LAWRENCE COUNTY COMMISSIONERS MEETING PUBLIC MEETING MINUTES OF Tuesday, May 13, 2014 The Lawrence County Commissioners Meeting was opened with the Pledge of Allegiance to the Flag followed by a Moment of Silence. The Lawrence County Commissioners Meeting of Tuesday May 13, 2014 was called to order by Commissioner Dan Vogler, at 10:00 a.m. in the Commissioners Meeting Room.. Office Manager Carol MacDonald called the Roll. Those in attendance were, Commissioners, Dan Vogler, Robert Del Signore, Sr., Steve Craig,; Chief Clerk/County Administrator James Gagliano, Clarence Nelson, Ed Allison, J.R. Hardester, Amy McKinney, Jeff Parish, Mary Kelly, Butch Wehr, and News Media. It was stated for the record that the meeting is being taped. Those wishing to speak shall be given five minutes. If they need more time, they are to see the Chief Clerk at another time and he will arrange for them to meet with the Commissioners. Those speaking are to state for the record their names, addresses and the nature of their business. Mr. Del Signore attending meeting at Vulcan Industries. ROW OFFICERS REPORTS AND COMMENTS GENERAL PUBLIC It was announced that J.R. Hardester, Chief Assessor received an award from the State Assessor s Association. Industrial Development 1. Meeting of Tuesday, May 6, 2014 APPROVAL OF MINUTES Moved by Mr. Craig seconded by Mr. Vogler to accept and file the minutes. Motion carried 2-0. Mr. Vogler congratulated Mr. Hardester on receiving the award. Mr. Craig had no comments Resolutions to be taken off the table: R E S O L U T I O N R-2014-060

WHEREAS, the Lawrence County Board of Commissioners is in need of the professional services of a Financial Advisor regarding a financing plan. NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that: 1. Robert W.E. Fisher, Registered Municipal Advisor, 239 4 th Ave. Ste. 1301, Pittsburgh, PA 15222, is hereby appointed as the Financial Advisor to assist in the preparation of a plan involving the issuance of a single general obligation debt issue. 2. The payment of the fees shall not exceed $15,000.00, payable from the proceeds of the proposed Obligations upon settlement of the sale of the Obligations.. Moved by Mr. Craig seconded by Mr. Vogler to approve said resolution. Motion carried 2-0. R E S O L U T I O N R-2014-061 WHEREAS, price quotes were requested from PennDOT approved appraisers by Taylor Engineering for the North Street Bridge replacement; and WHEREAS, proposals for the Right-of-Way Appraisal Contract for the North Street Bridge replacement were received by Taylor Engineering from two firms. NOW, THEREFORE BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS; that 1. Proposals for the Right-of-Way Appraisal Contract for the North Street Bridge replacement shall be awarded and authorization is given to execute an agreement with the appraiser listed below for an amount not to exceed $5,500.00. a. Chiappetta Agency, Inc., 1225 8 th Avenue, P. O. Box 439, Beaver Falls, Pa 15010. Moved by Mr. Craig seconded by Mr. Vogler to approve said resolution. Motion carried 2-0. R E S O L U T I O N R-2014-062 Whereas, budgets cannot always anticipate every extraordinary, ordinary, or contingency situation which arises throughout the fiscal year; and Whereas, Section 1784 of the County code permits the Commissioners by resolution to authorize budget transfers from any encumbered balance; and Whereas, the need to provide additional appropriations to certain accounts now exists. NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that: 1. Authorization is hereby given to the appropriate administrative officials to transfer a total of $12,000.00 described in detail on the attachment(s) designated as T-2014-3 a. Department of Public Safety Amount: $12,000.00 From: 01.411100.509000 Commissioners Contingency To: 01.421500.403100 Vehicle Expense Mr. Del Signore entered the meeting. R E S O L U T I O N R-2014-063 Whereas, The Lawrence County Jail had problems with the Dish Machine from U.S. Foods; and Whereas, Reinhart Foodservice gave the Lawrence County Jail a loner unit to use with the option to lease; and NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that; 1. A Dish Machine shall be leased to own from Reinhart FoodService, of Pittsburgh, PA for a five year term at an amount not to exceed $310.00 per month. 2. After the five year term, the machine will become property of the Lawrence County Corrections. 3. Reinhart FoodService is responsible for all repair, labor and parts during the leasing five-year Fperiod. Moved by Mr. Del Signore seconded by Mr. Craig to amend the agenda. Motion carried 3-0. Whereas, the Board of Commissioners wish to contract with a third party to provide maintenance of the emergency generator system at the Lawrence County Correctional Facility (Jail). NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS, that: 1. Emergency Generator Systems of 383 Brownhome Road, New Castle, PA 16105 is authorized to provide those services identified in the attached contract. 2. Total expenses for said contract shall not exceed $95.00 for the period of June 2, 2014, through June 2, 2015. R E S O L U T I O N R-2014-065 WHEREAS, on March 25, 2008 the County entered into an agreement with Johnson Controls, Inc. of Youngstown, Ohio to develop and implement energy and infrastructure improvements for the County; and WHEREAS, additional infrastructure improvements have been identified for Phase II of the project that requires the approval of a Project Development Agreement (PDA); NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISSIONERS; that a Phase II Project Development Agreement (PDA) between the County and Johnson Controls is approved. R E S O L U T I O N R-2014-066 Whereas, the Board of Commissioners of Lawrence County has determined that the former Almira Home, now serving as the offices of the Lawrence County Children and Youth Services, is in need of repair; and Whereas, the Board published a request for bids to complete the necessary repairs; and Whereas, complete bids for the repair work were received and opened at a public meeting of the Board of Commissioners. NOW, THEREFORE, BE IT RESOLVED BY THE LAWRENCE COUNTY BOARD OF COMMISISONERS, that: 1. The County will enter into an agreement with Arnold Blashak of 320 Shaw Street, New Castle, PA 16101 to complete the repairs identified in the attached document. 2. Mr. Blashak will provide these services for a fixed fee price of $59,800.00 R E S O L U T I O N R-2014-067 WHEREAS, Section 1784 of the County Code, Supplemental Appropriations Transfer of Fund; Appropriation Limits authorizes the Board of Commissioners, by resolution, to make supplemental appropriations for any lawful purpose from any funds on hand or estimated to be received within the fiscal year and not otherwise appropriated; and WHEREAS, various County departments have realized unanticipated income; and WHEREAS, the adopted 2014 budget must be adjusted to account for the additional income.
