Not oly does this cause pai ad sufferig to those people who are ijured, it ca ofte result i serious disruptio to the smooth ruig of the church ad its various activities. For example, if a cleaer, caretaker, orgaist or other volutary or paid member of the church staff is ijured ad uable to carry out their ormal duties, it may be extremely difficult to fid a replacemet at short otice. As well as the possibility that the ijured perso may make a claim agaist the church for damages i a civil actio, crimial prosecutios may be brought agaist idividuals as well as the Parochial Church Coucil or Trustees uder health ad safety law where pealties may be as high as a 20,000 fie ad two years imprisomet. The Icumbet, Churchwardes ad other members of the Parochial Church Coucil have a duty of care to esure the safety of ayoe who may visit the church, hall or churchyard for ay purpose. The Health ad Safety at Work etc, Act 1974 requires every employer with five or more employees to prepare ad brig to the otice of their employees a writte statemet of their geeral policy with respect to the health ad safety at work of their employees ad the orgaisatio ad arragemets for carryig out that policy. There will be some large churches where the Parochial Church Coucil actually employs five or more people ad i these cases there is o doubt that a writte health ad safety policy statemet is required. Employers with less tha five employees are exempt from the requiremet for a writte health ad safety policy. However, the Health ad Safety Executive ow regards voluteers as employees ad persos who make use of voluteers as employers. The same level of traiig, iformatio ad protectio must be give to both voluteers ad employees. I the light of this it is good practice to have a writte policy that sets out your orgaisatio ad procedures for health ad safety, eve if you employ less tha five people. It is the duty of every employee, icludig part-time employees such as orgaists, cleaers ad caretakers, to take reasoable care for their ow safety ad that of other persos who may be affected by their acts or omissios. Although these otes provide geeral guidace for parishes, a visit by a Ecclesiastical Isurace Cosultat ad Surveyor will be ecessary i most cases. Geeral The maximum umber o a tower tour at ay oe time should be set followig a risk assessmet takig ito accout the size of the tower, the cotrol of movemet withi the tower ad the umber of stewards available. The ease with which persos ca safely evacuate the tower i case of emergecy must also be take ito accout. As a geeral guide, the maximum umber o a tower tour at ay oe time should ot exceed 15, icludig the stewards. For small towers with difficult access the risk assessmet may result i a lower maximum umber beig allowed. A higher maximum umber may be permitted i a large tower with good access but, i ay evet, the maximum umber of persos i the tower at ay oe time should ot exceed 25. Access poits to other high level areas, eg roofs, roof spaces etc. alog the route should be secured by locked doors. Access to ay areas cotaiig dagerous machiery should be secured i a similar maer. Access to bell ad rigig chambers may be permitted but oly if the bells are left i the dow positio. It must be esured that the clock mechaism is eclosed should the tour ecompass this area. See sectio o the Coditios of use applyig to chage rigig bells. Access to the tower roof should oly be permitted durig fie weather ad ot durig heavy rai, sleet, sow, strog wids or temperatures of less tha 0ºC. Access to the tower must be by safe meas ad ladders, hatches etc. should be avoided. Doorways should be sufficietly wide to admit oe perso at a time, with ease. At the top of the tower it should be esured that parapets have a miimum height of 1.1 metres (existig parapets may require improvemet, with the additio of had rails etc. to make up this height). Access oto slopig tower roofs should ot be permitted. Where parapetig is pierced, ay gaps should be o wider tha 150mm. Larger gaps may eed to be fitted with additioal bars to reduce their width Duckboards should be provided aroud parapet gutters to prevet damage to the roof surface. These should be well maitaied ad treated with fugicide, as ecessary, to prevet the build up of algae. Should a spire be preset, the there should be a miimum width of walkway aroud the spire of at least 600mm ad with duckboards provided as above. Tours to other high level areas should be restricted to specialist groups such as architects, architectural studets ad cotractors. If the tour should ecompass crossigs at high level such as clerestories, triforia, roof spaces etc., the suitable walkways, with hadrails to a height of ot less tha 1.1 metres, must be provided, together with toe-boards ad itermediate rails. If areas with restricted headroom are visited, warig otices should be clearly displayed ad foam rubber pads fixed to ay low beams, ceilig edges, projectios etc. Should a charge be levied i coectio with the tour, this may have implicatios as regards the security of cash ad loss of moey isurace. If i doubt, parishes should cotact Ecclesiastical. Your Ecclesiastical policy will cover the legal liability of parishes for ijury to members of the public icurred followig accidets durig tower tours.

As isurers, we gai a dramatic, if expesive, isight ito some commo causes of loss ad it may be useful to Church Authorities for us to list some poits of maiteace ad maagemet, which may help to avoid a uecessary loss of heritage or ufortuate ijury to a church official, parishioer or visitor. Slips, trips ad falls Slips, trips ad falls are a major cause of ijuries to voluteers, church members ad visitors alike. Hazards are preset ot just i the church itself but i church halls, churchyards ad car parks - i fact aywhere where people are likely to walk. While most ijuries are mior, serious ijuries ca require hospital treatmet or lead to permaet disability. We have produced a checklist which is available o our website, highlightig some of the most commo hazards ad the cotrol measures that ca be put i place to reduce or elimiate the risk. Some of the items icluded are detailed below or i the followig pages. Gravestoes ad tombs Although the maiteace of gravestoes ad tombs is the resposibility of the deceased s family, the church may be resposible for ay ijury if the family caot be traced. It is, therefore, importat that all gravestoes ad tombs are regularly ispected to esure public safety. Please refer to the separate sectio o churchyard safety. Steps, stairs ad ladders Bell tower steps, steps dow to boiler rooms ad access ladders should all be ispected at least aually ad ay defects remedied. Ueve ad wor treads are a positive dager to the uwary ad whilst the idetatios created by footsteps over may ceturies may give a sese of history, they do othig for safety. Exteral steps dow to boiler rooms should ot be eglected ad these require frequet ad careful attetio to remove moss, algae, leaves ad other debris. They should be protected at the top by railigs ad a lockable gate, be fitted with a hadrail ad if used durig the hours of darkess be well lit. If the family caot be traced ad a ijury results from a gravestoe, the church may be held resposible. Footpaths Regular maiteace is required to esure these remai free from moss, algae, leaves, holes, loose materials, tree roots ad obstructios ad are reasoably level. Ramps ad steps eed particular attetio with had rails ad/or lightig provided, if hazardous. Bear i mid the difficulty the frail, elderly ad disabled may have i egotiatig access to ad from the church. Litter pickig Great care eeds to be take whe clearig litter, rubbish ad other debris from the churchyard. Hypodermic eedles, drugs-related litter ad hazardous materials must be collected ad removed by the Local Authority.

