1 AMENDED AND RESTATED RULES AND REGULATIONS VICTORIA SHORES CONDOMINIUM ASSOCIATION, INC. APPROVED BY THE BOARD OF DIRECTORS, JUNE 16 TH, 2011 Rules and Regulations are for the benefit of the overall population. Abuse of approved Rules and Regulations are subject to enforcement. Enforcement procedures are detailed at the end. 1. COMMON AREAS: Any sidewalks, driveways, entrances, stairwells and passageways which are General Common Elements or Limited Common Elements shall not be obstructed or used by any Owner or Tenant for any other purpose than to ingress or egress from the units. No vehicle belonging to Owners, Tenants, Family members or Guests of Owners or Tenants shall be parked in such a manner as to impede or prevent ready access to any entrance or to exit from the property. These areas include but are not limited to: driveways, fire lanes, walkways, and delivery areas. No article shall be placed on or in any of the General Common Elements or Limited Common Elements which are for the benefit of more than one unit except for those articles of personal property which are common property of all of the Unit Owners. Loitering is not permitted by Owners, Tenants, Family members or Guests of Owners or Tenants in any areas designated as Common. No running, rollerblading, skateboarding, bicycle riding, or the like is permitted at any time on any areas designated as Common. No bicycles, tricycles, scooters, rollerblades, skateboards, carts or wagons shall be used, operated, or allowed to stand on any portion of the Balconies or Common Elements. At the owner s risk, stairwells may be used to store such items provided they are tucked under the base of the stairs. The Association assumes no liability for, nor shall it be liable for any loss or damage to articles stored. 2. DECORATIONS The Association is permitted to display seasonal decorations in Common Areas not to exceed 60 days. Seasonal decorations are permitted to Unit residents with the following restrictions: Outside decorations are limited to front door only and are permitted for a maximum of 30 days. Use of decorations on the interior of units are to the unit residents discretion and (if hung inside a window affecting outside observance, must be removed in a maximum of 30 days). 3. HAZARDOUS MATERIAL: Owners, Tenants or their Family members or invited guests shall not use or permit to be brought into any building any flammable oils or fluids such as gasoline, kerosene, naphtha, or benzene, or other explosives, or other articles deemed hazardous to life, limb, or property without prior consent of the Board of Directors. LP gas fuels for barbeques are not permitted on the individual lanais. Residue from charcoal grills or the like is not permitted to be thrown into any designated common area for the purpose of cooling or extinguishing. Such action constitutes a fire hazard and parties responsible for such action are subject to maximum enforcement that the Florida Statute law provides in addition to Collier County enforcement. Barbequing is permitted 15 feet or more from the building.
2 4. LANAIS: No modification or alteration is permitted in any way to the structure or appearance of any lanai. Lanai s are to be kept clean and in neat condition, free of debris and refuse at all times. Lanais are not to be used for storage purposes or for keeping of animals in the animal owner s absence. If unit owner/tenant fails to do so, managing agent or Board of Directors reserves the right to correct such discrepancy at unit owner s expense. 5. NOISE/NUISANCE: Residents of Victoria Shores have the right to peaceful habitation. After 11:00 p.m. the following restrictions shall be enforced. Owners, Tenants, Family members, invited Guests shall exercise reasonable care to avoid making or permitting loud, disturbing or objectionable noises and in using or playing or permitting to be used or played musical instruments or devices in such manner that may disturb or tend to disturb owners or occupants of other units. Discharging firearms or fireworks is strictly prohibited. No Owner/Tenant shall use his/her unit, or permit it to be used, in any manner which constitutes or causes an unreasonable amount of annoyance or nuisance to the occupant of another unit, nor permit the premises to be used in a disorderly or unlawful way. The use of each unit shall be consistent with existing laws and the condominium documents with the Rules and Regulations promulgated in this document. Air conditioner noise is the responsibility of the Unit Owner. Repairs and service should be completed when notified of the problem. 6. OCCUPANCY: Maximum occupancy per unit is two (2) persons per bedroom. Occupancy in excess of approved amounts is in violation of County ordinance and Unit owners will be required to correct the situation. Unit owners, who have friends or family members occupying their unit, should inform the property manager of such occupancy. Each unit may be occupied by ONE family at a time. 7. VEHICLES AND PARKING: No vehicle belonging to Owners, Tenants, Family members or Guests of Owners or Tenants shall be parked in such a manner as to impede or prevent ready access to any entrance or to an exit from the property. These areas include but are not limited to: driveways, fire lanes, walkways, and delivery areas. Vehicles shall be parked within designated parking areas only and shall be operational at all times with current registration. Unit owners should use the parking space assigned to their unit only. Unit Owners and Tenants are required to register their vehicles with the Property Manager. All residents are required to display appropriate parking registration. Unit Owners and Tenants are required to obtain temporary parking passes for visitors staying overnight or longer. No hose washing, repairing or lubricating of vehicles is permitted in parking areas. Vehicles bearing commercial license plates and/or signage and/or exposed commercial service equipment are not permitted to park overnight in resident parking areas.
