Nicoulin, City Clerk 101 Shelby Pointe Drive 124 Blue Ridge Road Louisville KY Louisville KY BLUE RIDGE MEETING MINUTES SEPTEMBER 26, 2011 NEXT MEETING DATE: October 24, 2011 The regular monthly meeting of the City of Blue Ridge Manor, Ky. was held on September 26, 2011 at the Trinity Presbyterian Church. The meeting came to order at 7:30pm, Mayor Mike Ober presiding. The following were present: Fred A.Nicoulin, City Clerk Robert Carter, City Treasurer Julie Colucci - Commissioner Porter Lady - Commissioner Carla Kreitman - Commissioner Stan Chauvin III City Attorney Art Sims Blue Ridge Kathy Wayne Rosewood Court Darlene Pawley Rosewood Drive Valerie Thomas Dorsey Village Roger Lanning Dorsey Village Gino Leone Dorsey Village Conner Karem Blue Ridge Pat Gramig Blue Ridge Prior to the meeting, Mayor Ober distributed the August 22nd meeting minutes to all the Commissioners. The Mayor asked if anyone had any objections or corrections to be made to those minutes. The following corrections and additions are to be made to the August 22 nd monthly minutes: With reference to one of the attendees at the meeting, namely Darrell Metcalfe. He listed his residence as Plainview only. It was suggested to also include Blue Ridge Manor since he is considered a resident in both locations. Carla Kreitman made a correction on page three under the PICNIC DISCUSSION topic. The last line should read The band requested an additional tent for the occasion. The City of Blue Ridge Manor paid for this additional expense. Mayor Ober requested that the above changes be made and then called for a vote from the board to accept the August minutes with these changes included. All were in favor. Carla Kreitman moved that the August minutes be accepted with the changes. Porter Lady seconded it. Motion carried. Bob Carter, Treasurer, gave his report. Bob also indicated that he prepares a regular P&L statement for Deputy Pro Tem, Hans Klose. He would like to continue to do this as well as prepare a quarterly statement for the rest of the commissioners in order to keep everyone advised. Julie Colucci then made a motion that the financial report be approved. Carla Kreitman seconded the motion. Motion carried. 1

2 Before proceeding to the next item on the agenda, Mayor Ober commented on a brief conversation he had with former mayor, Mac Hardesty, regarding two long standing traditions that the City of Blue Ridge did on an annual basis. 1. The City of Blue Ridge has always conducted their monthly meetings at the Trinity Presbyterian Church without any payment to the Church for these accommodations due to their generosity in allowing us to use their facility, the City would give a $ stipend to the church for this kind offer. 2. An annual donation of $ to Hospaurus has always been a standard tradition for the City. This was due to the wonderful care they have given to some of the residents in the City of Blue Ridge over the years. Mayor Ober opened the floor for discussion regarding any concerns about continuing these two contributions. The only cause for concern expressed from the floor was a potential conflict with any City Ordinance that would conflict with these contributions. Stan Chauvin stated that he did not see where this would present any major problems and should be acceptable. Porter Lady moved that both contributions should be continued. Julie Colucci seconded the motion. Motion carried. MSD UPDATE OLD BUSINESS Construction of Parking lot at Municipal Park Mayor Ober presented some plans from MSD showing deeds and easements to the park and surrounding areas. The drive road in question regarding these plans to continue with construction parking lot spaces is listed as a private drive in these documents. Mayor Ober also stated that the MSD has no problem with any parking lot construction provided we use a porous material/gravel substance for the parking lots. This would curtail any drainage issues in the future. MSD also would require that we enlist an engineer to design the parking lots. There was also the question of the City purchasing a permit. Since the City of Blue Ridge is a 6 th class city this was a debatable issue. Mayor Ober will research this extensively and approach the County Attorney to receive an official opinion whether the City will need a permit or not in order to move forward Water Line Issue at Municipal Park From the drawings, Mayor Ober also reviewed with the Commissioners, the layout of the water and drainage lines outlining the park. It was apparent that the present drainage issue is derived from the City of J-town and not Blue Ridge. This too, has been a debatable issue over the years. MSD suggested that when the City of Blue Ridge enlists an engineer to design the parking spaces that they should also design plans for installing water lines to the Park. Stan Chauvin recommended the city to consider Ted Trautwine who is an experienced engineer and serves on the Barbourmeade council. Since there were no further recommendations, Stan will pursue this in order to continue with both projects. 2