Roots removig moisture from clay, soils ca lead to shrikage of the clay causig foudatios to move ad walls to crack. Braches fallig oto visitors, eighbourig property or cars are a frequet source of claims. Regular ispectios of trees, at least every six moths, should be cosidered essetial ad at least every five years by a tree surgeo. Boudary walls, feces ad lych gate Walk the boudary of your churchyard at least two or three times per year. Check for leaig pillars, posts, ad sectios of wall ad esure that the structure ad roof coverig of ay lych gate are soud. Early attetio to defects may prevet costly repairs later o. Draiage Ay water peetratig the walls of the church via the roof or from below groud is likely to cause extesive damage through rot to timbers, etc. Gutters, dowpipes ad roof valleys eed routie clearace at least every six moths. Special arragemets should be i place for clearace of sow ad ice from valleys ad the tower roof durig witry coditios. Esure that water shed from the buildigs drais away from the foudatios. Walls ad roof coverigs Visual ispectios of the exteral walls ad roof coverigs should be carried out at frequet itervals to discover ay defects requirig attetio at a early stage. Look out particularly for loose or defective piacles, parapets, roof crosses ad slipped or missig slates. Ispectios should be made after every period of stormy weather. Floors ad floor coverigs Most accidets i churches arise from slips, trips ad falls. It is most importat that all floor surfaces are ispected regularly ad ay defective areas made safe immediately ad repairs carried out as quickly as possible. Defective floors iclude ufixed, broke ad loose tiles ad pavig stoes. Rotte ad loose floorboards ad pew platforms are aother hazard. Trips ad falls are also caused by wor, frayed, loose or ufixed rugs, mats ad carpets, ad by trailig electric leads ad cables. All ufixed floor coverigs should be removed or fixed dow. Flammable liquids ad polishes A umber of major fires have bee caused by vapours give off by polishes withi a cofied space igitig spotaeously or by a spark from electrical switches. I o circumstaces should polish, polish rags or other flammable liquids be stored aywhere ear electrical switches ad preferably they should be kept i miimum quatities withi a metal cabiet i a well-vetilated area. Paraffi or petrol for law mowers must ot be stored withi the church.

19 Despite all reasoable precautios, losses of varyig magitude may still occur. Sesible forward plaig ca, however, miimise such losses ad some thought should be give to loss reductio measures. Security markig, egravig etc. plus a good descriptio may help the Police recover stole property. I o circumstaces should flammable liquids or polishes be stored aywhere ear electrical switches.

These otes are iteded to provide guidace i order to reduce the likelihood of ijury or damage to property. Paths should be reasoably level ad free of aythig that might cause someoe to trip or slip. Trees May churchyards cotai a large umber of trees. Although healthy trees may fall i extreme weather, diseased or dead trees are much more likely to fall, causig damage to the church or eighbourig buildigs ad presetig a possibility of ijury. The roots of trees ca also ecroach upo the foudatios of eighbourig buildigs causig subsidece or blockage of drais. All trees withi the churchyard should be ispected every six moths by a competet perso for sigs of disease or too close proximity to the church or eighbourig buildigs. A record should be kept of the ispectio ad ay subsequet work. This record will esure that the ispectio is carried out ad could prove useful i defedig ay legal claim agaist the parish. Ay required loppig, pruig or fellig should be carried out without delay. Where trees have previously bee pollarded, this practice should be cotiued at appropriate itervals. Where trees are the subject of a Tree Preservatio Order, the Local Authority should be cosulted prior to ay work beig carried out. Whilst it is accepted that experieced, competet members of the church ca carry out mior work, ay major fellig, pruig or workig at height must oly be carried out by a professioal cotractor. Oly persos suitably qualified ad equipped with the appropriate safety equipmet should operate chaisaws. Ay trees o eighbourig lad which could be a hazard to the church should be visually ispected durig the aual ispectio ad, if ay give cause for cocer, a letter should be writte requestig the ladower to take appropriate remedial actio. A copy of the letter should be retaied. Churchyard maiteace Equipmet used to maitai churchyards is ofte more powerful tha that used domestically. A umber of ijuries are caused each year that could be avoided by takig simple precautios. All garde machiery should be ispected ad serviced regularly ad ay defects remedied immediately. Appropriate safety equipmet should be used which ca rage from substatial footwear whe usig mowig machiery to ear defeders, safety goggles or visors, gloves ad footwear for usig trimmers ad hedge cutters. The maufacturers istructios should always be followed regardig use ad the provisio of safety equipmet. Had tools should be ispected for defects such as damaged blades ad loose hadles, ad should be kept sharp ad clea. Gloves reduce a perso s ability to detect whe a tool is slippig ad should therefore ot be wor whe usig woode-hadled, sharp-edged tools such as billhooks ad slashers.

