4 EXECUTIVE SUMMARY Three Spires Acoustics Ltd have been commissioned by Burberry Ltd to prepare a Noise Management Plan for the Burberry Prorsum Collection Event to be held at Perks Field, Kensington Palace Gardens on Monday 17 th February The Noise Management Plan is required as part of a planning application to the Local Planning Authority, The Royal London Borough of Kensington and Chelsea. This report has been carried out in accordance with the requirements of: The Royal Borough Kensington & Chelsea Planning & Noise Guidance BS5228-1:2009 Code of Practice for Noise and Vibration Control on Construction and Open Sites Part 1: Noise Code of Practice on Environmental Noise Control at Concerts 1995 Noise management procedures and controls have been detailed which address potential noise impacts from the construction of the temporary structure and music noise impacts from the Burberry Prorsum Collection Event and rehearsals. Proposed acceptability criteria have been detailed based upon national guideline criteria and standards and agreed in principal with the local authority environmental health department. We consider that this Noise Management Plan demonstrates that the proposed development is expected to comply with the requirements of Royal Borough Kensington & Chelsea and associated national guidance and therefore complies with the requirements of the National Planning Policy Framework, 2012 and will not cause a negative impact on amenity to residents in the vicinity of the proposed temporary development site. INTRODUCTION Three Spires Acoustics Ltd have been commissioned by Burberry Ltd to prepare a Noise Management Plan (NMP) for the Burberry Prorsum Collection Event to be held at Perks Field, Kensington Palace Gardens on Monday 17 th February 2014 The Noise Management Plan is required as part of a planning application to the Local Planning Authority, Royal Borough of Kensington and Chelsea SCOPE The primary purpose of this NMP is to describe the noise management regime that will be implemented to minimise noise levels emanating from the construction of the temporary structure and music noise from the event itself effecting sensitive community areas off-site. The NMP is required to; 1. Identify existing Local Authority acoustic control requirements for construction and music noise applicable to the proposed development. 2. Detail the predicted noise emissions due to construction and music noise from the proposed development. 3. Identify suitable noise mitigation both physical and managerial that will be incorporated within the construction of the temporary structure and the control of music noise from the event in order that the Local Authority s requirements will be achieved APPROACH All activities within the event site will be carried out so far as is reasonably practicable to limit any adverse environmental impact on adjacent noise sensitive premises. The remainder of this NMP is organised as follows: Section 2: Provides a general overview of the site, the construction process and details of the Burberry Prorsum Collection event. Section 3: Identifies the Local Authority s requirements regarding noise control and relevant guidance concerning construction noise and music noise control. Section 4: Defines the applicable noise management procedures that will be implemented for the duration of the build and the event in order to control noise emissions and achieve the Local Authority s requirements. Activities considered within this NMP are:- a) The construction of the temporary structure. b) The playing of recorded and live music as part of The Burberry Prorsum Collection Event, rehearsals and testing, including PA commissioning. CONSULTANTS EXPERIENCE Three Spires Acoustics is an acoustic consultancy specialising in providing advice to the entertainment industry and licensing authorities on matters relating to the management of sound at outdoor and indoor events. The team of consultants have experience dealing with many with outdoor concerts and events in London and the wider area with clients including; BBC, SkyTV & Burberry and events ranging from Proms in the Park at Hyde Park to SW4 Dance Festival at Clapham Common. All consultants are members of the Institute of Acoustics (IOA) and Chartered Institute of Environmental Health (CIEH) and several members of staff have a regulatory background. As well as the provision of sound and acoustic design/management for entertainment venues, the company deals with the whole range of acoustic, noise and vibration issues and our staff have presented expert testimony at planning and licensing hearings. 