IV. *Cases From 1/25/2012, 2/8/2012, 2/22/2012 and 7/10/2013 Nick Bartholomew REQUEST: Oak Drive Suite D Omaha NE Variance of section , grease interceptor Location: Q St /25/2012: Nick Bartholomew appeared before the Board. Mr. Bartholomew intends to open a new restaurant, and requested a waiver of the required grease interceptor. Mr. Bartholomew stated that his restaurant will offer breakfast and lunch only. The menu is health-conscious; french fries are the only item on the menu that will be fried.

5 Plumbing Board Page 5 Mr. Bartholomew s application stated that the installation of a grease interceptor would interfere with drive through customers being able to visit his business. It would also mean that the adjacent tenant (Pizza Hut) would not be able to receive deliveries, as the service entrances would be inaccessible during the time that the interceptor was being installed. Mr. Bartholomew stated that the previous tenant was a Blimpie s sandwich shop, which was not required to have a grease interceptor in it. When asked by Mr. Estabrook, Mr. Bartholomew stated that there are no plans to tear up the floor in this space. Mr. Estabrook asked Mr. Bartholomew to clarify his statement that a grease interceptor would inhibit the drive through lane of his business. Mr. Bartholomew replied that the area behind his restaurant currently contains Pizza Hut s grease catcher and a large trash dumpster. Service doors empty onto the drive through lane, and a local YMCA backs onto the other side of the drive-through lane. This leaves very little space for a grease interceptor. During the installation of a grease interceptor, customers using his business drive through window would be required to back out of the drive through in the direction in which they entered it instead of being able to drive around the back of the building. Construction would also prohibit deliveries of supplies to his neighbors. Mr. Wonder stated that the Plumbing Code requires a restaurant owner to have a grease interceptor if they produce grease. The previous tenant, Blimpie s, did not produce grease and was therefore not required to have a grease interceptor. Mr. Wonder asked for more information regarding the amount of grease that Mr. Bartholomew s menu will produce. Mr. Bartholomew stated that the only grease-producing item on the menu is a side order of french fries. The business will also serve turkey bacon and chicken sausage; however, the reduced amount of grease produced from these healthier items will be used for cooking. Mr. Estabrook pointed out that dishes must still be washed; grease on pans and cooking utensils would still enter the system. Mr. Wonder stated that the Board does have the option to allow a smaller grease interceptor if they feel that this would be an appropriate solution for this applicant. He added that he would be willing to work with Mr. Bartholomew to size an appropriate grease interceptor for this business, and to explore other grease-removal options for this applicant. After some discussion, Mr. Reed made a motion to hold this case over to the February 8 th, 2012 meeting of the Omaha Plumbing Board in order to allow Mr. Bartholomew time to meet with Mr. Wonder to discuss possible grease-removal options for this business. Second by Mr. Estabrook. AYES: Barrett, Estabrook, Killian, Miller, Reed, Salem, Wellendorf Motion carried 7-0 2/8/2012: No one appeared in support of this request. Mr. Wonder stated that he has spoken to Mr. Bartholomew since the Board s January 25, 2012 meeting; however, the applicant has not yet met with Mr. Wonder with plans for his business. Mr. Wonder stated that he added that he is still willing to work with Mr. Bartholomew to see if a smaller grease interceptor would work for the needs of this restaurant. Motion to hold this case over to the February 22, 2012 meeting by Mr. Estabrook. Second by Mr. Salem. AYES: Barrett, Estabrook, Miller, Reed, Salem, Wellendorf 2/22/2012: No one appeared in support of this request. Motion to place this case on file by Mr. Estabrook. Second by Mr. Salem. Second by Mr. Salem. 7/24/2013: Nick Bartholomew appeared before the Board. Mr. Wonder stated that after working with the applicant and reviewing Mr. Bartholomew s proposed menu, he was still of the opinion that a grease interceptor was needed at this location. Mr. Wonder suggested that the Board grant Mr. Bartholomew a waiver which would allow him to install a 250 gallon interceptor in place of the standard 750 gallon interceptor required by Code. Mr. Wonder added that since Mr. Bartholomew s initial appearance before the Board, it was recently discovered that the restrooms for this space are common restrooms shared by the tenant next door. Mr. Wonder stated that these restrooms meet fixture count requirements. There is no lock which would prevent customers from using the common restrooms. In response to the Board s question, Mr. Bartholomew stated that the tenant next door is an insurance agency which is not open on weekends; which would be Mr. Bartholomew s busiest days at the restaurant. After some discussion, Mr. Estabrook made a motion to approve a waiver allowing the installation of a 250-gallon grease interceptor at this location. Second by Mr. Salem. Motion by Mr. Reed to allow the use of common restrooms as shown on submitted drawings at this location. Second by Mr. Estabrook Bill Condon Jensen Well Company 767 Iowa St Blair NE REQUEST: Waiver to allow the installation of a private well for domestic use Location: N 47 th St Bill Condon of Jensen Well Company appeared before the Board. Mr. Miller commented that neither the Metropolitan Utilities District nor the Douglas County Health Department registered any objection to the proposed domestic well at N 47 th St. Motion to approve for domestic use only by Mr. Reed. Second by Mr. Estabrook.

