packaging waste regulations One of the better-known legislative initiatives to be implemented in recent years is the Producer Responsibility (Packaging Waste) Regulations 2005. Aimed at larger businesses in the packaging waste chain, the regulations currently affect businesses with a turnover of 2m+ who also handle more than 50 tonnes of packaging per annum. These businesses are required to register and provide data on packaging supplied. They must also calculate and meet stringent packaging recovery and recycling targets through PRNs (Packaging Recovery Notes) and certify their compliance, or face criminal prosecution. This is simply practical environmental management and common sense, but there are ways in which Veolia Environmental Services can lighten the administrative burden that these obligations place on your company. The Environmental Protection Act 1990 imposes a Duty of Care on producers of controlled waste, requiring them to take all reasonable steps to keep waste safe and ensure it is properly managed. The Duty of Care applies to anyone who "produces or imports, keeps or stores, transports, treats or disposes of waste". This legal requirement ensures that all waste producers follow the correct procedures for the containment, collection and disposal of waste. Under the Act, a transfer note describing the waste must be produced for every waste transfer. It is your responsibility to give correct written information on your Waste Transfer Note, signed by an authorised employee of your company and kept for two years. Monitoring and inspection by the Environment Agency has increased in recent years; if you break this law, you risk prosecution. Managing your obligations Your obligations under this legislation can be fulfilled annually. Veolia Environmental Services will supply you with your annual Waste Transfer Notes two months before they are due for renewal and will keep records of your Waste Transfer Notes for the required two year period. Having your records on our database means we can rapidly update and amend the system if your waste details or any other aspects should change, at no further inconvenience to you. Veolia Environmental Services manages this system for our clients in order to ensure that they comply with the law and to provide complete peace of mind.
