17 Legislative Requirements for Cranes Import / Sale - manufacturers & suppliers crane owners proper design & good construction free from patent defects WSHA 16 - Manufacturers & suppliers of cranes used at work has to ensure, so far as is reasonably practicable that information about the safe use is available to any person to whom it is supplied for use at work; it is safe & without risk to health when properly used; it is tested & examined. GPR 21(16) The owner of a crane must ensure that the crane is - (a) of good mechanical construction, sound material & adequate strength;
18 Legislative Requirements for Cranes Type Approval Scheme for Tower Cranes ensure that the tower crane brought into use in Singapore meet the mandatory and regulatory requirements for safe operation Apply to all models / types / brands of tower cranes Written procedures for the Type approval of Tower Cranes available online at Other Cranes Manufacturer s certificate, if new Used crane - valid certificate of statutory examination issued by regulatory authority of the country where it was last used

20 Legislative Requirements for Cranes Installation - worksite occupiers crane owners crane contractors Dismantling - worksite occupiers crane owners crane contractors WSHA 17 - Any person who erects, installs or modifies any lifting equipment for use at work has to ensure, so far as is reasonably practicable that it is installed or modified in such a manner that it is safe, & without risk to health, when properly used. safe erection / installation risk assessment competent personnel safe dismantling risk assessment competent personnel OOC 17(1) No person shall install, repair, alter or dismantle a mobile crane or a tower crane unless he is an approved crane contractor. => approved & registered with Commissioner for WSH.

22 Legislative Requirements for Cranes WSH (Risk Management) Regulations : Employers / Principals of workplaces are to: Assess risk to workers before work commences Eliminate the risk where possible, or if not take measures to control the risk such as: (i) Substitution (ii) Engineering controls (iii) Administrative controls Implement & (iv) Provision & use of suitable PPE Review Establish Safe Work Procedures Communicate the risk & control measures to the workers Hazard Identification Risk Control Risk Evaluation
23 Legislative Requirements for Cranes Use / Operation - worksite occupiers crane owners lifting personnel safe operation risk assessment, lifting planning safe equipment competent personnel to operate & maintain WSHA 11 - Occupier : > main contractor of worksite Every occupier must ensure, so far as is reasonably practicable, that the following are safe & without risks to health to every person within those premises (including public): > the workplace; > all means of access to or egress from the workplace; and > any machinery, equipment, plant, article or substance kept in the workplace. WSHA 12 - Every employer must protect, so far as is reasonably practicable, the safety & health of his employees or workers working under his direct control.
24 Legislative Requirements for Cranes Use / Operation - worksite occupiers crane owners lifting personnel GPR 21(1) Prior to 1 st use, a crane has to be thoroughly examined & tested by an Authorised Examiner (AE) & certified safe for use. Prior to erecting a tower crane, the occupier has to submit a Notification for Use of a Tower Crane to the Commissioner for WSH. 15-page guidelines on notification for use : safe operation risk assessment, lifting planning safe equipment competent personnel to operate & maintain > Layout plan certified by AE > NDT required at each erection for tower crane of 8 or more years of age (5 or more years if crane is imported as used) > Used cranes from countries without statutory inspection requirements or 10 years or more of age are not permitted for use

GPR 21(16)(b) The owner of a crane must ensure that the crane is properly maintained. 35 Legislative Requirements for Cranes Higher Penalties for Poor Safety Management & Performance Enhanced General Penalties under the WSH Act- For Individuals - S$200,000 and/or 24 months jail. For Corporations - S$500,000 fine. For repeat offenders where a fatality occurs during a previous offence & a 2nd fatality is caused Max. fine is doubled The WSHA hence allow the court to impose penalties taking into account all the relevant circumstances, including the culpability of the offender, the potential harm that could have been caused, and the harm actually done. 36 Legislative Requirements for Cranes WSH (Risk Management) Regulations Penalty for failure to conduct risk assessment and implement measures to eliminate or control risk: 1st offence - A fine not exceeding S$10,000 2nd or subsequent offence - A fine not exceeding S$20,000 or to imprisonment for a term not exceeding 12 months, or both
