Chambers 2007 Introduction Our construction practice in brief Over 20 years ago we were among the first law firms to recognise construction law as a specialist area in its own right and to develop a team dedicated to its practice. Since that time we have been in the forefront of developments in construction law and have consolidated our position as a leading practice in the field. This period has also seen the development of an everwider range of forms of construction procurement and public and private financing. As a firm we have recognised the changing nature of the construction industry by creating a number of further specialist teams devoted to PFI and PPP projects and the energy sector under the umbrella of our Energy Projects and Construction (EPC) group. As a key member of the EPC group we work closely with our colleagues in these related disciplines. At the same time our construction team remains focused on its core practice of advising on: the procurement of privately funded projects of all kinds matters arising during the course of projects from initial design through to completion of the works dispute resolution including litigation, arbitration, adjudication and all forms of ADR. Our practice is both domestic and international. From our London base and UK offices we act for clients in a wide range of jurisdictions from Chile to the Philippines. As a result of the global reach of our practice we also work on major projects of every kind with colleagues in our overseas offices and from our CMS alliance. A closer look at our Construction team Since we first established our specialist construction practice, we have worked for clients from all sectors of the construction industry. These include funders, developers, main contractors, specialist sub-contractors and consultants. The unusual breadth of our practice has given us a clear understanding of the key legal issues as they affect all sections of the industry. As a result we have played a leading part in advising on evolving forms of project procurement and developing ways of resolving disputes by formal or informal means. While most members of our team specialise in either drafting or disputes work, the team as a whole works closely together to ensure that we are able to make full use of our collective expertise in the service of our clients. Our industry knowledge and experience help us to ensure that we provide advice which is accessible, practical and geared to our clients needs. Our procurement practice Our procurement team has a track record of advising on some of the largest and most complex development projects in the country as well as a range of projects internationally. We are retained by major institutional investors to advise on all their development work and count some of the leading UK developers among our clients. We advise regularly on a spectrum of domestic and international forms of contract, including JCT, NEC and FIDIC. We have also developed suites of bespoke construction documents for a number of clients to match their procurement strategies. Our success as a practice results both from the high quality of our people and from long experience of the sector and of clients requirements in a range of different circumstances. Our advice is geared to ensuring as far as possible that in every case the client s chosen procurement route reflects an optimum allocation of risk for the client and our knowledge of the industry helps us to develop market-leading procurement solutions to meet our clients objectives. Our recent work has included: developing suites of standard construction documents for The Crown Estate drafting and negotiating the construction documents for Prudential s GreenPark scheme in Reading, one of the largest business parks in the UK with approximately 2.3million square feet of office space advising Suez Energy on the terms of EPC contracts for the construction of power plants in Chile. 5 Our disputes practice Our disputes team has long experience of helping clients to anticipate and where possible prevent disputes which can arise rapidly during the course of projects. Should a dispute occur, we work with clients and consultants to prepare and defend claims and often provide strategic advice to enable clients to resolve disputes, where possible without formal legal intervention. Even today, a reference to adjudication can catch a client unawares. In such situations we are able to move rapidly to assist and enable clients to defend their position effectively. We also have extensive experience of pursuing large and complex claims via adjudication and subsequent court enforcement. Adjudication may not be the best solution, however, in the case of substantial claims of this kind. In addition to advising on High Court proceedings, arbitrations and other contractual disputes processes, we advise increasingly often on informal ad-hoc types of alternative dispute resolution, including mediation and expert determination, often agreed outside the confines of the contract. Throughout we aim to adopt a realistic commercial approach to disputes resolution, with an emphasis on providing value for money. To help ensure a cost-effective service, our lawyers are supported by an experienced paralegal team and document management systems of proven reliability. Our recent work has included: successfully enforcing an adjudicator s decision for some 1.3million for a member of the Vinci group and acting as junior counsel for the purpose advising on disputes arising from a range of PFI and PPP sectors, including roads, hospitals and schools advising Mitsubishi Heavy Industries in relation to a $US1 billion power and steam desalination project in Saudi Arabia.
