1 EDGEWATER CITY COUNCIL BUSINESS MEETING MINUTES MAY 1, 2014 A business meeting of the Edgewater City Council was held in the City Council Chambers. ITEM 1. CALL TO ORDER Mayor McNulty called the meeting to order at 7:02:13 PM. ITEM 2. ROLL CALL City Clerk Beth A. Hedberg called the roll. ITEM 3. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. ITEM 4. APPROVAL OF AGENDA Councilman Riddle moved, seconded by Councilman Fleck, to approve the agenda as presented. The motion PASSED on the following vote: AYES: Councilwoman Keegan, Councilman Riddle, Councilman Fleck, Councilwoman Keeble, Councilman Teegardin and Councilwoman Spangenberg. NAYS: None. ABSENT: None. ABSTAIN: None. ITEM 5. CONSENT AGENDA MINUTES OF APRIL 17, 2014

2 Councilwoman Keegan moved, seconded by Councilwoman Spangenberg, to approve the consent agenda as presented. The motion PASSED on the following vote: AYES: Councilwoman Keegan, Councilman Riddle, Councilman Fleck, Councilwoman Keeble, Councilman Teegardin and Councilwoman Spangenberg. NAYS: None. ABSENT: None. ABSTAIN: None. ITEM 6. COMMUNICATIONS FROM THE CITY MANAGER, STAFF, AND BOARDS AND COMMISSIONS Community Services Director Dan Maples reported on the lead line replacement project; the City-wide garage sale and the 5K run. Information was provided regarding the spring clean-up event. Police Chief John Hough introduced Susie Ortiz, the newest Edgewater Police Officer. Chief Hough provided information regarding Officer Ortiz s education. He noted that she spoke Spanish and currently lived in Denver. Council welcomed Officer Ortiz. Chief Hough spoke about DUI enforcement plans for the Cinco de Mayo holiday. Chief Hough reported that the Police Department had been awarded a Victim Assistance and Law Enforcement Board grant of four thousand three hundred fifty-three dollars ($4,353) which would be used to create a soft interview room in the police station. Chief Hough said that the Department were in the pursuit of a Firehouse Subs grant to request funds to purchase tactical medical supplies, a police bicycle and a lightweight ballistics shield. Chief Hough said that a new officer would start on May 12th. Chief Hough said that the Department had collected one hundred and ten pounds (110 lb) of drugs during the Drug Take Back Initiative. A discussion was held with respect to the amount of grants that the Police Department had recently received. Chief Hough reported on the café the Police Department had recently set up outside their building as a team building exercise. Training with the Wheat Ridge Fire Protection District was addressed. Domestic violence calls were considered. No further reports were given. ITEM 7. PUBLIC COMMENTS (NON-AGENDA ITEMS) Steve Conklin said that he was the president of an organization that preserved the history of radio and television in Colorado. In July 1922 KFEL signed on the air. It was the third radio station in Colorado and the longest running radio station. 60 years ago today KFEL became KIMN. KIMN had been located in the City of Edgewater for approximately thirty (30) years. Pauline York said that the radio station did not want to move out of Edgewater but were displaced by the Edgewater Marketplace. ITEM 8. PROCLAMATION MAY IS MENTAL HEALTH MONTH 2014 Page 2

3 Mayor McNulty invited Dr. Leah Kruisch, school-based counselor, to the podium. Mayor McNulty proceeded to read the Mental Health proclamation which is attached hereto and made a part hereof by reference as Exhibit A. Dr. Kruisch thanked the Council on behalf of Jefferson County Mental Health Center. She provided statistics of the residents who had received services. Mayor McNulty noted that May was also Foster Care Month. ITEM 9. DISCUSSION AND POSSIBLE ACTION ON ORDINANCE 09-14, AN ORDINANCE AMENDING ARTICLES 1 THROUGH 17 OF CHAPTER 16 OF THE EDGEWATER MUNICIPAL CODE CONCERNING ZONING DISTRICTS AND ZONING REGULATIONS (FIRST READING) Councilman Fleck moved, seconded by Councilwoman Keeble, to approve on first reading and ordered published by law, Ordinance 09-14, an ordinance amending Chapter 16 of the Edgewater Municipal Code, concerning zoning, by amending Sections , concerning the purpose of Chapter 16; , concerning definitions; , concerning penalties for violations of Chapter 16; , concerning