Persos uder 18 years of age should ot use machiery. Grass cuttig A pricipal cause of accidets i churchyards is persos trippig over kerbs or graves that have become obscured by log grass. There is effectively o defece i such circumstaces to a claim that the church authorities have failed i their duty uder The Occupiers Liability Acts to esure that visitors are reasoably safe for the purposes they were permitted to be i the churchyard. If there is a risk of persos trippig over kerbs or graves the the grass must be kept to such a height that the kerb or grave is clearly visible. Regular grass cuttig is therefore essetial. Gravestoes ad tombs Over a period of time moumets suffer the ravages of frost ad water ad may become usafe. Serious ijuries ad eve fatalities have occurred whe apparetly securely mouted stoes have falle over. Maiteace of gravestoes ad tombs is the resposibility of the deceased s family. However, where the family o loger teds the grave or caot be traced, resposibility for ay ijury may rest with the church. All gravestoes, tombs ad vaults should be ispected at least aually. The ispectio eed ot be carried out by experts. A churchwarde, churchyard officer (if appoited) or other PCC member may udertake the work. Each stoe should be physically hadled to check for loose moutigs, disitegratig mortar or udue spallig caused by age or frost, thus rederig the stoework usafe. The prime fuctio of the survey is public safety. Stoes i a dagerous state should be carefully laid o the groud ad, where appropriate, the family cotacted to advise of the actio take, repair costs ot beig the resposibility of the church. Ay re-orderig of the churchyard or extesive work o idividual tombs will ecessitate a Faculty, although a umber of Dioceses ow have blaket Faculties for the makig safe of hazardous gravestoes. A ote of the survey should be recorded i the Parochial Church Coucil miutes, statig the date ad ames of the persoel udertakig the survey, that all stoes were ispected, together with a record of the umber of stoes actually laid or other actio take. Such actio would be a importat feature i the defece of ay legal claim agaist the church. Visitors Paths should be reasoably level ad free from aythig that may cause someoe to trip or slip. Boudary walls ad railigs should be stable ad i a good state of repair. Ay temporary hazardous areas such as ope graves or parts of buildigs udergoig repair should be adequately roped off ad suitable warig sigs erected. Ay permaet hazardous areas such as crypts or boiler houses should be locked or feced as appropriate. Remember that you owe a duty of care to trespassers ad i particular to childre who may see the churchyard as a excitig place to play.

22 22 GUIDANCE NOTES CHURCH HEALTH AND SAFETY Workig at height ad the safe use of ladders Accordig to statistics from the Health ad Safety Executive durig the year 2013/14, 29% of people who lost their lives at work, did so followig a fall from height. There are also thousads of major ijuries every year. Ladders should be set at a agle of 75º, that is oe uit of measure out from the wall, or support for every four uits of measure up. The Work at Height Regulatios 2005 subsequetly ameded by the Work at Height (Amedmet) Regulatios 2007 apply i Eglad, Wales ad Scotlad to employers, persos uder their cotrol ad to the self-employed. It is importat to remember that the Health ad Safety Executive regard it as good practice to provide voluteers with the same level of protectio as if they were employees. There is o Approved Code of Practice (ACOP) but the HSE have issued a Brief Guide, Ref: INDG401 (rev2) which ca be dowloaded free from the Iteret ( Defiitio of work at height The regulatios defie work at height as: (a) work i ay place, icludig a place at or below groud level where, if measures required by these regulatios were ot take, a perso could fall a distace liable to cause persoal ijury (b) movig aroud the workplace, except by a staircase i a permaet workplace where, if measures required by these regulatios were ot take, a perso could fall a distace liable to cause persoal ijury. All work at height activities should be risk assessed, i accordace with the Maagemet of Health ad Safety at Work Regulatios 1999, to idetify ad evaluate the hazards ad risks. Risks eed to be elimiated or suitable cotrol measures itroduced. The Work at Height Regulatios set out the followig key actio poits: Orgaisatio ad plaig Regulatio 4 requires that every employer esures that work at height is properly plaed, appropriately supervised ad carried out i a maer which, so far as is reasoably practicable, is safe. Orgaisatio ad plaig of work at height should also iclude plaig for emergecies ad rescue, ad esure work at height is ot udertake durig adverse weather coditios. Competece Regulatio 5 requires that every employer shall esure that o perso egages i ay activity, icludig orgaisatio, plaig ad supervisio, i relatio to work at height or equipmet for use i such work, uless he is competet to do so or, if beig traied, is beig supervised by a competet perso. Avoidace of risks from workig at height Regulatio 6 requires that every employer shall esure that work is ot carried out at height where it is reasoably practicable to carry out the work safely otherwise tha at height. Where work is carried out at height, every employer shall take suitable ad sufficiet measures to prevet, so far as is reasoably practicable, ay perso fallig a distace liable to cause persoal ijury.

23 Fallig from a height is the major cause of workplace fatalities with aroud 35 people dyig each year.

24 24 GUIDANCE NOTES CHURCH HEALTH AND SAFETY Selectio of work equipmet for workig at height Regulatio 7 requires that employers give priority to collective protectio measures over persoal protectio measures. They must also take accout of the distace ad cosequeces of a potetial fall ad the eed for easy ad timely evacuatio ad rescue i a emergecy. Requiremets for particular work equipmet Regulatio 8 covers requiremets for particular work equipmet icludig guardrails, toe-boards ad barriers, workig platforms, ets ad airbags, persoal fall protectio systems ad ladders. Schedules coverig these requiremets are icluded i the regulatios. Fragile surfaces Regulatio 9 states that o perso at work shall pass across or ear, or work o, from or ear, a fragile surface where it is reasoably practicable to carry out work safely ad uder appropriate ergoomic coditios without his doig so. Employers must esure, so far as is reasoably practicable, that suitable ad sufficiet platforms, coverigs, guardrails or similar meas of support or protectio are provided ad used so that ay foreseeable loadig is supported by such supports or bore by such protectio. If a risk of fallig remais, employers must take suitable ad sufficiet measures to miimise the distace ad cosequece of a fall. Promiet warig otices should be fixed o the approach to ay fragile surface. Ispectio of places of work at height Regulatio 13 requires that, so far as is reasoably practicable, employers ispect the surface, ad every parapet, permaet rail or other such fall protectio measure of every place of work at height prior to its use. Use of ladders Every year may people are ijured, some fatally, while usig ladders. More tha half the accidets occur because ladders are ot securely placed ad fixed. A ladder is a meas of access, ot a safe workig platform. Schedule 6 to the regulatios is effectively a checklist to esure the safe use of ladders ad states that a ladder should oly be used for work at height if a risk assessmet shows that more suitable equipmet, such as a tower scaffold or mobile elevated work platform, is ot justified because of the short duratio of the work or features at the site which preclude the use of such equipmet. The HSE have idicated that short duratio meas aythig up to 30 miutes. Schedule 6 Requiremets for ladders Every employer shall esure that a ladder is used for work at height oly if a risk assessmet uder Regulatio 3 of the Maagemet Regulatios has demostrated that the use of more suitable work equipmet is ot justified because of the low risk ad: (a) the short duratio of use, or (b) existig features o site which he caot alter. Ay surface upo which a ladder rests shall be stable, firm, of sufficiet stregth ad of suitable compositio, to safely support the ladder so that its rugs or stops remai horizotal, ad ay loadig iteded to be placed o it. A ladder shall be so positioed as to esure its stability durig use. A suspeded ladder shall be attached i a secure maer ad so that, with the exceptio of a flexible ladder, it caot be displaced ad swigig is preveted.

