2 nd Annual DUI SUPER SYMPOSIUM August 3-6, 2011 Rafe Banks, DUI Attorney Rafe Banks is a partner in the Cumming, GA law firm of Banks & Stubbs, LLP and a member of the Georgia Bar for over 30 years; Rafe Banks is a graduate of Emory College and Emory University Law School. A former prosecutor, he was an assistant District Attorney in the Blue Ridge Judicial Circuit for three years and District Attorney of that circuit for another 8 years. Since 1989, he has been in private practice in Cumming, Ga where his practice is almost exclusively criminal defense. A large part of that practice consists of DUI defense. Admitted to practice in the U.S. District Court for the Northern District of Georgia, the Georgia Court of Appeals, the Georgia Supreme Court, the U.S. Court of Appeals for the Eleventh Circuit and the U.S. Supreme Court he also has an active appellate practice. Nancy Bills, State Court Judge Judge Nancy Bills graduated Cum Laude with a BA Degree from UGA and then Cum Laude from Law School at UGA. After graduation from law school in 1989, she came to Rockdale Co. and began work as Assistant District Attorney. In 1996, became the Chief Asst. District Atty and worked in the District Attorney s Office as an Asst DA for over ten years. Judge Bills went into private legal practice for five years and handled primarily criminal defense and domestic cases. Until running for State Court in July 2004. Elected to the State Court Bench in January 2005, Judge Bills was re-elected in November 2008 to another four- year term. She began the Rockdale County DUI Court in 2006. Dr. Joe Citron, Ophthalmology Expert Dr. Citron is a graduate of the Albert Einstein College of Medicine and the Mayo Clinic. As a board certified Ophthalmologist, Dr. Citron has practiced medicine for over 35 years in Georgia. He has been involved in instructing police and other law related personnel for 30 years. Dr. Citron has given many instructional lectures regarding field sobriety tests and medical conditions. He has been a speaker at national and international conferences as well as authored chapters in legal texts regarding field sobriety tests. In 1997, Dr. Citron received his degree as a lawyer from the Georgia State College of Law and passed the Georgia Bar that same year. He splits his time between practicing medicine and legal consulting in criminal and civil cases. Matthew Cook, Personal Injury Attorney Matthew Cook is partner with McDonald, Cody & Cook, LLC in Atlanta, Georgia. He is a graduate from Walter F. George School of Law at Mercer University. He is a member of the American Bar Association; State Bar of Georgia, the American Association for Justice; Georgia Trial Lawyers Association; and Columbus Younger Lawyers Club. His firm focuses on wrongful death and Personal Injury litigation representing injured victims and their families in cases arising from tractor-trailer wrecks, commercial vehicle collisions, car wrecks, workplace and construction accidents, premises liability, nursing home abuse/neglect, railroad accidents involving vehicles and/or pedestrians and defective products. Matt has secured more than $70 million for clients in just the past 5 years for clients including a $5.47 million verdict in October, 2009 in Dekalb County, Georgia. Erin H. Gerstenzang, DUI Attorney Erin H. Gerstenzang is a criminal defense attorney in Atlanta, Georgia, whose practice focuses on DUI defense. She is an associate in the law firm of Stein & Ward, LLP. Erin has practiced DUI defense in New York as well as in Georgia. Erin has co-chaired a number of state-wide DUI defense CLE programs, including those recognized by the National College for DUI Defense and she has co-authored an article in the National Association of Criminal Defense Lawyers ( NACDL s ) magazine The Champion. Erin has lectured on various DUI topics throughout Georgia and New York. Erin is a 2004 graduate of Emory University School of Law and a 2001 graduate of Northeastern University. Mike Hawkins, DUI Attorney Mike Hawkins has a B.A. University of Alabama, 1989 and J.D. from Emory University, 1992. Mr. Hawkins served as a prosecutor in metro Atlanta for 5 years before entering private practice. He remains the youngest lawyer in the United States recognized by the American Bar Association as Board Certified in DUI Defense by the National College for DUI Defense. In 2008, he was elected to the Board of Regents for the NCDD. He is a frequent lecturer in Georgia and nationally on DUI issues. He serves as Vice-Chairman of the DUI Committee for the National Association of Criminal Defense Lawyers (NACDL) and served locally as President of the DeKalb Bar Association.