7 2. SITE & EVENT The event is to be located in Perks Field, Kensington Palace Gardens, London W8 4PX. The event is a presentation of the Burberry Prorsum collection for Autumn / Winter Up to 1600 invited guests will attend the event which comprises a 20 minute arrival period, similar in style to the walk-in period for a theatre, a 15 minute show and then guests egress over a further 20 minutes. The event space is set out with tiered seating either side of a runway 30 metres long. Guests arrive and depart via public transport, private cars and taxis. There is a lane closure in place on Bayswater Road to assist with ensuring minimal disruption to normal traffic. The construction of the temporary structure takes place over a three week period featuring up to 25 vehicles on site each day from 30 trailers to small vans. A temporary structure is erected to house the main event space plus a secondary backstage area. Power is supplied via super silent 500kva generators (running during working hours only) and a 100kva generator supplying 24hr power. The site is enclosed with Heras fencing and where applicable, 3m tall solid steep fencing. Additional vehicles on site include a 7m telehandler and 2 forklifts; the main marquee is erected with use of a Roto machine and there are 2 cherrypickers on site for a total of 4 days. Crew will be on site from Tuesday 28 th January 2014 until Tuesday 25 th February The process involves Day 1-10:installation of site infrastructure and structures Day 11-15: installation of interior elements lights, sound, rigging, scenic elements Day 16/17: Rehearsals and Show Day Day 18-25: removal of all elements An aerial photograph of the site is presented in figure 1 below. 8 EVENT Burberry held a Men s Fashion Week event in June 2013 at the Perks Field location. The 2014 event will be very similar in nature, including the construction of the temporary structure and the Fashion Week event itself. A summary of the noise measurements undertaken during the construction of the event site are presented in Table 1 below. It is considered that noise emissions due to construction site activities ( L Aeq,12hour) for each day period were not excessive and assessment against the threshold criteria detailed in BS5288 indicates that all measurements were below the threshold levels. Music noise during the event and rehearsal were also monitored and was compliant with the proposal set out in section 4.3 of this report. Ref:CH/NMP/2013/13 July 2013 Page 8 of 17

9 3. REGULATORY FRAMEWORK 3.1. DEVELOPMENT CONTROL National planning guidance is now contained within the National Planning Policy Framework (NPPF) the Framework (March 2012) and the Noise Policy Statement for England - NPSE (March 2010). Previously planning guidance on noise was contained within PPG24 (Planning Policy Guidance: Planning and Noise - PPG24, this guidance has now been withdrawn National Planning Policy Framework 2012 Under the heading of Conserving and Enhancing the Natural Environment, noise aims are detailed at s.123, which states that: Planning policies and decisions should aim to: avoid noise from giving rise to significant adverse impacts on health and quality of life as a result of new development; mitigate and reduce to a minimum other adverse impacts on health and quality of life arising from noise from new development, including through the use of conditions; recognise that development will often create some noise and existing businesses wanting to develop in continuance of their business should not have unreasonable restrictions put on them because of changes in nearby land uses since they were established; and identify and protect areas of tranquillity which have remained relatively undisturbed by noise and are prized for their recreational and amenity value for this reason CRITERIA Further national guidance relevant to construction and music noise control is detailed below; 3.3. BS5288: 2009 CODE OF PRACTICE FOR NOISE CONTROL ON CONSTRUCTION SITES There are no statutory limits regarding construction noise. BS5228-1:2009 Code of practice for noise and vibration control on construction and open site Part 1: Noise, provides guidance on assessing the significance of noise effects from construction activities in Annex E. For the purpose of this assessment, the noise level change approach detailed in Annex E.3.2 of BS5228-1: 2009 has been used to determine the significance of potential impacts from construction noise at the nearby residential receivers. The ambient noise level is determined through baseline noise survey at, or within the vicinity of, the nearest residential properties and then rounded to the nearest 5dB to determine the appropriate category (A,B or C) and subsequent threshold value. This is compared with the total noise level, including both the ambient noise and various contributions of construction noise. A significant effect is deemed to occur if the total noise level exceeds the appropriate category threshold value. Ref:CH/NMP/2013/13 July 2013 Page 9 of 17

