SYLLABUS: The course is delivered through 7 modules: MODULE 1 - CONTRACT ADMINISTRATION This module discusses the contract documents, programmes, planning, project records and notices and focuses on how good contract administration systems and procedures will help matters relating to claims. The assignments require you to discuss contract administration systems on projects on which you have worked and suggest ways that you may have helped or hindered claims. Assignments also cover procedures for managing claims and the writing of contractual notices in the correct form. MODULE 2 - TYPES OF CLAIM The ability to identify events that may give rise to claims is essential and this module discusses the various types of claim that are common within the industry. The module asks you to examine four case studies and identify circumstances that may lead to claims. You are also required to identify entitlement for the claim issues under the contract, discuss any legal principles that may be relied on and describe how the claim should be evaluated. MODULE 3 - STRATEGY, CLAIMS MANAGEMENT AND PRELIMINARIES TO THE CLAIM A claim strategy will dictate how claims are to be presented and how the respondent will deal with them. This module guides you into deciding suitable strategies from both the claimant s and the respondent s points of view. project, details of the contract and set the scene for the claim so that the reviewer may properly understand the issues in question. MODULE 4 - CAUSE AND EFFECT The analysis of cause and effect is one of the most important parts of a claim or response and if not dealt with correctly the claim may fail. In this module you are guided through the linkage of cause and effect and are required to produce cause and effect narratives, in the format that they could be included in a claim, for events detailed in a case study. MODULE 5 - DELAY ANALYSIS AND ENTITLEMENT used to demonstrate the effect of a delay on the time for completion. You are required to perform two simple delay analyses using commonly used techniques and produce narratives that could be included in a claim to explain them. The second part of the module deals with the claimant s entitlement and you are required to examine two case studies and produce narratives that could be included in a claim to properly demonstrate the claimant s entitlement. MODULE 6 - RESPONSES AND DETERMINATIONS Every claim requires a response and a response document should deal with the claim in a way that persuades both the claimant and the project owner that the response or determination of the claim is correct. This module asks you to produce response documents for three claims that are presented with varying degrees of detail and also to respond to them from both an equitable standpoint and a defensive point of view. MODULE 7 - WRITING, COMPILATION AND PRESENTATION OF A CLAIM produce an extension of time claim for one of the case studies.