2 nd Annual DUI SUPER SYMPOSIUM August 3-6, 2011 Maurice Hilliard, Municipal Court Judge Judge Maurice Hilliard has been elected to the Roswell Municipal Court since 1980. He also serves as a Pro Hac Judge of State Courts of Fulton, Cherokee, and Forsyth Counties since 1983; and, he formerly served in the Superior Courts of Fannin, Gilmer, Pickens, and Dawson Counties. Judge Hilliard is a member of the American, Georgia, Atlanta and cofounder and charter President of North Fulton Bar Association. Judge Hilliard is also the past-president of Georgia Council of Municipal Court Judges; and has served as a Faculty member in ICJE Program since 1991. In 2008, he received a 50 year certificate of membership from the State Bar of Georgia; and in 2011, Judge Hilliard received a Lifetime Achievement Award from the General Practice Urgent Legal Matters Section of State Bar of Georgia. Steve Jones, DUI Attorney Mr. Jones has successfully defended over 1000 OUI cases. He is the managing partner of the firm of Jones & Geraghty. Mr. Jones is a former prosecutor and is now a nationally recognized defense attorney. He authored the Massachusetts Practice Series volume on Drunk Driving Defense for Thomson West Publishing. He chaired the Massachusetts Continuing Legal Education (MCLE) seminars on Drunk Driving for 8 years and he lectures nationally for the National College for DUI Defense, the National Association of Criminal Defense Lawyers (NACDL) and for the criminal defense bar in over a dozen states. His practice is concentrated in the defense of individuals charged with Operating under the Influence (OUI, DUI, DWI) and related matters. Mr. Jones was elected to the Board of Regents of the National College for DUI Defense in 2003 and the Board of Directors of the Massachusetts Association of Criminal Defense Lawyers (MACDL) in 2009 He is a Board Certified DUI Defense Specialist*. Jeff Kidd, Accident Reconstuctionist Jeffrey A. Kidd is the owner of Collision Specialists, Incorporated, an accident reconstruction firm in Gainesville, Georgia. During his twenty-one year career with the Georgia State Patrol, Sgt. Kidd investigated over 2500 collisions and over 1000 fatal crashes. He aided with the publication of the accident investigation and reconstruction curriculums taught in the State of Georgia. Sgt. Kidd has taught in excess of 1,200 course hours in the field of accident investigation and reconstruction, with courses of study taught in Georgia, Florida and Connecticut. He has received full accreditation by ACTAR, The Accreditation Commission for Traffic Accident Reconstruction and maintains proficiency in the field by continuing education. Jeffrey A. Kidd has been recognized as an expert in the field of accident reconstruction in State, Superior and Federal Courts in Georgia. Ron Lloyd, SFST/DRE Expert Ron Lloyd has more than 21 years of experience investigating impaired driving cases, with the majority of that time spent as a State Trooper with the Georgia State Patrol. During his time as a State Trooper, he made nearly 1000 DUI arrests and was a member of the Alpha Team DUI Task Force that was based out of Metro Atlanta. He served as the Training Coordinator for DUI Detection and Standardized Field Sobriety Testing (SFST) training program and was responsible for training all State Troopers in that field of instruction. He was also a Drug Recognition Expert (DRE)/SFST Instructor and served as a member of the Georgia Technical Advisory Panel (TAP Committee), which was responsible for regulating and monitoring the DRE training program in Georgia. Ron has also served as the DRE Agency Coordinator for the State Patrol. Mr. Lloyd now serves in the private sector as a Consultant / Expert witness for SFST/DRE related DUI cases. Matthew Malhiot, Breath Test Expert Mr. Malhiot has over 30 years experience a Bachelor of Science degree from Park University and received training in DUI enforcement and forensic alcohol toxicology. Mr. Malhiot completed coursework at Robert F. Borkenstein Course