the application of Chapter 16; and , concerning land use compliance; repealing Section , concerning building permit application requirements; amending Sections , concerning application fees and deposits; and , concerning preapplication meetings; amending Article 3, concerning zone districts and district regulations; repealing Article 5, concerning the Residential B (R-B) zone district; amending Articles 6, concerning the Residential 1 (R-1) zone district; 7, concerning the Residential 2 (R-2) zone district; 8, concerning the Residential 3 (R-3) zone district; 9, concerning the Residential-Commercial 1 (R-C1) zone district; and 10, concerning the Residential-Commercial 2 (R-C2) zone district; designating Article 11, concerning the Residential 4 (R-4) zone district, as Article 10 and renumbering each section thereof accordingly; amending Article 12, concerning the Residential Planned Development (R-PD) zone district; repealing Article 13, concerning the Residential Trailer (R-T) zone district; amending articles 14, concerning the Commercial 1 (C-1) zone district; and 15, concerning the Commercial 2 (C-2) zone district; designating Article 16, concerning the Commercial 3 (C-3) zone district, as Article 14 and renumbering each section thereof accordingly; repealing Article 17, concerning the Industrial 1 (I-1) zone district; and adopting new Articles 15, concerning conditional uses; 16, designated as reserved; and 17, designated as reserved as presented. Attorney Renaud reviewed the changes that had been made to the ordinance as a result of the work session of April 17, Attorney Renaud advised that the definition of boarding and rooming house be changed by deleting the words, not including member of the family and inserting the words but not including members of a family, as defined herein prior to the words who might be occupying such building. Attorney Renaud said that, after conferring with City Planner McCartney, he would like to make a suggested change to Section to reinsert the stricken out sentence and to change it to read, On corner lots, buildings shall not be constructed within ten (10) feet of the street side lot line. This change would need to be made in three (3) different Page 3

4 portions of the Ordinance. The dwelling unit definition was changed. The final words of the definition was changed from cooking one the premises to cooking on the premises. Councilman Fleck and Councilwoman Keeble were in agreement to the changes made to the ordinance. VOTE was called for. The motion PASSED on the following vote: AYES: Councilwoman Keegan, Councilman Riddle, Councilman Fleck, Councilwoman Keeble, Councilman Teegardin and Councilwoman Spangenberg. NAYS: None. ABSENT: None. ABSTAIN: None. ITEM 10. GENERAL BUSINESS a. Discussion and Possible Finding of Council Vacancy Councilman Riddle moved, seconded by Councilwoman Keegan, to find a vacancy on Council based upon the resignation of Janka Flaska announced at the work session of April 3, 2014 and effective at the end of the regular Council meeting held on April 17, The motion PASSED on the following vote: AYES: Councilwoman Keegan, Councilman Riddle, Councilman Fleck, Councilwoman Keeble, Councilman Teegardin and Councilwoman Spangenberg. NAYS: None. ABSENT: None. ABSTAIN: None. City Attorney Renaud reviewed the Charter provisions with respect to a Council vacancy. Councilwoman Keegan moved, seconded by Councilman Riddle, to post and publish a notice of Council vacancy for thirty (30) days to fill the vacant Council seat until the next regular municipal election. The motion PASSED on the following vote: AYES: Councilwoman Keegan, Councilman Riddle, Councilman Fleck, Councilwoman Keeble, Councilman Teegardin and Councilwoman Spangenberg. NAYS: None. ABSENT: None. ABSTAIN: None. b. Discussion and Possible Amendment to the Council Rules of Procedure Regarding Council Meeting Start Time Council, by consensus, decided to leave the Council meeting start time at 7:00 pm. ITEM 11. PUBLIC COMMENTS There were no public comments. ITEM 12. MAYOR AND COUNCIL COMMENTS Councilman Riddle said that Council vacancies could be painful but it brought new life and a breath of fresh air to the Council. He was certain that Council would receive applications from very qualified candidates. Page 4

