2 DESERT MEDICINE RESEARCH CENTRE PALI ROAD, JODHPUR TENDER NOTICE (Terms & Conditions) Tender No. DMRC/Tech/RT/2013T009/ Dated: The Director, Desert Medicine Research Centre, (ICMR), Jodhpur invites sealed Tender in Two bid system i.e. Technical bid and Price bid from the reputed foreign/indian software developing companies or their authorized dealers and in case of imported software/hardware from their authorized Indian agents for supply, installation, testing and commissioning of E1 (PRI-ISDN) based IVRS System. The Tender should be submitted in two separate sealed envelopes i.e., (i) Technical bid and (ii) Price Bid. The details of technical specifications, Earnest money deposit, up to date IT/VAT clearance certificate, creditability of your firm list of customers etc. should be indicated in the Technical Bid and should be submitted in a sealed envelop with the cover marked as Technical Bid for IVRS System. This envelope should also contain bank draft for the Earnest Money Deposit. The cost of the supply, installation, testing and commissioning of E1 (PRI-ISDN) based IVRS System as per specifications given in this document, percentage of CST/VAT, Excise duty, custom duty, entry tax, transportation charges, installation charges, training charges and other expenditure in details should be clearly indicated in the Price Bid and should be submitted in sealed envelop in the cover marked as Price Bid for IVRS System. The detailed specifications of the E1 (PRI-ISDN) based IVRS System can be obtained from the Stores & Purchase Section of DMRC, Jodhpur on payment of Rs (Rupees Five hundred) towards Tender cost for each tender document either in cash or by Demand Draft of DD in the name of the Director, DMRC, Jodhpur on any working day from 10 A.M. to 5 P.M. The same can be obtained on request through Speed Post/Regd. Post against selfaddressed envelop by affixing postage stamps Rs. 50/- for each Tender document. The Tender document can also be downloaded from DMRC website and such tenders should be submitted with a separate DD for Rs.500/- being the cost of Tender document. The Tender document will be issued with effect from to and the last date for submission of filled in Tender is up to 1.00 P.M. The Technical Bid envelopes will be opened on at 4.00 P.M. The price bid of the successful bidders who qualify the technical specifications will be opened on the at A.M. NOTICE is hereby given that sealed tenders will be received up to 1.00 P.M on by the office of the Director, DMRC, Jodhpur on Two bid i.e. (i) Technical bid and (ii) Price bid. In the Technical Bid all the relevant information i.e., Technical Specification of the E1 (PRI-ISDN) based IVRS System and its accessories, with Make/Version & Model without rate, tender specification compliance statement, Technical Literature, Authorization letter from the Manufacturer/Companies, Earnest Money Deposit, up to date IT & ST clearance certificate, list of users/customers, period of delivery, warrantee and guarantee after sale, Annual service Maintenance beyond warranty and guarantee period, validity of rate quoted, Country of Origin etc. should be clearly indicated. In the Price Bid, the Unit Cost of the E1 (PRI-ISDN) based IVRS System and its accessories as per the given format, % of discount allowed to Research organization, % of Agent Commission Charges, % of CST/OST, Entry Tax, Excise/Custom Duty, Transportation Charges, Installation Charges, Training Charges, Terms of Payment as applicable should be clearly indicated. No other charges will be considered later on. 2. The Technical bid will be opened at this office at 4.00 PM on in the presence of authorized representative of the firms present at that time. The price bid of the successful technical bidder/tenderer will be opened on at 11A.M in the presence of authorized representatives of firms present at that time. 3. Compliance statement as per the tender specifications of the E1 (PRI-ISDN) based IVRS System and its accessories should be furnished by the bidder/tenderer along with the Technical bid. 4. The vendor should provide complete IVRS system which should include all hardware and software required for running the system on turnkey basis i.e. vendor should quote for all the items mentioned in the tender document and all the additional items not included in the tender document but required for running the system 5. The vendor will be responsible for integration of all the items of the IVRS system on site. 3

