1 ADELAIDE CASINO REWARDS PROGRAMME TERMS AND CONDITIONS In these Terms and Conditions: Adelaide Casino means SKYCITY Adelaide Pty Ltd t/as Adelaide Casino, its successors and assigns. Card means the Card issued to a Member in connection with his or her membership. Casino means SKYCITY Adelaide Pty Ltd t/as Adelaide Casino, its successors and assigns. Eligible Goods and Services means the goods, services and facilities of a Service Provider in respect of which Adelaide Casino has agreed (with the Service Provider) that Members will earn Points from the purchase or use of such goods, services and facilities. Eligibility Age means an individual aged 18 years or over. Member means a person whose application for membership of the Programme has been accepted and who has not ceased to be a Member under the terms and conditions of the Programme. Participant means a Rewards Provider or a Service Provider. PIN means the personal identification number for use with the Card. Points means rewards points earned by a Member from the purchase or use of Eligible. Goods and Services and otherwise awarded by Adelaide Casino under the terms and conditions of the Programme. Programme means the Rewards Programme administered by Adelaide Casino and called (with respect to Members who join) the Adelaide Casino Rewards Programme or other such names as Adelaide Casino may determine. Reward means the benefits, goods, services and facilities (including tickets and vouchers) provided from time to time under the Programme that can be obtained by a Member through the accumulation and redemption of Points. Rewards Provider means the Casino and any person who has an agreement with Adelaide Casino for Members to obtain Rewards from that person in consideration of the redemption of Points. Service Provider means the Casino and any other person who has an agreement with Adelaide Casino such that Members will earn Points for the purchase or use of Eligible Goods and Services supplied by that person. SKYCITY means SKYCITY Entertainment Group Limited. Membership, Cards and participation in general: 1. Membership of the Programme provides Members with the opportunity to accumulate Points for the purchase or use of Eligible Goods and Services. The number of Points earned by Members will determine their eligibility for Rewards during the period of the membership of the Programme. 2. Current acceptable photo identification, declaration of occupation and a residential address is required in order for an application to be accepted and a membership card issued. Membership is free of charge. 3. Adelaide Casino reserves the right to refuse any application for membership or terminate membership at any time for any reason, at its sole discretion (including without limitation if a Member trespasses in any area at the property of a Service Provider or agrees to bar him/herself from entering the property of a Service Provider). In the event that membership is terminated, all Points for that membership will be forfeited. 4. Membership is not open to employees and their immediate families of Adelaide Casino and any agencies associated with this Programme. 5. Membership is personal to each Member and membership cards are not transferable. Limit of one membership per person. 6. The Card is the property of Adelaide Casino and must be returned on demand including on termination of a membership. Adelaide Casino will determine the manner of delivery for a Card to a Member at its absolute discretion. Adelaide Casino will not be responsible for any loss suffered by a Member due to misuse or non delivery of a Card. If the Card is lost or stolen, Adelaide Casino must be notified immediately and the Casino may impose a charge for any replacement Card provided. Adelaide Casino is not responsible and will accept no liability for misuse of lost or stolen Cards. 7. First use of a Card by a Member and/or his/her signing of a Card means that the Member has read and understood these terms and conditions and accepts them as well as any rules, policies and procedures that may be adopted by Adelaide Casino and confirms his/her eligibility for membership, as amended from time to time. The Member further agrees to immediately advise Adelaide Casino of any change of address and other personal details provided by the Member on the application for membership to the Programme. 8. Adelaide Casino reserves the right to terminate the Programme at any time. Upon such termination, Members will have one month (or such longer period as Adelaide Casino may specify) from the date of notice of termination within which to accrue and redeem Points. At the end of the relevant period, all Points not redeemed will expire.