CODE OF PRACTICE ON ENVIRONMENTAL NOISE CONTROL AT CONCERTS 1995 The Code of Practice addresses environmental noise control at concerts and similar large music events involving high powered amplification when held in sporting stadia, arenas, open air sites and within lightweight buildings. Various guidelines and criteria are described including a table of maximum Music Noise Levels (MNL s.) Many councils refer to these benchmark levels when requiring controls for concert noise. 11 informed the review process. Two key findings from the research relevant to this application are detailed below; Annoyance rates for urban venues appear to be linked to music noise level rather than venue type, suggesting that the Code of Practice perhaps does not need to differentiate between these types of venues. Prior awareness of the concert appears to be important to managing residents expectations and allaying concerns. As prior awareness of the concert increases, the likelihood of being annoyed by the noise falls. As currently suggested in the Code of Practice, public relations are therefore crucial and concert organisers should continue to be encouraged to advertise these events to local residents, wherever possible Ref:CH/NMP/2013/13 July 2013 Page 11 of 17

12 4. NOISE MANAGEMENT 4.1. CONSTRUCTION NOISE CONTROL Best practicable means will be employed to keep the level of construction noise generated on site as low as reasonably practicable. Measures to be considered in implementing best practicable means will be consistent with the recommendations of BS5228 and include one or more of the following as appropriate: 4.2. GENERAL CONTROL MEASURES I. Careful selection of plant and construction methods. Only plant conforming to relevant national, EU or international standards, directives and recommendations on noise and vibration emissions will be used. II. Design and use of site enclosures, where practicable and necessary, to provide acoustic screening at the earliest opportunity. III. Choice of routes and programming for the transport of event site construction materials, and personnel. IV. Careful programming so that activities which may generate significant noise are planned with regard to local occupants and sensitive receptors SITE SPECIFIC CONTROL MEASURES I. Construction Activities will be limited to between and Monday to Saturday and to on Sundays II. Noise Limits The recommendations set out in Annex E.3.2 of BS5228-1: 2009 will be adopted with regard to noise limits. Noise monitoring will be undertaken periodically throughout the construction of the temporary structure at a representative location at the boundary with the closest residential properties which are considered to be Kensington Palace Road and identified as MP1 in figure 1 on page 7. The results of any noise monitoring will be made available, as required, to relevant local authorities IV. All compressors and generators shall be sound reduced models fitted with properly lined and sealed acoustic covers which shall be kept closed whenever the machines are in use. V. All machines in intermittent use shall be shut down in the intervening periods between work or throttled down to a minimum. Lorry engines will be switched off when vehicles are stationary. Noise emitting equipment which is required to run continuously shall be housed in a suitable acoustic enclosure Ref:CH/NMP/2013/13 July 2013 Page 12 of 17

13 VI. VII. VIII. IX. Temporary noise barriers will be used to reduce noise levels where appropriate and practicable. Barriers should be located as close to the plant as possible and, in order to provide adequate attenuation, should have a mass per unit area of at least 7 kg/m2. Where reasonably practicable, fixed items of construction plant should be electrically powered in preference to diesel or petrol driven. As far as reasonably practicable, noise from reversing alarms will be controlled and limited, through the following techniques; highly directional sounders, - use of broad band signals, - self adjusting output sounders Communication with residents- The event organisers will publicise details of the event to the surrounding community, in particular the nearest noise sensitive premises. A telephone number will be made available to residents in the event they wish to report noise problems MUSIC NOISE CONTROL MEASURES The following event noise management control measures which have been successfully implemented by Three Spires at many concerts and events within the London area will be adopted for the control of music at the Burberry event MUSIC NOISE LEVEL The control limits set at the mixer position shall be adequate to ensure that The Music Noise Level (MNL) shall not at any noise sensitive premises exceed 75dB(A) LAeq,15minute throughout the duration of the sound checks and event. ( The MNL shall include all music noise associated with the site.) 4.4. SOUND CHECK/REHEARSALS On the day before the show, sound checks shall only take place between the hours of and Sound System commission will take place on Day 11 of the build for a period of 1 hour. On the day of the event rehearsals and sound checks shall not exceed 2 hours, No sound checks or rehearsals shall commence before 10:00 hours ACOUSTIC CONSULTANT A suitably qualified and experienced noise control consultant will be appointed who will closely follow the methodology of this Noise Management Plan. The events management team will ensure that the promoter, sound system supplier and all sound engineers are informed of the sound control limits and that any instructions from the noise control consultant regarding noise levels are implemented PROPAGATION TEST The appointed noise control consultant will undertake a sound propagation test to correlate the music noise levels at the FOH with those observed at residential properties. The results of these tests will be used to fine tune the sound system in order to maximise the containment of music noise EVENT NOISE MONITORING Music noise monitoring will be undertaken periodically for the duration of the rehearsal and throughout the event itself. Monitoring will be undertaken at position MP1 identified in figure 1. The results from the propagation test will be used to set the sound limit at the FOH to ensure the MNL level in 4.3 above can be met. Ref:CH/NMP/2013/13 July 2013 Page 13 of 17

