Introduction Ms Stella Sigcau Minister Te Constitution of te Republic of Sout Africa Act, 1996 (Act No. 108 of 1996), section 32 stipulates tat every one as te rigt of access to any information eld by te State or any anoter person provided te information is required for te exercise or protection of any rigts. Te Act furter stipulates tat national legislation must be enacted to give effect to tis rigt. Te Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) ereafter referred to as te Act gives effect to te constitutional rigt of access to information eld by any public or private body and is required for te exercise or protection of any rigts. Te Act details te procedures to be followed wen making suc request for information eld eiter by a public body or private body. Section 9 of te Act, owever, recognizes tat suc rigt to access to information is subject to certain justifiable limitations suc as tose including, but not restricted to: Te reasonable protection of privacy; Commercial confidentiality; and Effective, efficient and good governance. Section 14 of te Act obliges public bodies to compile a manual to assist a person to obtain access to information eld by te public body. Subjects and Categories Automatic disclosure of records In terms of section 15 (1) of te Act, certain records can be accessed witout a person aving to request access in terms of te Act; e.g. Annual reports Media statements Speeces and messages Vacancies in te Department Te above records can be accessed at te web site of te Department of Public Works: ttp:// 7. Request Procedure Access to any existing recorded information in te possession of te Department may be applied for. Te payment can be made by ceque, postal order or bank deposit into te Department s bank account (proof of deposit to accompany te request). An acknowledgement is ten forwarded by te Information Officer to te applicant to confirm te status of te request Step 3: Information processing If te application is accepted, te Department will gater and prepare te information and calculate te cost payable Step 4: Final Notification Te applicant will be informed of te completion of is/er application as well as te outstanding fees payable to te Department Step 5: Payment and delivery Once te payment as stipulated in Step 4 is received (following te same payment process as stipulated in Step 1), te information is released to te applicant
19 7.2 General Information Te prescribed form must be filled in wit enoug particularity to, at te least, enable te Information Officer to identify te record or records requested: te identity of te applicant ; te form of record required, if te application is granted; te postal address or fax number of te applicant. Te applicant must indicate if te application is for a copy of te record or if e/se wants to inspect te records at te offices of te Department Access to te aforesaid information will only be granted to te applicant in a manner requested, unless suc manner would unreasonably interfere wit te running and operation of te Department or damage its records or infringe its copyrigt. If for, practical reasons, access cannot be given in te requested manner but in an alternative manner ten te fee for access will be calculated according to te manner tat te applicant ad requested. If te applicant is unable to read or write, or as a disability, ten e or se can make an oral request for te record, in wic event te Information Officer will complete te form. Te applicant must state tat e/se requires te information in order to exercise or protect a rigt, and clearly state te nature of te rigt to be exercised or protected. Te Department will process te request witin 30 days, unless te applicant as stated special reasons wic would satisfy te Information Officer tat circumstances dictate tat te prescribed time period sould not be complied wit. Te 30 (tirty) day period witin wic te Department as to decide weter to grant or refuse te request may be extended for a furter period of not more tan 30 (tirty) days if it is for a large amount of information, or if it requires a searc for information eld at anoter office of te Department and te information cannot reasonably be obtained witin te initial 30 day period. Te Department will notify te applicant in writing sould an extension be sougt. If a request is made on bealf of anoter person, ten te applicant must submit proof of te capacity in wic te applicant is making te request to te reasonable satisfaction of te Information Officer. Te applicant must pay te prescribed fee, before any furter processing can take place. 8. Fees 8.1 Te Act provides for two types of fees: An application fee, wic will be a standard fee; and an access fee, wic must be calculated by taking into account reproduction costs, searc and preparation time and cost, as well as postal costs. Wen te request is received by te Information Officer, te officer sall by notice require te applicant, oter tan a personal applicant, to pay te prescribed request fee (if any), before furter processing of te request. If a searc for te record as been made and te preparation of te record for disclosure - including arrangement to make it available in te requested form - requires more tan te ours prescribed in regulation 7(3), te Information Officer sall notify te applicant to pay te prescribed portion of te access fee as a deposit. 