO NOT ACCEPT CASH PAYMENTS FOR ANY REASON! 3. MOVE IN/MOVE OUT New residents are required to sign six (6) or twelve (12) month lease. At lease expiration, residents have the opportunity to renew their lease or continue their tenancy on a month-tomonth basis at the current market rate plus an additional fee of $50. 4. TERMINATION OF LEASE BEFORE EXPIRATION If the lease is broken for any reason, you agree to submit a thirty-day notice in writing and pay a lease buy-out fee equal to one and one half months rent for consideration of our agreement to permit early termination. 5. LOCKS AND KEYS A $25.00 fee will be charged for apartment lockouts after office hours and on weekends. This fee is payable to the person unlocking your door BEFORE the door is unlocked. Unauthorized locks are not permitted and the resident may not change existing locks. There is a $25.00 fee to change the existing lock for any reason not related to maintenance.

6. MAINTENANCE All maintenance requests should be called into the office at 855-0780. Requests will be recorded and kept in our files. After hour non-emergency calls may be left on the voice mail system provided at the office. Emergency maintenance only, (a problem causing damage to the apartment, building, grounds or one that results in a loss of essential services), should be called into the after hours answering service and your call will be returned by the maintenance employee on call. If the call is not an emergency, our staff has been instructed not to respond until the next business day. DO NOT CALL EMPLOYEES AT HOME, KNOCK ON EMPLOYEES APARTMENT DOORS OR STOP THEM IN THE PARKING LOT WITH MAINTENANCE REQUESTS! 7. PETS Only one pet per apartment is allowed. Pets are accepted at BROOKFALL I, BROOKFALL II AND SHADOWBROOK ONLY! Pet must be under 60 lbs. and spayed or neutered. Cats must be declawed on the front feet. Pets are allowed with an approved pet application and $300.00 non-refundable pet fee. A signed pet addendum is required before residents may have a pet in their apartment. Unauthorized pets will subject the resident to possible eviction. Guests may not bring pets on the property. (See pet addendum for complete pet rules.) 8. LAUNDRY FACILITIES Laundry facilities are provided for the exclusive use of the residents. Please help keep the laundry area clean. Please report any misuse of laundry equipment or broken machines to the office. 9. PEST CONTROL Pest control is provided for all apartments to effectively prevent a pest control problem. This service is provided weekly upon request ON TUESDAYS ONLY. If you have any pest control problems inside your apartment, please contact the office and an interior treatment will be scheduled for your unit. 10. DISPOSAL OF TRASH BROOKFALL I & II Dumpsters are provided for the disposal of household trash only. SHADOWBROOK A trash compactor is located near the rear entrance to Shadowbrook and is for household trash only. NO FURNITURE OR ANY LARGE ITEMS SUCH AS WASHERS, DRYERS, MICROWAVES, CONSTRUCTION DEBRIS OR ANY OTHER TYPE OF HOUSEHOLD FURNITURE OR APPLIANCES ARE TO BE PUT IN THE DUMPSTERS OR COMPACTOR OR LEFT BESIDE IT. THERE WILL BE A $40.00 CHARGE FOR ANY ITEM THAT HAS TO BE HAULED AWAY BY OUR STAFF.