Adelaide Casino may agree to combine the Programme with any other loyalty or rewards programme, or agree to Points being exchanged or exchangeable for loyalty reward points under any such programme (and vice versa), on such terms and conditions (including the exchange of Points into loyalty/rewards points of that other programme (and vice versa) as it may determine in its absolute discretion. 10. Adelaide Casino may establish, change or remove at any time different categories of membership to which different rules apply including but not limited to Point accrual rates, means of accruing Points and Rewards offered. Membership of a specific category will expire at the end of six months (or such longer period as Adelaide Casino may specify) and be reassessed according to the criteria applying at that date. 11. As part of the Rewards programme, trade promotion lotteries or other rewards based promotions proportionate to gaming activity may be offered from time to time, at Adelaide Casino s discretion. 12. Death or bankruptcy of a Member will result in cancellation of membership and forfeiture of all accumulated Rewards points. 13. These terms and conditions may be amended, varied or changed at any time, without notice by Adelaide Casino. The Casino may also amend, vary or change at any time without notice any other matter connected to the Programme. 14. Adelaide Casino collects Members personal information in order to conduct this Programme. If the required information requested such as a prospective member s residential address is not provided, the individual cannot participate in the Programme. Information provided by members to Adelaide Casino will be collected and held by the Casino. Adelaide Casino does not share your personal information with other persons outside the SKYCITY group, except where it has a legal obligation to do so or contractual arrangements for the provision of services, such as mail outs, with third party suppliers that may need access to this information to provide the relevant service. However, we require these suppliers to adhere to the principles of the Privacy Act 1988 (Cth) and to strict conditions governing how your personal information may be used. Adelaide Casino uses personal information only for the primary purpose for which it is collected, or for a related purpose where you would reasonably expect the information to be used, such as but not limited to: a. administering the Programme; b. planning, market research and promotion and marketing of goods, services and facilities of third party suppliers; c. the provision or performance of services relating to the Programme and/or Adelaide Casino; d. the verification of a member s current or existing status within any regulated barring registers, lists or databases; e. sending the Member information, including newsletters and transaction statements. Members may advise f. Adelaide Casino that they do not wish to receive Member information material; g. the protection of Adelaide Casino s rights and property, including, the protection of the integrity of the operation of the Casino; and h. Adelaide Casino, Participants and other contractual third party suppliers will also collect information about the Member s Points balance and information relating to and derived from the Member s transactions affecting his/her Points balance and may exchange such information between themselves and use it for the above purposes. Adelaide Casino may, for an indefinite period unless otherwise advised, use Member s personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Member. 15. While Adelaide Casino will not use personal information for any other purpose without your consent, we reserve the right to use the information in circumstances set out in the Privacy Act 1988 (Cth). These circumstances may be related to: a. a legal demand for the information from a law enforcement agency; b. a public or individual health and safety issue; or c. Members may request access to personal information and request that it be corrected at any time. Access to the Premium Gaming Areas for South Australian residents is by invitation only and restricted to members who have undergone the required qualifications including but not limited to:

3 a. Membership status within the Adelaide Casino loyalty program; b. Achieving or exceeding the regulated numerical threshold; c. Consent to checking barring registers, lists or databases; d. Not currently listed on any barring register, list or database; e. Passing a Host Responsibility Risk Assessment; f. Declaration that there is no current gambling problem; and g. Passing any appropriate Adelaide Casino background appraisal. 17. Access to Premium Gaming Areas for International/interstate members is available on request when the individual can provide identification proving their city/country of residency is not South Australia and by confirming they do not currently have a gambling problem. 18. Access to the Premium Gaming Area s for qualifying South Australian members is regulated at a maximum of 182 days. A Premium member can have their access extended beyond this prescribed timeframe if they adhere to the current Terms and Conditions. 19. Premium members can sponsor one guest at a time for entry into the Premium Gaming Areas. If the guest is South Australian the guest will be required to: a. Become a member of the Adelaide Casino Loyalty Program; b. Consent to checking barring registers, lists or databases; c. Not currently listed on any barring register, list or database; d. Passing a Host Responsibility Risk Assessment; and e. Declaration that there is no current gambling problem. 