14 The appointed noise control consultant will be in radio / telephone contact with FOH engineers and will inform if any interventions are needed to ensure that the MNL is adhered to COMPLAINT HANDLING In the event of a complaint from a resident within the locality of the event, The appointed noise control consultant will endeavour to visit the location and undertake a measurement of the indicative MNL. Results will be feedback immediately to the FOH position and action taken as appropriate PRE-EVENT INFROMATION & TELEPHONE CONTACT The event organisers will publicise details of the event to the surrounding community, in particular the nearest noise sensitive premises. A telephone number will be made available to residents in the event they wish to report noise problems COMPLIANCE REPORT A compliance report of all the noise level measurements made at each position will submitted to the client after the event. 16 APPENDIX A GLOSSARY Noise Noise is defined as sound unwanted at the point of reception. The range of audible sound is from 0 db to 140 db. The frequency response of the ear is usually taken to be about 18 Hz (number of oscillations per second) to Hz. The ear does not respond equally to different frequencies at the same level. It is more sensitive in the mid-frequency range than the lower and higher frequencies and because of this, the low and high frequency components of a sound are reduced in importance by applying a weighting (filtering) circuit to the noise measuring instrument. The weighting which is most widely used and which correlates best with subjective response to noise is the db(a) weighting. This is an internationally accepted standard for noise measurements. For variable noise sources such as traffic, a difference of 3 db(a) is just distinguishable. In addition, a doubling of a noise source would increase the overall noise by 3 db(a). For example, if one item of machinery results in noise levels of 30 db(a) at 10 m, then two identical items of machinery adjacent to one another would result in noise levels of 33 db(a) at 10 m. The loudness of a noise is a purely subjective parameter but it is generally accepted that an increase/decrease of 10 db(a) corresponds to a doubling/halving in perceived loudness. External noise levels are rarely steady but rise and fall according to activities within an area. In an attempt to produce a figure that relates this variable noise level to subjective response, a number of noise indices have been developed. These include: LAmax noise level: This is the maximum noise level recorded over the measurement period. LAeq noise level: This is the equivalent continuous A-weighted sound pressure level, in decibels and is defined in British Standard 7445 (BS 7445) [ ] as the value of the A-weighted sound pressure level of a continuous, steady sound that, within a specified time interval, T, has the same mean square sound pressure as a sound under consideration whose level varies with time. It is a unit commonly used to describe construction noise and noise from industrial premises and is the most suitable unit for the description of other forms of environmental noise. In more straightforward terms, it is a measure of energy within the varying noise. It is also the unit best suited to assessing community response. Music Noise Level (MNL) : the LAeq of music noise measured at a particular location. LA10 noise level: This is the noise level that is exceeded for 10% of the measurement period and gives an indication of the noisier levels. It is a unit that has been used over many years for the measurement and assessment of road traffic noise. LA90 noise level: This is the noise level that is exceeded for 90% of the measurement period and gives an indication of the noise level during quieter periods. It is often referred to as the background noise level and is used in the assessment of disturbance from industrial noise. Hz (Hertz): The tonal quality of a sound is described and measured in terms of the frequency content and is commonly expressed as octave or third octave bands, the latter being the division of the octave bands into three for finer analysis, across the frequency spectrum. The smaller the octave band or third octave band centre frequency number defined in terms of Hz, the lower the sound. For example 63 Hz is lower than 500 Hz and is perceived as a deeper sound. The attenuation due to air absorption and natural barriers increases with frequency i.e. low frequencies are always the most difficult to control Ref:CH/NMP/2013/13 July 2013 Page 16 of 17