on Alcohol, Drugs and Highway Safety: Testing, Research and Litigation and completed the course on Forensic Alcohol Program Management. Matthew also completed the Forensic Toxicologist Certification Board s course on Forensic Ethanol Analysis and Interpretation. Matthew completed the operator, maintenance and instructor certification courses offered by CMI on both the Intoxilyzer 5000 and 8000. Teaching and writing curricula gives Matthew an in-depth knowledge of instrumentations and procedures used by law enforcement. Gus McDonald, DUI Attorney Gus McDonald limits his practice area to defending DUI and serious traffic charges. Gus is the area Vice President for the Georgia Association of Criminal Defense Lawyers and has served on the three member panel for the National Association of Criminal Defense Lawyers, DUI advocacy committee. Gus is a frequent speaker on both the national and state ICLE programs. Gus has been lead counsel in over 500 criminal cases throughout North Georgia and Metro area of this state. Litigation results are overwhelmingly positive. Gus filed suit against the GBI crime lab over lacking protocol for blood testing in this state and as a result the GBI changed its policies. The firm is limits the number of open files so that each client can receive quality results.

2 nd Annual DUI SUPER SYMPOSIUM August 3-6, 2011 Parker Mcfarland, DUI Attorney Robert Parker McFarland, Jr. earned his Juris Doctor degree from Mississippi College School of Law in 2001. Parker has received extensive training in the field of DUI and is a regular instructor in the Standardized Field Sobriety Testing course. In 2005, Parker won a case at the Georgia Supreme Court which invalidated the obscene telephone calls statute on first amendment grounds, reversing his client s convictions. He has litigated hundreds of contested motion hearings and been successful in convincing trial courts to suppress the results of HGN and other field sobriety tests which were conducted improperly by the arresting officer. Justin McShane, DUI Attorney As Chairman/CEO of The McShane Firm - Pennsylvania s top DUI and criminal defense firm, Attorney Justin J. Anthony is the former SFST State Coordinator for Georgia and a former SFST/ DRE staff instructor for the Georgia Police Academy at the Georgia Public Safety Training Center (GPSTC). Anthony is a former IACP Drug Recognition Expert Instructor and a NHTSA Standardized Field Sobriety Testing (SFST) Instructor. Ben Sessions, DUI Attorney Ben Sessions is a partner in the Norcross firm of McIlhinney & Sessions. Allen Trapp, DUI Attorney Allen Trapp of Carrollton, Georgia, is one of only four attorneys in the State of Georgia who is board certified by the National College for DUI Defense. He currently serves as the Georgia Delegate to the National College for DUI Defense and as a vice president of the Georgia Association of Criminal Defense Lawyers. Allen is one of a handful of Georgia DUI attorneys to be selected by his peers as a Georgia Super Lawyer in both 2009 and 2010. He has also appeared on NBC s Dateline, CNN s Talk Back Live, and numerous local (Atlanta) news programs. Dr. Jimmie Valentine, Toxicology Expert Dr. Valentine has B.S. degrees in both Biology and Chemistry from Centenary College of Louisiana, M.S. and Ph.D. from The University of Mississippi in Medicinal Chemistry. He retired in 2008 from the University of Arkansas College of Medicine where he served for 19-years as Professor of Pediatrics, Pharmacology, and Myeloma Research. Dr. Valentine has published 60 papers in the scientific and medical literature, has written 12 chapters in books and in co-author of 3 books. He has presented many talks on the correlation of drug use and behavioral effects in relationship to levels determined in physiological fluids both in living and post-mortem situations. Dr. Valentine has testified in numerous civil and criminal trials, and administrative hearings concerning drug findings and has been qualified as an expert witness in a number of states.