3 Recreational vehicles and trailers including, but not limited to: boats & trailers, travel trailers, motor homes, wave runners & trailers, ATV s & trailers are permitted to be parked in common areas. Motorcycles and/or gasoline propelled scooters are not permitted to be parked or stored in any common area overnight. In the event that an electric car is purchased, the Owner is responsible for getting the electric work up to their unit, to include burial of the cable. No vehicles may be parked in a fire lane for any length of time. Unit owners may permit other unit owners or renters to use their assigned space. A written agreement must be filed with the property management company. Violations are subject to be towed at Owner s expense. 8. PASSKEY: The Managing Agent, or if there is no Managing Agent, then the Board of Directors shall retain a passkey to each unit. If an owner or tenant alters any lock or installs a new lock on any door leading into the unit, the owner shall provide a key for Managing Agent s or Board of Director s use in the event of an emergency. In the event of the forced entry by emergency personnel, the owner shall be responsible for the repair of the door. 9. PETS: Domesticated animals (hereinafter termed animals and excluding any description of farm animal) shall be kept in such a manner so as not to disturb other residents and shall not be kept, bred, or maintained for commercial purposes. Pets, whose weight is in excess of 30 pounds, are not permitted. Known violent or aggressive animal breeds are prohibited for the welfare of all residents. This includes, but is not limited to: Pit-bull or Rottweiler dogs, Fighting Cocks, Panthers, Cougars, or any other aggressive member of the cat family, Python or any member of the snake family. Owners of animals assume full responsibility for personal injury or property damage caused by their pets and each owner of an animal must agree in writing to indemnify the Association and hold it harmless against any loss, claim or liability of any kind or character whatsoever arising from or growing out of the privilege of having an animal in the building. All responsibility for animals of visitors shall rest with the owners of the unit visited. Pets must be leashed when walked in public, and pet owner is responsibility to clean up pet s excretion at all times. Animals are not allowed to urinate on the buildings. Animals should not be staked out on the Common Areas. Maximum of two domesticated pets per Unit are allowed for OWNER OCCUPIED UNITS ONLY. Tenants are not permitted to have pets of any kind. 10. PHONE/TV/CABLE: No unit resident shall install wiring for electrical or telephone installation or for any other purpose, nor shall any TV or radio antennae, machines, or electrical apparatus or appliances (other than ordinary household appliances), heating or air-conditioning units be installed in the unit, on the exterior of the building or be installed in such a manner that they protrude from
4 the walls or the roof of the building or are otherwise visible from the ground, except as may be expressly authorized in writing by the Association. 11. RENTAL/LEASE OF UNITS: Unit owners are obligated to submit a completed lease application, executed copy of lease and fee of $100 payable to Victoria Shores Condominium Association, Inc. for Board approval PRIOR to fifteen (15) days of commencement of any unit lease. Application forms can be obtained from the Management Company. Unit owners are responsible for all damage done by their tenant s during the time of their occupancy, moving in or moving out. Keys to the recreational areas and to the mail boxes for any tenant are the responsibility of the Unit Owner 12. SALE OF UNITS: Unit owners are obligated to submit a completed Sale/Transfer Application, and fee of $100 payable to Victoria Shores Condominium Association, Inc. Board approval PRIOR to the commencement of any unit sale. Application forms can be obtained from the Management Company. 13. SIGNAGE: Signage of any type, i.e. for sale, for rent, garage sale, etc. is prohibited from display to public view from within any unit, or in or around the Common Elements of any building or surrounding common areas. Realtor or Owner OPEN HOUSE SIGNS are permitted, with prior Board approval, on Saturday and Sunday s only, between the hours of 9:00 a.m. and 5:00 p.m. Approval forms are obtainable from a Board member or Management Company and must be approved PRIOR to exterior signs being installed. 14. STORAGE UNITS The Association assumes no liability for, nor shall it be liable for, any loss or damage to articles stored in any approved storage areas. Any damage to the General Common Elements or common personal property caused by the Owner, Tenants and/or family or guest of either Owner or Tenants shall be repaired at the expense of the Owner. 15. TRASH: All trash must be placed in sealed or tied bags or containers prior to being put in an approved disposal area and shall be transported to such disposal areas by residents. Litter is unacceptable. Containers have been placed in areas experiencing the greatest need of litter control. We encourage all residents to utilize those containers for minor trash collection rather than discarding in the common areas, which we all utilize. TAKE PRIDE IN THE VICTORIA SHORES COMMUNITY. Recycling bins have been provided for such purposes as noted on the bin. We encourage proper use of such recycling bins. Packaging materials must be placed in dumpster if not permitted in recycle bins. Boxes must be broken down to a size which fits into the container.