5 Councilwoman Spangenberg said that she was continually impressed by Edgewater citizens. There had been a meet and greet with the Wheat Ridge Fire Protection District Board candidates. Even though it had been held on the same day and time as the Easter Egg Hunt, there had been a really good showing. There had also been a good showing at the Wheat Ridge Firefighters Association Town Hall Meeting. The Edgewater citizens that had attended either function were well informed. Councilwoman Keeble said that Dan Maples, Joel Newton and Lee Stiffle-Meyer were initiating a community walking campaign which would be low or no cost. More information would follow. Councilwoman Keegan thanked the Edgewater Police Department. She said that recently a person had been driving her alley and going through trash and recyclable containers. Councilwoman Keegan had called the police. They responded instantly and spoke with the driver. Officer Nesbitt had spoken with Councilwoman Keegan after the incident and encouraged her to call the police at any time. It had been comforting and she had appreciated his attitude. Councilman Teegardin said that he d had the pleasure to meet Councilwoman Keegan s niece the previous Saturday. He had also see Mr. Newton on his way to the Jefferson County School Board meeting. The Board had been discussing teachers salaries. Councilman Teegardin spoke about Walk2connect. He thought that the organization might be of some assistance to the Edgewater community walking campaign. Councilman Fleck thanked the Parks and Recreation Department and said that the Easter Egg Hunt had been a blast. There had been a ton of kids present and the weather had been beautiful. Councilman Fleck said that the City should look for more opportunities like the Egg Hunt. He encouraged the Council to consider the terms of the capital investment that was made for an event against the possible payout for the community. Mayor McNulty said that she had attended a breakfast meeting with the County Commissioners and officials from other Jefferson County communities. She had been amazed to hear that the officals were looking to meet and work with the Jefferson County Board of Education when City Council had been meeting with them for several years. Mayor McNulty said that she had spoken to Board President Ken Witt. He told her he would be willing to meet with one (1) or two (2) Council members at a time for lunch. ITEM 13. 6 EXHIBIT A PROCLAMATION MAY IS MENTAL HEALTH MONTH - MAY 2014 WHEREAS, Mental Health month has been observed since 1949 to raise awareness about mental health conditions and the importance of mental health wellness for all; and WHEREAS, Mental illness is a leading cause of disability in Colorado and the state has the sixth highest suicide rate in the country; and WHEREAS, A lack of access to mental health services is repeatedly listed as one of the top five health threats around the state; and WHEREAS, Citizens of the City of Edgewater may be affected by mental illness regardless of age, gender, race, ethnicity, religion or economic status, and WHEREAS, Good mental health is essential to the overall health and emotional wellbeing of all children, youth, adults and families; and promotes a healthy community WHEREAS, Mental illnesses and substance use disorders are treatable, and recovery is possible when appropriate treatment services are available and accessible; and WHEREAS, The community health system is advancing the integration of treating mental health, physical health and substance use disorders together to realize better patient outcomes, reduced health care costs, and improved patient satisfaction; and WHEREAS, Community mental health providers play a critical role in responding to local emergencies and tragic events and are an essential resource for healing individual and community trauma; and NOW, THEREFORE, I, Bonnie McNulty, Mayor of the City of Edgewater, do hereby proclaim May 2014, as Mental Health Month and call upon all citizens, government agencies, public and private institutions, businesses, and schools to recommit our communities and resources to increasing awareness and understanding of mental health, providing appropriate and accessible services for all citizens, and making mental health a priority.
