Introduction Purpose The purpose of THE WINGMAN STANDARD is to reflect our customer s performance expectations when they purchase charter. WYVERN is not a regulatory authority; compliance with THE WINGMAN STANDARD, beyond the regulatory requirements of the governing Civil Aviation Authority (CAA), is voluntary. Policy Statement In accordance with WYVERN s policy, WYVERN reserves the right to remove an Operator from The Wingman Report (TWR) at any time due to significant operational changes, in the event of an incident or accident, or for any reason deemed detrimental to the intent and the integrity of THE WINGMAN STANDARD. WYVERN will not audit or re-audit a company with a fatal accident in the last five years unless the final National Aviation Accident Investigation Authority report has been issued. Background Some of the most sophisticated and efficiently run flight departments around the world share certain operational traits that govern their processes, procedures, systems and policies which are commonly referred to as Industry Best Practices. THE WINGMAN STANDARD is based on the operating practices of those departments and organizations. The following requirements, as set forth in THE WINGMAN STANDARD, reflect Industry Best Practices and operational oversight that are indicative of a safe, world-class aviation organization and are a reasonable and achievable program for those charter operators who commit to operate to a higher standard. Applicability Operators are evaluated against the criteria contained in THE WINGMAN STANDARD, the requirements of their internal policies and procedures, and against recognized industry best practices. Wyvern has chosen to benchmark the Wingman Program audit processes using the International Standard of Business Aircraft Operations (IS-BAO) Standards and Recommended Practices. The scope of the evaluation includes those operational activities referenced in the IS-BAO protocols, a review of the company operational history and safety record, Safety Management System (SMS), Internal Evaluation Program (IEP), administrative composition, technical documentation, pilot and aircraft records, training requirements, and maintenance operations including technician training and experience. An Operator s adherence to THE WINGMAN STANDARD and successful audit conducted by WYVERN will achieve WINGMAN Certification. Organization Sections 1 3, are general requirements of THE WINGMAN STANDARD and are applicable to all operators, regardless of aircraft type, base location, and mission. The appendices that follow further specify the requirements for functional missions and further clarify resources that are used as references in THE WINGMAN STANDARD. In sections where the Appendix differs from the general requirements, the Appendix shall take precedence. All technical terms used herein will be aligned with those supplied in Appendix C document (f), unless otherwise defined by WYVERN. 3

Scope Wyvern performed a Wingman Standard Audit on The Berkeley Group LLC on July 22-24, 2015. The Berkeley Group LLC was evaluated for compliance with: The requirements of the Operator s policies, actual practices, and procedures; The Wingman Standard by Wyvern; The International Standard of Business Aircraft Operations (IS-BAO) Standards and Recommended Practices. The scope of the audit included; however, was not limited to: Interviews with Key Personnel; A review of The Berkeley Group LLC s Safety Management and Emergency Response Systems; A review of The Berkeley Group LLC s administrative composition; A review of The Berkeley Group LLC s operational history and safety record; A review of The Berkeley Group LLC s operational control; A review of The Berkeley Group LLC s company manuals; A review of The Berkeley Group LLC s Pilot and Aircraft records; A review of The Berkeley Group LLC s training requirements and records; A review of The Berkeley Group LLC s security procedures; A review of The Berkeley Group LLC s maintenance operations. The term referred to as Non-conformity is the non-fulfillment of a requirement specified in the most current version of THE WINGMAN STANDARD (TWS) by WYVERN. TWS is an established criteria used as a basis for measuring an operator s level of non-conformity. Any non-conformity identified during the audit requires evidence of remedial action before WYVERN can determine compliance. Compliance is defined as a product of activity that meets required characteristics and was performed in accordance with the required processes and system requirements; the output of one or more processes and the controls under which the processes occurred. Non-Conformities Identified Below are the Non-Conformities that were identified during the onsite-evaluation. The Operator, at the time of the audit, was found to be in compliance with all other sections of The Wingman Standard by Wyvern, as well as ICAO, 9859 as it applies to Safety Management Systems, and, Emergency Response Plans that are not listed below. 1 Non-Conformities Regarding IS-BAO Protocols 3.2.2.b. A Safety Risk Profile has not been performed toward company s SMS. Resolutions Providing Compliance The Operator has provided documented evidence to the IS-BAO Auditor, and has been found to meet the IS-BAO criteria. 1 Wingman Specific Non-Conformities Company ERP does not list Wyvern within the company s ERP notification list in the event of an accident or incident (Ref. The Wingman Standard 1.4.2). Resolutions Providing Compliance The Operator has provided documented evidence to Wyvern Audit Management, and has met the Wingman Standard criteria. 4

