What is a notification? In general parlance, a notification is nothing but an announcement notice issued by a government body to highlight certain procedures resolutions taken. However, some notifications are issued under provisions of certain official laws, such as the Environment (Protection) Act, These kinds of notifications are by themselves considered to be laws and are legally actionable. Notifications such as the Coastal Regulation Zone Notification 2011 (hearafter CRZ 2011) often deal with a specialised aspect (such as coastal protection) of a broader subject of law (such as the environment) and contain me details on that subject. An introducty section on the booklet and the CRZ Notification, Activities regulated and prohibited in the four maj CRZ zones and 3. Imptant infmation on enfcement. In the section on the four CRZ zones we have grouped all activities pertaining to specific sects. You will see that in a zone, the regulation f each sect varies. We hope that this will help readers clearly understand how this law regulates a range of activities. It should also make it easier f you to find the infmation you are looking f quickly. The sects covered in the CRZ 2011 are: 1. Industry (Maj projects commissioned by government and private) 2. Notification 1991 The CRZ Notification 1991 was issued under certain provisions of the Environment (Protection) Act (EPA), These provisions gave the central government the power to take any measure necessary to protect the environment (Sec. 3.1 of the EPA), including identifying areas in which certain industries and operations could not be carried out (Sec. 3.2.v of the EPA). The CRZ Notification 1991 divided the coast into various zones CRZ 1, 2, 3 and 4 based on the fragility and the level of development already present. It established rules deciding what could and could not be built in these various zones and laid a protective cloak over coastal spaces, intertidal areas and estuarine waters protecting fish breeding sites, cal reefs, mangroves and even sites of aesthetic beauty and histic value. From 1991 to 2011 However, in the years following its introduction, around 25 amendments (until 15 th May 2009) were introduced to this notification by the Ministry of Environment and Fests (MoEF), which diluted the protective mechanisms set in place by the iginal 1991 notification. F most of these decisions, no public consultation was carried out. In 2004, an Expert Committee was set up under the chairmanship of Dr. M.S. Swaminathan to review the CRZ 1991 notification. The committee presented its rept in 2005 just after the Indian Ocean tsunami. Based on the recommendations of the committee, it was decided to replace the CRZ 1991 with a new notification, the Coastal Zone Management (CZM) Notification which would take into account potential natural disasters and develop a me holistic framewk f coastal protection. Despite protests about inconsistencies in the suggestions of the Swaminathan Committee, a draft Coastal Management Zone (CMZ) notification was drawn up in 2007 and redrafted and released f public opinion in The draft CMZ Notification 2008 met with vigous opposition from fishing communities and environmental activists and groups, who felt that the CMZ was nothing but an attempt to disempower local communities and allow industries to acquire prime coastal lands. Due to the massive public pressure, a second Expert Committee was constituted in 2009, again under the chairmanship of Dr. M.S. Swaminathan, to review the draft CMZ Notification After several public consultations, the committee proposed that the CMZ notification be allowed to lapse and the iginal CRZ Notification 1991 be used as the basic framewk f any new regulation. 4 5

In response to the pressure from the people and the Expert Committee, the Central government finally passed the CRZ 2011 Notification. While several regressive amendments to the CRZ Notification 1991 that allowed SEZs, IT and service sect industries from acquiring land within the CRZ area have been removed from the CRZ 2011, there are several clauses in this law that indicates that this new CRZ 2011 may not be an improvement to the iginal. The CRZ 2011 notification The CRZ 2011, like its predecess, remains a zoning law classifying coastal areas into four categies CRZ 1, 2, 3 and 4. Unlike the CRZ 1991, it excludes the Andaman and Nicobar Islands as well as the Lakshadweep Islands from its jurisdiction. It however has included the area from the LTL upto 12 nm into the sea, namely the territial waters, under its purview.
