2 ماهنامة كانون / شمارة 134 و المرتهن ضمن عقد الرهن اذ ان مفاد البند 7-7 من قانون التخطيط و الميزانية المصاق عليه عام 2012 يمنعالتوكيلبالعزل. واحد المقاالت االخرى في هذا العدد هو بعنوان قواعد التشديد في اصول المحاكمات للمحاكم التاديبية لرؤساء و مساعدي مكاتب التوثيق الرسمي بقلم السيد علي توسلي الذي يبين فيه قواعد تشديدالعقوبةالتاديبيةسواء القاعدةاالعدادية او قاعدةالتقادم و قاعدةالخيارفيالتشديد و قاعدةتحديدالعقوبة و قاعدةاالنحصارفياالنفصال ليوضحبانغيابايمنهذهقواعد التشديدالخمس يجعلمنغيرالممكنتطبيقتشديدالعقوبةالتاديبية. و ثمة مقال بعنوان دراسة الموقع الحقوقي للتسجيل االلكتروني بقلم السيد محمد مهدي اسدي يشير فيه الى ان التسجيل االلكتروني يعني في واقع االمر اضفاء التخصصية على نشاطات التسجيلفيمكاتبالتوثيقالرسمي. وفيقسم نافذة يتطرقالسيدمحمدعظيميانفيمقاليحملعنوان افضلااللياتالعمالنية لمفاد الملحق االول من المادة االولى للتعليمات التنفيذية لمشروع منظومة الدفع االلكتروني للمال في مكاتبالتوثيقالرسمي. وهومقالملفت. و الضمان التنفيذي لتصرفات الراهن في العين المرهونة من وجهة النظر الفقهية هو مقال اخر في هذا العدد من شهرية كانون. و اهم اوجهه هو جمع نظريات الفقهاء حول هذا الموضوع فيما يقول كاتبه السيد صابر ناظمي ان ثمة مجاال مفسوحا امام الباحثين الحقوقيين النجاز البحث و الدراسةالفقهية الحقوقيةللنظرياتالمدرجة. وفيالقسمالثانيمن»السؤالوالجواب«يردالسيدمحمدعظيميانعلىهذاالسؤالوهو:هل انه يجب في تنظيم وثائق»تمديد المدة«او»زيادة المبلغ«تنظيم وثيقة الرهن بالضرورة في مكاتبالتوثيقالرسميالمنظمةلوثيقةالرهن كمايسعىمقال»دورالمحاميفيالوقايةمنوقوعالجرم«بقلمالسيدتينزينبشيدائيانومريم نادريفردالقتراحانيكون»محامياالسرة«احدالبرامجاالجتماعيةاالحترازية. و يتضمن هذا العدد القسم السادس و العشرين من»قاموس مفردات و مصطلحات الوقف«قام بصياغتهووضعهالسيدجليلمحمدي.

Seyed Jalil Mohammadi. «L enregistrement non-autorisée de la propriété d autrui» est le titre d un autre article écrit par MM. Dr.Ali Rafiei Moghaddam et Mohammad Amin Pourchangiz qui expliquent les exemples des actes juridiques non-autorisés. Enfin, comme dans tous les numéros du mensuel, après l actualité, les lois, les règles et les thèses judiciaires, le mot du mois, la présentation des livres juridiques et intéressants, on trouvera l extrait d articles en langues anglaise et arabe que nous espérons pouvoir attirer l attention des chercheurs juridiques, des étudiants et des professionnels juridiques.

5 خالصه 129 contradiction issue de l acceptation par le bénéficiaire d une hypothèque du mandat donné par l auteur de l hypothèque dans le contrat d hypothèque, indiquant que le mandat irrévocable a été interdit par l alinéa 7-7 de la Loi du budget de Un autre article intitulé «Les règles de l aggravation du Code de procédure du tribunal disciplinaire des notaires et clercs», est la note dont l auteur, M. Ali Tavassoli, expliquant les règles de l aggravation des peines disciplinaires, y compris «la règle numérique», «la règle de la prescription», «la règle de l option pour aggravation», «la règle de la détermination pénale», «la règle de l exclusivité dans le décharge», cherche à souligner que l absence d une de ces cinq règles de l aggravation rendra impossible l application de l aggravation des peines disciplinaires. «L étude de la fonction juridique de l enregistrement électronique" est le titre d un article écrit par M. Mohammad Mehdi Asadi qui estime que l enregistrement électronique signifie en effet le transfert à l étude notariale d une partie des activités d enregistrement. Dans la rubrique «La fenêtre» M. Mohammad Azimian explique l un des problèmes affrontés par les études notariales dans un article intéressant intitulé «La meilleure solution opérationnelle des dispositions de la 1 ère remarque du 1 er article du Règlement exécutif du projet de paiement électronique des sommes dans les études notariales». «La garantie d exécution des jouissances de l auteur d une hypothèque sur l objet hypothécaire du point de vue du droit islamique» est le titre d une note dont l élément le plus important consiste dans le rassemblent des thèses des docteurs de la loi islamique à ce sujet. L auteur, M.Saber Nazemi Poul souligne qu il y a lieu que les chercheurs juridiques se concentrent sur l étude jurisprudentielle et juridique les thèses déjà proposées. Dans la deuxième partie des «Questions réponses» M. Mohammad Azimian répond à la question de savoir si, lors de l enregistrement des actes «Renouvellement» ou «Majoration» de l acte d hypothèque, il faut ou non procéder à leur enregistrement en l étude notariale qui a établi l acte d hypothèque. Les auteurs de l article «Le rôle d un avocat dans la prévention des crimes», Mmes Zeinab Sheidaian et Maryam Naderi Fard, cherchent à proposer «l avocat de la famille» comme un des programmes préventifs sociaux.

