Dikaflush, with its Dikaflush Tecno variation, is the synthesis of essence when speaking of electronic controls with concealed WC cistern. Both models have a simple and elegant stainless steel vandal-proof plate. Dikaflush is the standard WC version, Dikaflush Tecno is the configuration for hanging WCs, with specifically designed recessed techno-structure settings. Both models are available in variation with or without pre-flush before full flush. All versions come with a button that adds manual operations to electronic ones. The Dikaflush range meets some space requirements to avoid the sensors range of action from interfering with the stall door. However, if this distance is not available, an alternative sensor can replace the normal standard sensors upon request to activate flushing on hand approach. GENERAL CONDITIONS a) The delivery and/or formulation of any sales, supply or service order implies, by the purchaser and unless otherwise agreed in writing the application and acceptance of these sales conditions. b) For all intents and purposes of Civil Code art. 1419, the invalidity of a single clause in these general conditions does not null and void the contract, nor the other clauses. c) Any clause added to the margin or body of the sales order or correspondence, in conflict with these general conditions, may only be enforced on the seller upon prior written acceptance. d) All information and specifications contained in the catalogues and seller s notices (concerning, for example but not limited to, product prices, sizes and features) must be intended as merely indicative. Consequently, the seller reserves the right to change and/or eliminate product models and relevant prices at any time and without any prior notice of any kind, without any liability to the seller or compensation for the purchaser orderer. Similarly, technical studies and recommendations are only supplied by the seller as exemplary, releasing the seller from any pertinent liability. The purchaser or user must check that provided goods and services are compatible with the use for which the products were intended and with the special conditions of use. e) The purchaser or user states he/she is aware that the installation and assembly of some equipment requires special conditions that must be met such as power and cold, hot or mixed water supply as well as water drains. For this purpose, always refer to the assembly instructions. 2. OFFERS AND PRICES a) Any estimate made for any type of our products or any order for equipment and/or products is only intended as final after notice of receipt and acceptance is sent by DMP Electronics Srl to the purchaser. Any modification, accessory or option requested after notice of receipt is sent shall be invoiced separately. b) Every shipment shall be invoiced at the prices effective on the date of shipment or withdrawal. Fees are net of taxes. c) Any cancellation shall not be taken into account after notice of order receipt is sent or after the order is partially or totally filled, unless otherwise agreed in writing. DMP Electronics Srl reserves the right to deliver and invoice all goods and materials whose shipment was ordered on the day of cancellation. Orders are accepted without any single shipment commitments. 3. PAYMENT CONDITIONS a) Terms and schedules Invoices may be paid at the DMP Electronics Srl headquarters by cheque, bank or money order or direct bank deposit from the customer s bank 30 days, end of the month, from the date of shipment or withdrawal, net and without discounts, whatever the day of the month shipment or withdrawal occurs. Any other payment mode or schedule shall only be accepted as an exception and only if indicated in writing on the sales order and relevant acceptance. The seller reserves the right to change sales conditions at any time and demand collateral from the purchaser to ensure payments. First shipments to new customers shall be made against advanced payments or COD, unless otherwise agreed. b) Payment Interests as per Legislative decree 231 dated October 9, 2002 shall apply to any late payments from the day following the due date and without the need for formal notice of default. Default or delayed payments at a single due date shall, as per Civil Code article 1186, null and void any later due dates and give the seller the right to immediate collect payment for all outstanding receivables without prior notice. Similarly, default or delayed payment shall give the seller the right to cancel and suspend any current orders or contracts and suspend, as per Civil Code article It is understood that any advanced payment shall not give the purchaser any right to reductions or discounts on amounts due. c) Balance withholdings Any quality claims on supplies shall not give the purchaser the right to suspend payments unless faults or defects are recognised in writing by the seller. In this case, suspension is limited to the sole amount due for the products and/or services subject to the claim. The purchaser does not have the right to compensation or balances on amounts invoiced by the seller. 