20 An applicant wose request for access to a record as been granted, must pay an access fee for reproduction and for searc and preparation, and for any time reasonably required in excess of te prescribed ours to searc for and prepare te record for disclosure, including making arrangements to make it available in te requested form. 21 8.5 Access fees Te access fees payable by an applicant referred to in regulation 7(3) are as follows: 1) For every potocopy of an A4-size page or part tereof: 60c 2) For every printed copy of an A4-size page or part tereof eld on a computer or in electronic or macine - readable form: 40c 3) For a copy in a computer-readable form on i) stiffy disc: R5,00 ii) compact disc: R ) For a transcription of visual images, for an A4-size page or part tereof R ) For a copy of visual images R Granting / Refusal of Requests 9.1. Refusal of Request Te main grounds on wic Department can refuse a request for information relate to: Te mandatory protection of te privacy of a tird party wo is a natural person, if te request entails te unreasonable disclosure of personal information regarding tat tird party; Mandatory protection of te commercial information of a tird party, if te record contains: trade secrets of tat tird party; financial, commercial, scientific or tecnical information, if te disclosure is likely to cause arm to te financial or commercial interests of tat tird party; 6) For a transcription of an audio record, i) for an A4-size page or part tereof R12.00 ii) For a copy of an audio record R17.00 To searc for and prepare te record for disclosure: R15, 00 for eac our or part of an our, excluding te first our, reasonably required for suc searc and preparation. For purposes of section 22(2) of te Act, te following applies: a) Six ours as te ours to be exceeded before a deposit is payable; and b) One tird of te access fee is payable as a deposit by te applicant. 6) Te actual postage is payable wen a copy of a record must be posted to an applicant. Information disclosed in confidence by a tird party to te institution, if te disclosure could put tat tird party at a disadvantage in negotiations or commercial competition; Mandatory protection of confidential information of tird parties if it is protected in terms of any agreement; Mandatory protection of te safety of individuals and te protection of property; Mandatory protection of records wic would be regarded as privileged in legal proceedings; Te commercial activities of te Department, wic may include trade secrets of te Department s financial, commercial, scientific or tecnical information; disclosure of wic is likely to cause arm to te financial or commercial interests of te Department and information wic, if disclosed could put te Department at a disadvantage in negotiations or commercial competition
22 9.2. Appeal A computer programme wic is owned by te Department, and wic is protected by copyrigt. Te researc information of te Department or a tird party, if it entails te disclosure of te identity of te Department, te researcer or te subject matter of te researc and would as a result place te researc at a serious disadvantage. Requests for information tat are clearly frivolous or vexatious, or wic involve an unreasonable diversion of resources sall be refused. An applicant may lodge an internal appeal against a decision of te Information Officer of a public body to refuse an application for access; or taken in terms of section 22, 26(1) or 29(3), in relation to tat applicant wit te Minister of Public Works or te person designated in writing by te Minister. A tird party may lodge an internal appeal against a decision of te Information Officer of a public body, as defined in paragrap (a) in section 1, to grant a request for access. Manner of appeal, and appeal fees An internal appeal must be lodged in te prescribed form witin 60 days; if notice to a tird party is required by section 49 (1) (b), witin 30 days after notice is given to te appellant of te decision appealed against; or if notice to te appellant is not required, after te decision was taken te notice of appeal must be delivered or sent to te Information Officer of te public body concerned at is address, fax number or electronic mail address and it must identify te subject of te appeal and state te reasons for te internal appeal and may include any oter relevant information known to te appellant; If, in addition to a written reply, te appellant wises to be informed of te decision on te internal appeal in any oter manner, e/se must state tat manner and provide te necessary particulars to be so informed. Were applicable, te appeal must be accompanied by te prescribed appeal fee, and must specify a postal address or fax number. If an appeal is lodged after te expiry of te period referred to, te Minister of Public Works, or a person designated in writing by te Minister, must - upon sowing good cause - allow te late lodging of te appeal.