20. Entry to the Premium Gaming areas is at Adelaide Casinos discretion and can be revoked at any time. Points: 21. Points are not transferable. Points may only be redeemed by the Member who has earned them and proof of identification may be required. 22. Points are valid for one year from the date that they are accrued and any Points that are not redeemed within one year will expire. All Points are redeemed on a first in-first out basis. 23. Any Points accrued for any purchase or money spent that is then reimbursed or refunded will be deducted from the Member s Points balance. 24. Adelaide Casino is not responsible and will not accept any liability for a Card or system failure or the Member not swiping or incorrectly swiping their Card at the point of sale of a Service Provider, nor is it under any obligation to provide the Member with Points under any of these circumstances. Gaming Points can be earned on all gaming machines and selected tables. Rewards: 25. Rewards may only be obtained by the Member swiping their Card and entering their correct PIN. 26. Rewards are not transferable. 27. Adelaide Casino is not responsible for lost or stolen Reward vouchers or tickets after they have been issued or sent to the member. 28. Adelaide Casino reserves the right to cancel, withdraw or substitute Rewards at its discretion and is not responsible and will accept no liability for any loss arising from a cancellation, withdrawal or substitution of Rewards. 29. Adelaide Casino makes no warranties or representations either express or implied with respect to the quality, standard, fitness or suitability for any purpose of any goods or services (including Rewards) offered as part of the Programme and, to the extent permitted by law, disclaims any and all liability for any loss, damage or claim that arises in connection with any of those goods and services. 30. In the event that liability cannot be excluded by law, liability for a breach of a condition or warranty in relation to goods or services provided in the course of the Programme is limited to: a. In the case of goods, to either one or more of the following: - the replacement of the goods or the supply of equivalent goods; - the repair of the goods;

4 - the payment of the cost of replacing the goods or of acquiring equivalent goods; or - the payment of the cost of having the goods repaired; and b. In the case of services, to: - the supplying of the services again; or - the payment of the cost of having the services supplied again. 31. 6 Abuses of the program: 40. Any fraud or misuse of the Card or improper conduct (as determined by Adelaide Casino in its absolute discretion) or breach of these terms and conditions will result in the Casino taking appropriate Adelaide Casino Rewards (as determined by Adelaide Casino in its absolute discretion) which may include the cancellation of membership and the forfeiture of the Card and any Points. 41. Each Member is responsible for keeping his or her PIN secure and confidential. Where the Member chooses his or her PIN he or she must not choose sequential numbers, personal information or any other easily found or known PIN. The Member must not disclose the PIN to any person except to a staff member of the Casino or a Rewards Provider for the purposes of redeeming Points. Adelaide Casino will not be responsible or liable for disclosure of a PIN by a Member outside these circumstances or use of a Member s PIN by another person. Any person who uses a Member s PIN to obtain Rewards will result in that Member s Points balance being irreversibly reduced as a result of that use. 42. Membership of the Programme does not give access to the benefits of any other restricted access club or facility of Adelaide Casino or another Participant s venue and does not entitle a Member to obtain access to any area, club or facility in the Casino or another Participant s venue. Any Member found attempting to access any such area, club or facility without permission will be deemed to be in breach of these terms and conditions. Adelaide Casino is a member of the Casinos and Resorts Australasia and complies with the Australian Casino Association Privacy Code which can be viewed at Adelaide Casino reserves the right to verify the validity of a Member s Points or purchases or use of Eligible Goods and Services and to disqualify any Member who acts other than in accordance with these terms and conditions from further participation. 44. Adelaide Casino is not liable for any loss or damage whatsoever which is suffered (including but not limited to direct, indirect or consequential loss) or for personal injury which is suffered or sustained by a Member as a result of their membership to this Programme, except for any liability that cannot be excluded by law. 45. Adelaide Casino s decision on all matters pertaining to the Programme, including but not limited to the distribution of Rewards, is final and binding with no correspondence being entered into 46. Adelaide Casino Management can downgrade a member s Rewards tier at any time, if the member has been absent for an extended period of time or has not attained the qualifying number of Rewards points in the required time frame to remain in their current tier or for any other reason.. Review of members tiers will take place every 6 months.