11. GROUNDS You are responsible for helping us to keep the grounds clean. Please do not throw any litter down that would have to be picked up by our staff. THIS INCLUDES CIGARETTE BUTTS! Please report anyone you see abusing this rule. 12. FIREWORKS Fireworks on the property are strictly prohibited! 13. FITNESS CENTER (SHADOWBROOK RESIDENTS ONLY!) THE FITNESS CENTER IS FOR THE EXCLUSIVE USE OF SHADOWBROOK RESIDENTS AND THE FITNESS CENTER RULES ARE POSTED INSIDE. The Fitness Center is locked at all times and is accessible only by the resident s assigned key. ALL RESIDENTS UNDERSTAND THAT FITNESS CENTER IS TO BE USED AT YOUR OWN RISK. NO ONE IS ALLOWED IN THE FITNESS CENTER UNDER THE AGE OF EIGHTEEN (18) WITHOUT A PARENT OR GUARDIAN PRESENT. Do not allow underage children to enter the fitness center for any reason without an adult or guardian. 14. GUESTS AND NON-RESIDENTS Any person occupying an apartment for more that a two-week period that is not listed on the lease agreement must have prior approval to occupy the unit from management. It is a lease violation to move anyone in without written consent from the office, and could result in eviction. 15. PARKING AND MOTOR VEHICLES Each apartment has one assigned space marked by apartment number. All other unmarked spaces for second vehicles and guests are provided on a first come first serve basis. Parking in another resident s assigned space is prohibited, and cars will be towed at the owner s expense. The speed limit is fifteen (15) miles per hour and is not to be exceeded. Please turn down radios when driving through the property. Parking is provided for cars, vans, motorcycles and pick-up trucks under twenty (20) feet in length. Motorcycles and motorbikes are permitted in the parking areas only. Parking on sidewalks, entry areas, grass, under stairwells or in front of dumpsters, compactor or fire hydrants is prohibited and vehicles will be towed at the owner s expense. NO NOTICE WILL BE GIVEN BEFORE A VEHICLE IS TOWED. Major car repairs and oil changes are prohibited on the property. The resident will be charged for any damage to the parking areas caused by oil leaks. All vehicles are to maintain current license and registration as required by law. Abandoned or non-functioning vehicles will be tagged and towed at the owner s expense if not removed or repaired. BROOKFALL I & II Parking of boats, commercial trucks, trailers or recreational vehicles is expressly prohibited unless the vehicle is approved by management, recorded in your tenant file and parked in a designated area. SHADOWBROOK Parking for boats, commercial trucks, trailers or recreational vehicles is provided in the RV Parking Area only. All vehicles must be approved by management and recorded in your tenant file.

16. PORCHES AND DECKS/PATIOS AND BALCONIES In order to obtain a neat and uniform appearance of the properties, please keep porches and balconies clear of brooms, mops, bicycles, toys, garbage, towels, rugs, etc. A maximum of two lawn chairs per apartment, one small table and plants are permitted in these areas. Grills are not allowed for use on porches or balconies. They may be used at least twenty-five (25) feet from all buildings. Please do not dispose of ashes or used coals on the grounds. All rules concerning grills are in compliance with the fire code and insurance regulations. Please report anyone violating this rule for it is only to insure the safety of all. 17. PERSONAL PROPERTY It is recommended that all tenants obtain renter s insurance to cover all personal property in the apartment. We will not be responsible for loss, theft or damage to personal property. 18. GOOD NEIGHBOR POLICY Residents must respect the rights of their neighbors to quiet enjoyment of the property. Please keep noise levels to a minimum, especially late in the evening and in the early morning hours. Residents are responsible for the behavior of their guests. Two or more noise complaints could result in eviction. 19. ACTIVITIES IN PARKING AREAS All children must be supervised by an adult when outside on the property. Bicycles, skateboards, roller blades, etc. are not to be used on sidewalks or in between cars. All residents are urged not to let children ride or play in the parking lot areas or driveways. The parking lot is considered a private street and we will not be responsible for any injury that occurs when playing in these areas or any other area of the property. 20. VANDALISM Any vandalism or destructive behavior on the property could result in a notice to vacate. This includes buildings, sidewalks, parking lots, fences, laundry rooms, pool area, fitness center, offices, cars, etc. Please do not use chalk or paint anywhere on the property. 21. APARTMENT INTERIOR Your apartment has been decorated with custom mini-blinds and/or vertical blinds and wallpaper. You are responsible for the proper use and care of all items in your apartment during you tenancy. Any damages to blinds, wallpaper, flooring or appliances caused by improper use or care will be charged to the resident. 22. SMOKE DETECTORS The smoke detector in your apartment has been installed for your safety and the safety of your neighbors. Detectors are not to be removed except to be replaced or repaired by our maintenance staff. The tenant agrees to check the smoke detector periodically and notify management of any malfunction or power loss so our staff can make necessary replacement or repairs. Please report anyone violating this rule, for it is only to insure the safety of all.

THESE RULES AND POLICIES ARE SUBJECT TO CHANGE AND ADDITION AS MANAGEMENT DEEMS NECESSARY. THEY ARE LEGALLY BINDING AND WILL BE ENFORCED.
