3 ORDINANCE AN ORDINANCE APPOINTING ROBERT G. BARBER AS A FULL TIME GLENDALE POLICE OFFICER, ESTABLISHING A ONE YEAR PROBATIONARY PERIOD AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That Robert G. Barber, having successfully passed Glendale s hiring processes and as recommended by the Police Chief, is now hereby appointed by the Mayor as a full time Glendale Police Officer, with a one year probationary period and a starting wage at 85% of the current Top Patrolman pay effective August 1, SECTION II: This ordinance is hereby declared to be an emergency measure for the purpose of the timely and efficient administration of Village affairs, to allow the filling of vacancies in the Glendale Police Department, thereby providing adequate manpower for responding to emergencies and other incidents in the Village, as provided by Ohio Revised Code , and shall take effect immediately upon passage. PASSED: August 1, 2016
4 ORDINANCE AN ORDINANCE AUTHORIZING THE INCREASE OF APPROPRIATIONS OF THE GENERAL FUND FOR THE SCHOOL CROSSING GUARD POSITION AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the appropriations of the Police Account of the General Fund be increased from $850,432 to $862,432, an increase of $12,000, (lines through ) due to the receipt of a grant from a private foundation to provide a school crossing guard to be stationed at the intersection of Congress and Sharon Avenues, which primarily serves Glendale Elementary and Saint Gabriel Elementary Schools during the school year. SECTION II: This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this ordinance shall take effect immediately upon its passage. PASSED: August 1, 2016
5 ORDINANCE AN ORDINANCE AUTHORIZING THE INCREASE OF APPROPRIATIONS OF THE VILLAGE CAPITAL FUND TOWARD THE PURCHASE OF HYDRAULIC RESCUE EQUIPMENT JAWS OF LIFE AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the appropriations of the Village Capital Fund be increased from $170,220 to $182,720, an increase of $12,500, (line ) for the local match of a grant from a private foundation to provide funding for the purchase of Hydraulic Rescue Equipment Jaws of Life for the Glendale Fire Department. SECTION II: This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this ordinance shall take effect immediately upon its passage. PASSED: August 1, 2016
6 ORDINANCE AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO AWARD THE BID FOR SELF CONTAINED BREATHING APPARATUS TO VOGELPOHL FIRE EQUIPMENT IN THE AMOUNT OF $153,150 OF WHICH THE FEMA ASSISTANCE TO FIREFIGHTERS GRANT SHALL PAY 90% WITH THE REMAINDER TO BE PAID FROM THE VILLAGE CAPITAL FUND AS APPROPRIATED AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the Administrator is hereby authorized to award the publicly bid Self Contained Breathing Apparatus project to Vogelpohl Fire Equipment in the total amount of $153,150, said contractor having been found to be the lowest and best, with 95% to be paid by the Federal Emergency Management Agency (FEMA) Assistance to Firefighters Grant and the remainder to be paid from Village Capital Fund appropriated for SECTION II: This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this ordinance shall take effect immediately upon its passage. PASSED: August 1, 2016
7 ORDINANCE AN ORDINANCE AUTHORIZING THE ADMINISTRATOR TO AWARD THE BID FOR THE BREATHING AIR SYSTEM PROJECT TO BREATHING AIR SYSTEMS IN THE TOTAL AMOUNT OF $59, AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the Administrator is hereby authorized to award the publicly -bid Breathing Air System project to Breathing Air Systems in the total amount of $59,999.20, said contractor having been found to be the lowest and best bidder. SECTION II: That the total amount of the award above includes payment and acceptance of the Base Bid of $56, plus Optional Bid item for a Five-Year Service Agreement at $5, less $2, for the value of the trade-in of existing equipment. SECTION III. That 95% of the Base Bid of $56, will be paid by the FEMA Assistance to Firefighters Grant and the remainder minus the value of the trade-in of existing equipment will be paid from Village Capital funds appropriated in SECTION III: This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this ordinance shall take effect immediately upon its passage. PASSED: August 1, 2016
8 ORDINANCE AN ORDINANCE AUTHORIZING THE VILLAGE ADMINISTRATOR TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF GLENDALE AND THE HAMILTON COUNTY HAMILTON COUNTY PLANNING & DEVELOPMENT FIELD OPERATIONS DIVISION FOR THE REPAIR AND REPLACEMENT OF FIRE HYDRANTS AS NEEDED AND DECLARING AN EMERGENCY BE IT ORDAINED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the services of the Hamilton County Planning & Development, Field Operations Division would be beneficial to assist in the repair and maintenance of fire hydrants on an as needed basis throughout the Village; and SECTION II: That the Village Administrator is hereby authorized to execute an agreement detailing the terms and costs associated with these services; SECTION III: This ordinance is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this ordinance shall take effect immediately upon its passage. PASSED: August 1, 2016
