Procurement Options Available Framework OJEU trust based OJEU collaborative based OJEU - EPR
Frameworks Already through OJEU May be national, local or commercial Typically contract T&Cs set These may also be set: Price Term Supplier choice Often involves local tendering from shortlist
OJEU these are changing the open procedure, under which all those interested may respond to the advertisement in the OJEU by tendering for the contract; the restricted procedure, under which a selection is made of those who respond to the advertisement and only they are invited to submit a tender for the contract. This allows purchasers to avoid having to deal with an overwhelmingly large number of tenders; the competitive dialogue procedure, following an OJEU Contract Notice and a selection process, the authority then enters into dialogue with potential bidders, to develop one or more suitable solutions for its requirements and on which chosen bidders will be invited to tender; and the competitive negotiated procedure, under which a purchaser may select one or more potential bidders with whom to negotiate the terms of the contract. An advertisement in the OJEU is usually required but, in certain circumstances, described in the Regulations, the contract does not have to be advertised in the OJEU. An example is when, for technical or artistic reasons or because of the protection of exclusive rights, the contract can only be carried out by a particular bidder.
OJEU Trust Based You will need: To develop the specification ( or borrow one and amend) Develop the business case for internal sign off (typically 5 case model) Select the most appropriate OJEU route to follow Select the contract you will use (ie OGC, updated PASA) Run the tender typically 6-9 months Complete the contract and business case If you are a non FT then TDA may be involved in approval
OJEU - Collaborative You will need: To do as for the trust but multiple time for the business case Agree very strong governance Have sign off and recourse to CEO s so everyone plays nicely Normally requires a central programme director or non trust body who can act a lead and arbitrator The same vision across the collaborative Patient Acceptance that sometimes the process will move at the rate of the slowest member
OJEU - EPR How well do you get on with your IT friends? Who is leading? What say does radiology have? Can you ensure that the RIS and even the PACS will work for you as now? Have the benefits of this approach been mapped out (there are many of them)? Is radiology part of the larger design team for this approach and been involved from the outset?
Summary OJEU s are well under way or complete Frameworks are being used Some trusts have taken short terms options to wait and see Please don t wait for someone to come along and solve it for you..
