Self-Directed Study OTHER COURSES FEATURING THIS MODULE (please list below) TOTAL STUDY HOURS for this Module 1 AIM OF THIS MODULE This module is designed primarily for candidates who have been nominated by their employer to undertake training for the AMHP role. However it will provide comprehensive coverage of the legal and policy frameworks in mental health that might be of interest to other candidates, for example advice workers.

2 The module meets a number of specified requirements for AMHP training as set out in section 3 of the Mental Health Specialist Standards and Requirements for Post- Qualifying Social work Education and Training in particular Key Competence Area 2 (GSCC revised 2007). These may be summarised as: Requirements related to law and policy for roles identified in the Mental Health Act 2007 Legislation and related policy and codes of practice and responsibilities for identified professional roles and accountabilities; The application of legislation in relation to specific groups and diversity Critical evaluation of local and national policy to inform practice using relevant research This module is designated at PQ Higher Specialist level and can form part of a PG Diploma (GSCC 2005). This module maps to the following criteria: Higher Specialist criteria (GSCC 2005 para 51) i, ii, iii, vii, Advanced Award i, iii, v Programme learning Outcomes: 2.1.2, 2.1.4, 2.1.5, 2.1.7, 2.1.8, 2.2.2, Social Work NOS Key Roles 1,2,3,4 and 5 2 BY ENGAGING SUCCESSFULLY WITH THIS MODULE YOU WILL BE ABLE TO 2.1 Critically apply knowledge of mental legislation, related codes of practice and national and local policy guidance to complex and high risk situations; 2.2 Critically apply in-depth knowledge of other relevant legislation, codes of practice, national and local policy guidance, in particular the Children Act 1989, Children Act 2004, Human Rights 1998 and the Mental Capacity Act 2005 taking account of values such as rights and choice; 2.3 Apply in-depth knowledge and understanding of the particular needs of children, young people, their families and communities to AMHP Specialist Mental Health practice in the context of those particular needs, taking into account risk and rights; 2.4 Demonstrate a sophisticated understanding of social inequalities, including race such that culturally appropriate measures are taken in the application of knowledge of mental health legislation; 2.5 Able to define the legal position and accountability of AMHPs in relation to the Acts, any employing organisation and the authority on whose behalf they are acting; 2.6 Critically evaluate local and national policy to inform AMHP specialist mental health practice 2.7 To base AMHP specialist mental health practice on a critical evaluation of a range of research and evidence based practice, including that on the impact of the experience of discrimination on mental health. 3 THESE ARE EXAMPLES OF THE CONTENT OF THE MODULE Introduction to module Overview of Mental Health Acts (1983 & 2007), the Mental Capacity Act (2005), Children Acts (1989, 2004), Human Rights Act (1998). 3 The AMHP role, powers, accountability and responsibilities The AMHP role - interpreting and applying legally defined threshold criteria in complex practice situations (risk, rights, judgements and dilemmas in decision making). Other statutory roles within the legislation that interface with the AMHP role The AMHP role in interprofessional practice 4 THESE ARE THE MAIN WAYS YOU WILL BE SUPPORTED IN YOUR LEARNING TO ACHIEVE THESE OUTCOMES TUTOR-LED AND TUTOR DIRECTED ACTIVITIES Lectures and workshops will introduce underpinning, and key concepts and theories related to law and policy in relation to the statutory role of AMHP and the Mental Health Act The input will be multi-professional and include practitioners. In the main these will be interactive sessions in which you will be expected to engage in group discussions and small group activity, based around exercises and case studies. A Blackboard site will include discussion board activities and resources to support your learning. This approach to learning and teaching will draw on and challenge your knowledge and experience in order to explore issues fully and to enhance your understanding. You will be expected to research topics, individually or in groups, in preparation for tasks presented in the formal teaching sessions. Tutorials will provide opportunity for the students to reflect on learning during the module, to obtain guidance on assessment activity and to consider the work to be included in the summative tasks.

4 STUDENT DIRECTED LEARNING This will take the form of: Critical reflection of your own practice experience Extending knowledge and developing the input provided by wide reading provided by the course team, and independent research Using the VLE to be fully informed of the assessment tasks in order to make best use of the assessment support provided by the module team Self reflection and application of the materials to your current experience or professional practice Development and maintenance of your PPDP portfolio Formative Assessment AMHPs - evaluate your report on the shadowing experience submitted as part of the admissions process Non-AMHPs you will need to reflect on an interview with a service user or carer who has been involved in an assessment under the Mental Health Act. In-module retrieval will be available prior to the examination board. Task 2 - a Project Presentation You will negotiate a topic with the course team, which will be of direct relevance to practice. You will conduct private study on both the research and policy aspects of this topic, and present your findings in a medium that is accessible to others. Examples of possible topics are: working with interpreters under the MHA 1983, local usage of s5.2 detention and factors influencing the length of detention, factors that influence risk judgements by AMHPs and other specialist mental health staff, local policy on the agreed "Place of Safety" and the influences this may have on assessment outcomes. Examples of media for presentation of findings are: Word document in a short report format, PowerPoint presentations, Wiki, webpages. Task 3-2 legal case studies These will be presented for assessment at the same time as the case studies for the companion module "The AMHP Role in Practice". Candidates will select two cases from their practice placement as a trainee AMHP, and present an analysis of each that addresses the AMHP requirements found in Key Competence area 2 (which is summarised in the module learning outcomes). For formative and summative assessments feedback will be timely and will identify strengths and suggestions for improvement. Where necessary it will identify particular concerns to be discussed with your tutor, or indicate where further specialist help should be sought, for example study or research skills. You will be given formative feedback on a draft of one of your case studies, at the mid point in your practice placement.
