Development Clawback Both lots will be offered for sale subject to a clawback in favour of the current Seller arising from the future development of the land or any part thereof within a period of 80 years from the date of completion. The amount of the clawback to be paid by the Buyer (or any subsequent owner or security interest holder) following the grant of planning consent for any development or change of use will be 50% of the uplift in value, to be the difference between the value of the land or the relevant part with planning consent and the aggregate of the then agricultural value with actual costs relating to obtaining of planning consent. Tenure The property is offered for sale with vacant possession given on completion. Basic Payment Scheme The land is registered for Basic Payment Scheme purposes, however there is no Basic Payment Scheme Entitlements included in the sale. Environmental Schemes The land is currently not entered into any Environmental Stewardship agreement. Definitions of Guide Price and Reserve Price Guide Price: An indication of the Sellers s current minimum acceptable price at Auction. The guide price or range of guide prices is given to assist prospective Buyers in deciding whether or not to pursue a purchase. It is usual, but not always the case that a provisional reserve range is agreed between the Seller and the Auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the Seller at any time up to the day of the Auction in light of interest shown during the marketing period, a guide price is issued.