5 Large Item Disposal charges are the responsibility of the Unit Owner. The Association will assist Unit Residents in this regard. However, the Association requires that any large item requiring special handling be brought to their attention in order to make arrangements for proper disposal by Collier County. Any additional charges involving removal of such item(s) will be investigated by the Property Manager and charges will be applied to appropriate accounts based on information provided by resident witnesses. Christmas trees should be placed on the Huntington berm and not in the Trash Collection area. 16. WINDOWS. No windows shall be covered with aluminum foil or similar material. No windows, doors or screen doors are to be left in the open position when the occupant has left the unit. It is prohibited to hang garments, rugs, or any other items from the windows, lanais, balconies or any of the facades of the building. No exterior clothes lines shall be erected. No outside laundering or drying of any garments is permitted. No rugs shall be beaten on the lanais. No dust litter, or rubbish shall be swept from the unit into the halls or hallways. 17. COMPLIANCE AND DEFAULT REMEDIES: FINES: The Board of Directors may levy reasonable fines against Unit Owners responsible for violations of Association Rules and Regulations or condone such violations by their tenants, family, or guests. These fines shall be in an amount deemed necessary by the Board to deter future violations, but in no event shall any fine exceed the maximum amount allowed by law. Unit Owners will be given reasonable notice and a reasonable opportunity to correct the violation. Unit Owners will have the opportunity to be heard before a committee of unit owners prior to any fine being imposed for an uncorrected violation. 18. VIOLATION ENFORCEMENT PROCEDURE Unit owner will be notified in writing of an existing violation. At that time the Unit Owner will be given a 14 day timeframe in order to correct the violation. If pertinent, the Unit Owner will be offered assistance in having repairs made and the cost of those repairs shall be added to the Unit Owner s account. If the violation is not corrected within 14 days, a Certified, Return Receipt letter will be mailed to the Unit Owner notifying them of the date, (not less than 14 days from the date of the letter), time and place that the Violation Hearing will be held. The Unit Owner will be encouraged to attend the Violation Hearing in order to present evidence, written or oral argument on all issues involved, and shall have opportunity at the Violation Hearing to review, challenge, and respond to any material consideration by the Hearing Committee. The Committee will then excuse the Unit Owner and deliberate. If pertinent, the Committee will recommend a fine to be not less than $25 per day for each day that the violation continues to go uncorrected up to a maximum of $1000 per violation as permitted by law.
6 19. CORRECTION OF HEALTH AND SAFETY HAZARDS: Any violations which are deemed by the Board of Directors to be a hazard to the public health or safety may be corrected immediately as an emergency matter by the Association and the cost thereof shall be charged to the Unit Owner. 20. NEGLIGENCE/DAMAGE CAUSED BY CONDITION IN UNIT: In the event that a unit should be damaged due to a water leak or any other uncontrollable act, the association will only be responsible for the limited common area, such as drywall inwards. If the occurrence is due to the lack of maintenance by a neighboring resident and causes damage to your unit, the offending unit which the leak or action began in will be responsible per 11.7 of community documents. 21. UNIT OWNER REQUIRED MAINTENANCE: Each Unit Owner is responsible for the following: -Screen, windows, and window glass - Entrance Door to the Unit and its interior surface -All other doors within the unit and its interior surface -All Electrical, Mechanical and Plumbing fixtures, switches, valves drains and outlets -ALL Appliances, Water Heaters, Smoke Alarms, and Vent Fans -All Air conditioning, and Heating equipment, thermostats ducts, and installation servicing that unit exclusively. -Carpet and Flooring -Door and window hard ware -The Main water shut off in that unit -All Interior, partition walls which do not form part of the boundary of the unit. -All Drywall, lath, Plasterboard, Furring and similar materials in the perimeter walls and ceilings of the unit. The association maintains the limited common areas and requires per your documents that you service your unit s equipment. If you do not service your Mechanical equipment and it causes damage to another unit you will be held responsible. 22. INDIVIDUAL UNIT INSURANCE COVERAGE: 15.1 Of Victoria Shores Declaration of Condominium: Each Unit owner is responsible for insuring his own unit, and the personal property therein; all floor, wall and ceiling coverings; all built in cabinets, appliances, water heaters, air conditioning and heating equipment, and electrical fixtures which it is required to carry by law and under the Condominium Documents, and may obtain and keep in force any and all additional insurance coverage as it deems necessary. The association asks that you obtain and maintain your own personal property insurance policy to protect yourself and the unit owners around you. The association also asks that you provide proof of this insurance on an annual basis.
