2 Message from the Chairman Tena koutou e te iwi o Ngā Rārua. He mihi nui ki a koutou i roto i ngā ni āhuatanga o te wā. He karanga tenei kia whakamōhio atu ki a koutou nga rongo e pā ana ki ngā mahi whakatau i nga take o ngai taua o Ngā Rārua i raro i Te Tiri o Waitangi. In 2005, Ngā Rārua iwi members mandated Ngā Rārua Iwi Trust to nego ate on their behalf with the Crown a se lement of our historical Treaty of Waitangi claims. Our nego a ons with the Crown have been intensive and have resulted in a Deed of Se lement that iden fies what the Crown accepts it did wrong in its dealings with our tūpuna, an apology by the Crown to our people and Iwi, the detrimental impact the Crown s ac ons had on our people as well as the cultural, and commercial redress the Crown is offering our Iwi. The purpose of this booklet is to provide you, as a member of Ngā Rārua, with informa on so you can make an informed decision about the Deed, as well as the en ty that would receive and manage the redress assets on your behalf. The Trust believes no further improvement on this offer is possible for Ngā Rārua at this me, or in the foreseeable future. While our Trust and the Crown have accepted the Deed, it is now up to you to decide whether or not you support it and the en ty proposed. My fellow trustees and I urge you to support the three resolu ons to bring the Deed to frui on by cas ng a yes vote. Our iwi can only receive the redress assets if there is sufficient support from iwi members. Our Trust will be holding five mee ngs for iwi members, where they will get the opportunity to discuss ma ers in more detail with Trust representa ves and me. 3 Frequently Asked Ques ons Who is the se lement for? The se lement is for all descendants of an original iwi member of Ngā Rārua. All descendants, whether they live within or outside the tribal area, are en tled to benefit from the se lement. Original iwi members are defined as: Persons who exercised customary rights predominantly in the Nga Rārua area of interest at any me a er 6 February 1840 by virtue of being descended from 1 or more of the recognised ancestors of Nga Rārua; and/or Those individuals who se led in Golden Bay, Motueka, Whakatu and Wairau as a result of the raupatu during the 1820s and who were recorded on the tle to land or reserves [in the Ngā Rārua area of interest] as being Ngā Rārua owners or occupiers of those lands or reserves, being the persons listed on the next two pages. What does the Deed actually se le? The Deed will fully and finally se le all Ngā Rārua historical Treaty of Waitangi claims against the Crown for incidents up to 21 September This means all claims of individuals, whānau or hapū who affiliate to Ngā Rārua, whether or not they were filed with the Waitangi Tribunal, will be se led through the redress package on offer. This does not stop Ngā Rārua from filing contemporary claims against the Crown for incidents that happened a er 21 September What is the ra fica on process? Before Ngā Rārua members and the Crown can sign the Deed of Se lement, there must be a demonstra on of support from iwi members. Therefore Ngā Rārua iwi members aged 18 years and older are given the opportunity to vote. This is called the ra fica on process. There are three resolu ons to vote on see below. If the Deed is given a majority yes vote (i.e. ra fied ), we will hold a signing ceremony which you can a end. We plan for the signing ceremony to be held at Parerārua, Wairau Pā in April Once the Deed is signed the se lement legisla on will be introduced into Parliament. A er the legisla on is enacted the redress will transfer or come into force. The day this happens is referred to as the se lement date. Where can I get more detailed informa on from? They and the Deed of Se lement can also be viewed online at Hardcopies can be viewed at the Ngā Rārua Iwi Trust office in Blenheim or Te Puni Kōkiri in Auckland, Wellington and Hamilton. RESOLUTIONS & RECOMMENDATIONS The trustees of Ngā Rārua Iwi Trust recommend that iwi members support the se lement and ra fica on by cas ng your votes in favour of the following resolu ons. 1. I accept the Ngā Rārua Deed of Se lement. 2. I agree that Barry Mason sign the Ngā Rārua Deed of Se lement on behalf of the people of Ngā Rārua. 3. Two of our Trustees - Olivia Hall and Rima Piggo recently resigned from Ngā Rārua- A awa Iwi Trust (NRAIT) because NRAIT are opposing our se lement. This ac on on their part is in line with legal advice to Ngā Rārua Iwi Trust.