7 Plumbing Board Page 7 I. *Journeyman Plumber Examination Applications Cory Amill Patrick Av Omaha NE ServiceOne Inc 9335 J St Omaha NE Cory Amill appeared before the Board with Marty Anderson of ServiceOne Inc. After reviewing the application file, it was determined that Mr. Amill s file did not contain proof of schooling hours. Mr. Amill completed four years of schooling through ; he left before completing his fifth year of apprenticeship with the union. Mr. Anderson stated that he had gone to to obtain copies of Mr. Amill s school records; however, after viewing the submitted records from Local 16, the Board was unable to clearly determine that Mr. Amill had completed the requisite number of schooling hours. Pat Leddy,, stated that he would send the required clarified documentation to the Board Secretary today. Motion by Mr. Estabrook to approve, with the stipulation that the applicant submit proof of schooling hours to the Board Secretary before testing. Second by Mr. Salem. Robert C Bartak 4245 S 147 th Plaza #105 Omaha NE F St Robert Bartak appeared before the Board. After reviewing the application file, it was determined that the applicant s file did not contain sufficient proof of on-the-job hours. Mr. Bartak submitted updated on-the-job hours to the Board; this updated form brought Mr. Bartak s hours over the minimum requirements for work hours. Pat Leddy,, stated that he would send the required proof of schooling to the Board Secretary today. Motion by Mr. Estabrook to approve, with the stipulation that the applicant submit proof of schooling hours to the Board Secretary before testing. Second by Mr. Salem.

After reviewing the file, it was determined that Mr. Kudlacek s schooling and onthe-job hours meet qualifications for the exam; however he has not completed a full four years with an apprentice license. The Board agreed that Mr. Kudlacek was not eligible for the August 2013 examination. Motion to hold this case over to the October 23, 2013 meeting by Mr. Estabrook. Second by Ms. Schaap. Brad A Latto From 3/26/08, 4/23/08 & 10/26/ S 8 th St Missouri Valley IA Carmody Plumbing 8504 N 29 th St Omaha NE /26/2008: Mr. Latto was present. The Board asked Mr. Latto to provide his records indicating that he has been working in the plumbing trade since December of Mr. Estabrook made a motion to layover until April 23. Mr. Leo seconded the motion. AYES: Estabrook, Killian, Leo, Reed, Baker Motion carried 5-0 4/23/2008: Mr. Latto was not present. Mr. Miller made a motion to place this item on file. Seconded by Mr. Leo Ayes: Clifton, Estabrook, Leo, Miller, Reed, Baker Motion carried /26/2011: Brad Latto and Mike Knutson of Carmody Plumbing appeared before the Board. Mr. Miller stated that this case previously appeared before the Board in 2008 (above). At the time of his last appearance before the Board, he was asked to provide information regarding his work records. Mr. Latto submitted that information for the Board s review today. Mr. Miller reviewed the application file, noting that Mr. Latto meets the on-the-job work hours required in order to take the Journeyman examination. Mr. Knutson stated that Mr. Latto has been with Carmody Plumbing for one year, and has worked outside of Omaha s jurisdiction during that time. Mr. Latto stated that prior to his employment with Carmody Plumbing, he was working with his father for Latto Plumbing in Missouri Valley. He also worked for Ladd Plumbing in Council Bluff, Iowa. When asked, Mr. Latto stated that he has never been registered as an apprentice plumber in Omaha because he did not work in this city. He was a registered apprentice in Iowa during the time when he was employed by Ladd Plumbing. His case file included proof of almost eight years of experience in plumbing.

