THORNTON LE DALE PARISH COUNCIL Minutes of the Meeting held on Tuesday 5 th April 2011 at the Hill Memorial Institute Present: Councillors: G Acomb, (Chairman), P Mills, D Porter, R Hetherton, C Olsson, J Garbutt, C. Wilkin. In Attendance: J Leng (Clerk), N Baxter (Press) A. Marsden (Agenda Item 4 - Allotments). Code of Conduct: Declarations of Interest were declared by: Cllr. Mills for Agenda Item 7 (Planning Applications) 122. Apologies: None received. 123. Absent: None. 124. Public Questions: A concern was raised by a Parishioner regarding a proposed new bridge on a planning application for discussion at the meeting. The Chairman informed the Parishioner that she should raise her concern with NYMNPA. 125. Allotments: Andrew Marsden thanked the parish council for sending out the letters regarding the proposed setting up of the Allotment Association. He received 9 replies out of 36 sent out. 8 were in favour and a further 2 were interested. An inaugural meeting would take place shortly and a member of the parish council would be invited. (Cllr. Wilkin arrived) Due to a large number of parishioners waiting for available allotments, the parish council agreed to halve 2 plots that have become available, thus giving 4 people ½ an allotment each. The rental on the ½ plots will be 14. If ½ an allotment isn t required then the parishioner will stay on the waiting list until a full one becomes available. The size of plot 35 and 35a was discussed. The tenant of the plots considers that he does not actually have two plots. Members, after consideration and 1

looking at photos of the plot, agreed to reduce the amount payable from this year to 40 per year. i) THAT the Clerk notifies the 4 parishioners at the top of the allotment waiting list of the opportunity to have half a plot for the sum of 14. ii) THAT the Clerk informs the allotment holder of the parish council s decision to charge a new rate of 40.00 for plot 35. 126. Minutes of the Meeting of the Council: The minutes of the meeting held on 01 st March 2011 were received. THAT the Minutes of the Meeting held on 01 st March 2011 be approved and signed by the Chairman as an accurate record. Matters Arising Rental of Bull Field A concern regarding horses grazing on the Bull Field was discussed. Cllrs Hetherton and Mills thought that horses may make a mess of the field and would prefer to see the field kept in the spirit it was intended (more for flocks and some herds of animals). Horses using the field for grazing made more money and the rental has increased by 65 this year. Cllr. Porter noted that as the field was in trust, the parish council had a duty to obtain as much money as possible from the rental of the field. Village Traders Cllr. Garbutt informed members that a meeting would be held on Thursday 07 th April 2011 and all were welcome to attend. Clock Winding The Clerk informed members that after asking Smiths of Derby if they would be willing to match Cumbria Clock Company s quote she did not receive a response until 2 weeks later (to agree to match the quote)by which time it had been decided to give the contract to Cumbria Clocks as Smith s had not responded. Members agreed that Cumbria Clock Company Limited would be doing the work. A 30% deposit would be required from Cumbria Clock Company Ltd. A donation kindly offered on behalf of a former resident of the village would be received at Thornton le Dale Show. Music on the Green Cllr. Hetherton asked if the Village Traders had obtained a licence to perform on the village green this year. Councillors were unsure but the Clerk would ask Martin Blythe. A copy of a letter previously sent to Mr Blythe regarding Music on the Green would be sent to all Councillors for information. Cemetery Shed Cllr Mills informed Members that he had received 3 quotes from local builders to repair the stone shed. As variations in the price were too great, the Chairman suggested that the matter be discussed at a later date (after the elections in May) Cllr Mills asked to receive the initial letter asking for quotes from the Clerk. 2