25 CHURCH HEALTH AND SAFETY GUIDANCE NOTES A portable ladder shall be preveted from slippig durig use by: (a) securig the stiles at or ear their upper or lower eds (b) a effective ati-slip or other effective stability device, or (c) ay other arragemet of equivalet effectiveess. A ladder used for access shall be log eough to protrude sufficietly above the place of ladig to which it provides access, uless other measures have bee take to esure a firm hadhold. No iterlockig or extesio ladder shall be used, uless its sectios are preveted from movig relative to each other while i use. A mobile ladder shall be preveted from movig before it is stepped o. Where a ladder or ru of ladders rises a vertical distace of ie metres or more above its base, there shall, where reasoably practicable, be provided at suitable itervals sufficiet safe ladig areas or rest platforms. Every ladder shall be used i such a way that: (a) a secure hadhold ad secure support are always available to the user, ad (b) the user ca maitai a safe hadhold whe carryig a load uless, i the case of a step ladder, the maiteace of a hadhold is ot practicable whe a load is carried, ad a risk assessmet uder Regulatio 3 of the Maagemet Regulatios has demostrated that the use of a stepladder is justified because of: (i) the low risk, ad (ii) the short duratio of use.

26 26 GUIDANCE NOTES CHURCH HEALTH AND SAFETY Ladder stadards Oly ladders which meet the appropriate British or Europea stadards should be used. BS 1129 applies to woode ladders, BS 2037 applies to metal ladders ad BS EN 131 applies to both. Choice of ladder Esure the ladder is suitable for the job, is of the correct costructio material ad the appropriate legth. Ladders should ot be paited as this ca hide defects. For electrical work oly use ladders of a o-coductive material. Allow oe metre of ladder legth above the highest rug you use. Never stad o the top three rugs. Stepladders Stepladders are suitable for small jobs of short duratio where it is ot possible to rest a ladder agaist a wall or other support. They should oly be used for mior maiteace at low levels. The stepladder should have a A frame with a small workig platform at the top which ca be used to hold tools ad materials. The platform should ever be used to stad o. There must be a mechaism to prevet the legs from spreadig out ad a safety catch to prevet the joit opeig. They must be placed o firm, level groud. The height of the steps should ot exceed three times the width of the base. Routie checks Before use, the ladder should be checked to esure that the geeral coditio is soud ad that it is clea ad dry, free from wet pait, oil, mud or other slippery substaces. I additio checks should be made to esure that there are: o cracks o rugs missig, bet or loose o stiles (outside uprights) damaged or bet o warpig or splittig of woode ladders o corrosio of metal ladders o sharp edges (metal) or spliters (wood) foot pads, caps ad other rubber fittigs are i place ad soud. Safe positioig The ladder should be placed o a firm, level, dry surface. Where this is ot possible, for example workig o grass, the feet should be tied to stakes i the groud to stop slippig ad a large, flat board placed udereath the feet to prevet them sikig ito the groud. The ladder should oly be set agaist structures capable of supportig the load that will be imposed upo them. Esure the ladder caot be kocked over by passig traffic. Exclusio zoes may be ecessary to esure uauthorised people do ot pass udereath the ladder. Fixed ladders The use of fixed ladders as a meas of access betwee floors should oly be cosidered where a covetioal staircase caot be accommodated ad their use is cosidered safe, based o risk assessmet. Ladders should be maitaied i a good state of repair ad securely fixed i positio. Rugs should be firmly secured i a horizotal positio ad provide a good foothold. They should exted at least 1.1 metres above ay floor accessed by the ladder. Where ladders pass through floors, the size of the opeig should be as small as practical, feced ad a gate provided where ecessary to prevet falls. Where possible, safety hoops or a permaetly fixed fall arrest system should be fitted to the ladder, as determied appropriate from risk assessmet. All ladders should be cleaed regularly before beig stored. Climbig or grippig surfaces should be free of oil, grease, mud or other slippery substaces. Timber ladders may be coated with a trasparet ocoductive fiish such as varish, shellac or a clear preservative but ot ay opaque coverig such as pait. Alumiium equipmet should be give a adequate protective coatig whe it is subject to acids, alkalis or corrosive substaces. Storage Storage areas should be easily accessible. Ladders should be stored i coditios similar to those i which they will be used, protected from direct exposure to the elemets ad well vetilated. Storage racks should give protectio agaist damage, with sufficiet support to prevet excessive saggig. Materials should ot be stored o top of ladders. Ladders should be chaied ad locked to prevet uauthorised use. Routie maiteace Ladders should carry a idetificatio umber ad a maiteace log should be kept. As well as a ispectio every time prior to use, a ispectio ad maiteace schedule should be employed to esure every ladder is thoroughly ispected o a regular basis, depedig o the eviromet where it is used ad stored ad the frequecy of use. If ay defects are foud, the ladder should be withdraw from use, suitably labelled ad segregated for repair or safe disposal. Cords, chais ad ropes should be checked ad replaced if defective, ad pulleys should be lubricated regularly. Missig or defective pads or sleeves should be replaced.

