1 THE A21 TRUNK ROAD (TONBRIDGE TO PEMBURY DUALLING) COMPULSORY PURCHASE ORDER COMPULSORY PURCHASE OF LAND AND RIGHTS BETWEEN TONBRIDGE AND PEMBURY IN KENT In December 2009 the Secretary of State for Transport ( the Secretary of State ) published proposals to improve the A21 between Tonbridge and Pembury in Kent. The proposals included, in draft, the A21 Trunk Road (Tonbridge to Pembury Dualling) Compulsory Purchase Order (No ) 20. under sections 239, 240, 246 and 260 of the Highways Act In March 2010 the Secretary of State for Transport and the Secretary of State for Communities and Local Government ( the Secretaries of State ) gave notice that Public Local Inquiries would be held into the Secretary of State s proposals and the objections which have been made in connection with the proposals. In June 2010 the Secretaries of State wrote to all statutory objectors and other interested parties stating that it had been decided to postpone the Public Local Inquiries for the time being. In December 2012 the Secretaries of State wrote to all statutory objectors and other interested parties stating that the statutory process is to be resumed and that Public Local Inquiries will be held on a date and at a place to be announced. If made, the A21 Trunk Road (Tonbridge to Pembury Dualling) Compulsory Purchase Order (No ) 20 will authorise the Secretary of State to purchase compulsorily the land and the new rights described below for the purpose of :- a) the construction of the new trunk roads between Tonbridge and Pembury in the Parishes of Southborough in the Borough of Tonbridge and Malling and Capel, Pembury and Southborough in the Borough of Tunbridge Wells, all in the County of Kent in pursuance of the A21 Trunk Road (Tonbridge to Pembury Dualling) Order 20..; b) the construction and improvement of highways and the provision of new means of access to premises in those Parishes and Boroughs in pursuance of the A21 Trunk Road (Tonbridge to Pembury Dualling Side Roads) Order 20..; c) the improvement of the Trunk Road in those parishes and boroughs; d) the diversion of watercourses and the execution of other works on watercourses in connection with the construction of the new trunk
2 roads, the construction and improvement of other highways and the execution of other works mentioned above; e) use by the Secretary of State for Transport in connection with such construction and improvement of highways and the execution of other works mentioned above; and f) the mitigation of any adverse effects which the existence or use of the highways proposed to be constructed or improved will have on their surroundings. Copies of the draft Compulsory Purchase Order and of the map referred to therein, together with copies of the A21 Trunk Road (Tonbridge to Pembury Dualling) Order 20.. and the A21 Trunk Road (Tonbridge to Pembury Side Roads) Order 20.. have been deposited and may be seen at all reasonable hours from 18 February 2013 until 2 April 2013 at the Highways Agency, Major Projects (South), Federated House, London Road, Dorking, Surrey, RH4 1SZ; Tonbridge Library, Avebury Avenue, Tonbridge, Kent, TN9 1TG; Pembury Library, The Hop House, Hemwood Green Road, Pembury, TN2 4HS; Tunbridge Wells Library, Mount Pleasant Road, Tunbridge Wells, Kent, TN1 1NS; Tunbridge Wells Borough Council, Town Hall, Royal Tunbridge Wells, Kent, TN1 1RS; Tonbridge & Malling Borough Council Gateway, Tonbridge Castle, Castle Street, Tonbridge, TN9 1BG and Kent County Council Reception, Invicta House, County Road, Maidstone, Kent, ME14 1XX. Any person may object to the draft Compulsory Purchase Order in writing and addressed to the Secretary of State at the offices of the Highways Agency, Major Projects (South), Room 2A, Federated House, London Road, Dorking, Surrey, RH4 1SZ to arrive not later than 2 April 2013 and should state the title of the Order. It should give the grounds of objection and the objector s address and interest in the land. In the preparation of an objection and the statement of grounds of objection, it should be borne in mind that the substance of any objection or representation will be made available to the independent Inspector appointed for the Public Local Inquiries and may be communicated to other people who may be affected by it. All objections to the draft Compulsory Purchase Order received in 2009/10 will also be made available to the independent Inspector appointed for the Public Local Inquiries and may be communicated to other people who may be affected.