3 Mayor Ober briefly mentioned about another drainage issue, The Winham Project. He discussed this with Councilman Jerry Miller who was able to receive a grant to fund this project. KAREM & KAREM LETTER OF RESIGNATION A letter of Resignation from Karem & Karem Pick Up Service was read to the Commissioners explaining reasons why they could no longer provide these services to the City. The mayor wished them much success in their future endeavors. Mayor Ober also read a very nice Thank You letter from the former mayor Mac Hardesty regarding the Park dedication. He was very complimentary to everyone s efforts that made the Dedication Program an impressive memory for him and his wife Mary. He also was very pleased with the plaque at the Park entrance and the floral bouquet that was presented to his wife. STREET SWEEPER BID Robert Carter gave an update report on the Street Sweeper Bid Request. He reported that this company revised their original bid stating that they do not provide any trash pick-up services. Mayor Ober suggested that the Board table the bid till further review RESIDENTIAL MAINTENANCE ORDINANCE Stan Chauvin proceeded with the second reading of the Residential Ordinance #6. After the second reading, Stan Chauvin reported that Ordinance #6 would be published once the Board approved. Porter Lady moved that Ordinance #6 be accepted and published in the paper. Julie Colucci seconded the motion. Motion so moved. At this time, Stan addressed the draft of Ordinance #7 to the Board with the first reading and giving due notice that Hans Klose was not present at the first reading. This ordinance involves parking restrictions within the City. After the reading Stan said that he would give this ordinance a more official title before the second reading at next month s meeting. Gino Leone asked if the ordinances would apply to the other entities in the City. Stan s response was that the ordinances only support City enforcements in all cases. Mayor Ober encouraged the Board to pursue a separate commercial ordinance as soon as possible. This ordinance will provide proper guidelines for the commercials property owners within the City to ensure proper upkeep and maintenance of their property. UPDATED MAILING LIST Mayor Ober commented that while he was at the Deeds and Records office, he acquired an updated mailing list of the City residents as well as the Commercial properties. He indicated that if anyone would like a copy of the list, he would be happy to send it to them. He also wanted the updated list to be given to the printing company that is responsible in mailing out the quarterly newsletter. At the last mailing there were 12 letters that were returned with insufficient or incorrect addresses. 3

4 COMMISSIONERS REPORTS Porter Lady Department of Parks and Recreation Porter reported that since the Mayor and the City Attorney were able to locate the deed/easement of the Park, he will have the Water company contact Stan Chauvin for a copy in order to proceed with the installation of a waterline to the park. Porter also recommended that the City consider purchasing the property near the entrance of Dorsey Village. This would also include the areas by Baskin Robbins where there is a ditch and the back areas of the Bank and Rosewood sections. He suggested that this area could then be maintained free from litter and debris along with the rest of the City entrances. There was also some discussion of putting up a fence to separate the commercial from the residential areas between Baskin Robbins and the concrete headwall. Roger Lanning made note that if the City were to consider this that all residents of Dorsey Village be contacted since they now own this property. He also mentioned that a long lease option might be a more favorable approach for Dorsey Village and the City of Blue Ridge to consider. Gino Leone proposed that we get and engineer and plan to survey these options. Roger Lanning offered to provide the City with a recent survey that Dorsey Village has. It was also suggested that when we enlist the engineering services of Mr. Trautwine that we also have him do the following three areas for the City s future planning. That would be: Parking lot space by the Municipal Park Water line installation to the Municipal Park Dorsey Village purchase of outlining areas Mayor Ober and Stan Chauvin will put a plan of action together and keep the Board advised of future steps to be taken. Carla Kreitman Department of Community Affairs & Public Records Carla Kreitman gave a brief report regarding her research for proving a website for the City of Blue Ridge. She spoke to some IT experts in order to provide the best options for the City. She also mentioned that Metro Louisville has a website that we could become involved with their set up but she felt we could get a more personalized design and possibly recruit some U of L students who major in Web Design and get something more customized. Once she gathers more information, Carla will report back to the Board of her findings. Carla also reported that several residents were inquiring about a possible Yard Sale for the City residents. Some discussion arose regarding the technicality of sponsorship by the City without conflicting with any city ordinance or City By Laws. Julie Colucci mentioned that other 6 th class cities would conduct these type of yard sales using terms such as Community Wide or in some cases, the Homeowner Association would sponsor this type of event. Carla will further research this interest and report back to the Board on what she has been able to uncover. 4

5 Julie Colucci Department of Public Safety Julie reported that there was a sign down at Woodstock and Blue Ridge that will be replaced. She also received some pricing quotes for the No Soliciting signs that will be located at each of the entrances of the City, condominiums, and apartment sections. She indicated that the cost would run somewhat over $400 depending on size of the signs. She also needed clarification of the exact verbiage to be used. Some discussion proceeded and it was also suggested that the Ordinance number should definitely be included. Julie received approval from the Board to proceed. Julie also researched the possibility of a Neighborhood Watch. She reported that there would be a representative from the Neighborhood Watch come and speak to the residents regarding the guidelines and its planning. Discussion from the floor included notifying the residents through the Winter Newsletter and schedule a meeting for this purpose to prepare to have this in place by the Spring. Julie also reviewed the police patrol reports to evaluate the coverage we are paying for and its effectiveness. She reported that the police were not aware of the location to the entrance of the park. She also felt that several patrolling schedules should be encouraged specifically for the park. Presently, according to the reports, there have been no weekend patrols, no evening patrols and Dorsey Village is also not being patrolled. The other issue that was of some concern is that the Police patrols are done by a plain clothesman rather than a policeman in uniform. It was unanimous that this was unacceptable. Mayor ober suggested we have a meeting with Metro Police to discuss these issues. Julie will contact them to set up a meeting as soon as possible. It was also suggested by Stan Chauvin that if we cannot get these issues resolved, we could consider approaching the St. Matthews Police as well as the J-town Police for other options. Mayor Ober then asked if there was any other business that needed to be addressed. Fred Nicoulin commented that he personally delivered all the tax bills to the post office for mailing. It was brought to his attention by some of the residents that they had not received them. Mayor Ober suggested to send out a second batch along with a letter that should state, payment is on demand within 30 days from receipt of this second notice. If payment has been recently sent, please disregard this notice. There being no further business, the Mayor asked for a motion to adjourn. Carla Kreitman moved for adjournment.