4 6. The vendor should provide 3 years warranty for the complete IVRS system and quote for 2 years rate of AMC thereafter. 7. The vendor should provide all the technical documents and the anitivirus solution for the system with 3 years subscription. 8. The number and quantity entered in the schedule is the probable number of quantity, which are required to be supplied. Not withstanding the estimate of probable numbers, the Director has the right to order or not to order any number of any such articles at all. 9. Manufacturer/company s name, i.e. Make, Model, price etc. should be clearly mentioned. If imported, the name, address of authorized Indian agent should be mentioned. 10. If you are authorized supplier of such items of Software/Hardware, an authorization letter from manufacturer/company should be provided. 11. The rate should be quoted either by the Indian Agent on behalf of the foreign principal or the foreign principal directly, but not both. Further, in cases where an agent participates in a tender on behalf of one manufacturer/company, he should not quote on behalf of another manufacturer/company for the same item. 12. The rate quoted should be valid for a period of ONE YEAR from the date of opening tender. 13. DMRC reserves the right to reject all tenders without having to assign any reasons and to call for submission of fresh tenders and on such terms as it may in its discretion determine. 14. DMRC shall not be obliged to accept any tender based only on the lowest price offer but reserves the right to accept a tender bearing in mind the value of tender, the credibility of the party and its ability to execute the supply in accordance with prescribed specifications and standards and within the stipulated time period. DMRC therefore, shall not be obliged to give reason justifying either the rejection or the acceptance of any tender. 15. If a tender is quoting for various models for a particular item, the tender deposit (Earnest money 2.5% should be made for the value of the Model that has the highest price and should be submitted in shape of Demand Draft made in the name of the Director, Desert Medicine Research Centre, Jodhpur. However EMD will be exempted in case of approved DGS&D/NSIC supplier in support of proof for the quoted Software/Hardware. The EMD will be refunded to the unsuccessful bidder after decision. 4

5 16. Each tender must contain not only the rates in figures but must also the rate expressed in words. 17. Discount/rebate allowed to scientific research organization may be mentioned indicating the rate of discount. 18. Whether the Software/Hardware are indigenous/imported? If indigenous, the price should be quoted up to DMRC, Jodhpur in Rupees only. If imported, the Foreign Firms should quote their price in their concern country Currency with F.O.B. basis indicating the name of Indian Agent who has the responsibility to deliver the materials at DMRC, Jodhpur. The charges incurred from the port of dispatch to DMRC, Jodhpur i.e., freight, insurance, custom clearance etc., should be quoted in Indian Rupees by the Indian Agent along with F.O.B. Price. Regarding Custom/Excise Duty, the Centre has availed the Exemption of Custom/Excise Duty Certificate from Govt. of India. Preference will be given to the firm quoting the price in Indian Rupees instead of Foreign Currency. 19. Percentage of Indian Agent Commission charges should be clearly indicated in the tender/quotation. 20. The period of warranty and guarantee should be ensured from the date of installation, but not from the date of shipment or invoice. 21. The Supplier has to ensure the availability of spare parts & service maintenance for at least 10 years, on payment of cost if applicable. 22. Service facility beyond warranty/guarantee period may also be indicated including the name of the firm, financial position, past performance, labor relation etc. 23. Up to date Sales Tax/VAT Tax & I.T. clearance certificate etc. from appropriate authority to be furnished. 24. Selected firm should ensure the delivery strictly as per their terms and condition. Otherwise, penalty of 0.50% on Software/Hardware cost will be charged per day, subject to maximum of 6%. In case the amount equal 6% of the order value deductible as penalty and the supplier is still unable to complete successful installation, the DMRC reserves the right to cancel the order and no payment will be made to the supplier. 25. Repeated Problem: if during the warranty period any system as a whole or any sub system has any failure on two or more occasions in a period of 3 months it shall be replaced by equivalent new equipment or any alternative steps are to be taken which would serve the purpose to DMRC. 26. Space, electrical load, power point etc., needed for the hardware may also be indicated. 5

6 27. To make the Software/Hardware operational, does it need additional accessories? If so, please indicate the list of accessories whether it is included in cost of Software/Hardware. 28. Consignment should be securely and properly packed to withstand transportation. Supplier is fully responsible until the delivery of consignment to DMRC, against any loss/damage/leakage/breakage/shrinkage/perishablity etc. If necessary supplier should insure the consignment. 29. Please indicate if any training material including technical and scientific literature is needed or included in package deal. 30. The Bidder should mention the time required for delivery and installation of Software/Hardware. 31. In case of any manufacturing defect or damage during the transit/installation, the item/hardware should be replaced with a new set, without any extra charges for the same. 32. Is the Software/Hardware a proprietary one? If so, certificate may be furnished that they have not supplied the Software/Hardware at a cost lower than quoted to any other organization. 33. If the item is proprietary one (i.e., this type of Software/Hardware is not manufactured by any other company) supporting document is to be provided in support of this. 34. Whether the items included Excise duty/custom duty. If so, the rate may be shown separately. It is also noted that Government of India exempts this center for custom duty and excise duty % performance Security Deposit on total order value should be deposited by the successful tenderer in shape of Demand Draft or Bank guarantee valid from the date of installation made in the name of the Director, Desert Medicine Research Centre, Jodhpur placing firm order. The same will be refunded only after expiry of guarantee/warranty period or one year from the date of installation, whichever is later. It will not carry any interest amount for the period retained by DMRC Jodhpur. 36. If the tender(s) fails to execute the order(s) within a reasonable time, as indicated in the tender from the date of receipt of order for supplies or as mutually agreed to, the order will be cancelled and the security deposit will be forfeited by the Desert Medicine Research Centre, Jodhpur. They will also be liable for all damages sustained by the Institute for non supply of Software/Hardware including the liability to pay any difference between the prices accepted by him and those ultimately paid by the institute for the 6

