1 ADMINNATIONAL ADMINITRATOR OF EUROPEAN REGISTRY AND PK REGISTRY EUROPEAN REGISTRY DATA SHEET N 4: TRUSTED ACCOUNT LIST I. SCOPE Pursuant to Article 26 paragraph 1 of the European Union Regulation 389/2013, the auction delivery accounts 1, holding accounts and trading accounts may have a trusted account list in the European registry. The table below recalls the main types of accounts in the European registry. Types of accounts in the European Registry Annex I of the European Regulation EU 389/2011 Operator holding account 1. Holding account Aircraft operator holding account Person operator holding account National holding account 2. Trading account Trading account 3. Other accounts Verifier account External platform account 1. What is a trusted account list? Each account in the European registry has a trusted account list. This list is compiled and validated by authorized representatives of the account holder. Trusted account list enables secure transfers of quotas and Kyoto units and accordingly to alleviate the constraints applicable to other transfers (see Point III: safety rules by account type). 2. Who is responsible for the trusted account list set up and management? The setting up, management and updating of the trusted account list is the responsibility of each account holder. He refers to the authorized persons to modify accounts. 2 3. What is a trading account? The concept of this "trust account list" is linked to the planned introduction of other types of accounts in the European Registry, especially trading accounts Since 02/10/2012 you may request the opening of a trading account. This requires providing all necessary documents 2. Trading accounts can: - Perform transfers to any account Third, in accordance with conditions prescribed by regulation and particularly at the end of the delay of 26 hours. - Make transfers immediately, if the destination account is validated as a trust account (the validation becomes effective after regulatory delay of 7 workings days) Note to operators and aircraft operators: - Please note that the compliance operation is not possible from a trading account. - The compliance operation is only possible from your deposit account EU-100-xxx. II. CHARACTERISTICS OF THE TRUSTED ACCOUNT LIST Each holding account has a trusted account list. Accounts held by the same account holder are included automatically on the trusted account list. You will access this function via the new tab added in the details of your account European Registry (see screenshot in page 3) When a request to add an account on the trusted account list is approved by an authorized representative of the account, a period of 7 workings days applies before this addition will be effective. During this period, the application may be cancelled. The 7 workings days delay does not apply when you remove an account from the trusted account list. The update is taken into account once the task is validated The main features of the concept of "trust account list" are: 1. Authorized representatives of the trusted account list In general, each account must have at least two authorized representatives 3 and at least one additional authorized representative 4. 2 The required list of documents is attached to the form for opening a trading account to download from the site 3 Except for the verifier account who is required to have at least one authorized representative 4 The authorized representatives may request transactions and other processes on behalf of the account holder but not to validate. Additional authorized representatives can validate transactions. 2/7
3 In accordance with the European regulation 5, the approval of an additional authorized representative shall not be required to make a transfer to an account in the trusted account list of the account holder. - Modifications to the trusted account list can be made by an authorized representative or additional authorized representative. - Modifications to the trusted account list can be validated by an authorized representative or an additional authorized representative. (if no additional authorized representative has been designated) 2. Execution of transfers to an account on the trusted account list. In accordance with Article 65 of the European Regulation EU 389/2013, the transfer of quotas or Kyoto units from a holding account is only possible to an account on the trusted account list. (See diagram safety rules by account type" point III) This restriction does not apply to trading accounts; Article 66 of the European Regulation EU 389/2013 specifies that transfers of quotas and Kyoto units are only possible to a trading account or to a holding account. For the validation of transactions, Article 23 paragraph 3 of the European Regulation EU 389/2013 states that transfers initiated from "external platform accounts" or transfers to accounts on the trusted account list does not need validation from the additional authorized representative. 3. Execution period of transfers for account in the trusted account list. Article 39 of the European Regulation EU 389/2013 states: a) that any transfer of quotas and Kyoto units, is launched immediately if validated (by an additional authorized representative of the account) from Monday to Friday, excluding French public holidays days, between 10:00 and 16:00, Paris time. b) that any transfer validated outside of these hours dedicated to their execution is launched on the following French business day at 10:00, Paris time c) a period of 26 hours is observed between the launch of the transfer and its execution. This delay does not apply to transactions between a trading account and an account on the trusted account list. d) This period is suspended on Saturday and Sunday from 00:00 to 24:00 and on French public holidays. 5 Article 23 paragraph 3 of the European Regulation EU 389/2013 3/7