The object of the CDM Regulatios is to establish a culture of loss prevetio i the costructio idustry. The regulatios came ito effect from April 2015 ad place legal resposibilities o ayoe havig costructio work completed o o-domestic premises, referred to as the cliet. Compliace with the regulatios will help esure the costructio work is well orgaised ad maaged safely. The guidace o the legal requiremets i The Costructio (Desig ad Maagemet) Regulatios 2015 summarises the role of the cliet as follows: Make suitable arragemets for maagig a project. This icludes makig sure: - other dutyholders are appoited; - sufficiet time ad resources are allocated; Makig sure - relevat iformatio is prepared ad provided to other dutyholders; - the pricipal desiger ad pricipal cotractor carry out their duties; - welfare facilities are provided. A project is otifiable to the HSE if the costructio phase will be loger tha 30 days or 500 perso days of costructio work, ad have more tha 20 workers o site simultaeously at ay poit i the project. Cliets must appoit pricipal desigers ad pricipal cotractors as soo as practicable ad before the start of the costructio phase, so they have eough time to carry out their duties to pla ad maage the pre-costructio ad costructio phases respectively. The Pricipal Desiger These are desigers appoited by the cliet i projects ivolvig more tha oe cotractor. They ca be a orgaisatio or a idividual with sufficiet kowledge, experiece ad ability to carry out the role. Their duties are to: Pla, maage, moitor ad coordiate health ad safety i the pre-costructio phase of a project. This icludes: - idetifyig, elimiatig or cotrollig foreseeable risks; - esurig desigers carry out their duties; - regularly update, review ad revise the health ad safety file for the project; Prepare ad provide relevat iformatio to other dutyholders; Liaise with the pricipal cotractor to help i the plaig, maagemet, moitorig ad coordiatio of the costructio phase. Pricipal cotractors These are cotractors appoited by the cliet to coordiate the costructio phase of a project where it ivolves more tha oe cotractor. Their duties are to: Pla, maage, moitor ad coordiate the costructio phase of a project. This icludes: - liaisig with the cliet ad pricipal desiger; - preparig the costructio phase pla; - orgaisig cooperatio betwee cotractors ad coordiatig their work. The CDM Regulatios apply to costructio work. This icludes restoratio work to your church.

Cotractors Cotractors are those who do the actual costructio work ad ca be either a idividual or a compay. Their duties are to: Pla, maage ad moitor costructio work uder their cotrol so that it is carried out without risks to health ad safety; For projects ivolvig more tha oe cotractor, coordiate their activities with others i the project team i particular, comply with directios give to them by the pricipal desiger or pricipal cotractor; For sigle-cotractor projects, prepare a costructio phase pla. Paperwork The regulatios require the followig two documets: health ad safety file this cotais iformatio regardig the health ad safety issues of all aspects of the desig ad is i effect a maual for the completed project to help you maage health ad safety matters arisig from future maiteace, repair ad demolitio work to the buildig. The file is prepared by the Pricipal Desiger ad give to you at the ed of the project the Costructio Phase Pla this relates to health ad safety issues durig costructio ad executio of the project. It is developed by the pricipal cotractor.

31 CHURCH HEALTH AND SAFETY GUIDANCE NOTES 31 Buildig works/repairs The followig poits should be cosidered by the Parochial Church Coucil whe settig out o a programme of works: Plas/specificatios should be draw up of the works to be carried out i cojuctio with the Architect. The specificatio should make referece to site/buildig security, eg ladders to be removed, boardig for scaffoldig whe ecessary. A Faculty for the work should be applied for. Details of the work should be set to Ecclesiastical for cofirmatio of isurace for Faculty applicatio. Questioaires issued by Ecclesiastical eed to be completed ad retured so advice ca be give regardig cover required uder the terms of the cotract. I some cases a higher policy excess may be ecessary whilst the works are i operatio. A Hot work permit will be set with the questioaires. Where hot work is beig carried out durig a cotract, it is imperative that the procedures outlied i the permit be implemeted ad the permit completed. This documet should be passed to the Architect Depedig o the ature ad extet of work, cosideratio should be give to requestig a resurvey by Ecclesiastical oce the works have bee completed so that a revised scheme of isurace ca be prepared, takig ito accout the alteratios that have bee made. The PCC should esure that they comply with the provisios of the Costructio (Desig & Maagemet) Regulatios It is strogly recommeded that oly cotractors who agree to follow the Lead Sheet Associatio stadards ad who are experieced i workig with lead, be asked to udertake ay work ivolvig the repair or istallatio of lead. If this period is likely to be exceeded the Ecclesiastical must be iformed so extesios of cover ca be arraged. 11 Electrical supply istallatios, both temporary ad permaet, should be istalled i accordace with the Regulatios for Electrical Istallatios issued by the Istitutio of Egieerig ad Techology (IET), Curret Editio, plus ay formal amedmets, uder British Stadard BS 7671.