4. PROPERTY RIGHTS a) Delivered goods remain property of the seller until the purchaser fulfils all obligations, specifically until the fully paid. 5. TERMS a) Delivery or ready terms are intended indicative. b) Any delivery delay or partial delivery shall not give the purchaser the right to claims or damage compensation and interest. c) In all cases, observance of delivery schedules assumes the observance of contract obligations by the purchaser and, specifically, of the payment terms, and of the non occurrence of any event of force majeur. 6. DELIVERIES a) Supplies are also sold as received and accepted by the purchaser from our warehouses and payable as such, with the shipment or withdrawal date considered as invoice date. b) Whatever the sales conditions, goods travel at the addressee s exclusive risk and peril, even for carriage paid goods, free delivery with invoiced charges or free. The seller shall not be liable for any faults, losses, deteriorations of any nature, nor for delays that goods may be subject to during transport. c) The addressee of the goods must, upon receipt, check delivered material in presence of the carrier, promptly indicating any faults and expressing any reserves, noting them on the shipping bills. This also applies in the event packaging is integral. 7. MATERIAL CONFORMITY a) Any claim on product consistency upon delivery, their quantity or weight and compliance with the shipping bill, must be made in writing within 8 (eight) days from receipt by the Customer or be forfeited. b) No claim on product composition at deliver, delivered quantity, weight or conformity with the shipping bill is admitted 8 (eight) days from receipt by the customer. c) No returns shall be accepted unless previously agreed in writing by the seller, even if delivered after indicated delivery dates. Any return accepted by DMP Electronics Srl shall only be shipped carriage paid by the sender, to the notified address, unless otherwise agreed. d) Credit balances shall only be defined after receipt and inspection of quantity and quality of returned materials and packaging. Any returned goods that suffered alterations, even slight, shall be held available for the sender or shall be subject to invoice discounts proportionate to invoiced amounts, corresponding to inspection fees, repairs, storage, etc. e) Sanitary and plumbing system must be purged to avoid any risk of product deterioration or damage (refer to the technical specification in the assembly instructions). 8. WARRANTY All equipment supplied by the seller has be subject to Quality Controls before leaving the factory. The warranty is valid at the following conditions: 1) Equipment is guaranteed for 24 (twenty four) months from the date of purchase against material and factory defects. The date of purchase must be proven by purchase document or sales receipt (essential for warranty validity) to be presented to the authorised Service Centre technician. 2) Strictly observe that specified and required in the Installation and Use instructions, enclose with each DMP Electronics product. Failure to observe the indications and specification in the Instructions shall immediately null and void the warranty. 3) The warranty does not cover: Damages caused by incorrect installation, neglect, negligence, carelessness, improper equipment use (use with incorrect voltage, unsuitable socket); electrical system abnormalities such as voltage other than the limit set by CEI regulations (+/- 10% of nominal value); plumbing system abnormalities; collision, falls, accidents, transport damages, etc.; marginal defects that have negligible effects on equipment value or operations; the use of aggressive chemical detergents that damage equipment body; normal operating wear (batteries, o-ring, diaphram, engines, etc.). 4) The warranty is null and void in the event of tampering or repairs by unauthorised personnel or with non DMP Electronics original spare parts. 5) The warranty is only valid if the date of purchase is validated by the dealer s stamp and signature on the warranty certificate and if received by DMP Electronics within 20 days of purchase. 6) Repairs within warranty terms do not extend warranty coverage. The warranty on replaced parts is only effective for the original product warranty period. 7) Equipment must only be repaired at an Authorised DMP Electronics Service Centre, indicated by the dealer or by the DMP Electronics sales department. 8) Repairs under the warranty at an Authorised DMP Electronics Service Centre are free of charge. The purchase document or sales receipt must be enclosed with this certificate. For warranty validity, these documents must be presented to the Authorised DMP Electronics Service Centre technician for both on-site and laboratory repairs. 9. DISPUTES a) Any dispute that may arise on the execution and/or interpretation of this contract, including disputes on supplies, services or payments, shall be exclusively submitted to the Court where DMP Electronics S.r.l. is located, even in the event of multiple plaintiffs and/or warranty claims. Payment by bank bill or other payment acceptance is not exempt from this condition. These General Sales Conditions do not have contractual nature; DMP Electronics reserves the right to change product features without prior notice. Registered trademark.
