4 1 Objective and background The Danish Government, The Capital Region of Denmark and 11 municipalities (Lyngby-Taarbæk, Gladsaxe, Herlev, Rødovre, Glostrup, Albertslund, Brøndby, Høje-Taastrup, Hvidovre, Vallensbæk, Ishøj) agreed on 20 June 2013 to construct a Light Rail on Ring 3. The agreement is based on a programme study prepared in March 2013: Programme study concerning a Light Rail on Ring 3. The above mentioned parties entered in February 2014 into a partnership Hovedstadens Letbane. The partnership was based on a bill passed in the Parliament in February Hovedstadens Letbane has the formal name Ring 3 Letbane I/S until a construction law is passed in the Parliament. The EIA process is almost finished and a proposal for a construction law is expected to be presented for the Parliament shortly hereafter. The construction law is expected to pass the Parliament around the first of April Since the legislation that will form the basis of constructing the Letbane på Ring 3 is not yet available, there will be a certain amount of uncertainty associated with some of the information given below; this includes the timing of the award of contracts assignment and the subsequent construction of the Letbane på Ring 3, which will be clarified in the tender documents. Hovedstadens Letbane (HL) will be responsible for design; construction, operation and maintenance of the Letbane på Ring 3 (Ring 3 Light Rail). HL invites via the published contract notices applicants to seek prequalification for the works needed for the construction of the Letbane på Ring 3 and for the Operation and Maintenance of the Letbane på Ring 3 in a period of 15 years after start of the commercial operation. This document is intended to provide information about the Letbane på Ring 3 and the intended scope of work for the contracts put out to tender and thereby assisting contractors in preparing their application for prequalification. On the basis of the applications for prequalification HL will select four contractors for each contract that will be invited to participate in the tender procedure, which will be in the form of negotiated tender procedure. 2 Letbane på Ring 3 The Letbane på Ring 3 will have 28 stations on a 28 kilometre double track from Lundtofte in the North to Ishøj in the South. The alignment is illustrated at figure 1 (next page). Frequent services at 5 minute intervals on weekdays make the light rail an attractive public transport solution. The light rail is expected to carry passengers a year. The number may increase to , as the area along the line gradually develops. Page: 4 of 21

6 The Letbane på Ring 3 will connect the existing 5 lines in the Copenhagen commuter rail system (The S -train system), create 6 new transport hubs in the Capital Region and underpin other public transport plans including the National Transport strategy. The Letbane på Ring 3 will also create significant urban development potential for towns within the municipalities and bring growth as citizens, employees and companies will be attracted to the region as it offers efficient public transport. For further information on the vision for the Letbane på Ring 3 please visit 3 Contract structure The contract structure will be: A. 5 contracts for Civil Works including roads, bridges and other complex structures B. 1 contract for Transportation System (TS) including Stations, Substations and CMC (CMC Building contractor as nominated subcontractor, cf. below). The TS contractor will be subcontractor to the O&M contractor for part of the maintenance C. 1 contract for Control and Maintenance Centre (CMC) Building (the contractor will be transferred to the TS Contractor as a nominated subcontractor) D. 1 contract for Operation & Maintenance (O&M). The TS contractor will be subcontractor for part of the maintenance. In the following, the different contracts are described Contracts for Civil Works The 5 contracts include all Civil Works except CMC building, Stations, SUB Stations and Transportation Systems. The 5 contracts also include landscaping works. For details please refer to section 4.1. The interfaces to the TS Contract will be detailed further in the tender documents. The 5 contracts are procured as design and build contract. 8 3.2 1 contract for Transportation System The contract for Transportation System includes design, supply and installation of all TS works and supply of Rolling Stock. Further the contract includes Sub Stations for electrical equipment, supply and installation of Stations and the CMC (CMC building as nominated subcontractor). The interfaces to the Civil Work contracts and the O&M contract will be detailed further in the tender documents. The TS contract will also include part of the maintenance works for a period of 15 years of all TS equipment. The TS Contractor will be transferred to the O&M contractor as a nominated subcontractor for part of the maintenance after substantial completion. The parts of the maintenance, which shall be performed by the TS Contractor will be defined further in the tender documents. The TS Contract is procured as a design and build contract based on functional requirements. Stations will be procured based on a design developed to a more detailed level by the Employer CMC Building Contract The CMC Building Contract shall be procured and transferred as a nominated subcontractor to the TS contractor as a design and build contract. The exact interfaces to the TS Contractor and the CW-VBG Contractor will be detailed further in the tender documents contract for O&M The contract for O&M comprises taking part in the design and contruction phase as Betriebsleiter in accordance with BOStrab, mobilisation before start of the commercial operation and operation and maintenance for a period of 15 years after start of commercial operation. The contract is procured as a service contract. The O&M contractor is obliged to include the TS contractor as a nominated subcontractor for part of the maintenance. The parts to be performed by the TS Contractor will differ from system to system and will be detailed in the tender documents. Page: 8 of 21