9 AGREEMENT This Agreement is entered into on this day of, 2016 by and between the Board of County Commissioners, Hamilton County, Ohio ( County ) and the Village of Glendale, Hamilton County, Ohio (Village of Glendale ). RECITALS WHEREAS, Hamilton County has adequate manpower to perform fire hydrant repairs with the Village of Glendale, Ohio; and, WHEREAS, the Village of Glendale desires the services of Hamilton County Planning & Development, Field Operations Division, in repairing fire hydrants with the Village of Glendale. NOW, THEREFORE, IT IS AGREED by and between Hamilton County and the Village of Glendale as follows: 1. The services of the Hamilton County Planning & Development, Field Operations Division, are hereby made available to the Village of Glendale for the purpose of repairing or replacing fire hydrants with the Village of Glendale corporation limits. Said repairs shall be in accordance with the attached fee schedule adopted by the County, which may be amended from time to time. If such fee schedule is amended, the County shall notify the Name of City/Village within ten (10) days. The County s Planning & Development Director shall charge fees for the services performed under the authority of this Agreement. Work will be invoiced on a monthly basis. All fees collected by the County s Planning & Development Director shall be deposited into the Hamilton County Treasury. (a) Response Time: It is the goal of Hamilton County Department of Planning & Development, Field Operations Division, to respond to the following hydrants as stated: - Priority fire hydrants (hydrants out of service) within 24 hours and repair or determine the need for and schedule work - Non-priority fire hydrants (hydrants in need of repair but still operable) within 72 hours and repair or determine the need for and schedule work. Note: hydrant replacement will take longer because of O.U.P.S. utility check. (b) Material: The Village of Glendale will supply all hydrants along with any part that is not Hamilton County standard. If materials are supplied by Hamilton County, all materials will be invoiced at cost. (c) Traffic control: The Village of Glendale will supply signage and personnel (flaggers) when needed. (d) Restoration: The Village of Glendale will place top soil, seed, straw and repair/replace any road pavement, sidewalk or driveway that is disturbed. 2. This Agreement shall commence as of this day of, 2016, and, unless modified by mutual agreement of the parties or terminated earlier pursuant to its terms, shall continue in effect from year to year. 3. This Agreement may be terminated by either party upon ten (10) days prior written notice if the other party breaches any material term hereof and the breaching party fails to cure such breach
10 within ten (10) days after receiving notice of such breach from the non-breaching party. In addition, either may terminate this Agreement at any time for any reason or for no reason at all upon sixty (60) days written notice delivered to the other party. 4. Except as otherwise provided herein, all notices and other communications shall be in writing and sent to the addressees set forth below, unless such party has notified the other party of a new mailing address. Notices shall be deemed to have been properly given on the date deposited in the U.S. Mails, if mailed; or on the date received if delivered in any other manner. 12 RESOLUTION A RESOLUTION AUTHORIZING THE TRADE-IN OF UNNEEDED, OBSOLETE OR UNFIT-FOR-USE EQUIPMENT AND/OR MACHINERY IN THE FIRE DEPARTMENT AND DECLARING AN EMERGENCY BE IT RESOLVED, by the Council of The Village of Glendale, State of Ohio, three-fourths of SECTION I: That the Village of Glendale Fire Department has the following equipment and/or machinery which are no longer needed for public use, are obsolete, or are unfit for the use for which they were acquired: Breathing Air System Equipment SECTION II: That the Village has need of new equipment and/or machinery of the same or similar type and the Council of the Village of Glendale finds it in the best interests of the Village that the sale of the obsolete, unneeded or unfit equipment and/or machinery be made simultaneously with the purchase of the new equipment and/or machinery of the same type. SECTION III: Section ((B) of the Ohio Revised Code permits a village to sell equipment and /or machinery to the person or firm from whom the village proposes to purchase other equipment and/or machinery and to have the selling price credited against the purchase price of the other equipment and/or machinery which it is purchasing. SECTION IV: That the Village hereby authorizes the sale (trade-in) of the abovereferenced equipment and/or machinery to Breathing Air Systems, the firm from whom the Village intends to purchase new equipment and/or machinery and to have the selling price credited against the purchase price of the other equipment and/or machinery. SECTION V: That the above-listed equipment and/or machinery shall be sold to Breathing Air Systems for the price of $2, and that that purchase price shall be credited against the purchase of new equipment and/or machinery from Breathing Air Systems. SECTION VI: This resolution is hereby declared to be an emergency measure for the immediate preservation of the public peace, health and or safety, as provided by Ohio Revised Code Specifically, emergency action is necessary to ensure the timely and efficient payment of Village invoices, to ensure the continuation of important Village projects, and to ensure the proper administration of Village affairs. Therefore, this resolution shall take effect immediately upon its passage.