32 32 GUIDANCE NOTES CHURCH HEALTH AND SAFETY 12 All gas supplies should be istalled by a Gas Safe Registered gas fitter. Gas supplies to appliaces should be by fixed pipig or armoured flexible tubig. Gas cyliders should be located outside buildigs, secured ad protected from uauthorised iterferece. 15 For major works (usually where the cotract value exceeds 1,000,000) Ecclesiastical will require that the cotract is subject to the Joit Code of Practice o the Fire Prevetio o Costructio Sites, joitly published by the Costructio Federatio ad The Fire Protectio Associatio You must esure that cotractors have adequate Public Liability ad Employers Liability isurace ad that their policy covers your iterest if claims are made agaist the PCC. Public Liability isurace should be for at least 5,000,000. You should obtai a copy of the policy schedule or have writte cofirmatio from their isurers or their itermediary, settig out the period of isurace, idemity limit ad priciple clauses. Whilst you may ot be directly resposible for health ad safety arisig from the activities of cotractors you may well be held liable if thigs go wrog. 33 CHURCH HEALTH AND SAFETY GUIDANCE NOTES 33 The Cotrol of Asbestos Regulatios 2012 The Cotrol of Asbestos Regulatios 2012 came ito force o 6 April 2012, coverig the cotrol of asbestos at work ad asbestos licesig. Uder Regulatio 4, if you are resposible for maagig the maiteace ad repair of a buildig you have a duty to maage ay asbestos i the buildig. Regulatio 4 applies to all o-domestic premises icludig places of worship. Persos at greatest risk are those who have bee ivolved i the buildig trade, particularly those whose work ivolves drillig, sawig or cuttig ito the fabric of premises, such as plumbers, electricias, carpeters, shopfitters ad ayoe udertakig routie maiteace work. There are three mai types of asbestos still foud i premises. These are commoly called blue asbestos (crocidolite), brow asbestos (amosite) ad white asbestos (chrysotile). All of these are hazardous, although blue ad brow asbestos are more hazardous tha white. It is impossible to idetify the differet types accurately by sight. More ofte tha ot, the material will have bee paited or mixed with aother compoet. To idetify accurately the type of asbestos, it is ecessary to carry out laboratory aalysis o a sample. Asbestos ad asbestos-based products have bee used as fire breaks i ceilig voids, fire protectio aroud structural steelwork, thermal isulatio for pipes ad boilers, wall ad ceilig paels, partitios, soffit boards, roofig ad wall claddig, gutters, raiwater pipes ad water taks, textured coatigs ad viyl or thermoplastic floor tiles. Duty holders uder the regulatios must carry out: a suitable ad sufficiet assessmet to establish if there is asbestos i the premises, its quatity ad what coditio it is i presume that materials cotai asbestos, uless there is strog evidece that they do ot make ad keep up to date a record of the locatio ad coditio of asbestos-cotaiig materials (ACMs) or presumed ACMs i the premises assess the risk of the likelihood of ayoe beig exposed to fibres from these materials prepare a pla that sets out i detail how to maage the risk from this material the measures to be specified i the pla for maagig the risk must iclude moitorig the coditio of ay asbestos ad esurig that ay asbestos is properly maitaied or, where ecessary, safely removed take the ecessary steps to put the pla ito actio review ad moitor the pla ad the arragemets made to put it i place provide iformatio o the locatio ad coditio of the material to ayoe who is liable to work o or disturb it, ad make it available to the emergecy services. The duty holder must establish whether or ot asbestos is preset i the buildig, ad this ca be achieved by the followig methods: lookig at buildig plas ad ay other relevat iformatio, such as builders ivoices, which may idicate if ad where asbestos was used i the costructio or refurbishmet of the premises carryig out a thorough ispectio of the premises, both iside ad out, to idetify materials that are, or may be, asbestos cosultig with architects, employees or safety represetatives who may be able to provide more iformatio. If there are ay doubts about ay of the materials i the premises the the presumptio must be made that it cotais asbestos. The oly materials where it is safe to presume that they do ot cotai asbestos are glass, timber, metal ad stoe. Asbestos surveys ca be udertake at two differet levels, referred to as maagemet surveys, ad refurbishmet ad demolitio surveys. Maagemet surveys Udertake to maage the risk from ACMs durig the ormal occupatio ad use of a buildig. This type of survey may ivolve some mior itrusive work for samplig ad aalysis purposes but ca also ivolve presumig the presece or absece of ACMs. The survey should also iclude a assessmet of the coditio of ay ACMs or presumed ACMs to help prioritise the subsequet asbestos maagemet pla. Refurbishmet ad Demolitio surveys Udertake whe a buildig, or part of a buildig, is goig to be refurbished or demolished. This type of survey should be completed prior to ay work beig udertake which disturbs the fabric of the buildig if a previous maagemet survey of the area was ot itrusive. This type of survey is fully itrusive ad may ivolve destructive ispectio to gai access to all areas of a buildig. This type of survey must be completed before ay refurbishmet or demolitio work is udertake to locate ad describe ACMs i areas where this type of work is beig udertake. This type of survey should oly be udertake i uoccupied areas of a buildig to miimise the risks to others. It is possible to commissio a combiatio of survey types for differet areas of a buildig. Regulatio 5 requires duty holders to idetify, by aalysis or otherwise, the type of asbestos ivolved i ay work which exposes or is liable to expose idividuals to asbestos. A competet perso must be employed to udertake a survey of the premises to idetify ACMs. The survey should be carried out i accordace with the HSE Guidace Asbestos: The survey guide. HSE recommeds the use of orgaisatios accredited by UKAS to ISO/IEC to carry out asbestos surveys. Duty holders are resposible for esurig they employ competet surveyors. Curretly there is o sigle accreditatio scheme for idepedet surveyors but they must be required to demostrate that they hold persoel certificatio from a UKAS approved Certificatio Body to ISO/IEC stadard or that they have achieved the required level of competece through a alterative approved route.

36 36 GUIDANCE NOTES CHURCH HEALTH AND SAFETY Oly cotractors who are approved ad licesed by the Health ad Safety Executive are allowed to remove ad, i most cases work o, asbestos. Some tasks, by o-licesed cotractors, are permitted but from April 2012 some of this work became otifiable to HSE (otifiable olicesed work NNLW). Records of the work must also be kept ad from April 2015, medical examiatios of people doig the work will be required. Oly people who have received adequate traiig are permitted to carry out work ivolvig asbestos. The duty holder should esure that the perso udertakig the survey has the appropriate liability isurace by obtaiig a sight of the policy or other evidece. UKAS operate accreditatio schemes for laboratories ad surveyors udertakig asbestos survey ad testig. Details are available from UKAS o their website A former scheme ABICS (Asbestos Builders Ispectio Certificatio Scheme), was discotiued i October 2010 ad is o loger available. If it is decided to leave ACMs that are i good coditio i place, a ote eeds to be made of where they are located o a asbestos register. ACMs ca be labelled with asbestos warig sigs, although this is ot madatory. If asbestos is ot labelled, the duty holder must esure that those who might work o the material kow about its locatio. A Permit to Work system will esure that ayoe workig o the premises is alerted to the presece of asbestos. Where it is ot possible to safely maage asbestos left i place it must be removed by a cotractor licesed by the HSE.