9 Plumbing Board Page 9 Mr. Miller commented that Mr. Latto holds a master plumber license in Bellevue, Nebraska and Council Bluffs Iowa. He also has 64 hours of apprenticeship schooling through Iowa Western Community College. Mr. Wonder asked Mr. Latto how long he has been in the plumbing business. Mr. Latto replied that he has been plumbing since approximately This gives him a total of sixteen years of experience in the plumbing field. Mr. Miller commented that all of Mr. Latto s training and experience appears to be on the Uniform Plumbing Code, which Omaha does not use. When asked by Mr. Killian, Mr. Latto stated that he has held a master plumber license in Bellevue, Nebraska and Council Bluffs, Iowa since Mr. Wonder stated that he does not believe that Bellevue and Council Bluffs qualify as cities of equivalent size. He stated that the Board should instead consider the number of years in which Mr. Latto has been in the plumbing field. Mr. Wonder stated that the Board has attempted to set regulations regarding the number of years of work which cancel out the required years of schooling for out-of-jurisdiction plumbers, but has yet to agree upon that number. He asked the Board members how many years of on-the-job training is sufficient to replace schooling for these special cases. Mr. Barrett suggested that Mr. Latto be directed to take the placement examination. Mr. Reed stated that those in his field without an accredited degree are generally allowed to test for licensure if they have double the amount of work experience hours. If this was applied to plumbing examinations, out-of-jurisdiction applicants without apprentice schooling would be required to have at least eight years of on-the-job training in order to be considered to have met the schooling requirement. Mr. Miller disagreed with this statement, citing the importance of school for apprentice plumbers. Mr. Salem agreed with Mr. Miller, stating that work experience should not be allowed to take the place of schooling. Mr. Reed countered that it was not reasonable to ask a plumber who has been in business for thirty years in another city to go back to college for four years to learn basic plumbing theory when it is obvious that they have a great deal of experience. Mr. Salem stated that these applicants should be directed to take the placement examination, adding that he would not approve such applicants to sit for licensure unless the placement examination had been administered. Mr. Wonder stated that the Plumbing Division does have a placement examination that it can administer; however, this examination is meant for those requesting to become apprentice plumbers. The placement examination is not meant for those asking to take the journeyman or master plumber examinations. Mr. Latto was asked to describe the type of work he performed during his sixteen years in the plumbing field. Mr. Latto replied that he did both residential and commercial work, including repairs, remodeling, utilities, and all other areas generally concerned with plumbing. Mr. Reed asked the Board members how many years of on-the-job training is equivalent to a college degree. Mr. Reed stated that the Board handles this kind of case once or twice per year; however, it would be a good idea to settle this matter now in order to avoid debate in the future. Mr. Estabrook stated that the Board handled a similar case in the past involving some plumbers from Fremont. These applicants were required to take the placement examination before being allowed to take the journeyman test. Mr. Wonder replied that the applicants in that previous case had far less experience than Mr. Latto has; and this was the reason behind directing them to sit for the placement examination. Mr. Latto has more than double the experience than the Fremont applicants that Mr. Estabrook referred to. Mr. Knutson stated that Mr. Latto s brother, Ben, appeared before the Board recently with journeyman plumber licenses from Bellevue and Iowa. The Board granted Ben Latto s request for testing. Brad Latto has master plumber licenses from the same jurisdictions. Mr. Knutson asked that the Board approve his employee to take the journeyman examination as requested. Mr. Wonder confirmed this statement, but noted that regulations have changed since Mr. Latto s brother s appearance before the Board. Mr. Reed stated that because the Board sees so few of these cases, it may not be best to create a hard-and-fast rule for dealing with out-of-jurisdiction plumbers. However, if the Board is disinclined to grant Mr. Latto s request, then they owe it to him to be very specific in what he needs to do in order to get approved to test. Mr. Barrett stated his opinion that attending school would be the main solution for Mr. Latto, or satisfactory completion of the placement examination. Mr. Latto protested that there are apprentices in Omaha that have taken the journeyman test numerous times, but fail to pass it because they don t know the Omaha plumbing code. Completing school is not a guarantee that you are a good plumber. Mr. Reed agreed with this statement, adding that the plumbing examination weeds people out. He asked the Board members again how many years of work experience make up for schooling.