They are authorized to operate two charter ready fixed wing aircraft based at the primary location; and, their most recently issued Aircraft Authorization Operations Specification has an effective date of 05SEP2014. The Berkeley Group LLC holds Air Operator Certificate number 9TBA565M, originally issued on 21JAN2010 by The US Department of Transportation Federal Aviation Administration, and is valid indefinitely. All of the aircraft types are approved for the use of a Minimum Equipment List, (MEL), and an Electronic Flight Bag. The Operator is also authorized to operate under the following Doing Business As, (DBA), name: NV Jets. The Berkeley Group LLC s Accident / Incident History The company stated that there have been no accidents or serious incidents in the past 5 years and a search of aviation safety databases, at the time this report was created, confirmed no significant records. The Berkeley Group LLC s Safety Management System (SMS) Per the Wingman Standard. The Operator shall have a well-documented and implemented Safety Management System (SMS) in compliance with ICAO Document 9859, 3rd Edition, dated May 2013 or the most recent revision. The SMS shall be under the direction and control of a designated Safety Manager (or equivalent title). The SMS shall include systematic procedures, practices and policies for the management of risk including a comprehensive Emergency Response Plan (ERP) as outlined in Chapter 5, Appendix 3 of the same ICAO document as referenced above. a. The Safety Manager will be shown in the Operator s Table of Organization as having direct access to the most senior management person in the company. b. The system shall include an established Safety Committee whose membership is comprised of representatives from each department within the company, e.g., flight operations, maintenance, scheduling, administration, etc. The Chair of the Safety Committee will report directly to the President of the company and may be the designated Safety Manager. The committee will meet at least quarterly. c. All company employees must have direct access to the Safety Manager and the Safety Committee regarding safety issues and all reported issues must be free from the threat of reprisal. d. The responsibilities and authority of the Safety Committee and Safety Manager must be documented with all pertinent information in the Operations Manual or a standalone Safety Manual that has been approved by senior management and communicated to the department. e. The Operator shall continually improve the effectiveness of the SMS through the use of the safety policy, safety objectives, audit results (internal and external), data collection & analysis, corrective & preventive actions, and management review. f. The Operator shall develop a policy in the company SMS that would require that a Flight Risk Assessment Tool (FRAT) be used prior to each flight departure that would identify potential hazards and weigh the risk associated with each hazard. This FRAT should allow for mitigation of potential hazards that would allow for the reduction of risk to an acceptable level. The Berkeley Group LLC implements a documented Safety Management System (SMS). The Auditor measured the Operator s Safety Management System against The Wingman Standard, and, with the guidelines of ICAO Document 9859, 3rd Edition, dated May 2013. There were required improvements cited in the non-conformities section that the Operator has now met, and proven compliance with. The SMS is under the direction and control of a designated Safety Manager that includes systematic procedures, practices and policies for the management of risk including an Emergency Response Plan (ERP) as outlined in Chapter 5, Appendix 3 of the same ICAO document referenced in this section. The Berkeley Group LLC s Aircraft Liability Detail Aircraft liability insurance coverage for the Operator s aircraft is provided by the following Underwriter: Federal Insurance Company Policy # 9958-7399-05 valid through 14FEB2016 This policy is written with a Combined Single-Limit (CSL) liability of $100 million per aircraft. Conclusion The Berkeley Group LLC provided evidence that the non-conformity has been resolved. Accordingly, WYVERN finds The Berkeley Group LLC to be in compliance with the requirements of THE WINGMAN STANDARD by WYVERN. 7
