17 Regular Agenda Item No. 15A Attachment 1 RESOLUTION NO. 12- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFIC GROVE CORRECTING APPROVED RATE ADJUSTMENT FOR THE COLLECTION, TRANSPORTATION, RECYCLING AND DISPOSAL OF SOLID WASTE AS PROVIDED BY WASTE MANAGEMENT FINDINGS 1. The City of Pacific Grove (City) and Waste Management are parties to an agreement providing for an exclusive franchise to collect solid waste. 2. The City of Pacific Grove approved a rate increase equal to 4.00%, applicable to both residential and commercial refuse hauling and recycling services provided by Waste Management, inc. pursuant to the franchise agreement. 3. The City of Pacific Grove increase of 3.95% to implement new mandates by the State Water Resources Control Board s Resolution No , adopted on March 20, The City wishes to adjust the rates to ensure consistency with the City Council s intent and the franchise agreement. NOW, THEREFORE, THE COUNCIL OF THE CITY OF PACIFIC GROVE DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council determines that each of the Findings set forth above is true and correct, and by this reference incorporates those Findings as an integral part of this Resolution. SECTION 2.