7 articles. The Director, Desert Medicine Research Centre, Jodhpur, will assess such damages and his decision will be final. 37. The contract for supply cannot be sublet without the permission of the Director. 38. If any of the equipment supplied by the tenders is found to be bad or unsound, unmerchantable, inferior in quality, or not in accordance with the description or otherwise faulty for unfit for use or unwholesome, the price or prices, of such Software/Hardware has already been made to the tender, shall be refundable. If the payment has not been made, the tenderer will not be entitled to any payment whatsoever for such Software/Hardware. 39. Terms of payment should be mentioned including geographical location of the supplier, technological development availability etc. In case of indigenous Software/Hardware the payment will be released only after receipt of the materials and satisfactory installation at DMRC, Jodhpur in all respect as per order and duly certified by the user/indenter and Verification Committee. However, for imported items, the payment will be made through FDD/Sight Draft on F.O.B. Value. The FDD/Sight Draft will be released only after receipt of the materials by this centre as per order specification and satisfactory installation duly certified by the user/indenter and verification committee. However, a Xerox copy of the FDD/Sight Draft will be sent along with the confirm purchase order for reference. 40. Resource facility/manpower available with supplier and stage of supplier s technological development availability, Inspection methods and quality control standards etc. may be mentioned. 41. Whether the Software/Hardware is approved by DGS&D/NSIC? If so, copy of the same may be furnished. 42. The Offer should be submitted in the name of the Director, Desert Medicine Research Centre, Jodhpur in a sealed cover in double bid system super scribed in each bid Offer due on for supply of in the tender box or by post only. The centre will not be responsible for late receipt of the tender. 43. Any attempt at negotiation direct/indirect on the part of a tenderer with authority to whom tender has submitted or tender accepting authority will render the tender liable to exclusion from consideration. 44. Tender document is not transferable and tender received by fax will not be considered. 7

8 45. The Director, DMRC, Jodhpur reserves the right to accept/reject any or all of the tenders so received without assigning any reason thereof. 46. Entire equipment including Hardware, Software etc. shall be delivered and installed within 4 weeks of placement of purchase order. Installation and commissioning of the equipment shall be carried out by the supplier and shall be completed within above stated 4 weeks. All the hardware / software must be supplied in sealed condition; with the original producers/manufacturers seal intact, open items will be returned back. A packing list should be supplied separately for each packing case giving clear indication of items available in each packing case. 47. Free of cost professional training (user and administrative) for all hardware and software should be provided. The training will be conducted at O/o DMRC after installation, testing and successful commissioning of the system. The date of commencement of training will be given by the nominee of DMRC. The approved supplier shall have to provide this training free of cost and no extra payment will be made by the purchaser towards training. Tenderer not able to provide the training shall be rejected. The training should be provided by experienced trainers. 48. No payment shall be made for goods rejected at site on testing. 49. All the equipment Hardware/Software will be tested and demonstrated keeping general guidelines for tests of DMRC for their functionality, compatibility & features as well as any other prescribed test. The installation is supposed to be completed only after the purchaser is satisfied with the performance of the entire system and its taking over at each site in DMRC. 50. The tender should be submitted in the prescribed document only, signed & sealed on each pages as well as enclosures. 51. The supplier shall indemnify the purchaser against all third party claims of infringement of patent, trademark or industrial design rights arising from use of the goods or any part thereof in Indian Telecom Network. 52. DMRC reserves the right to upgrade/replace any parts of the systems, and also to shift the system to any other office without prior notice. 53. Only the manufacturers or their authorised dealers are eligible for participation in the tender. In case of authorised dealers authorisation letter from manufacturer to participate in this particular tender should be submitted. 8

9 54. Documents/ Literatures / Broachers clearly giving specifications of the items proposed to be supplied should be enclosed along with tender documents. 55. The purchaser is free to award the contract to the same or different vendors Part wise/item wise depending upon the outcome of evaluation.
