5 Penticton Creek Council Meeting May 4, 2015 Project Location:
6 Objectives Return Penticton Creek to a more healthy stream state with a focus on habitat features that benefit Kokanee, Rainbow Trout and Riparian wildlife; Address existing failing flood protection infrastructure; Meet or exceed existing flood protection measures; Improve aesthetic and social values; Increase economic contributions to the local community; Be consistent with the Downtown Plan, Penticton Creek is an important natural amenity; Be consistent with the OCP, promotion of critical species habit and the restoration of fish stocks in Okanagan Lake.
7 Project Background Council identified the enhancement of the Downtown as a strategic priority; Key component of the plan was recognition of the importance of Penticton Creek; 2012 Q3 Proposal received to request funding from the Habitat Conservation Trust Foundation (HCTF) to develop a restoration plan for Penticton Creek; 2013 Q1 Four years of grant funding obtained to cover the cost of designing a restored creek channel; 2013 Q2 City Council established the Penticton Creek Restoration Committee to work with staff to make the restoration of the Creek a priority; and 2014 Q1 a consultant was hired through an RFP process to work on preliminary and detail design.
8 Milestones and achievements Design flow finalized; Showcase Project Area defined; Project Background Funding of $333,000 has been secured for construction of the showcase project for this year; and Preliminary Design underway for Showcase Project.
9 Design Flow: Design Flow Mould Engineering determined a Design Flow consistent with Provincial flood requirements; The Design Flow will be used for hydraulic analysis and detailed design: Historical information = 40 m3/s + 25% for peaking factor = 10 m3/s + 20% for climate change (recommended by APEG) = 10 m3/s Recommended Design Flow = 60 m3/s
10 Design Flow STAFF RECOMMENDATION That an Instantaneous 1 in 200 year design flow of 60 cubic meters per second be used for detail design purposes.
11 Flood Protection Considerations Considerations: Flood protection considered as part of the project; Vitally important to protect adjacent property owners & the community at large from flooding; Real and perceived risks of flooding have to be addressed; Any decrease in freeboard (rise in water levels) could be seen as an increased flood risk;
12 Flood Protection Considerations Considerations: A more conservative and defensible position would be to ensure that the new design does not present any less freeboard than the original design; This is called a No-rise approach; Since March 5, 2015 Mould Engineering has established that the showcase project could be designed and constructed to achieve a no-rise situation; However private land with in the M178 Plan area would be required (Discussed in detail later).
13 Flood Protection Considerations The balance: Tolerance for the risk of flooding attributed to any proposed works vs; Fish habitat improvements; Lowering the risk of flooding also lowers the fish habitat improvement value and vice versa; There are locations where the creek could rise with no impact on flood risk.
14 Flood Protection Considerations Key considerations: The original concrete flood protection works, particularly upstream of Ellis Street, are gradually failing; How will a lesser freeboard be viewed by adjacent landowners; How will a reduction in fish habitat values impact funding.
15 Flood Protection Considerations STAFF RECOMMENDATION That the showcase area be designed utilizing a No-Rise philosophy adjusted where possible to enhance fish habitat while not significantly increasing the risk of flooding.
16 M178 Plan and Bylaws Between Five bylaws were enacted related to the channelization of Penticton Creek; The purpose of the bylaws was to establish a corridor of land on which the City could construct, maintain, repair and replace creek flood protection works; These bylaws fall under section 34 of the Community Charter which allows for appropriation of land without compensation.
17 M178 Plan and Bylaws The City is obliged to provide clear notification to property owners of intended work on their land; Existing creek flood control works include the concrete channel and the berms; Today s legislation, under Section 34 of the Community Charter would also permit the City to appropriate land for flood control works.

19 M178 Plan and Bylaws Moving forward It is proposed to work on private property reserved for that purpose by the aforementioned bylaws and the M-178 plan; Work is restricted to the limits of the actual construction undertaken previously; The showcase project could be constructed without impact to private land, using new concrete, however other sections of the creek upstream cannot be restored without reutilizing private property reserved for that purpose in the M-178 plan; Staff recommends that this precedent should not be set.
20 M178 Plan and Bylaws STAFF RECOMMENDATION That privately owned lands contained within the M-178 Plan be utilized in the construction of the Flood Control / Habitat restoration of Penticton Creek.

23 Showcase Project Selection was based on: Can be constructed within available budget ($333,000); Area is highly visible, providing excellent showcase opportunity; Potential to improve fish habitat; Addresses section of creek with severe short term channel maintenance requirements; City has control over the lands on which the works are proposed to be constructed via the M178 Plan.

25 Showcase Project - Habitat The no-rise design represents a decline in fish habitat quality compared to allowing the creek level to rise; However there will be a substantial improvement over the current channel; Biggest benefit of the project will be generated from the showcase component; Demonstrating values and building support for long term larger scale/higher quality restoration; It is anticipated the current funders will continue to support this project on the basis of the long term benefits.

37 Showcase Project STAFF RECOMMENDATION That the City proceed with permit applications for the showcase project and with public consultation and following permit approvals proceed with construction of an 80m showcase project directly upstream of the Ellis Street Bridge in STAFF RECOMMENDATION That the 2016 Budget process include a Master Plan for the Penticton Creek Restoration project and that staff actively pursue funding for this project.

39 Staff Recommendation THAT Council endorse moving forward with Penticton Creek Restoration project in accordance with the following Plan of Action: 1. Use an Instantaneous 1 in 200 year design flow of 60 cubic meters per second for detail design purposes; 2. That the showcase project be designed with a No-Rise philosophy adjusted where possible to enhance fish habitat while not significantly increasing the risk of flooding; 3. Utilize privately owned lands contained within the M-178 Plan in the construction of the Flood Control / Habitat restoration measures;
40 Staff Recommendation Cont d 4. Proceed with permit applications for the showcase project and with public consultation; 5. Following permit approvals, proceed with construction of an 80m showcase project directly upstream of the Ellis Street Bridge in 2015; 6. Include in the 2016 Budget a Master Plan for Flood Protection and Aquatic Habitat Restoration for the length of Penticton Creek from Okanagan Lake to the Penticton Creek II Dam by the Water Treatment Plant; and 7. Actively seek out funding sources for the Master Plan work.
41 Alternatives 1. THAT Council direct staff to cease work on the Showcase Project until such time as a Penticton Creek Flood Protection and Aquatic Habitat Restoration Master Plan for the length of Penticton Creek from Okanagan Lake to the Penticton Creek II Dam is completed; AND THAT Council direct staff to bring forward to the 2016 Budget the above noted Master Plan project; AND THAT staff pursue funding sources for the Master Plan work.