9 4 Scope of work 4.1 CW Contracts The Letbane på Ring 3 alignment runs through a total of 8 municipalities in a mixture of on-street and off-street environments, passing through approximately 60 signalised road junctions. It will require over 60 new or modified, structures comprising bridges, underpasses and retaining walls. Figure 3 Light Rail Bridge and Pedestrian / Cycle Bridge The Roads Contracts include the design and construction of the Civil Works for the light rail alignment and the associated road works and structures. This includes the track alignment design and all geometric and structural road design, drainage, street lighting, traffic signals, road signage, structures, earthworks and demolitions. The scope of works includes the management of interfaces, cooperation and collaboration with other contractors and consultants. In particular, there will be a high degree of design and construction interface with the Transportation Systems contractor and the other Civils Works Contractors. The Civil Works contractors shall further coordinate with the Utility Companies in the latter s relocation of utilities and in some cases it will be necessary to facilitate relocation works. The Contracts will include for all permanent and temporary works, including traffic management. Although the Contracts are predominantly design and build, a detailed design will be provided for the certain bridges and retaining walls at the light rail crossings of Nærumbanen and Banedanmark infrastructure at the new Copenhagen Ringsted railway line, Glostrup, Herlev, Buddinge and Lyngby. In the following subsections data for each of the 5 CW contracts are provided. As mentioned in section 1 there will be some uncertainty associated with the information given. That also includes the split between lateral and central alignment and the split between slab track and ballast track form in the 5 tables on the following pages. 14 4.2 Transportation System Contract The contract for Transport System (TS) includes design, supply and installation of all TS works and supply of a complete light rail system: Rolling Stock: Passenger vehicles and Service vehicles Control and Maintenance Centre (CMC) with stabling, control room, train wash, workshop with all required equipment for maintaining and operating the system (CMC Building as a nominated subcontractor, cf. above). Supply and installation of all Stations and Substations. Act as the system integrator during all phases. The contract further includes part of maintenance of the TS equipment for a period of 15 years after start of commercial operation. The split will be detailed in the tender documents. The transportation system shall be designed in accordance with the German BOStrab regulations. All equipment and systems will be similar to those found on equivalent modern European light rail networks. Transport System infrastructure element of the TS contract includes Permanent Way (Track), Traction Power, Power Supply, SCADA, Intermodal Transport Control System (ITCS), Passenger Security and Information System (PSIS), Control Room, Radio and Communication, Signalling, CMC Equipment, Stations and Traction. Traction Power will be a 750V DC overhead system with traction return through the rails. A dedicated 10kV ring fed from 3 connections to the D.O.N.G. Page: 14 of 21

15 grid will supply the Traction Power and 400V AC network. Substations will furthermore house SCADA and communication equipment. Permanent Way (Track) will include the track super structure and be twin track, standard steel rails, 1435mm gauge, approx. 80% ballasted and 20% slab track (embedded grooved rail). PSIS will be at fixed installations at stations as well as on the Light Rail vehicles (LRV). Voice and data transmission will be provided via a fibre network, radio, Wi-Fi and mobile technology. The signalling system will be based on the fundamental principles of driving by sight, but with interlocking system at a few locations. Road junction interfaces will be by local LRV detection providing a request for priority to the local signal traffic controller. Figure 7 Design to a more detailed level of the stations will form part of the tender documents. Rolling stock is anticipated to be 27 units, bi-directional vehicles, 100 % low floor, 2.65 m wide and between 30 m and 35 m long standard light rail vehicles. Passenger vehicles shall be capable of operating 130,000km/year with high reliability. Page: 15 of 21

16 4.3 CMC Building Contract The contract includes a turnkey contract for construction of a Control and Maintenance Centre (CMC), for the light rail system. The Centre is to be located west of Ring 3 and north of Ballerup Boulevard. This contract is part of the overall construction of the light rail system. The project comprises the construction of the Control Centre with a gross floor area of approximately m2. The building will house facilities for the preparation of the light rail system including washing facilities and workshops. In addition, the Control and Maintenance Centre includes a control room for monitoring the light rail operation as well as an emergency control room, which at the same time should be able to function as a training facility. Hence the building will house a large number of technical installations. In addition, the building will hold administrative premises including offices, kitchen, canteen and locker rooms with shower facilities. Figure 8 CMC The design and build contract also includes clearing of the site, site development, retaining walls and outdoor installations such as parking spaces but not railway specific installations such as track and overhead line system. However the sub structure for the track will be part of the Building Contract. The design and build contract does not include specialist LRV maintenance equipment, which is part of the scope of work for the TS Contractor. Page: 16 of 21

