1 MINUTES of a meeting of the CABINET MEMBER FOR HIGHWAYS AND TRANSPORT held at County Hall, Matlock on 7 May 2010 PRESENT Councillor C Jackson (Cabinet Member) Also in attendance Councillor B C Lucas. The Cabinet Member agreed to consider the Urgent Report of the County Secretary on Conferences and Seminars (Minute 81/10) because approval was required before the next meeting. 74/10 PETITIONS RESOLVED (1) to receive the undermentioned petitions:- LOCATION/SUBJECT SIGNATURES LOCAL MEMBER Wirksworth, Water Lane 55 Cllr G Purdy Concerns Regarding Pedestrian Safety Weston-on-Trent, Main Street Concern Regarding Pedestrian Safety Chesterfield, Skeldale Drive Request to Protect Property and Safety from a Footpath Adjoining Washlands Area Ripley, Junction of Broadway and Nottingham Road Request for Traffic Safety Measures 64 Cllr J P Harrison 26 Cllr S Blank 90 Cllr D Bowley (2) that the Strategic Director -Environmental Services investigates the matters raised in the petition. 75/10 MINUTES RESOLVED that the non-exempt Minutes of the meeting of the Cabinet Member for Highways and Transport held on 22 April 2010 be confirmed as a correct record and signed by the Cabinet Member. 76/10 PETITION REQUEST FOR REPAIRS TO CULVERT TO PREVENT FLOODING IN KNIVETON Following the receipt of a petition requesting urgent repairs to an allegedly blocked culvert in Kniveton, investigations have been undertaken. 1

2 There was an old culvert which carried a stream under Back Lane under the property known as Old Hall and beneath Foxholes Lane to discharge into the main brook. The culvert could not take the water in the stream during storm conditions which overflowed into the road. Its maintenance and repair was the responsibility of the owner of land through which it passed. Officers have attempted to examine the culvert with camera equipment but without success. Upstream there appeared to have been a partial collapse of the stone built culvert and at the lower end hard calcified deposits have restricted the culvert. There appeared to be no manholes on the length of private land. It was considered necessary to reconstruct the sections of culvert under both roads and install an improved grill to prevent debris entering the culvert. The estimated cost was 20,000 and a scheme has been nominated for inclusion in the 2010/11 Service Plan. It was not possible to tell if work would be required to the private length within the perimeter of the Old Hall. RESOLVED (1) to note the current position with regard to the maintenance of a culvert in Kniveton; and (2) that the Strategic Director Environmental Services to inform the petitioners accordingly. 77/10 ENFORCEMENT ACTION UNDER THE HIGHWAYS ACT 1980 THE BROOK AREA, MAIN STREET, CALVER The area concerned lay between the road and a brook course and formed part of the adopted highway. The area was improved in 2000 to provide an amenity area and limited parking. The Parish Council maintained the area and has provided three wooden flower tubs. However the area fell within the ownership of the adjoining landowners, who always claimed that they controlled it. They have also placed three planters in the area which effectively prevented access to the parking area. Correspondence with the owners and their Solicitors and the County Secretary over the last twelve months failed to convince them that the area was adopted highway. It was therefore proposed that legal action be taken to secure the removal of the planters. The Parish Council would also be required to remove their planters. RESOLVED to authorise the appropriate legal enforcement action being taken regarding the Brook Area, Main Street, Calver. 78/10 B6013 FAR LAUND, BELPER PROPOSED 30MPH SPEED RESTRICTION Following consultation and formal advertisement of the proposal to extend the 30mph speed restriction on Far Laund, Belper, one objection has been received form Belper Town Council who wished the speed restriction to remain at 40mph. 2

3 The continuous fronting development on both sides of Far Laund corresponded with the criteria for a 30mph speed restriction. The road safety record revealed that during the past five years seven personal injury accidents have been recorded. Traffic speed surveys revealed mean speeds between 29mph and 33mph thereby demonstrating that the majority of drivers recognise the urban character of Far Laund. RESOLVED (1) to approve the extension of the 30mph speed restriction on Far Laund, Belper as advertised; and 2) the Local Member and Belper Town Council be advised of the decision. 79/10 PROPOSED LIMITED WAITING, NO WAITING AT ANY TIME AND BUS STOP CLEARWAY RESTRICTIONS MAIN ROAD, LANGWITH DRIVE, LANGWITH Following consultation and formal advertisement of proposals to introduce waiting restrictions on Main Road, Langwith Drive, Langwith, one objection was received. The objection requested an extension to the limited waiting to the north-east of the Premier Store on Main Street. The objectors comments have been noted, however it was believed that the proposals as advertised created a balance of sufficient on-street parking to accommodate trade associated with the local businesses together with facilities for local residents. RESOLVED that (1) the County Council proceeds with the introduction of the proposals on Main Road, Langwith Drive, Langwith as detailed on drawing number NTA/FS/142/09; and 2) the objector be advised of the decision. 80/10 REGIONAL DEPARTMENT FOR TRANSPORT ROAD SAFETY PARTNERSHIP GRANT SCHEME The Department for Transport annually invited bids for funding to attract innovative road safety projects from Road Safety partnerships. The latest scheme was aimed at Regional or Sub- Regional project rather that from individual Road Safety Partnerships. Road Safety Partnerships within the East Midlands region have met and agreed to participate, although the tight timescale has meant that some authorities have not been able to do so. The bid members were Derbyshire County Council, Nottinghamshire County Council (lead authority), Nottingham City Council, Highways Agency, Lincolnshire County Council and Leicester City Council. The regional bid was intended to change the attitude and behaviour of drivers and passengers towards dangers caused by the four most common causes of death and serious injury in road traffic collision in the region. They 3

4 were drink driving, speeding, mobile phone use whilst driving and not wearing a seat belt. A specific emphasis would be made towards year olds. The campaign would be assessed by a survey of changes in attitude before and following the campaign; before and after speed measurements on 20 routes across the region and indicative reductions in casualties for all 20 routes across the region. Four routes have been identified in Derbyshire. The key element of the bid was the evaluation of the scheme. In conjunction with Nottingham University and the Department of Transport s own evaluation team, attitudinal studies would be conducted to benchmark any improvement over the period of the scheme. It was currently estimated that the work would require a budget of 19,000 as contribution to costs ad it was anticipated that the Derby and Derbyshire Road Safety Partnership would provide 10,000. This could be accommodated within the Road Safety revenue budgets. RESOLVED to approve (1) the County Council s participation in the project involving Road Safety Partnerships from the East Midlands, supported by the Department for Transport s Road Safety Partnership Grant; and 2) the receipt of Road Safety Partnership Grant funding as appropriate. 81/10 CONFERENCES AND SEMINARS RESOLVED to approve the attendance of Councillor Mrs J Wharmby at the LGUI and Natural England Workshop on Local Environmental Leadership on 17 May 2010, in Manchester, with the appropriate Members allowances. 82/10 EXCLUSION OF THE PUBLIC RESOLVED that the public, including the press, be excluded from the meeting during consideration of the remaining item on the Agenda to avoid the disclosure of the kind of exempt information detailed in the following summary of proceedings:- SUMMARY OF PROCEEDINGS CONDUCTED AFTER THE PUBLIC, INCLUDING THE PRESS, WERE EXCLUDED FROM THE MEETING 1.
