3 Terms and conditions (1) Tenders should be valid for a minimum period of NINETY days from the last date for submission of the tender and shall be submitted by filling in the prescribed format attached as Annexure-A and Annexure-B, accompanied by copies of necessary documents to confirm the specifications. The price quoted shall remain firm and no change of the same will be permitted on any account during the validity period. (2) Tender documents are to be submitted in two sealed covers. 1st will contain the Technical Document, EMD and statutory certificates. 2nd will contain the Rate as per Financial Bid Format. Violation to this would result in invalidation of tender. Both Cover I (Technical Bid) and Cover II (Financial Bid) should be enclosed in another envelop superscribing Tenders for supply of Notebook Computers addressed to the JT. RUBBER PRODUCTION COMMISSIONER (DEV), RUBBER BOARD HEAD OFFICE, SUB-JAIL ROAD, COLLECTORATE PO, KOTTAYAM , should reach this office latest by 2 PM on 21/03/2011. (3) The technical bids will be opened on 21/03/2011 at 2.30 PM, in the presence of those bidders who choose to be present. The bidder may be required to demonstrate an identical product before a group of officers of the Board and satisfactorily clarify their queries as part of the technical evaluation. The financial bids of the technically qualified bidders only will be considered for opening, under intimation to the bidders. The financial bids of the technically disqualified bidders will be returned unopened and the EMD remitted by them will be refunded. (4) The goods supplied under this tender shall be original/new components/parts and that no refurbished/duplicated/second hand/pirated components/parts/operating system are used or would be used and shall not have any defect arising from design, materials and workmanship or from any act or omission of the supplier that may develop under normal use of the supplied goods. All items should carry free of cost repair / replacement onsite warranty support including Operating System for carry-in anywhere in India for a minimum period of THREE years from the date of successful installation of the goods to the satisfaction of the Board. (5) Terms and conditions for supply, if any, should be mentioned in the tender itself. Such terms and conditions, if not conforming to this notice, will not be binding on Rubber Board, unless otherwise mutually agreed to in writing. Inclusion of fresh terms and conditions, additionally, after placement of firm order will not be permitted. (6) The rate quoted shall be inclusive of all expenses such as all duties, taxes, transportation and other incidental expenses for delivery and installation at the Head Office of the Board or any location as specified in the firm order, and for support for a period of three years of the systems at the specified locations. (7) Full technical support for the installation and maintenance of the hardware, system software and other software that may be procured by the Board, must be provided by the supplier during the warranty period. (8) The tender offering the lowest price for the goods having the required specifications and warranty support for a period of three years may be considered as responsive, provided it meets all other terms & conditions. (9) The items shall be supplied and installed in the specified locations of the Board within 10 days from the date of firm order. Items supplied will be inspected with reference to the specifications given by the Board and the other additional features offered in the tender. Items which are not of good quality or which do not conform to the requirements / specifications will summarily be rejected. The supplier shall remove such rejected items from the premises of the Board within 24 hours of such intimation at their own expenses. (10) Ninety percent payment can be effected on completion of the installation of the enitre system to the satisfaction of the Board with the required user-training and entering a service agreement with the Board for a period of three years from the latest date of installation of the items. The balance 10 % will be released against Security Deposit by way of an irrevocable Bank Guarantee of a nationalised bank valid for a period upto completion of the warranty period. The EMD remitted can be adjusted against the Security Deposit. The supplier is bound to make good any loss or damage of any loss on Ref. No. RP/COMP/PC/2/ dt.25/02/2011 Page: 3 of 5

4 account of manufacturing defects during the warranty period. In the event of any loss or damages during the period, Board shall be entitled to deduct from the deposit the amount of such loss/damages, costs and expenses as the case may be. No interest is payable on the said security deposit. (11) The supplier's shall arrange a one-day operational training to the users at seven locations as specified by the Board five in Kerala and one each at Agartala (Tripura) and Guwahati (Assam). (12) Remedial (breakdown) maintenance support is to be provided throughout the Board's working days and as per the Board's requirement, within the specified time limit. (13) The Rubber Board reserves the right to accept or reject any of the tenders without assigning any reason thereof. The Board also have the right to increase or decrease the quantity of items and/or to select and order such items only from the bid offer while placing the firm order. (14) All tenders shall be accompanied with an Earnest Money Deposit of ` 1,00,000/- (Rupees one Lakh only) by way of Demand Draft favouring the Rubber Production Commissioner, Rubber Board, Kottayam. EMD cannot be exempted in any case. Tenders without EMD shall be considered nonresponsive. (15) In case the successful tenderer fails to execute the order as per the terms and conditions, the EMD deposited shall be forfeited without further notice. (16) The tenderer may also quote the rates for any accessories of the required equipments as optional so that the Board may also include those items, if found necessary. (17) The relevant details to be furnished are as follows: Cover I: (i) (ii) Full contact details of the bidder including postal address, telephone number, mobile number, address etc. Earnest Money Deposit. (iii) Signed copy of the terms & conditions. (iv) (v) (vi) Make, model, specifications, deviations, if any, additional features, etc. of the products offered (with options, if any) against the requirement as per Annexure A. Copies of necessary documents to prove the capability of the vendor to supply and maintain such systems supported by an escalation matrix. A statement showing the guaranteed minimum response time and the guaranteed maximum downtime for each item. (i.e. defined as the number of days for which the equipment is not usable because of the inability of the supplier to repair it.) (vii) Certificate from the OEMs stating that the vendor is authorised to supply and provide support to their equipment. (viii) Copies of documents supporting ISO certification, Microsoft certification etc. (ix) (x) Cover II: A list of reputed major customers in the Government/Banking sector to whom the systems have been supplied earlier and their contact details. An undertaking of authenticity of notebook computer in the specified format attached. Nothing but the costs in the format for financial bid as per format in Annexure B duly attested by the authorised signatory I/We confirm that the offered products meet the specifications given above. I/We also agree to abide by all the aforesaid terms and conditions in case the order is placed on us. The deviations (if any) and additional features are highlighted for reference. 5 UNDERTAKING OF AUTHENTICITY OF NOTEBOOK COMPUTER Sub: Tender notice No: RP/COMP/PC/2/ dt.25/02/2011 Ref: Tender No dated supplied by.. We hereby undertake that all the components, parts, operating system, hardware, battery and other items mentioned in Annexures A & B being supplied/quoted to you shall be original new components from the respective manufacturer of the product and that no refurbished/duplicate/second hand parts/components/pirated operating system are used or shall be used. We shall also undertake that in respect of licence of operating systems if asked by you in the purchase order the same shall be supplied alongwith authorized licence-certificate and also that it shall be sourced from the authorized source. We hereby undertake to produce the certificate from our supplier in respect of all components/parts of the Notebook Computer in support of the above undertaking at the time of delivery/installation. In case of default and we are unable to comply with the above at the time of delivery or installation, we agree to take back the Notebook Computers without demur and return the money if any paid to us by you in this regard.