127. Accounts for Payment: The Clerk submitted a list of accounts for payment. THAT the list of accounts circulated be passed for payment and cheques signed in accordance with the accounts submitted. 128. Planning Applications: NYM/2011/0155/LB NYM/2010/0969/FL Grid Reference: 483377 482465 Bleach Mill Farm, Maltongate, Thornton le Dale. Development Description: Application for Listed Building consent for internal and external alterations and extensions to outbuilding to form dwelling. Application for change of use, alterations and extensions to outbuilding to form a dwelling together with creation of a new beck crossing. Mr & Mrs P Mills Cllr Mills declared an interest and left the building. THAT Members of this Council have no objection to the internal and external alterations and extensions to the outbuilding to form a dwelling, however, concerns regarding a new beck crossing, especially the positioning (road visibility) and the height and design of the proposed bridge, which may cause a backup of water when the beck is in spate, meant that Members of this Council objected to the proposed application. NYM/2011/0138/FL Grid Reference: 485658 487293 8 Low Dalby. Development Description: Application for installation of 3no. upvc windows and 1no.uPVC door. Mr Damian Smith THAT Members of this Council had no objection to this proposal. 3

Additional Information/Amended Details: NYM/2011/0047/FL Grid Reference: 483709 483291 Ellerbeck House, Priestmans Lane, Thornton le Dale. Development Description: Application for construction of a single storey extension to the southern elevation. Mr and Mrs Calam Amended Design railings rather than parapet wall to south elevation. Ryedale District Council Description: 11/00168/CLOPUD Top Bridge Lodge, Thornton Lane, High Marishes, Malton. Certificate of Lawfulness to determine whether the occupation of the applicant would satisfy the terms of the agricultural occupancy condition, that being Condition 03 of planning approval 3/135/96A/PA dated 03.10.1977. Mr A Crawford THAT Members of this Council had no objection to this proposal. 128. Planning Decisions: The Clerk reported receipt of planning decisions as notified by the Authority and Ryedale District Council. April 2011 For Information Only: Trees in conservation Area Hazel Croft, Westgate, Thornton le Dale proposed removal of 2no. Leyland Cypress. Hedgerow Removal Notice Highfield Grange, Thornton le Dale retention notice issued as hedgerow met criteria for an important hedgerow (existed for 30 years or more and a record is held as an integral part of a field system pre-dating the Inclosure Acts. 129. Chairman s Report: The Chairman reminded Cllr. Olsson of the trimming of a tree covering a No Entry sign in the centre of the village. Cllr. Olsson mentioned that the work to trim the tree would be undertaken on Friday. 4

A parishioner living next to the cemetery has requested permission to build a low stone wall next to the cemetery hedge. After a site visit (by the Chairman) the Chairman suggested that permission be given for the work. Councillors agreed and asked the Clerk to send a letter advising of the parish council s decision and also ask that the parishioner be responsible for replacing the hedge if it is damaged whilst the work is undertaken and also to maintain the hedge height. Advertising boards were again causing an obstruction on the pavements in the village the Chairman noted and asked that the Clerk send another letter asking NYCC Highways to enforce removal as the parish council would not be responsible for any impending accidents. 130. Clerk s Report: The Clerk received a request from Mr Alvey for better plants this year in the planters outside the Almshouses. Cllr Garbutt noted that there were decent plants there already but kindly offered to provide the Village Caretaker with further plants for the planters. Cllr. Porter suggested that a flagpole was erected on the Institute building to be used on special occasions. The Clerk is to ask the Institute Management Committee and NYMNPA for any comments/permission required regarding the matter. Cllr Porter also asked for a letter of thanks to be sent to Greta and John Skaife for their tireless work in keeping the flowers looking lovely at the Remembrance Memorial (outside of the Institute). Cllr Garbutt informed Members of fly tipping that has occurred at the top of Whitbygate. The Clerk is to inform RDC Streetscene. Cllr Olsson noted that the old street light on Dog Kennel Lane hasn t been removed since the new one was erected. The Clerk is to ask RDC for removal of the old light. A trench-type hole in the road near the village green requires attention by NYCC Highways Cllr. Porter noted. Councillors agreed to hold a meeting on the 3 rd May 2011 (the Annual Parish Meeting will be beforehand). The Annual Meeting will be held on the 12 th May 2011. There being no further business the meeting was adjourned at 8.55pm (for the Clerk s appraisal) and the press and public asked to leave.