37 CHURCH HEALTH AND SAFETY GUIDANCE NOTES 37 Coditios of use applyig to chage rigig bells As a geeral rule, bells should always be left i the dow positio other tha for rigig. This is accepted good practice ad provides ew rigers with practice i rigig up ad rigig dow. It also reduces corrosio to the clapper bolt caused by moisture collectig i the bells. From a health ad safety perspective it is extremely hazardous for bells to be left up particularly if fire fighters or others eed to eter the tower or if uauthorised persos, icludig childre, iterfere with the ropes. Where local circumstaces require bells to be left i the up positio these otes are to provide guidace to bellrigers i implemetig safe practices. The otes idicate a geeral safe case that should be iterpreted to meet each uique local situatio. Geeral Bells should be left i the dow positio whe ot i use durig the workig week betwee 7am Moday ad 6pm Friday with Public Holidays excepted. Outside this period, if bells are left i the up positio the the ropes must be hoisted towards the ceilig o a spider ad locked i positio. Notices warig that the bells are up ad that the ropes must ot be touched should be displayed i the rigig chamber. The access door to the bell chamber must be kept locked, a dager otice exhibited ad a sigle key kept i the cotrol of the Rigig Master or deputy. If access is required to the bell chamber durig the weeked, whilst the bells are up, the this must be uder the cotrol of the Rigig Master or deputy. Adult rigers The residet Rigig Master, or other perso resposible for tower safety, must take reasoable steps to esure that they are satisfied that all adult rigers (those aged 18 years ad over) icludig visitig rigers are competet, i good health, ad of suitable height ad build. Competet meas that rigers have sufficiet experiece i the opiio of the Rigig Master, or be i the process of beig traied i bell rigig. The Rigig Master must war visitig rigers of the particular circumstaces attached to the tower. Juior rigers Juior rigers must be at least eight years old. Writte coset must be obtaied from a paret or guardia for each child to rig or to be taught to rig. Childre must be i good health, ad of suitable height, build ad temperamet. Childre must be suitably experieced or be i the process of beig taught to rig. It should be at the discretio of the Rigig Master as to whether or ot a child is suitable. At least oe resposible adult other tha the Rigig Master (eg the paret of oe of the childre preset, or a experieced adult riger) must be preset whe childre are i the bell tower. A record should be maitaied of each juior riger s istructio ad traiig, ad their level of competece. As a geeral rule, bells should always be left i the dow positio other tha for rigig.

38 38 GUIDANCE NOTES CHURCH HEALTH AND SAFETY Special coditios cocerig heavy rigs of bells Rigs of bells where the teor weighs 20cwt or more may additioally be left i the up positio durig the workig week, providig that the followig coditios are met. The bell-frame must be secured agaist ay perso beig able to come ito cotact with the bells without the authority of the Rigig Master. This may be doe by cagig i the bell-frame, fecig ay walkway or securig ay door adjacet to the bell-frame with materials sufficietly robust to prevet access. A sigle cotrolled door i the cage or scree shall be provided with a sigle key, which shall remai i the cotrol of the Rigig Master or deputy whilst the bells are up. Where o access route to aother part of the buildig passes through the bell chamber, the access door to the bell chamber itself may be cosidered the cotrolled door. Turig the clappers of bells up wrog Where it is ecessary to tur the clapper of a bell to the right side after rigig bells up the the followig must be observed: (a) the procedure for turig the clapper must be specified i detail ad approved by Ecclesiastical. A copy shall be displayed promietly i the rigig chamber proposed activity ad timescale. They must udertake to advise the resposible perso at a prescribed time of the completio of the task. Failig receipt of such advice, the resposible perso must take immediate steps to ascertai the safety of the Steeple Keeper. Uauthorised access to the rigig chamber must be prohibited whilst work is beig udertake o the bells ad/or bell frame. Defiitios Rigig Master Otherwise Tower Captais or Coductor, beig the perso with delegated powers from the Icumbet, PCC or alterative authority, with resposibility for the rigig of the bells ad safety withi the tower. Steeple Keeper The perso with delegated resposibility for the geeral maiteace of the bells. Spider Rope ad pulley system with hook upo which the ropes ca be hug ad draw up towards the ceilig. Rigig room Room or area from which the bells are rug. Bell chamber The area of the tower i which the bellframe is located. (b) oly the Rigig Master or other traied deputy shall be allowed to carry out the procedure. Bell maiteace All maiteace should be udertake with the bells dow either by, or uder the directio of the Steeple Keeper. A secod perso should be preset with the Steeple Keeper durig maiteace operatios to assist ad take actio i the evet of a emergecy. Loe workig should be avoided. However, where this is ot possible, a Steeple Keeper workig aloe amogst the bells must take steps to advise aother resposible perso of their Up positio The bell mouth upwards ad the bell at rest supported by the stay ad slider mechaism i readiess for full circle rigig. Dow positio The bell mouth dowwards ad at rest. Wrog positio Havig rug the bell up the clapper is restig agaist the higher side of the bell mouth (the wrog side) ad before rigig ca commece the clapper has to be moved over to the lower side.