4 III. SAFETY RULES BY ACCOUNT TYPE (Diagram) The table below is provided for information purposes only and do not in any way replaces the applicable regulation. INITIATION ACCOUNT TYPE DESTINATION ACCOUNT CHARACTERISTICS Not on the trusted account list - Transaction: Forbidden In accordance with Article 60 of the European Regulation EC 1193/2011 Holding Account On the trusted account list - Transaction: Possible - 26 hours delay before finalisation : Applicable* - Mandatory validation by ARR : Not required - Transaction validation by SMS Code : Required Not on the trusted account list - Transaction: Possible - 26 hours delay before finalisation: Applicable* - Mandatory validation by ARR: Required - Transaction validation by SMS code : Required Trading account On the trusted account list - Transactions: Possible - 26 hours delay before finalisation: Not Applicable, immediate transfer between 10:00 and 16:00, excluding weekend and holidays - Mandatory validation by ARR: Not required - Validation de la transaction par code SMS : Not required * : Excluding weekends and holidays, between 10:00 et 16:00, in accordance with article 36.2 of the European Regulation EC 1193/2011 Note concerning the not required mandatory validation by ARR: If there is an Additional Authorized Representative on the account he/she will have to approve the transaction. IV. HOW TO ADD AN ACCOUNT TO THE TRUSTED ACCOUNT LIST? Accounts held by the same account holder are included automatically on the trusted account list. The addition of another account to the trusted list may be proposed by any authorized person. A delay of 7 workings days after validation is required to add an account to the trusted account list. Stage : Add an account to the trusted account list To connect to the European Registry, click on this link: 1. Click on the Login button to the top left of the screen 2. On the screen which then appears (ECAS portal), fill out the requisite fields 3. Click on the " " button Warning: You will then be directed to another screen and a code will be sent to your mobile phone by text message. 4/7
5 4. Enter this code and click on the " " button. NB: You are now on the European Registry home page 5. On the European Registry homepage, go to the " " menu. 6. Click on " " to have access into your list of accounts 7. In the " " column to the right. 8. Click on " " 9. Click on the " " tab. 10. click on " " 11. Enter the account number to add in the trusted account list 12. Click on 13. The system will display a transfer confirmation request. Confirm the information and click on " " or " If you cancel at this stage you must re-start the process. 14. Once confirmed, the system will display the transaction approval request. Please fill in the requested fields. (Password and mobile phone), then click on " " 15. A code will be sent to your mobile phone by text message, enter the code. Then click on " " 16. The system will then display a message to confirm that the transaction has been received. Ex : Stage : Validation of the operation To connect to the European Registry, click on this link: 1. Click on the Login button to the top left of the screen 2. On the screen which then appears (ECAS portal), fill out the requisite fields 5/7
6 3. Click on the " " button Warning: You will then be directed to another screen and a code will be sent to your mobile phone by text message. 4. Enter this code and click on the " " button. NB: You are now on the European Registry home page 5. Go to the " " menu on the left of the screen. European Registry homepage 6. Select the square button and click on " " to assign the task 7. Your name should appear in the column "Claimant". Then click on the task to validate NB: The line will be highlighted in orange. 8. Then, click the task number, on the bottom of the screen 9. The system displays the details of the transaction to validate. Confirm the information and then click on either " " or " " 10. The system will display a transfer confirmation request. Confirm the information and click on " " or " If you cancel at this stage you must re-start the process and go back to amend the incorrect information. 6/7
7 11. Once confirmed, the system will display the transaction approval request. Please fill in the requested fields. (Password and mobile phone), then click on " " 12. A code will be sent to your mobile phone by text message, enter the code. Then click on " " 13. A screen will then be displayed confirming the operation. After validation, a delay of 7 workings days is required to add an account in the trusted account list.
