Snyder retirement Planning begins now Query?: If any of us,or members of our family, needed an expensive cancer drug to support their quality of life, who would hesitate for a moment to make the expenditure? Should we be any less concerned about our own future quality of life and financial health in retirement? This being said, why is it that the vast majority of lawyers, even with the advantages of a doctorate degree, acquired business acumen, and good old fashioned common sense, fail to take full advantage of tax deferred investments in qualified plans such as 401k s for their future. This is one of the few areas aside from the Home Mortgage Interest Deduction where Uncle Sam is actually our partner. The logical progression in the practice of law is from law student to experienced practitioner, to active parent and community member, to senior member of the bar, to retiree. If you were to blink you could pass quickly from one phase to the next without realizing the transition. Student loans, mortgages, car loans, credit card balances in addition to Maryland's tax rates (one of the highest in the nation) erode both the desire and ability to start investing for the future. A little knowledge of the fundamentals of Investing and the" Power of Money invested" reinforce that time is "of the essence". Pursuant to The rule of 72's you can compute how long it will take to double your net worth. Simply divide 72 by the sustained rate of return. I know that it may be hard to believe, but this is mathematically correct based on compounding returns. When you consider your income tax bracket and realize that a qualified pension investment and the compounded growth is applied tax deferred you understand the immediacy. Who would want to pay more taxes on their income to the government rather than build a future for their family. When put in this context the choice seems clear! 3 current update circuit court notes DcM coordinator: We are pleased to announce the appointment of Richard Dabbs to the position of DCM Coordinator. Rick has been with the judiciary for over 30 years, most recently in the role of Lead Family Division Case Manager. His in-depth process knowledge coupled with his court experience make him the perfect candidate for this role. We are excited to have Rick in place to assist with all DCM-related questions or concerns. He can be reached at or via telephone at circuit court Phase ii renovations: Effective Monday July 14, 2014 at 8:00 PM the Terrace Corridor connecting the Circuit Court to the EOB will be closed. The closure is required to construct a new entrance from the EOB plaza into the Circuit Court. The closure is expected to last through November 14, During that time all access between the Circuit Court and the EOB will be through the EOB Lobby located on the Monroe Street side of the Circuit Court. Thank you for your patience as we continue with Phase II of the renovations. The circuit court for Montgomery county, South Tower Opened: The South Tower, formally known as the Annex, officially opened April 28, Effective Monday, July 14, 2014 at 8:00 PM, the South Tower may only be accessed by entering the Circuit Court from the Maryland Avenue entrance or the Monroe Street entrance. The South Tower houses the family and juvenile divisions, including judges, masters, evaluators, case managers, self-help center staff and clerk s office staff. Unless you are experienced in balancing a portfolio among Large, Small and the Midcap sectors and picking single issue stocks you are in need of professional help. Sadly almost anyone can declare themselves to be an investment advisor. Even an adviser who holds a Series 7 securities license may only be a salesperson touting the funds their brokerage offers for sale. A good financial planner will research and present multiple investment options and constantly adjust, reinvest and rebalance your portfolio. Sadly, it's not as simple as buying a few different Stock Mutual funds and waiting. An ethical and concerned financial planner will move you between different sectors in the same fund and buy "B" shares to reduce your costs and preserve your corpus even at the expense of foregoing greater commissions. Such a financial planner is in it for the long term being more concerned about positive feedback and referrals. You need to watch out for investment counselors who "churn" single issue stocks or funds earning multiple and quick commissions. You should take the time to read as much as you can and always question investment recommendations and strategies at regular meetings to review your portfolios performance. Ready to invest in your future? If not now, then when? Don t Blink! Judges rotation Effective July 7, 2014: On July 7, 2014, the Circuit Court Judges began a new 18 month rotation ending January 1, Starting 90 days ago, all Civil and Criminal cases that were newly assigned to Track 4 have been assigned to a judge in the new rotation. note that there will be a change in location when the court moves into the new annex. You ve been meaning to do something about that box in your attic filled with your precious family letters, books, or photographs. Yet you re worried that preserving your keepsakes will take more time and money than you presently have. Thankfully, you can put such fears to rest by following some simple steps to properly store your precious papers at home: 1. First, take that box out of your attic, and any in your basement while you re at it. Choose a new storage spot somewhere central in your house that experiences the least amount of rapid changes and extremes in temperature and humidly. An ideal environment is F and 30-40% RH. An unstable environment causes problems such as mold, dried out adhesives and leather, pests, condensation, and brittleness. Pick cool and dry places like under your bed, in a dresser drawer, or in your closet. 2. Keep your items away from direct sunlight and florescent light, which can cause irreversible fading and deterioration. Use blinds and low wattage bulbs around your papers. 3. Next, select a proper storage box. Archives and museums use acid-free and lignin-free boxes or inert polyester sleeves to prevent brittleness and protect items from pests, dust, and chemical offgassing. The rule of thumb with any container is to avoid it if it has a smell (good or bad) or is dirty. Pack items loosely, but securely; avoid using staples, rubber bands, and newsprint. Store oversized items flat. 4. Lastly, follow the campsite rule: leave your items in the same condition that you found them in. Avoid laminating, rolling, and folding. Don t place your photos in static-cling albums. Avoid writing directly on your items (or do so in light pencil, if you have to) and handling them frequently. Label external containers, only touch the corners of your papers, and make use copies for every-day reference. Now grab that attic box today and go get preserving! It s easy! Peter writes that this book is about monarch butterflies, rain, science, sheep, kids, religion and a small town in Tennessee. The members of our group in past years have read and enjoyed three (3) of Ms. Kingsolver s A balancing AcT With lawyers and staff taking time off, is summer a good time to make changes and implement plans? Summer can be a challenging time to implement change. Here s what I recommend coaching clients accomplish during July and August: 1. Set and meet goals for billable hours for you and your staff. 