39 CHURCH HEALTH AND SAFETY GUIDANCE NOTES 39 Sale of secod-had goods Each year may dagerous items (particularly electrical items) are geerously doated to orgaisatios with the ed-users ofte beig the most vulerable members of society. Whilst these items are give with the best of itetios, the ed result could be ijury or possibly death. These guidace otes are desiged to help you avoid acceptig the most hazardous items ad to esure the safety of those who purchase from you. Sale or supply as a mai busiess If you sell or supply secod-had goods you should follow the guidelies oted below. Furiture ad soft furishigs The Furiture ad Furishigs (Fire) (Safety) Regulatios 1988 (as ameded) gover the sale ad supply of ew ad secod-had furiture ad furishigs. The law applies to retailers, secod-had shops ad charity shops as well as auctioeers. The regulatios apply to upholstered domestic furiture, icludig settees, chairs, bed bases, mattresses, headboards, stools, diig chairs, sofa beds ad garde furiture suitable for idoor use. Nursery items such as prams, pushchairs, playpes, cots ad carrycots are also icluded. Cushios ad pillows are cotrolled as well as loose covers for upholstered furiture. Ay furiture maufactured ad sold sice 1990 should comply with the regulatios. Ay upholstered furiture made before 1950 is totally exempt, eve if it has bee re-upholstered. You should be able to tell that furiture complies with the Regulatios as a permaet label should be attached to the item. This is ormally headed CARELESSNESS CAUSES FIRE ad the states that the item complies with the Furiture ad Furishigs (Fire) (Safety) Regulatios It also explais i detail that the various compoets comply with the relevat igitability tests. Beds ad mattresses do ot have to have the permaet label, but usually have some idicatios that the regulatios have bee met, such as a blue BS 7177 label claimig compliace ad showig the date of maufacture. As a guide, furiture ad furishigs maufactured betwee 1950 ad 1990 should ot be accepted for sale. Electrical appliaces Heatig appliaces ad electric blakets should ever be accepted. There is a substatial risk of these items beig faulty ad possible serious ijuries or death resultig. Other electrical items may be accepted for sale provided that you have them ispected ad tested by a competet perso, such as a suitably qualified ad experieced electricia, preferably a member of the Natioal Ispectio Coucil for Electrical Istallatio Cotractig (NICEIC), the Electrical Cotractors Associatio (ECA) or the Natioal Associatio of Professioal Ispectors ad Testers (NAPIT), before the goods leave your cotrol. A register should be kept of all items ispected, icludig Esure that ay upholstered furiture offered for sale complies with the regulatios o fire safety.

Gas appliaces These items may be accepted for sale provided that you have them ispected ad tested by a competet perso, such as a gas istaller registered with the Gas Safe Register, ad a record is kept of all items ispected, icludig date of ispectio, descriptio ad ay serial umbers, ad the item should be tagged to show that it has bee ispected. Toys New toys must comply with the Toys (Safety) Regulatios Toys that are secod-had eed ot comply with the same regulatios but rather they are covered by the Geeral Product Safety Regulatios They do ot eed to be labelled with the CE mark or the address of the maufacturer or distributor, but they must still be safe. Special warigs ad istructios are required for both secodhad ad ew toys. Electrically operated toys (other tha battery toys), must be ispected prior to sale by a qualified ad experieced perso i the same way as for other electrical items ad details recorded as oted above. Ay other toy must be ispected prior to sale by a suitably traied ad experieced perso to esure it complies with all the relevat regulatios. Toy Safety Tips Youg childre ca choke o small items so avoid toys like marbles or aythig with small detachable parts for childre uder three years old Avoid toys with log strigs ad straps for ifats Check that a child's figers wo't get caught i ay movig parts Further guidace ca be obtaied from your local Tradig Stadards Officer. Childre s clothig I order to prevet ijury ad possible stragulatio i childre, the Childre s Clothig (Hood Cords) Regulatios 1976 prohibit the sale or possessio of a child s outer garmet with a hood, where a hood cord is fitted. This icludes secod-had clothig. The regulatios apply to raicoats, overcoats, aoraks ad other garmets suitable for outerwear, ad icludes tracksuit tops. To see if the regulatios apply, faste the garmet ad lay it out as flat as possible. If the chest measures less tha 44cm (approx 17.5 iches) the the garmet must ot be fitted with a hood cord. All clothig should be checked to see that it is clea ad safe for someoe else to wear. Occasioal sales of goods at fêtes ad jumble sales You should try ad follow the guidelies give above as far as possible, but we accept that it is ot practical to arrage a professioal ispectio of electrical ad gas equipmet. The best thig is to refuse doatios of electrical ad heatig appliaces. For toys ad other items, use commo sese. A resposible perso should be appoited to check through the items prior to sale to elimiate ay which seem dagerous by virtue of their ature or coditio.

Legislatio Provided certai basic precautios are followed there is o reaso whatsoever why churches should ot be ivolved with the preparatio ad sale of food. This may rage from the oe-off aual evet, such as the church fête, a weekly coffee morig or luch, or a full scale caterig operatio providig a large umber of meals o a daily basis. Differet cosideratios apply depedig o the scale of the operatio, ad these are outlied below. What the law says The Food Safety Act ad Geeral Food Regulatios 2004 make it a offece for ayoe to sell or process for sale, food which is: harmful to health cotamiated to such a extet that it would be ureasoable to expect it to be eate falsely described, advertised or preseted ot what the customer ca reasoably expect. The purpose of this sectio is ot to alarm but to give some simple advice as to what ca be doe to miimise the risks to your ow safety ad that of others i the church eviromet. The greatest risk to persoal safety arises whe people are o their ow. Practices that have bee followed for may years without icidet may o loger be safe ad the fact that othig has goe wrog i the past is o reaso to be complacet. Now is the time to examie the way you do thigs ad make ay chages that are ecessary. You ca do this by carryig out simple risk assessmets. First of all, you eed to idetify what are the hazards. These are situatios where there is the potetial for someoe to be harmed. The you must establish what is the risk. This is the actual likelihood of someoe beig harmed, takig ito accout the measures you have i place to limit the cosequeces. These measures are called cotrols. By-products of combustio emitted ito the eviromet from vehicles, busiess ad dwelligs are ow causig cocers over issues such as ozoe depletio ad global warmig, ad millios of toes of waste are beig deposited i ladfill sites at a ever-icreasig rate. I order to address these cocers the UK has developed its ow evirometal strategy. The Hazardous Waste (Eglad ad Wales) Regulatios 2005 ad The Lists of Wastes (Eglad) Regulatios 2005 These regulatios defie hazardous waste, but essetially it ca be regarded as ay waste that may be harmful to huma health or the eviromet, e.g. asbestos, healthcare waste, chemical wastes ad solvets. Orgaisatios producig hazardous waste will usually eed to otify their premises to the Regulator, the Eviromet Agecy for Eglad ad Wales, so that they ca periodically ispect the premises to esure hazardous waste is beig properly hadled. However, there are some exceptios ad premises that produce less tha 500kg of hazardous waste per aum will ot eed to otify the Regulator. The Eviromet Agecy ca be otified i writig, by phoe, or olie.