6 Extrait d articles de Kanoun N o 134 et 135 Dans le mensuel n o 134 et 135 de Kanoun, édition des mois octobrenovembre et novembre-décembre 2012, le lecteur pourra lire les articles suivants: La rubrique «Point de vue», écrit par le directeur du mensuel M.Mohammad Reza Dashti Ardakani, est consacré à la nécessité de l attention que le législateur doit donner à la question importante des conseils spécialisés avec notaires et clercs lors de la modification des dispositions législatives et règlementaires. L éditorial de ce numéro, par M. Reza Tajgar, conseil du directeur, dans le cadre de la «Mot du jour», évoquant les problèmes rencontrés par la société du notariat, y compris le blanchiment d argent, le faux, les crimes informatiques, l escroquerie par internet, jette un nouveau regard sur les crimes organisés. Intitule «La nature de l instrument légal du pouvoir judiciaire pour prévenir des crimes organisés», l article explique profondément le souci du de la société juridique et pose la question de savoir quel est en principe l instrument légal du pouvoir judiciaire pour la prévention des crimes organisés. Puis, la rubrique «Echo» contient une note intitulée «Le principe de relativité du contrat dans le jugement du tribunal disciplinaire des notaires et clercs», écrite par M. Mohammad Azimian et qui est intéressante et laisse à réfléchir. Dans la partie des «articles», on lira un article de Mme Behnoush Falahat Pisheh intitulé «Une étude de l article 777 du Code civil et de son adaptation à l alinéa 7-7 de la Loi du budget de 2012 et à l article 34 du Code de l enregistrement». L auteur évoque la question de la

The twenty-sixth part of the endowment dictionary, compiled by Mr. Seyed Jalil Mohammadi, is also printed in this issue. The article entitled unauthorized registration of properties belonging to other people, by Dr. Ali Rafiei Moghadam and Mr. Mohammad Amin Pourchangiz, reviews instances of unauthorized possession and is very thought-provoking. Lastly, much like the previous issues, after all the discussions, news, rules, regulations, judicial decisions, word of the month, and introducing interesting legal books; the translations of the abstract of this issue are available in Arabic and French.

8 ماهنامة كانون / شمارة 134 و Act of 2012 and also Article 34 of the Registration Act, authored by Ms. Behnoush Falahat Pisheh, which discusses the conflicts resulted from mortgagee s accepting representation of mortgagor within the framework of a mortgage contract considering the provisions of the Clause 7-7 of the Budget Act of 2012 which restricts granting irrevocable power of attorney. Among the other articles of this issue, in an article entitled rules of aggravation of punishment in the procedures of the disciplinary courts of notaries public and notary assistants, the author, Mr. Ali Tavasoli, explains the rules of aggravation of punishment, including numerical rule, statute of limitation, rule of option for aggravation, rule of complete discretion over the punishment and rule of exclusivity for dismissal and specifies that the lack of each of the five rules of aggravation, makes the application of disciplinary punishment aggravation rule impossible. Reviewing the legal function of electronic registration is the title of an article by Mr. Mohammad Mehdi Asadi which believes that in fact the electronic registration signifies the transfer of delegating part of the registration responsibilities to the notaries public. Mr. Mohammad Azimian, in the Window section, explains one of the problems faced by notaries in an interesting article entitled The best operational solution stipulated in the provisions of Note 1, Article 1 of the Executive Regulations on Electronic Payment System at Notary Public Offices. The performance guarantee for possessions of mortgagor in mortgaged property from the viewpoint of Islamic law is the title of a short article, the most important aspect of which is having gathered the opinions of jurists in this respect. The author, Dr. Saber Nazemi Poul stresses that it would be appropriate if legal scholars focus on the applicability of such opinions in terms of judicial and legal regulations. In the second part of Questions - Answers, Mr. Mohammad Azimian answers the question that whether the deed of renewal or deed of price increase of the mortgage shall be drawn up by the notary public having initially prepared the deed of mortgage.

9 Abstract of Knoun Monthly, Issue Numbers 134 & 135 Knoun Monthly, Issue Numbers 134 and 135, November and December 2012: In the Viewpoint column authored by the managing editor, Mr. Mohammad Reza Dashti Ardekani, emphasizes the necessity for legislators paying attention to specialized consultation services provided by notaries public and notary assistants by the time of enactment and amendment of rules and regulations as a matter of great importance. In the Commentary of the Day column of the editorial of this issue, Mr. Reza Tajgar, advisor to managing editor, discusses the problems befalling the notary public association, such as money laundering, forgery, computer crimes and cyberfraud and adopts a different approach to the emergence of organized crime phenomena. He takes a deeper look at the current concerns of the legal community under the headline Nature of the legal means of the judicial system for preventing and combating organized crime and poses the question that what are the legal means used by the judicial system for preventing and combating organized crime from a general viewpoint? In continuation, Mr. Mohammad Azimian discusses the doctrine of privity in the common law of contract in judgments rendered by disciplinary courts of notaries public and notary assistants in the column Echo, which is very interesting and deserving of careful thought.