2. Take a vacation (or two) and enjoy it. Make sure you and your staff replenish. 3. Make a strategic plan for the fall and start it the day after Labor Day so you don t run into the Thanksgiving/Holiday period. While implementing your plan, make sure you and your staff keep meeting billable hour goals. Notice that I mention billable hours mentioned twice. Billing drives the firm and when you make it a priority, your firm stays profitable. Successful firms always make sure that billable hours and marketing are consistently driven all months of the year. There is no good reason not to meet billable hour goals. Implementing change, whether a policy or staff change, should be done when it can be most successful and it is important to choose your times wisely. Strategic leaders know that balance is important. They make sure that they themselves and the staff get time off and get things done. Plans might be for increased marketing efforts, increased staff efficiency, administrative changes, a new computer program, new employees, etc. So if you want balance this summer make sure you and your staff work hard, keep your billing up, and get strategic plans ready to be implemented the day after Labor Day and not a day later. James rogers Miller, Jr. June 15, July 25, 2014 Jim Miller, Jr. was born in Sandy Spring, Montgomery County, Maryland on June 15, Following his years at Landon School, he attended Wesleyan University, graduating with a Bachelor of Arts in 1953 and then on to Georgetown University Law Center where he achieved his LL.B. in In that year Jim joined his father and stepmother in a general, civil practice in Rockville, at 200B Monroe Street. During his years of private practice, he was committed to a variety of endeavors of public service, ranging from the presidency of the Rockville Chamber of Commerce, service on the Governor s Commission on Reorganization of the Government of the State of Maryland, Maryland House of Delegates from 1963 to 1967 and President of the Bar Association of Montgomery County in On September 28, 1970, President Richard M. Nixon nominated Jim to the United States District Court for the District of Maryland, where he served until December 1986 when, as a result of some questions of health, he took early retirement from the Bench. The Judge spent time restoring his health and energies, sailing and enjoying his family at his home on Maryland s Eastern Shore. In August of 1991, Judge Miller returned to Miller, Miller & Canby and serving in an of counsel capacity took up the role as counselor to the firm, while actively building a much renowned reputation as a mediator and arbitrator. He continued very actively in maintaining a heavy schedule of mediations and arbitrations, gradually slowing that endeavor until the death of his wife, Jo Anne, in Not long after that loss, the Judge once again returned to his beloved Eastern Shore and to a new winter home in Boca Grande, Florida and took up a life of more extensive travel and family contacts. Judge Miller passed away in Easton, Maryland, on June 25, He is survived by his children James R. Miller, III, Andrew C. Miller, Merrie H. Miller Delauder and Katherine T. Miller Goldberg, his loving companion Patricia L. Chapman, and his brother Thomas C. Miller. A memorial service was held on Tuesday, July 15 at the Bozman United Methodist Church. Immediately following the service, there was a reception at the Miles River Yacht Club, in St. Michaels, MD U.S. District Court Judge Ellen Hollander, one of the Judge's former law clerks, delivered a eulogy at the service. The practice of law involves a multitude of considerations to include, not only a variety of practice areas, but also work/life balance, a choice between government and private practice, and practice at a large or small firm. Assessing one's priorities and finding a practice that fits one's goals can be a difficult task. This task can be made less daunting with the guidance of an attorney-mentor. By participating in the Montgomery County Bar Association Mentor-Mentee Program, experienced attorney-mentors are paired with newpractitioner-mentees. The mentors share their experiences and wisdom with their mentees. Both mentors and mentees build relationships with each other, involve themselves in the Montgomery County Bar Association, and network with other mentors and mentees. With their involvement, each can learn from one another. If you have practiced law for more than seven years, we encourage you to volunteer as a mentor in the Montgomery County Bar Association Mentor-Mentee Program. The Clerk of the Court, Loretta Knight, brings the following matters to your attention: rule : Exclusion of Personal identifier information in court Filings. By a Rules Order filed on May 1, 2013, the Court of Appeals adopted new Rule , effective July 1, 2013, to require the exclusion of certain personal identifier information from court filings. Subsequently, by a Rules Order filed on July 2, 2013, the Court of Appeals amended Rule on an emergency basis (effective July 9, 2013), and also adopted a new companion rule, Rule (with a deferred effective date of July 1, 2014). The amended Rule differs from the original in several important ways. First the amended Rule now applies only to pleadings and other papers filed in an action in other words, litigation records and not to administrative records, business license records or notice records as defined in the Rules. Second, the amended Rule clarifies that it does not apply to filings by a judge or judicial appointee. Third, the amended Rule no longer classifies birthdates as personal identifier information requiring exclusion from filings. Fourth, the amended Rule now allows only two exceptions, for: financial account identifiers specifying the property allegedly subject to forfeiture in forfeiture actions, and the record of an administrative agency proceeding. The companion rule, rule , when it takes effect on July 1, 2014, will require filers to include, in each covered filing, a certificate confirming their compliance with rule interpreters: As soon as it is known that an Interpreter is not required, please immediately notify the Clerk s Office. Throughout the year, we will be exploring the stages of a collaborative law case: from enrolling the client to assembling the team to advocating without being positional to finalizing an agreement.