10 Plumbing Board Page 10 Mr. Wonder stated that the placement examination covers things like safety and tools. It includes little to no information regarding Omaha Plumbing Code regulations. Understanding of Omaha Plumbing Code is tested by the journeyman and master plumber examinations, not the apprentice placement examination. Mr. Reed suggested that the Board adopt a policy of requiring out-of-jurisdiction applicants with less than the number of hours of schooling required by Omaha code to show proof of eight years of on-the-job experience before being allowed to sit for licensure. This number would be double the amount of years of schooling currently required by Omaha code. Mr. Wonder stated that the City has adopted such a policy on two other licenses not related to plumbing and added that this would be an acceptable benchmark for future cases. Mr. Barrett countered that, using that proposed policy, Mr. Latto would still be short on work experience, as his case file only proves seven out of his claimed sixteen years of experience. Mr. Wonder stated that the Board could then approve Mr. Latto to test in February of 2012, or could deny his application now. Mr. Latto could then reapply for the February 2012 examination once he has completed his work hours for this year. Motion to deny by Mr. Estabrook. Second by Mr. Salem. AYES: Barrett, Estabrook, Miller, Reed, Salem, Wellendorf NAYS: Killian. Motion carried 6-1 8/13/2013: Mr. Latto appeared before the Board. Mr. Wonder explained that Mr. Latto s last appearance before the Board, he had been told that he needed additional work experience in order to meet the qualifications for testing under the Code. Mr. Latto has since accrued additional work hours and now meets testing qualifications. Motion to approve by Mr. Reed. Second by Mr. Estabrook. Mr. Miller reviewed the file and commented that all appeared to be in order with the application.

After reviewing the application, it was determined that Mr. Mann did not meet qualifications to test for an Omaha license; namely, he needed additional on-the-job training hours. Motion by Mr. Reed to approve, with the stipulation that the applicant submit proof of working at least 14,000 hours for a minimum of eight consecutive years as stipulated by Omaha Plumbing Code to the Board Secretary before testing. Second by Mr. Estabrook. Jeffrey J Shudak 120 Ivy Drive Council Bluffs IA F St Jeffrey Shudak appeared before the Board. Mr. Shudak submitted additional documentation of his work hours to the Board. After reviewing the submitted materials and Mr. Shudak s application file, the Board determined that Mr. Shudak was missing documentation of his school hours.. Pat Leddy,, stated that he would send the required proof of schooling to the Board Secretary today. Motion by Mr. Reed to approve, with the stipulation that the applicant submit proof of schooling hours to the Board Secretary before testing. Second by Mr. Estabrook. Mr. Miller reviewed the file and commented that all appeared to be in order with the application. Motion to approve by Mr. Estabrook. Second by Mr. Reed.

Garrett W Wirges From 4/24/ Magnolia St Omaha NE Dave Janke Plumbing Inc Grover St Omaha NE /24/2013: Garrett W Wirges appeared before the Board. Mr. Miller reviewed the file, commenting that Mr. Wirges has not completed a full four years of apprenticeship. His start date was May 22, Mr. Wirges asked the Board to grant him permission to take the examination in May, adding that his start date is only a few weeks after the test date. Motion to deny by Mr. Reed. Second by Mr. Estabrook. AYES: Barrett, Estabrook, Feyerherm, Miller, Reed, Salem, Schaap Motion carried 7-0. Request denied. 7/24/2013: Garrett Wirges appeared before the Board. Mr. Miller reviewed the file and commented that all now appeared to be in order with the application. Mr. Miller reviewed the file and commented that all appeared to be in order with the application.

Mr. Wonder stated that Mr. Gabrelcik holds a master plumber license in Minnesota; this state does not accept Omaha s plumbing license for applicants seeking to sit for examination. In response to the Board s question, Mr. Gabrelcik stated that he has held his Minnesota license since 2005, adding that this state does not require schooling in order to obtain a license. Mr. Gabrelcik stated that he could provide additional documentation of his work hours to the Board Secretary if needed. Motion by Mr. Reed to approve, with the stipulation that the applicant submit proof of working at least 21,000 hours for a minimum of twelve consecutive years as stipulated by Omaha Plumbing Code to the Board Secretary before testing.