17 4.4 O&M Contract The service includes operation and maintenance of Light Rail assets on Ring 3 for 15 years. The contract is not a concession contract. The contracting entity puts the necessary rolling stock and the complete system at disposal of the contractor. Light Rail on Ring 3 is planned to run with headway up to 5 minutes. Trains depart with such short intervals that timetables are not necessary for the passengers. The passengers are only informed of the time interval between the trains. The average travel speed including stops is approximately 30km/h. The service is managed from the Control and Maintenance Centre (CMC) which includes workshops, washing machine facilities, operation control facilities and offices. The contractor for Operation and Maintenance (O&M) will be responsible for the daily operation of the light rail system and be the point of contact to the employer, authorities, police, etc. in relation to the light rail operation. This will include taking the role as Betriebsleiter in accordance with BOStrab from an early stage of the design and build phase. Furthermore the O&M contractor will be responsible for the provision of an organisation including trained drivers and other staff required to provide the service. The O&M contractor will be obliged to include the TS Contractor as a nominated subcontractor for some part of the maintenance of the TS equipment for a period of 15 years after start of commercial operation. The O&M contractor shall provide all ancillary equipment and road vehicles required to provide the service. Page: 17 of 21

19 6 The Employer Hovedstadens Letbane (HL) has established a project organisation to manage the public procurement procedure, staffed by HL and assisted by the law firm Viltoft as legal advisor, while Bascon A/S assist on public procurement procedures. The management and staff of Metroselskabet I/S form also the management and staff of Hovedstadens Letbane. Even though the resources are shared the two companies are two different companies with different set of owners. The 5 roads contracts will be based on an AB/SB document (HL supplement and changes to ABT 93). The TS Contract will be based on an AB/SB document (HL supplement and changes to ABT 93) for the works and a special M SB for the maintenance and based on system and functional requirements. The CMC Building contract will be based on an AB/SB document (HL supplement and changes to ABT 93). The O&M contract will be based on a special O&M SB for the Operation & Maintenance. Page: 19 of 21

20 All contracts will in the AB/SB documents contain labour and social clauses, requirements in relation to health and safety and requirements in relation to working environment, etc. 7.2 Language and legislation The working language within the project will be primarily English, but also Danish. The authority and 3 rd party contact and information will be both English and Danish. Submissions intended for coordination with authorities and third parties shall be provided by the Contractor in Danish. All contracts will be subject to Danish law and jurisdiction. 8 Procurement process 8.1 Procedure All contracts will be procured in accordance with the negotiated procedure in the EU utility directive (2004/17/EF, dated 31 March 2004). 8.2 Periodic Indicative Notice (PIN) To inform the market about the upcoming procurements a PIN was published 16 September 2015 at Tender Electronically Daily (TED) with the number: 2015/S Prequalification 6 contract notices are published at TED: 2015/S for CW-I 2015/S common for CW-VBG and CW-RH, where each contract will be a lot in the contract notice 2015/S common for CW-G and CW-L, where each contract will be a lot in the contract notice 2015/S for the TS contract 2015/S for the CMC Building contract 2015/S for the O&M contract In relation to required information in an application for prequalification reference is made to the contract notices, section III.2 for the individual contracts. 21 8.4 Negotiation process HL will in all CW contracts and the CMC Building contract reserve the possibility to identify the Most Economically Advantageous Tender (MEAT) after receipt of the first tender. It is expected that at least one round of negotiations and clarifications will be needed for all contracts and for the TS and O&M contracts more rounds of negotiation may be needed. HL will prepare Minutes of Meetings from the negotiation meetings stating agreed actions and referring process. The result of the negotiations will be documented by Tenderers in their revised tenders CW contracts and CMC Building contract HL will in the CW contract reserve the possibility to shortlist 2 or 3 Tenderers at any time after receipt of first bid TS and O&M Contracts Due to the size of the contracts HL will invite all Tenderers submitting a tender, who HL is not obliged to reject, for negotiations. Further HL will reserve the possibility identify the MEAT after receipt of the revised tender or to shortlist after receipt of a revised tender. 8.5 Contract award The award criterion will be the Economically Most Advantageous Tender (MEAT). Sub criteria will be stated in the tender documents 8.6 Owner s decision In accordance with the law Lov om letbane på Ring 3 (No. 165, dated ) is Hovedstadens Letbanes entering into construction and operational contracts presupposes the owners approval of the economical basis of the project prior to signing such contracts. When the result of all the procurement processes described in the present document is known the result has to be presented for the owners for the owner s final approval. Announcing the MEAT to the Tenderers (conditional of the owner s approval) after the approval in the Board will start the standstill period. The contracts can be signed as soon as possible after the owner s approval, which is expected in the beginning of Page: 21 of 21
